To document an AI-assisted mortgage decision, preserve the application and decision-relevant data, identify the exact model and underwriting-policy versions, capture the model output and every human intervention, and retain evidence that any adverse-action reasons match the factors actually considered. Keep mortgage valuation disclosures and delivery records separately, and make the complete record retrievable for the periods required by Regulation B and any longer institutional, investor, state or enforcement hold. The checklist below is a practical control set for U.S. mortgage lenders, not a substitute for counsel or an institution-specific records policy.
Why an AI mortgage decision still needs an ordinary compliance record
Artificial intelligence does not create an exception to the Equal Credit Opportunity Act (ECOA) or Regulation B. The Consumer Financial Protection Bureau (CFPB) states that adverse-action requirements apply regardless of the technology used and that a creditor cannot deploy a complex algorithm if it cannot provide specific, accurate reasons for an adverse decision. See the CFPB Circular 2022-03.

A compliance reviewer therefore needs to reconstruct more than a final “approve” or “deny” value. The file should show what information entered the decision, which model and policy were active, what the system returned, whether a person changed the result, and how the notice was generated. It should also show that the customer-facing reasons describe the principal factors actually considered or scored.
“The adverse action notice requirements of ECOA and Regulation B, however, apply equally to all credit decisions, regardless of the technology used to make them.” — Consumer Financial Protection Bureau, Circular 2022-03

What the law expressly requires you to retain
Specific and accurate adverse-action reasons
When a lender takes adverse action, the notice must state specific principal reasons. “Failed internal policy,” “did not meet our standards,” or a bare statement that an applicant did not achieve a qualifying score does not explain the action adequately. A list of sample reasons is not a safe harbor: the selected reason must correspond to a factor the creditor actually considered or scored.
Credit-score disclosures under the Fair Credit Reporting Act (FCRA) do not replace ECOA reasons for the credit action. If a notice includes FCRA score factors, preserve that material, but do not use it as the sole explanation of why the application was denied, limited, or priced differently.
Application and evaluation records
Under 12 CFR § 1002.12(b), the general consumer-credit rule ordinarily requires a creditor to keep specified records for 25 months after notifying the applicant of action or of an incomplete application. The categories include:
- The application.
- Applicant characteristics collected for compliance monitoring.
- Other written or recorded information used to evaluate the application that was not returned at the applicant’s request.
- Copies of written action notices and the specific adverse-action reasons, or a memorandum when the reasons were delivered orally.
- Applicant statements alleging a violation.
The period is not a universal “keep every AI artifact for 25 months” rule. Regulation B includes exceptions and different periods, including a 12-month rule for certain business-credit applications, a special rule for some large-business or trade-credit applications, and continued retention through final disposition when the creditor has actual notice of an enforcement investigation or proceeding. Apply the rule to the record categories and applicant type at issue, then follow any longer state, investor, agency, charter or institutional schedule.

