Short answer: owning a percentage of a song does not automatically give you permission to upload every version of it. First separate the composition (music and lyrics) from the sound recording (the particular performance), then read every collaboration, label, producer, publishing and distribution agreement. You may need written authorization from the other rightsholders, and the distributor may impose stricter rules than copyright law.
In the United States, a default joint-work rule can allow one co-owner to grant a nonexclusive license for the whole work while accounting to the other owners. That default can be changed by contract, and it does not make a distributor accept a release. The practical test is therefore threefold: do you have authority under your agreements, do you have all additional licenses required for the material, and does your chosen distributor accept the release under its current policy?

What you may own: the composition and the master are different rights
A song normally involves at least two separate copyrighted works. The musical composition is the underlying music and lyrics. The sound recording, often called the master, is a particular recorded performance of that composition. The U.S. Copyright Office says, “Copyright in a sound recording is not the same as, or a substitute for, copyright in the underlying musical composition.” The owners of those two works can be different.

| Sound recording (master) | The specific recorded performance you plan to release | Who paid for and owns the recording? Did a label, producer or artist receive an ownership interest? Is the recording subject to an exclusive license? |
A songwriting percentage does not automatically determine who owns the master. Conversely, a share of a master does not clear the composition. Map both works separately before opening a distributor account.

Credits, payments and ownership are not interchangeable
Being listed as a writer, vocalist, producer or featured artist does not by itself establish a particular ownership percentage. Payment for studio work, a royalty promise, a credit, or participation in a session can have a different legal effect from an assignment or license. Use the signed agreement and the governing law to identify rights; do not infer ownership from a streaming credit or an informal split discussed in messages.
Read the agreements before choosing who uploads
Collect the documents connected to the song and recording:
- Co-writing or split-sheet agreements.
- Artist, label and recording agreements.
- Producer, beat, session-musician and featured-artist agreements.
- Publishing, administration and work-for-hire agreements.
- Any earlier distribution, licensing or synchronization agreement.
For each document, locate the clauses that answer these questions:
- Ownership: What percentage, if any, does each party own in the composition and the master?
- Authority: May one party authorize distribution alone, or are joint signatures or written consents required?
- Exclusivity: Is a license exclusive, and has another party already received exclusive rights?
- Scope: Which formats, platforms, territories, languages and promotional uses are covered?
- Term and termination: How long does the grant last, and what happens if a party withdraws?
- Accounting: How are income, expenses, statements and audits handled?
- Restrictions: Are samples, interpolations, remixes, alternate versions or artificial-intelligence elements restricted?
Have every relevant contributor confirm the final split in a signed document before release. TuneCore advises collaborators to agree shares in writing, and a written agreement can replace the default legal assumptions that would otherwise apply.
What U.S. joint-work law may allow—and what it does not guarantee
The U.S. Copyright Office describes a default rule for jointly owned works: “Each co-owner may thus grant a nonexclusive license to use the entire work without the consent of other co-owners, provided that the licensor accounts for and pays over to his or her co-owners their pro-rata shares of the proceeds.” This is a U.S.-specific description of a default for joint works, not a universal permission slip.
The rule can be altered by a collaboration agreement, publishing deal, label contract, exclusive license or other arrangement. It may also be difficult to apply when the parties disagree about whether a joint work exists, what each person contributed, or whether an assignment occurred. A court or lawyer may need to resolve those issues. The rule concerns the relevant copyright and does not automatically authorize use of a separately owned master, sample or other third-party material.

