Keep the AI agent as a preparation aid, not the accountable taxpayer, tax practitioner or auditor. For each material tax decision, preserve the supporting records and a version-linked decision packet showing what the agent did, what a human reviewed and approved, and what action followed. Indian tax rules set recordkeeping and retention duties for particular records and taxpayers; the official sources cited here do not prescribe a universal AI decision log or require retaining an agent’s full reasoning.
What should an AI-assisted tax decision record contain?
Create a packet for each material tax position, return adjustment, journal entry, withholding decision or filing action. Treat the fields below as a practical governance design—not a statutory AI form. Keep required books and source records independently of a chat transcript or an AI vendor’s dashboard.

- Identity and scope: taxpayer or entity, tax regime, tax year or return period, issue identifier, responsible business owner, and whether the decision remained a draft or was acted on.
- Evidence: copies or stable references to relevant invoices, ledgers, contracts, returns, notices, reconciliations and other source material. Record each document’s date, origin and version, and link each material agent statement to the evidence that supports it.
- System context: agent or application name, model and version where available, run timestamp, task or prompt version, connected tools or data sources, and material configuration changes. If a detail was not captured, do not reconstruct or backfill it as though it were known.
- Decision: the question asked, agent output, assumptions, cited tax provisions or source records, uncertainty or escalation flags, and any human edits, rejection or override. Preserve prior versions and their changes rather than silently replacing an answer.
- Approval: reviewer’s name or unique user ID, role and authority, what they reviewed, whether they approved, rejected or returned it for correction, the timestamp, and any conditions. Bind approval to the exact version reviewed.
- Outcome and retention: final journal entry, return or form version, payment or withholding action, filing acknowledgment, and the retention schedule or legal hold applied.
This structure makes the path from evidence to action traceable. The legal recordkeeping requirements themselves depend on the tax regime, taxpayer and records involved.
How should the packet connect to statutory tax records?
GST records and electronic edits
Section 35 of the Central Goods and Services Tax Act requires registered persons to keep true and correct accounts for specified matters, including inward and outward supplies, stock, input tax credit and output tax. It permits electronic accounts in the prescribed manner. An AI-generated summary does not replace the invoices, books, supply records, stock information, ITC support or other evidence required for the taxpayer’s situation. See CGST Act section 35.

For records covered by the relevant chapter, CGST Rules rule 56 addresses electronic data and edits. It says incorrect entries are not to be erased or overwritten and that, where records are electronic, “a log of every entry edited or deleted shall be maintained.” It also provides for electronic records to be authenticated by digital signature. Preserve the underlying accounting record and its required edit history; a separate AI decision packet can link to that record, but should not substitute for it. See CGST Rules rule 56.
Income-tax books and audit workflow
The Notified Income-tax Rules, 2026 include electronic-record requirements for the books and documents covered by the cited rule. Those records must remain accessible in India at all times, and daily backups must be kept on servers physically located in India. Verify that the provision applies to the specific taxpayer and record set before using it to decide where to store a prompt, agent log or other data; it is not a blanket India-hosting rule for every AI-related data object. See the Notified Income-tax Rules, 2026.

Where the applicable tax audit workflow uses Form 3CB-3CD, the Income Tax Department’s guidance describes an accountant’s examination and certification, with the CA uploading the form using a digital signature certificate in the described process. A workflow log can show what a reviewer considered, but an AI output or approval record is not the accountant’s signed report. The form guidance applies to the described form workflow, not every tax decision. See the Form 3CB-3CD User Manual.
How long should Indian tax records be kept?
Do not use one retention period for every Indian tax record. The cited periods below attach to different regimes and records; check amendments, the taxpayer’s circumstances, any applicable notice or proceeding, and other retention laws before setting a deletion date.
Rank #3
| Record set | Period stated in the cited source | Important qualification |
|---|---|---|
| GST records under section 36 | 72 months from the due date of furnishing the annual return for the year relating to those accounts and records. | For records relating to an appeal, revision, other proceeding or investigation, preservation extends to one year after final disposal or the otherwise applicable period, whichever is later. See CGST Act section 36. |
| Books and documents covered by rule 46(9) of the Notified Income-tax Rules, 2026 | Seven tax years from the end of the relevant tax year. | Preservation continues until completion where the related assessment has been reopened. This period is for the books and documents covered by that rule, not every tax-related file or AI data object. See the Notified Income-tax Rules, 2026. |
Set retention and legal holds against the applicable record set, not just the AI conversation. Where a packet is needed to explain a retained accounting entry or filing, make sure its references and version history remain usable for the relevant period.
Can an AI agent approve a tax return?
An agent can prepare a draft, identify an issue or route a decision for review. Do not treat its output as the accountable human’s approval or as a statutory certification. The person with the appropriate authority should inspect the evidence and the precise version being approved; where a form requires an accountant’s opinion, certification or digital signature, retain that signed workflow evidence separately. The Form 3CB-3CD guidance describes such a role in its applicable workflow.

How can a team make the approval trail auditable?
- Open a scoped decision record. Identify the taxpayer, tax regime, period, issue and accountable business owner before running the agent.
- Preserve the inputs. Store the applicable source documents and versions in the record system, and link the run to them. Keep statutory books and records in the required form independently.
- Capture the run. Record the agent, available model/version information, task version, timestamp, connected data sources and material settings. Mark unavailable metadata as unavailable rather than guessing.
- Record the review. Keep the output, assumptions and uncertainty flags together with edits, overrides or rejection. Route unclear or material issues to an appropriately qualified reviewer.
- Bind the decision to a version. Record reviewer identity and role, decision and timestamp, plus any conditions. The approval should identify the exact packet or document version reviewed.
- Link to the action. Attach the final journal entry, return or form version, payment or withholding action and filing acknowledgment, as applicable.
- Apply retention controls. Assign the relevant schedule and any legal hold; verify required access, backup and edit-history controls for the covered records.
What should a tax auditor or reviewer be able to trace?
For a material conclusion, a reviewer should be able to move from the final return figure or accounting entry back through the human decision to the agent output and the source evidence. The packet should make visible what changed, who reviewed it, which version they saw, and whether the result was actually used. A transcript without stable links to documents, final actions and retained books may not establish that chain.
When assessing an accounting or approval system, check whether it provides:

Evaluate actual product controls, contract terms, data locations and applicable legal coverage; a feature label or vendor claim alone does not establish compliance.
How does personal-data timing affect AI tax records?
Tax files and AI inputs can contain personal data. Map what the system processes, who can access it, where records are stored and when they are deleted to the laws and commencement dates that apply. The MeitY commencement notification dated 13 November 2025 staggers provisions of the Digital Personal Data Protection Act: some commenced on publication, another group is scheduled one year later, and a further group eighteen months later. The Digital Personal Data Protection Rules, 2025 also stagger commencement: rules 1, 2 and 17–21 commenced on publication; rule 4 is scheduled one year after publication; and rules 3, 5–16, 22 and 23 are scheduled eighteen months after publication. As of 7 October 2026, the one-year and eighteen-month dates have not all elapsed. Check the official DPDP Act commencement notification and Digital Personal Data Protection Rules, 2025 and any corrigenda before treating a particular duty as operative. These sources do not establish a general India-only hosting mandate for all prompts, logs or AI data.
