Start by obtaining the lender’s exact classification in writing, preserve every record, and challenge the decision with the lender before approaching the RBI Ombudsman or a court. Fraud and wilful-default decisions can have serious civil consequences, but the remedy depends on whether you are contesting the lender’s internal decision, information supplied to a credit-information company, or both.
RBI’s July 15, 2024 release requires regulated entities to follow natural-justice principles before classifying a person or entity as fraud. The Supreme Court’s decision in State Bank of India v. Rajesh Agarwal likewise treats fraud classification as a decision requiring a fair opportunity to respond. Credit-report disputes follow a separate correction process, with a 21-calendar-day step for the credit institution and an overall 30-calendar-day resolution framework, subject to the applicable RBI rules and exclusions.

First identify what has actually been recorded
Do not assume that an adverse entry in a credit report proves that the lender has classified the account as fraud. A lender may have recorded one or more of the following:
- Fraud classification: an internal regulatory classification based on suspected fraudulent conduct.
- Wilful-defaulter classification: a defined RBI process concerning intentional non-payment, diversion or siphoning of funds, disposal of secured assets, or another specified ground.
- Ordinary default or NPA status: a payment-performance classification that does not, by itself, establish fraud or wilful default.
- Red-flag or investigation status: an internal warning or investigation stage that may not be a final fraud decision.
- Incorrect credit-information entry: a wrong account status, amount, date, ownership, liability, or borrower identity reported to a credit-information company.
Ask the lender to identify the precise label, the date it was applied, the authority that approved it, and every credit-information company to which it was reported. Ask separately whether the label is final or only under investigation. Keep the lender’s response because it defines the dispute you must pursue.

Build a complete record before challenging anything
Preserve evidence before sending a detailed representation. Download reports and statements rather than relying on a live portal that may later change. Keep originals and submit copies with an index.
- Loan agreement, sanction letter, security documents, repayment schedule, and amendments.
- Complete account ledger and bank statements covering the disputed period.
- Payment confirmations, cancelled-cheque images, transfer references, and receipts.
- Fraud, red-flag, wilful-default, recall, demand, or recovery notices and proof of service.
- Emails, SMS messages, call summaries, grievance acknowledgements, and meeting minutes.
- Credit reports showing the disputed field, report date, and report number.
- Forensic-audit or investigation material supplied by the lender, to the extent provided.
- Invoices, contracts, tax filings, stock records, board minutes, end-use evidence, and explanations for relevant third-party transactions.
- Police, cybercrime, or other complaint acknowledgements if an alleged transaction has been reported.
- Identity and authority documents for a company, director, guarantor, legal representative, or authorised signatory.
Prepare a chronology with the date of sanction, disbursement, each payment, alleged event, notice, reply, classification, and first appearance in a credit report. Number your annexures and refer to each one in the representation. A clear chronology prevents the dispute from being reduced to a general denial.
How to challenge a fraud classification
RBI’s 2024 fraud-risk directions govern the process for banks and financial institutions covered by those directions. The RBI release dated July 15, 2024 states that regulated entities must comply with natural-justice principles in a time-bound manner before classifying persons or entities as fraud. The Supreme Court in State Bank of India v. Rajesh Agarwal described fraud classification as carrying “serious civil consequences for the borrower” and required a fair opportunity to respond.

Request the notice and the material relied upon
Write to the authority named in the notice and the lender’s grievance officer. Request:
- The complete show-cause notice and the proposed classification.
- Each allegation, the rule or factual ground said to support it, and the deadline for reply.
- The documents, audit findings, transaction extracts, and other material relied upon, subject to lawful limits on disclosure.
- The identity or designation of the competent authority or committee that will decide the matter.
- The procedure for a hearing or written response and the expected decision date.
- A reasoned final order and correction of every report sent to credit-information companies if the proposed classification is withdrawn or changed.
If the lender gives only a vague statement such as “fraud observed” or “audit irregularity,” ask it to identify the transaction, date, document, person involved, and alleged loss or benefit. State that you cannot answer an allegation that has not been particularised.
Rank #2
Answer every allegation with evidence
Use a numbered response matching the lender’s allegations. For each item, state whether you admit, deny, or cannot admit it; give the relevant date and document; explain the commercial or operational context; and identify the remedy sought. Depending on the case, useful material can include:
- Bank records showing where disbursed funds went and how they were used.
- Invoices, delivery records, tax filings, contracts, and confirmations from counterparties.
- Board resolutions, authorisation records, and minutes explaining who approved a transaction.
- Repayment evidence and correspondence showing attempts to regularise the account.
- Independent explanations for accounting, valuation, documentation, or identity discrepancies.
- Evidence distinguishing an employee, agent, director, guarantor, or unrelated third party’s conduct from your own.
Do not destroy, alter, or selectively edit records. If a document is unavailable, say why, identify where it may be obtained, and provide a substitute record. Ask for a hearing where the allegations are complex or the consequences include reporting, recovery action, or exclusion from further credit.