If your project is outside the United States, do not assume this rule applies. Copyright, co-ownership and licensing rules vary by country. A release marketed internationally may also require territory-specific permissions even when the uploader is located in the United States.
Distributor eligibility is a separate hurdle
A distributor is a service provider with its own warranties, takedown procedures and eligibility rules. Satisfying a legal default does not force a distributor to accept the upload.
| Service policy described in the cited guidance | What it means for a partial owner |
|---|---|
| TuneCore states: “You cannot distribute any content through TuneCore if you do not have 100% of the rights to that content.” | An uploader who owns only a share should not rely on a joint-owner default; obtain whatever authorization TuneCore requires or use a service whose current policy permits the arrangement. |
| DistroKid says artists keep ownership, while its terms require users to have the rights and permissions necessary for the service’s use. | Keeping ownership is not the same as proving authority to upload. Review the current terms and be prepared to document permissions from other owners. |
| Distributor cover and licensing workflows differ. | A process offered for one service or territory may not clear the same use elsewhere. Follow the chosen service’s current instructions. |
These are operational policies, not statements of universal copyright law. Policies, plan features and eligibility checks can change, so read the live terms immediately before submission. Keep copies of the terms and any approval or correspondence connected with your release.
A safe distribution process for a partially owned release
1. Create a rights map
- Write the song title and identify the composition and the exact master recording as separate entries.
- List every known writer, lyricist, publisher, performer, producer, label and other claimant for each entry.
- Record the percentage or interest stated in each signed agreement.
- Mark any assignment, exclusive license, work-for-hire clause, reversion provision or unresolved dispute.
If you cannot identify the master owner separately from the composition owners, stop before upload. A distributor cannot fix an incomplete chain of title.
2. Confirm who can authorize the release
Match the proposed release to the agreement. Check whether one co-owner may grant a nonexclusive license, whether another party must sign, and whether an existing exclusive deal controls distribution. Ask for a written authorization that identifies the recording, the composition, the distributor, the territories, the term, the permitted uses and the accounting obligation. Store the signed document with the final audio and metadata.

Read the rights warranty, indemnity, takedown and dispute provisions, not just the upload screen. Confirm whether the account holder must own 100 percent of the content, whether written consents are accepted, and whether the service has special rules for collaborations, labels, covers or samples. If support staff approve an exception, obtain that approval in writing before release.

- [Dont Hesite to Order] 24 hours customer services and professional technology team are standing by
4. Audit the audio and metadata
- Make sure the audio is the version covered by the authorization.
- Use accurate writer, publisher, performer, producer and featured-artist credits.
- Do not list yourself as the sole owner if another party owns or controls a share.
- Check that the title, artist names, version label and release date do not conflict with an existing release.
- Keep the uncompressed master, session records and final metadata file as evidence of what was authorized.
5. Clear third-party material
Identify any pre-existing composition, recording, sample, interpolation, remix element, beat, voice, image or spoken performance. Obtain the relevant written license before upload. A co-writer’s permission for a new song does not automatically clear a sample taken from another recording.
6. Submit only after the chain is documented
Upload from the account authorized by the agreements and distributor policy. If the service asks for proof, provide the signed consent, license or ownership document rather than relying on a royalty split screen. Set a release date that leaves time to respond to questions or a rights review.
7. Preserve records and monitor the release
Save the submitted metadata, agreements, invoices, approvals, takedown notices and royalty statements. Watch for claims from a co-owner, publisher, label or rights-management service. If a dispute arises, pause promotion and seek advice rather than re-uploading the same material through another account.
Covers, samples, interpolations and remixes need their own clearance
Newly recorded covers
A cover is a new recording of a pre-existing composition. TuneCore says a digital cover released through its service needs a mechanical license from the composition copyright holder before release. A cover workflow does not grant rights in the original sound recording.
CD Baby’s guidance distinguishes a song you co-wrote from a cover: writing a song with another person does not automatically make your recording a cover. Its policy also describes licensing requirements for cover releases and additional direct licensing for distribution outside the United States. Check the current service, territory and permitted uses before relying on a distributor-provided license.
Samples and interpolations
A sample uses audio from an existing recording and generally requires permission from the owner of that recording, commonly called a master-use license. An interpolation re-creates part of the underlying composition without copying the original audio; it can still require permission from the composition owners. TuneCore warns that its cover process does not clear samples or interpolations.

