How to Dispute an Unauthorized Credit Card Surcharge

If a merchant added a credit-card surcharge you did not agree to, first determine whether the underlying purchase was yours. An authorized purchase with an unexpected or incorrectly disclosed fee is usually handled as a possible billing error; a transaction you never authorized should be reported as suspected fraud immediately. For a qualifying credit-card billing error, send a written notice to the issuer’s billing-dispute address within the statutory period, preserve your records, and pay the undisputed part of the bill.

This guide is written for U.S. consumer credit-card transactions. Surcharge legality depends on the transaction location, date, card type, merchant channel, applicable federal and state law, and card-network rules. A surcharge is not automatically illegal everywhere, and calling an authorized purchase “fraud” merely because its fee was unexpected can send the dispute through the wrong process.

Start by identifying what actually happened

“Unauthorized surcharge” can describe several different problems. The remedy depends on whether you authorized the card transaction, whether the amount differs from what you agreed to, and whether the merchant disclosed the fee before payment.

What happened How to describe it to the issuer Likely issue
You did not make or authorize the card transaction at all. Unauthorized transaction or suspected fraud. Report it immediately under the issuer’s fraud procedure.
You made the purchase, but the merchant charged more than the agreed price. Authorized purchase; incorrect amount. Potential billing error. State the exact difference and attach the receipt or advertised price.
You made the purchase and a separate surcharge appeared without the promised notice. Authorized purchase; disputed surcharge or inadequate disclosure. Potential billing error and possibly a consumer-protection or network-rule issue.
You paid with a debit or prepaid card. Debit or prepaid-card dispute. The credit-card FCBA procedure described here may not apply; use the protections and deadlines for that card type.

The Federal Trade Commission (FTC) says federal law limits liability for unauthorized credit-card use to $50 under the applicable legal framework. That figure is not a general limit on a surcharge you knowingly paid and later challenge.

Check the charge before contacting anyone

Compare the statement with the transaction record

  1. Copy the merchant name exactly as it appears on the statement.
  2. Record the transaction date, posting date, base price, surcharge amount, and final total.
  3. Compare the statement with the itemized receipt, order confirmation, signed agreement, or checkout record.
  4. Note how the fee was labeled: surcharge, convenience fee, service fee, processing fee, or another term. The label alone does not establish legality.
  5. Identify whether the card was a credit card, debit card, or prepaid product and where the transaction occurred or was processed.

A fee can be challenged because it was not shown before payment, differed from the amount disclosed, was calculated incorrectly, or was prohibited by applicable law. You need to identify the factual defect rather than simply assert that every credit-card fee is unlawful.

Preserve every piece of evidence

Save a PDF, photograph, or screenshot of the statement entry, itemized receipt, advertised price, checkout page, menu, sign, or terms that described the fee. Keep emails, text messages, chat transcripts, and the merchant’s response. Write down when you saw the price and when you paid. Retain your card agreement and locate the issuer’s address for billing disputes, errors, or inquiries. That address is often different from the address used for payments.

The FTC recommends keeping transaction details and receipts available and sending copies, not originals, with a written dispute. Keep a complete copy of your letter and proof that the issuer received it.

Is the surcharge illegal?

Federal disclosure and total-price rules

The FTC’s fee guidance says a business may charge or pass through payment-processing fees when otherwise permitted by law. Where a customer has a viable way to pay without the fee, the fee may be treated as optional for the FTC’s total-price analysis. Even then, the business must disclose it and include it in the final amount before requesting payment, and it may not misrepresent what the charge is.

If a fee is mandatory or cannot reasonably be avoided, the applicable rule generally requires it to be included in the displayed total price in covered contexts. The FTC’s examples are context-specific; they do not decide every surcharge question for every merchant, product, channel, or jurisdiction.

State and local law

State and local rules can prohibit surcharges or impose requirements about notice, signs, receipts, caps, or the type of payment affected. The controlling law is the law in force where and when the transaction occurred, not a general internet summary. A card-present purchase, an online order shipped to another state, and a telephone transaction may raise different jurisdictional questions.

Visa’s merchant guidance says credit-card surcharging is permitted in most U.S. states subject to limitations, while some jurisdictions prohibit it or impose additional conditions. Visa’s state-law summary dated February 15, 2024 is a historical snapshot, not a current survey. Verify the law for the transaction’s location and date before asserting that a particular fee violated state law.

Card-network requirements

Network rules are separate from the Fair Credit Billing Act (FCBA) billing-error process. Visa’s general rules require compliance with applicable law and prohibit adding to the normal or advertised price unless law expressly permits the surcharge. Mastercard’s merchant guidance likewise requires compliance with state and federal law, disclosure at the point of interaction, and the dollar surcharge to appear on the receipt.