After submitting the response, request a written decision that addresses each material defence and identifies the evidence accepted or rejected. If the lender withdraws the classification, ask it to notify every credit-information company and other recipient of the corrected status, then obtain fresh reports to verify the change. If the lender confirms the classification, obtain the complete order and take it to an Indian banking or financial-services advocate for advice on interim relief and the appropriate forum.
How to challenge a wilful-defaulter classification
Wilful default is not another name for an ordinary missed instalment. The 2024 RBI Directions prescribe a transparent, non-discriminatory process observing natural justice. The directions cover the categories identified by RBI, including covered banks, financial institutions, NBFCs, asset-reconstruction companies, and credit-information companies.
Obtain the exact alleged ground
Ask the lender to specify which defined ground is alleged and the facts said to establish it. The record may concern:
Rank #3
- Intentional non-payment despite the borrower having the capacity to pay.
- Diversion of finance away from the sanctioned purpose.
- Siphoning of funds so that the funds are unavailable to the lender or business.
- Disposal or removal of secured assets without the lender’s knowledge.
- Another ground expressly recognised by the applicable RBI directions.
Capacity to pay, control of funds, end-use, asset disposal, and intent are fact-sensitive issues. A bare statement that an account is overdue does not answer them.

Use the committee process
Request the notice, evidence, audit extracts, proposed finding, committee composition or designations, reply deadline, hearing procedure, and the reasoned decision of the competent committee. Reply to each element separately. For example, distinguish a genuine business loss from intentional non-payment; show the trail of funds rather than merely asserting that money was used for business; and explain any asset sale with approvals, consideration received, and application of proceeds.
If a wilful-default finding is withdrawn or set aside, demand correction of consequential credit reporting and written confirmation of the recipients notified. If it is upheld, preserve the notice, response, evidence, and final decision for legal advice. The RBI directions do not create one universal court remedy for every factual situation.
Correcting a wrong credit report
A credit-information dispute is separate from the lender’s internal classification. File the correction with both the reporting lender and the relevant credit-information company. A bureau generally cannot invent the lender’s underlying facts; the lender must supply corrected information.
State the correction precisely
Identify the account number, report date, exact field, value currently shown, correct value, date on which it became wrong, and the evidence attached. Examples include a wrong borrower identity, duplicated account, incorrect outstanding amount, paid account still shown as overdue, incorrect date of default, wrong ownership type, or a fraud or wilful-default notation that the lender has withdrawn.

Understand the RBI time framework
The cited RBI framework describes a 21-calendar-day period for the credit institution to send corrected information and an overall 30-calendar-day period for resolving the complaint. The calculation can depend on when the complaint is complete and on exclusions in the applicable framework, so retain proof of submission and any request for additional information.
Where the complaint runs beyond 30 calendar days, the framework provides compensation of ₹100 per calendar day, subject to its exclusions and the claimant details and procedure required by RBI. State the dates clearly, ask the lender or credit-information company to calculate any compensation, and preserve evidence of the delay. RBI credit-reporting directions also require more frequent submission and ingestion of credit information, with the cited provisions effective from January 1, 2025; check the current directions for any later amendments.
Verify the result
Obtain a fresh credit report after the lender confirms correction. Check every bureau report, not only the one in which you first noticed the error. Look for residual remarks, a different account number, a duplicate tradeline, or a corrected balance paired with an unchanged adverse status. If the lender corrected one field but not another, file a new, narrowly defined dispute referring to the earlier acknowledgement.

When and how to use the RBI Ombudsman
Use the lender’s or credit-information company’s grievance channel first. Under the RBI Integrated Ombudsman Scheme, a complaint can generally be filed when the regulated entity has not responded within 30 days or the response is unsatisfactory. The scheme is intended to provide cost-free redress for deficiency in service by regulated entities.
Best Value
Prepare the Ombudsman submission
- Attach the original complaint and acknowledgement number.
- Attach the lender’s or bureau’s reply, or evidence that 30 days passed without a reply.
- Include the disputed credit report, notices, chronology, and key supporting documents.
- Describe the specific service failure and the remedy requested, such as correction, a written explanation, or compensation available under the applicable framework.
- Disclose any court, tribunal, arbitration, insolvency, criminal, or other proceeding involving the same subject.
Keep the submission focused on the regulated entity’s service deficiency and the documentary correction sought. The Ombudsman route is administrative redress; it may not finally determine complex contractual liability, title, criminal culpability, insolvency issues, or every damages claim. Filing an Ombudsman complaint does not automatically stop recovery, possession, auction, reporting, or other enforcement action.