Remixes and derivative versions
A remix, edit, translation or other derivative version may implicate both the original master and composition. Obtain authorization that expressly covers the new version, not merely the original track. If a producer or label owns the master, a writer-only consent is insufficient.
The U.S. statutory mechanical route
The U.S. Copyright Office describes a Section 115 statutory-license path for certain nondramatic musical works, subject to notice and royalty conditions. It does not clear a third-party sound recording, samples or every possible use. Confirm that your release qualifies and satisfy the statutory requirements; do not treat the statute as a replacement for master-use or other permissions.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Royalty splits distribute money; they do not create rights
A distributor’s split feature is an accounting tool. It tells the service how to divide revenue after the release has been accepted. It does not establish who owns the composition or master, authorize the upload, or replace a signed agreement.
TuneCore describes track-level splits on eligible paid Unlimited plans. Its guidance says a split can be added after submission, but revenue already posted is not divided retroactively. Confirm the current plan, timing and eligibility before relying on the feature. Agree on percentages and payment obligations in writing even when a platform can automate payments.
Your written agreement should address income that the distributor does not collect, such as publishing royalties, neighboring-rights income, advances, direct licenses and synchronization fees. Specify who sends statements, when payments are due, how disputes are handled and whether a recipient’s tax or identity information is required.

Choose the route that matches your authority
| Route | When it fits | Documents and risks to compare |
|---|---|---|
| One co-owner uploads after documented authorization | The agreements permit one account holder to distribute and the distributor accepts that authority. | Written grant, nonexclusive or exclusive scope, territory, term, accounting duties and the distributor’s rights warranty. |
| All relevant owners authorize or participate | The contract or distributor requires joint approval, or the parties want a shared release workflow. | Signatures or account roles, accurate metadata, payment allocation and a process for changing or withdrawing the release. |
| Pause for legal review or additional licenses | Ownership is disputed, an exclusive contract may apply, or the audio includes third-party material. | Cost and delay of clearance versus the risk of rejection, takedown, unpaid royalties, indemnity claims or litigation. |
Compare every route on the same seven axes: composition rights, master rights, authority and consent, exclusivity, territory and term, distributor eligibility, third-party licensing, and payment accounting. The cheapest upload path is not necessarily the lowest-risk path.

Common failure modes and how to correct them
“I wrote half the song, so I can upload it.”
Writing a percentage may give you a composition interest, but the master may belong to someone else or be subject to an exclusive deal. Map both copyrights and obtain the required authorization.
“The split tool proves our percentages.”
A split tool records payment instructions. It cannot amend a contract or prove ownership. Use a signed split or license agreement as the ownership record.
“The distributor accepted the file, so all rights are cleared.”
Acceptance is not a legal determination. A later complaint can trigger a takedown or account restriction. Keep the chain-of-title documents and respond promptly to claims.

A cover license concerns the composition in the new recording. A sample copies audio from another recording and may require a separate master-use license; an interpolation may require separate composition permission.
“A U.S. rule applies everywhere.”
The joint-work and Section 115 explanations above are U.S.-specific. For releases involving other countries, obtain advice on local ownership, collecting societies, moral rights, compulsory licenses and territorial restrictions.
Pre-upload checklist
- I have identified the composition owners and master owner separately.
- I have read every collaboration, label, producer, publishing and prior distribution agreement.
- The proposed uploader has written authority covering this recording, use, territory and term.
- No exclusive license or withdrawal restriction blocks the release.
- All samples, interpolations, covers, remixes and other third-party elements are cleared.
- Credits, percentages and ownership statements match the signed documents.
- The distributor’s current terms allow this ownership and authorization structure.
- The payment split is documented separately from the copyright grant.
- I have retained the agreements, approvals, final audio and submitted metadata.
If any item is unresolved—especially a disputed share, an exclusive contract or unidentified sample owner—do not upload until a lawyer familiar with music rights reviews the situation. This is a decision framework, not personalized legal advice.