Mastercard’s page lists a 4% maximum network cap and also says the surcharge is limited by the merchant’s cost of acceptance in relevant cases. A network cap is not permission to charge that percentage automatically: a state or local rule, the merchant’s actual cost, or another network requirement can impose a lower limit.

Step-by-step: dispute an authorized surcharge through the issuer

1. Decide whether the FCBA process fits

The FCBA billing-error process covers qualifying credit-card billing errors, including unauthorized charges and certain incorrect amounts. An authorized purchase with an undisclosed or wrong surcharge may qualify, but the issuer will need the facts showing what was agreed, what was disclosed, and what was posted. If the entire transaction is unfamiliar, use the issuer’s fraud channel immediately rather than describing only the fee.

2. Ask the merchant for an explanation when useful

Contact the merchant promptly and ask:

  • What was the fee called and why was it charged?
  • Where and when was it disclosed before payment?
  • How was the amount calculated?
  • Why does the receipt or statement differ from the advertised or agreed price?

Request a correction or refund if the fee was missing from the disclosure, exceeded the stated amount, or was calculated incorrectly. Keep the response. A merchant conversation can resolve the matter quickly, but Regulation Z commentary says you do not have to contact the merchant before sending a qualifying billing-error notice to the issuer. Do not let negotiations consume the issuer’s statutory deadline.

3. Send a written billing-error notice to the correct address

For a qualifying credit-card billing error, mail or otherwise deliver a written notice so that it reaches the issuer within 60 days after the first statement containing the error was sent. Use the issuer’s billing-inquiries, billing-disputes, or billing-errors address shown in the agreement or statement—not the payment address unless the issuer specifically identifies it for disputes.

Include:

  • Your name and account information.
  • The merchant name and the transaction and posting dates.
  • The exact amount you dispute.
  • What the receipt, advertised price, or prior disclosure showed.
  • What appeared on the statement.
  • Why you believe the difference is a billing error, such as missing disclosure, an amount above the disclosed fee, or a charge you did not authorize.
  • Copies of the statement, receipt, screenshots, notices, and merchant correspondence that support the explanation.

Use a trackable delivery method when possible and retain the letter, attachments, and delivery confirmation. Do not send irreplaceable originals.

A factual letter template

I dispute the $___ charge posted by ___ on ___. The receipt/posted price showed ___, but the statement/receipt charged ___. I believe this is a billing error because ___. Please investigate under the billing-error procedures. Copies of the statement and receipt are enclosed.

Adapt the wording to the actual facts. If you made the purchase, say so and describe the surcharge problem accurately; do not call an authorized transaction “fraud” simply because the fee was unexpected.

4. Track the issuer’s response

The issuer generally must acknowledge a proper written notice within 30 days unless it has already resolved the issue. It must resolve the billing-error inquiry within two billing cycles and no later than 90 days after receiving the notice. Keep the acknowledgment and every later letter, email, or statement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Stage What to expect What you should do
Notice received The issuer records the written billing-error claim. Keep delivery proof and your complete file.
Acknowledgment Usually within 30 days, unless the issuer already corrected the issue. Check that the disputed transaction and amount are identified correctly.
Investigation The issuer reviews the account records and your evidence. Respond promptly to requests and continue paying the undisputed balance.
Final result Within two billing cycles, but no later than 90 days after receipt. Read whether the issuer corrected the account or explains why it considers the bill correct.

5. Pay the undisputed part of the bill

During the investigation, the FTC says you may withhold the disputed amount and related finance or other charges, but you must pay the undisputed portion, including finance charges attributable to that portion. Follow the issuer’s instructions and your card agreement so an otherwise current account does not become delinquent.

If the issuer concludes that the bill is correct, it must explain the result and state how much is owed. You may appeal in writing within the payment period stated by the issuer or within 10 days after receiving the explanation, whichever is later. Include the specific evidence the first review overlooked and keep proof of the appeal.

Use the right procedure for each kind of dispute

When you did not authorize the transaction

Call the issuer’s fraud or security number immediately, follow its instructions, and monitor the account for related charges. Tell the issuer whether the card or account information may have been compromised. The federal $50 liability limit described by the FTC concerns unauthorized credit-card use; it does not decide a disagreement over a surcharge on a purchase you made.

When you authorized the purchase but the amount is wrong

Describe the mismatch in dollars and documents: for example, the receipt showed a $100 purchase and the statement posted $108, or the merchant disclosed a $2 fee but posted $5. Attach the receipt, order confirmation, or price display. A precise amount comparison is more useful than a general claim that the charge “looks wrong.”

