If an incident happened elsewhere, use that country’s complaint and oversight systems. In the U.S., the right reporting channel, deadlines, confidentiality rules, oversight powers, and recording laws vary by state and locality. Start by protecting your safety, then make a factual record and choose the channel that fits the incident.
What to do first if you feel unsafe
If you are in immediate danger, move to a safer place and contact an appropriate emergency resource if it is safe to do so. Do not confront or follow the officer, return to the scene, or try to record an encounter if that could increase the danger. Recording laws depend on state law and circumstances; there is no single nationwide rule established here.

If you are concerned about reporting through the officer’s agency, you can check whether a civilian oversight body or an appropriate federal channel accepts reports. A local lawyer or legal-aid organization may help you assess options. These routes have different authority and none guarantees protection or a particular result.

Make a dated account as soon as you safely can. Use plain language, describe events in chronological order, and separate what you personally saw or heard from what someone else later told you. Do not fill gaps with guesses. Put words in quotation marks only when you genuinely remember them verbatim; otherwise, say that you are paraphrasing.

Details to record
- Date, approximate time, and location.
- The officer’s name or badge number, if known, plus the agency and any patrol-car or other identifying details.
- What the officer did and said, including exact words you recall, and what happened immediately afterward.
- Names and contact information for witnesses, if safely available.
- Any connection to official police activity, such as a stop, call, investigation, or other encounter.
- Which details are uncertain, and how you know what you know.
Preserve records and evidence
- Keep original texts, emails, voicemails, call logs, photos, videos, and related paperwork. Where possible, retain an unedited original and make a separate working copy.
- Note where originals remain, when copies were made, and to whom you sent them. Do not alter or delete originals.
- If there was an injury or property damage, preserve related records and photographs.
- Keep complaint receipts, reference numbers, staff names, and follow-up correspondence.
- Consider privacy and safety before posting sensitive evidence publicly, particularly if a legal matter is pending.
These are practical preservation steps, not a federally prescribed form. Do not gather evidence in a way that puts you or someone else at risk.
Where to complain about a police officer
There is no single complaint office for every incident. Check the relevant agency and locality’s current official instructions. The available channels can differ in what they investigate, review, or can do.

Police department internal affairs or professional standards
Look on the department’s official website for internal affairs, professional standards, or its equivalent. Verify how to submit a complaint and evidence, whether there is a deadline, how to get a receipt or case number, and how status updates work. Ask what information may be disclosed and whether the process offers confidentiality; do not assume a complaint can be anonymous or confidential.
Civilian oversight
Search the city or county’s official website for a civilian police review, oversight, auditor, or inspector general office. Some bodies investigate complaints; others review completed investigations or examine broader patterns. Confirm that the office accepts this type of complaint and whether it can investigate, recommend outcomes, or impose them. A DOJ-backed national report recommends that complaint processes not discourage, dissuade, burden, threaten, or intimidate complainants; that recommendation does not establish that every locality follows it or that every complaint will be accepted.

Federal routes
Federal reporting is not a universal substitute for a local complaint. The U.S. Department of Justice (DOJ) describes different routes for possible criminal civil-rights violations and for specified civil-enforcement matters.
- Possible criminal civil-rights violation: DOJ says a person may contact the FBI or the U.S. Attorney’s Office for the relevant district. DOJ describes federal criminal enforcement as requiring proof of a deprivation of a federal right, willfulness, and action under color of law. A threat or unpleasant interaction alone does not establish those elements or mean a federal crime occurred. See DOJ’s Law Enforcement Misconduct guidance.
- Specified civil-rights enforcement matters: DOJ directs reports about the Police Misconduct Statute, Title VI, or the OJP Program Statute to civilrights.justice.gov. DOJ describes the Police Misconduct Statute as addressing a pattern or practice by state or local law-enforcement agencies, not every isolated incident. Title VI and the OJP Program Statute apply under particular discrimination, funding, and program conditions; harassment or racial slurs are examples DOJ identifies as potentially covered, not proof that a statute applies in a particular case. DOJ says it cannot bring a case based on every report. See Addressing Police Misconduct Laws Enforced By The Department Of Justice.
- Federal officer: DOJ’s guidance identifies the federal civil-rights reporting route for applicable allegations involving federal officers and criminal reporting routes where a criminal violation is alleged. The relevant agency may also have its own complaint process; verify its current official instructions.
DOJ’s Civil Rights Division states: “If you would like to report a violation of the Police Misconduct Statute, Title VI, or the OJP Program Statute, contact the Justice Department at civilrights.justice.gov.” This route is for those specified matters, not every complaint about an officer. Additional information appears on DOJ’s Conduct of Law Enforcement Agencies page.

Local lawyer or legal aid
A local attorney or legal-aid organization can assess whether the facts may support an individual legal claim and identify time limits that apply in your jurisdiction. Check the person’s licensure, location, eligibility rules, scope of help, and any costs. Do not assume an internal complaint pauses a legal deadline.
How to choose among the reporting options
| Route | Typical role | What to verify |
|---|---|---|
| Department internal affairs or professional standards | Agency complaint and administrative review | Intake rules, deadline, evidence format, receipt, status updates, and disclosure policy. |
| Civilian oversight | Independent investigation, review, or audit, depending on the local model | Whether the body accepts the complaint, has investigative authority, and can recommend or impose outcomes. |
| FBI or U.S. Attorney’s Office | Possible criminal civil-rights referral | Whether the facts plausibly concern a federal criminal violation; referral does not promise an investigation or prosecution. |
| DOJ Civil Rights Division online report | Specified federal civil-enforcement matters, including applicable systemic or discrimination-related concerns | Whether the statute and its factual conditions fit. DOJ says it cannot bring a case based on every report. |
| Local lawyer or legal aid | Individual assessment of possible legal claims and time limits | Licensure, jurisdiction, eligibility, scope, cost, and deadlines. |
You may be able to use more than one route, but each has a different purpose. Check the official instructions for each office and keep a separate record of every submission.

What if the officer threatens you for reporting?
Preserve a dated record of later contact or retaliation, including messages and witness details, if you can do so safely. DOJ describes attempts to prevent a victim or witness from reporting misconduct as a form of obstruction it may prosecute when the evidence permits. That does not mean every alleged threat meets the legal standard or that prosecution is assured.
If contacting the same agency feels unsafe, consider whether a civilian oversight body, the FBI, the U.S. Attorney’s Office, the DOJ channel, or local legal counsel is appropriate for your circumstances. Their powers differ, and none guarantees protection or a particular outcome.
What a complaint can—and cannot—establish
“Harassment” and “threat” describe how an event may feel; they do not by themselves determine whether conduct was unlawful, criminal, discriminatory, or within DOJ’s authority. The details, applicable law, and connection to official activity matter. A factual complaint can help an office assess what happened, but submitting one does not guarantee an investigation, discipline, or another remedy.