Mortgage appraisals and other written valuations
For a first-lien dwelling application, Regulation B § 1002.14 requires copies of appraisals and other written valuations developed in connection with the application. For closed-end credit, delivery is generally promptly upon completion or at least three business days before consummation, whichever is earlier; open-end credit uses the account-opening timing. Permitted waivers and other regulatory provisions can change the operational steps.
Track the valuation document version, completion date, delivery date and method, any waiver, and the evidence of delivery. This is a mortgage-specific disclosure control and should not be buried inside a generic model log. The current Regulation B text governs the details.
The practical AI decision record: a field-by-field checklist
No single statute prescribes the exact fields below. They are a recommended evidence set that makes the legal application, evaluation and notice records reconstructable and ties model governance to the deployed version. Minimize duplication of sensitive data; where the controlled loan file already holds a document, store a secure pointer and integrity check rather than an unnecessary second copy.
| Record area | Capture | Review purpose |
|---|---|---|
| Case and decision | Application identifier; product and transaction type; decision stage; decision date and time with time zone; action; responsible business unit. | Establishes which transaction and event the record describes. |
| Inputs and sources | Decision-relevant data received; source and retrieval time; transformations and derived variables; data-quality flags; missing-data treatment. | Shows what the system actually saw and whether a value was imputed, excluded or stale. |
| Model and policy identity | Model or vendor name; model version; deployment or configuration identifier; underwriting-rule and policy version; effective dates; material change identifier. | Allows a reviewer to reproduce the applicable logic instead of consulting today’s configuration. |
| Output and reason trace | Raw output, score or recommendation; reason-generation method; principal factors; mapping from factors to customer-facing reasons; accuracy-test result. | Connects the adverse-action notice to factors actually considered or scored. |
| Human involvement | Reviewer identity or role; review time; override or exception; rationale; final disposition. If there was no human review, record that fact. | Separates automated output from a later judgment and prevents an implied review that never occurred. |
| Notice evidence | Notice content and reasons; delivery date and method; applicable FCRA information; valuation disclosure, waiver and delivery records. | Demonstrates what the applicant received and when. |
| Validation and monitoring | Links to validation, performance, bias or fair-lending assessment, change approval and monitoring records, with population, time window and model version. | Shows that supporting tests cover the version used in this case. |
| Governance and access | Decision owner; approval status; vendor documentation; known limitations; escalation route; retention and disposal schedule; access log. | Establishes accountability and controlled handling of personal information. |
How to build the record during the mortgage workflow
- Open a case record at application intake. Assign a stable application identifier and record product, lien position, transaction type, channel and decision stage. Link to the authoritative loan file rather than copying every identity or income document into an AI repository.
- Freeze the input snapshot used for evaluation. Store each decision-relevant value with its source, retrieval time and transformation history. Record missing-data handling, overrides to source data and quality warnings. A later corrected value must not silently replace the value that drove the original decision.
- Resolve model and policy identity before scoring. Record the model version, deployment or configuration ID, underwriting-policy version and effective dates. If a vendor service supplies a score, preserve the vendor’s model identifier and the lender’s integration configuration, not just the vendor name.
- Capture the unmodified output. Preserve the raw score, probability, recommendation, threshold result or other output returned by the system. Store generated reason codes before any display-layer translation, together with the reason-generation method.
- Record human action explicitly. A reviewer should enter identity or role, timestamp, decision, override or exception and a concise rationale. When no person reviewed the case, record “no human review” rather than implying that an underwriter confirmed the model.
- Map reasons to actual factors. For each principal reason, retain the underlying variable or rule, its value or state at decision time, and the mapping used to create the notice language. Test that the mapping does not select a convenient sample-list item that was not used by the model.
- Issue and archive notices. Save the exact adverse-action notice, delivery method and date, including any FCRA score information when applicable. For first-lien dwelling applications, archive the appraisal or other written valuation, version, waiver (if any) and delivery evidence in the mortgage disclosure record.
- Attach governance references. Link the case to the validation and monitoring reports that cover the deployed model version and relevant population and time window. Include change-approval evidence when a material release preceded the decision.
- Apply retention, access and legal holds. Put the record under the schedule applicable to the applicant and credit product. Restrict access by role, log retrievals, and suspend disposal when an investigation, complaint, litigation or other hold requires continued preservation.
How to explain an AI mortgage denial
Start with the principal factors, not the technology
The notice should identify the principal reasons for the credit action in understandable, concrete terms. Examples might describe a debt-to-income threshold, insufficient documented income history, an unresolved verification discrepancy or collateral information that the decision process actually used. The examples are illustrative; a lender must use the factors present in its own evaluation.

Do not write “the algorithm denied your application,” “you failed our internal policy,” or “your score was below our cutoff” without naming the material factors behind that result. A score can be included when required or useful, but it is not a substitute for the ECOA explanation.
Keep generated language tied to the scored record
Reason text should be generated from a controlled mapping whose inputs are preserved. If a model ranks several contributors, define how the principal reasons are selected, how ties are handled and how a human may correct an inaccurate explanation. The record should show the factors considered or scored even when a later reviewer disagrees with the outcome.
Separate an automated recommendation from the final action
If an underwriter changes an automated recommendation, the notice must describe the reasons for the final credit action, while the audit trail retains both the original output and the override rationale. If policy rules, a fraud control or a manual exception supplied the decisive factor, identify that factor rather than attributing everything to the model.

Design for a targeted production request
A reviewer should be able to retrieve one complete case by application identifier and obtain the input snapshot, version manifest, raw output, reason trace, human-action log, notice and valuation evidence without searching multiple unindexed systems. Use immutable timestamps and a checksum or equivalent integrity control for exported files. Maintain a readable event timeline as well as machine-readable data.

Use the shortest necessary copy of sensitive data
AI logs can expose income, employment, credit and protected-class information. Keep the authoritative document in the controlled loan system, tokenize identifiers in analytics stores, encrypt records in transit and at rest, and grant access according to job role. Record who opened or exported a case. A pointer is useful only if it remains resolvable for the entire applicable retention period.
Handle holds and corrections carefully
When a complaint, examination, investigation or proceeding is known, place the relevant records on hold and prevent automated deletion. Preserve the original decision snapshot when a source document is later corrected; append the correction and its effective time instead of overwriting history. Document disposal approvals and the records actually destroyed after a hold is released.