Obtain advice from an Indian advocate experienced in banking or financial-services disputes when you need a binding adjudication, urgent injunction, damages, disclosure, or a response to enforcement. Depending on the lender, security, amount, contract, and procedural stage, possible routes may include:
- A writ petition where a public-law decision or statutory fairness issue is properly engaged.
- Civil or consumer proceedings where jurisdiction and maintainability requirements are satisfied.
- Debt Recovery Tribunal proceedings involving recovery or security enforcement.
- Arbitration where the contract contains an enforceable arbitration clause and the dispute is arbitrable.
- Insolvency proceedings where the statutory conditions and forum are met.
- A police or cybercrime complaint where the evidence concerns a criminal act, identity misuse, or unauthorised transaction.
There is no single universal forum or limitation period for all incorrect classifications. Forum selection depends on the respondent’s status, the relief sought, the amount, the security, the existence of another proceeding, and whether an urgent hearing is pending. Ask counsel to assess limitation, interim relief, evidence preservation, and the effect of any parallel Ombudsman or recovery process.
Choosing the right route
| Route | Main objective | Best first target | Key limitation |
|---|---|---|---|
| Lender representation | Withdraw or explain a fraud or wilful-default decision; correct downstream reporting | Bank, NBFC, financial institution, ARC, or other reporting lender | Usually does not provide an independent binding adjudication |
| Credit-report dispute | Correct a wrong tradeline, balance, date, status, or identity field | Reporting lender and relevant credit-information company | Cannot by itself decide every underlying contractual or criminal issue |
| RBI Ombudsman | Administrative redress for deficiency in service | Regulated entity, after its grievance route | Generally requires no response within 30 days or an unsatisfactory response; scope and maintainability rules apply |
| Court or tribunal | Binding orders, injunctions, damages, recovery defence, or other specialised relief | Forum selected from the facts and applicable law | Cost, representation, limitation, jurisdiction, and parallel-proceeding risks |
Compare the routes by the remedy needed—correction, compensation, injunction, or damages—the type of respondent, urgency of enforcement, evidence and disclosure required, cost and representation, and whether another forum already has the dispute. A pending case can affect Ombudsman maintainability or compensation.
A practical representation format
Use a subject line that identifies the account and the requested action, for example: “Representation against proposed fraud classification and request for documents—loan account [account number].” Any account-specific variable should be replaced before sending; do not leave template text in the final letter.
- Identify the borrower, guarantor, company, authorised signatory, loan account, and contact details.
- State when and how the adverse classification or report entry was discovered.
- List the exact allegations or incorrect fields in numbered paragraphs.
- Answer each item with dates, facts, and annexure references.
- Request the notice, evidence, committee procedure, hearing, reasoned decision, and reporting correction as applicable.
- Ask for written acknowledgement, the case number, the responsible officer, and the decision timeline.
- Reserve legal rights without making threats or unsupported accusations.
Send the representation through the channel specified in the notice and the lender’s grievance policy. Use a method that produces an acknowledgement and retain proof of delivery. If a deadline is close, submit a focused response first and explain which documents will follow, rather than missing the deadline while assembling a perfect bundle.
Common mistakes that weaken a dispute
- Treating a credit entry as proof of fraud: obtain the lender’s classification and notice.
- Sending only a general denial: answer each allegation with a date, document, and explanation.
- Ignoring deadlines: request an extension in writing and submit a protective response before the due date.
- Complaining to RBI first: complete the lender or bureau grievance process and preserve the acknowledgement.
- Submitting altered or incomplete records: provide originals for inspection and clearly labelled copies.
- Waiting while enforcement advances: seek urgent legal advice if possession, auction, arrest risk, insolvency, or a hearing is imminent.
- Assuming one correction updates every report: verify each credit-information company’s fresh report.
- Ignoring company authority: include board authorisation, power of attorney, or other proof that the signatory may act.
What the available rules do—and do not—establish
The cited RBI directions and Supreme Court judgment establish process protections and correction routes, not an automatic deletion of every adverse account history. A borrower who genuinely owes money may still have an accurate overdue or NPA entry even if a separate fraud allegation fails. Conversely, a corrected fraud or wilful-default decision may require consequential reporting changes, but the exact implementation must be verified in fresh reports.
The regulatory material available for this guide does not establish a reliable success-rate statistic for these disputes. Do not rely on online claims that promise removal, guaranteed compensation, or a guaranteed court result. Regulatory directions and reporting systems can change; the directions cited here were current in the materials accessed on October 13, 2026. Verify the current RBI text and obtain case-specific legal advice before relying on a deadline, forum, or remedy.