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

When you authorized the purchase but object to the surcharge

Identify the actual basis for the objection: no notice before payment, a notice that was hard to see or contradicted the advertised total, an amount above the disclosed fee, a mandatory fee presented as optional, or a possible violation of state law or network rules. The issuer’s billing review and a regulator or network inquiry may address different questions, so document each one separately.

When the card was debit or prepaid

Do not assume the FCBA credit-card procedure applies. Debit-card error and unauthorized-transfer protections have different rules, notice periods, and investigation requirements. Contact the debit-card issuer promptly and ask for its written dispute instructions. Preserve the same receipts, screenshots, and fee disclosures.

What to do if the issuer or merchant does not fix it

Escalate an issuer-process problem

Build a timeline showing when the statement was sent, when your written notice arrived, what the issuer acknowledged, what you paid, and what decision it issued. If the issuer appears to have ignored a timely qualifying notice, failed to investigate, or mishandled the required response, you can consider filing a complaint with the Consumer Financial Protection Bureau. Attach your timeline and copies, not originals.

Report a possible network-rule issue separately

If the problem is point-of-sale disclosure, the surcharge shown on the receipt, or a network cap, use the relevant card network’s current official reporting or inquiry channel when one is available. Network rules do not replace your FCBA rights, and a network review does not necessarily determine whether the issuer must credit your account. Verify the current route before submitting a complaint because reporting options can change.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Consider a state or local consumer complaint

If the fee appears to violate a state disclosure or pricing rule, contact the appropriate state or local consumer-protection office. State the transaction location and date, the price shown before payment, the fee disclosure, and the final amount. Avoid claiming a statewide violation unless the rule actually covers that merchant, transaction type, and payment method.

Common mistakes that weaken surcharge disputes

  • Waiting for the merchant. A refund conversation does not extend the issuer’s billing-error deadline.
  • Sending the notice to the payment address. Use the billing-inquiries address identified for disputes.
  • Disputing the whole purchase when only the fee is wrong. State the exact surcharge and leave the undisputed amount clear.
  • Calling an authorized purchase fraud. Use accurate terms so the issuer routes the matter correctly.
  • Assuming a network percentage is a legal entitlement. A network maximum does not override a stricter state rule or cost-based limit.
  • Relying on a screenshot without the date or context. Preserve the full page, receipt, sign, or statement showing when and where the disclosure appeared.
  • Paying nothing while the account is reviewed. Continue paying the undisputed balance and applicable finance charges on that balance.
  • Sending original documents. Keep originals and provide copies.

A practical decision checklist

  1. Confirm the card was a U.S. consumer credit card and identify the transaction location and channel.
  2. Decide whether you authorized the underlying purchase.
  3. Compare the advertised or agreed price, disclosed fee, receipt, and statement.
  4. Calculate the exact amount in dispute.
  5. Save the statement, receipt, price display, checkout record, and correspondence.
  6. Ask the merchant for an explanation or correction if doing so is useful, without delaying the issuer notice.
  7. Send a written notice to the issuer’s billing-dispute address within the statutory window.
  8. Pay the undisputed balance and keep proof of every payment.
  9. Track the issuer’s acknowledgment, investigation, and final decision.
  10. Appeal or escalate with a dated timeline if the response is incomplete or the merchant’s disclosure appears unlawful.

Frequently asked questions

Can a merchant charge a credit-card fee without telling me?

Whether it may do so depends on the transaction, applicable federal and state law, and network rules. A fee that was not disclosed before payment, was omitted from a required total price, or exceeded the disclosed amount can support a billing-error dispute, but the facts must be evaluated under the rule that covers that merchant and transaction.

Does the word “surcharge” prove the fee is illegal?

No. Merchants use several labels for payment-related fees, and the label does not decide legality. Focus on the disclosure, amount, optionality, payment method, transaction location, and law in force on the transaction date.

What if I noticed the fee after the issuer’s notice period?

Send the issuer a written explanation anyway and ask what remedies remain under the card agreement or other law. Explain when you first received the statement and why notice was delayed. Do not assume a merchant conversation or a later statement automatically resets the statutory period.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I dispute only the surcharge instead of the whole transaction?

Yes. State the amount of the surcharge and confirm that you authorized the underlying purchase if that is true. Paying the undisputed purchase amount while the fee is reviewed makes the scope of the claim clear.

Will the issuer decide whether the merchant violated a state surcharge law?

The issuer can investigate a qualifying billing error and correct an account, but a network or government agency may be better positioned to assess a merchant’s compliance with a particular state or network rule. You may need to pursue those questions separately.