The National Institute of Standards and Technology describes its AI Risk Management Framework (AI RMF) as voluntary. Its lifecycle approach covers pre-design, development, deployment, use, testing and evaluation, with trustworthiness characteristics including validity and reliability, security and resilience, accountability and transparency, explainability and interpretability, privacy, and fairness. A lender can use those concepts to index validation reports, data and model inventories, fairness assessments, incident records, vendor attestations, change approvals and monitoring results. Label this material as governance evidence chosen by the institution. It does not replace Regulation B’s required application, evaluation and notice records, and it does not turn a voluntary framework into a legal retention period.
Best Value
Comparing documentation approaches
There is no regulator-published ranking of a particular software product or template. Evaluate an approach against the following practical criteria:
| Approach | Reconstructability | Reason accuracy | Retention and retrieval | Mortgage evidence | Privacy and governance |
|---|---|---|---|---|---|
| Loan-file extension with versioned AI manifest | Strong when inputs, outputs and interventions are linked to the application. | Strong if reason mapping is stored with the notice. | Uses existing records controls; test cross-system links. | Can link valuation versions and delivery proof. | Usually benefits from established access controls. |
| Central model-governance repository linked to loan files | Strong for model versions, tests and approvals; case-level input capture must be explicit. | Depends on preserving case-specific reason traces. | Requires reliable identifiers and synchronized schedules. | Valuation records may need a separate mortgage disclosure system. | Good lifecycle visibility; limit broad analytics access. |
| Vendor-hosted decision log | Varies; contractually require raw outputs, configuration, timestamps and export capability. | Insufficient if the lender cannot verify the factors behind notice reasons. | Confirm export format, availability, deletion terms and legal-hold support. | Do not assume the vendor retains appraisal delivery evidence. | Review sub-processors, permissions, encryption and incident duties. |
| Manual spreadsheet or memo supplement | Weak for high-volume or frequently changing models; vulnerable to omissions. | Can document a specific override, but not reliably reproduce automated reasoning. | Version, access and retention controls require disciplined administration. | May track delivery dates but should not replace the authoritative valuation copy. | Higher risk of uncontrolled duplication and exposure. |
Common failures and how to correct them
- Only the final decision is saved. Add an immutable input snapshot, model and policy manifest, raw output and human-action event.
- The notice uses a generic policy phrase. Replace it with specific principal factors that the evaluation actually considered; have compliance test the mapping.
- A sample reason list is treated as a menu. Require evidence that each selected reason was a scored or otherwise considered factor.
- FCRA key factors are substituted for ECOA reasons. Preserve both disclosures and keep their legal purposes distinct.
- Model versions are inferred from deployment date. Record an explicit version and configuration ID for every decision, including vendor updates.
- Human overrides disappear into a final status. Capture reviewer role, time, changed fields and rationale, including the fact of no review when applicable.
- Valuation delivery is mixed into the AI log or omitted. Maintain the appraisal or written valuation copy, applicable waiver and delivery evidence under the mortgage-specific process.
- Logs contain excessive personal data. Replace duplicate documents with controlled references, tokenize analytics identifiers and audit access.
- Automatic deletion runs during an examination. Apply and test legal-hold procedures that suspend disposal and preserve the original record.
- Governance reports cover a different model version or population. Store coverage dates, population definition and version with every validation or monitoring link.
What changed in the 2026 ECOA rule context
The CFPB’s ECOA resource page reports a final rule issued April 22, 2026, addressing provisions concerning disparate impact, discouragement of applicants or prospective applicants, and special purpose credit programs. The detailed text, effective dates and litigation or application status are not established here. Before changing a documentation schedule or notice process on that basis, review the final rule and current legal status with counsel. Existing duties to preserve evaluation records and provide accurate, specific adverse-action reasons remain the operational baseline described above.
A concise audit-packet test
For a sampled application, a reviewer should be able to answer these questions from the preserved records:
Free tools Windows power users keep installed
One-click scans. No signup required.
- Which product, lien position and decision event are being examined?
- What exact data and derived values entered the evaluation, and when were they retrieved?
- Which model, deployment configuration and underwriting policy were effective?
- What raw output and thresholds did the system produce?
- Who reviewed or overrode the result, or was there no human review?
- Which factors were principal to the action, and where is the mapping to the notice?
- What notice was delivered, by what method and date?
- For a first-lien dwelling application, where are the valuation copy, version and delivery records?
- Which validation, fairness, monitoring and change-approval records cover this model version and population?
- What retention schedule, access history or legal hold governs the packet?
If any answer requires reconstructing events from memory or from an unversioned vendor dashboard, the control is not yet audit-ready. Correct the capture process for new decisions and preserve available historical evidence under the applicable policy and legal advice.
