Tell customers they are interacting with AI at the beginning of the first direct exchange. Make the notice short, visible and unmistakable, then explain what the system does, where it can fail, what data it uses, when a person reviews the case and how to request a human or challenge an outcome. Clear disclosure does not guarantee higher trust, but it lets customers calibrate reliance instead of feeling misled later.

What a confidence-preserving disclosure looks like

A useful notice answers the customer’s immediate questions without forcing them to open a policy document:

As an Amazon Associate I earn from qualifying purchases.

  • What is this? Identify the system as AI in the first message or prompt.
  • What can it do? Name the jobs it performs, such as answering product questions, finding account information or routing a support request.
  • What can it not do? State meaningful limits, including the possibility of mistakes and decisions the system is not authorized to make.
  • How can I reach a person? Give a visible handoff command or button and explain what happens after escalation.
  • What happens to my information? Describe the data used, retention period and whether conversations train or improve models.
  • What if the answer is wrong? Provide a correction, appeal, refund or complaint route.

A concise opening can then be followed by deeper information for customers who need it. The aim is not to make the bot sound impressive; it is to make the customer’s decision about relying on it informed.

A practical opening message

“You’re chatting with our AI assistant. It can answer product and account questions and help route requests. It may make mistakes and cannot approve exceptions or make final decisions. Ask for a person at any time; a human reviews escalated cases. We use the information in this chat to provide support and retain it for [period]. We do not use it to train or improve models unless our policy says otherwise. If an answer affects you, you can ask us to correct it or review it.”

When disclosure is required or strongly expected

European Union: Article 50 of the AI Act

Article 50 of the European Union AI Act requires providers of AI systems intended to interact directly with natural persons to inform people that they are interacting with an AI system, unless the interaction is obvious from the circumstances and context. The European Commission’s Article 50 FAQ says the notice must be given “from the start of the first interaction in a clear and distinguishable manner.” It also says the obvious-interaction exception should be interpreted restrictively.

The Commission says these transparency obligations apply from 2 August 2026. They cover more than support chat: the rules address direct interactive AI, AI-generated or manipulated content, deepfakes, certain text published for matters of public interest, and emotion-recognition or biometric-categorisation systems. The exact obligation depends on the system and use case, so an EU deployment should be reviewed against the applicable category rather than relying on a generic chatbot notice.

OECD guidance: meaningful information and challenge rights

OECD AI Principle 1.3 calls for meaningful, context-appropriate information about an AI system’s capabilities and limitations. It also emphasizes making stakeholders aware when they are interacting with AI, explaining outputs where feasible and useful, and enabling people adversely affected by an output to challenge it. The OECD.AI principle page states: “AI Actors should commit to transparency and responsible disclosure regarding AI systems.”

United States: truthful promises and material facts

A 2024 U.S. Senate Committee on Homeland Security and Governmental Affairs hearing record described transparency as “an important part of building trust in AI systems” and used a customer-support chatbot telling the consumer it was powered by AI in response to the first query as a practical example.

The Federal Trade Commission says companies must honor promises about customer-data use. A promise not to use customer data for secret purposes, such as training or updating models, must match actual practice. The FTC also warns that omitting material facts that affect a purchase can create enforcement risk. A disclosure therefore cannot be technically true while concealing a data use or limitation that a reasonable customer would consider important.

These sources do not create one worldwide script. They establish a useful baseline: disclose early, make the information distinguishable, describe capabilities and limits honestly, and give people meaningful recourse. Organizations serving several jurisdictions should map the strictest applicable timing and labeling requirements to each channel.

Design choices that protect confidence

Decision Confidence-preserving choice Weak choice and risk
Timing Show the notice in the first direct interaction, before the customer relies on an answer. Reveal AI only after a complaint or handoff; customers may feel deceived.
Prominence Place the notice in the conversation, voice introduction or visible interface control. Bury it in terms or a privacy-policy link that most users will not see.
Specificity Name the system’s job and a consequential limitation. Use vague wording such as “This service may use AI,” which does not explain the interaction.
Human control Offer an immediate handoff and say what a human will review. Provide no person, appeal or challenge route.
Data transparency State data categories, retention and model-training use in plain language. Say only “your data is secure” or make an overbroad non-use promise.
Content labeling Label generated or manipulated material when a customer could mistake it for human-created or authentic content. Use an inconspicuous watermark or no label at all.

Use plain language, not defensive language

“AI assistant” is clearer than an invented human name or a profile photo that suggests a person. “It may make mistakes” is more useful than “results may vary.” Explain the practical consequence: “Do not use this answer as approval for a refund; a specialist must confirm eligibility.” Keep legal detail available through a “How this works” or privacy link, but do not make the link a substitute for the initial notice.

Match the notice to the channel

  • Text chat: Put the disclosure in the first visible message and keep the “Talk to a person” control persistent.
  • Voice: Say the AI identification before collecting account details. Repeat it if a caller joins after the introduction.
  • Email or messaging: Identify AI-generated replies in the opening line and provide a human reply route.
  • Agent-assist tools: If a customer is speaking with a human while AI drafts or retrieves information, disclose the AI role when it materially affects the interaction or data use. Do not claim that the human personally wrote every sentence if that is untrue.
  • Public content: Apply the relevant label to generated or manipulated material, including deepfakes and certain public-interest text. Where rules require it, add the required machine-readable marking as well as the visible label.

Explain human oversight without overstating it

“Human reviewed” can mean a specialist checked every answer, sampled a small percentage, or becomes involved only after an escalation. Tell customers which one applies.

Describe the actual workflow

  • Say whether a person reviews every high-impact decision, only escalated cases, or quality samples.
  • Name the trigger for escalation, such as a disputed charge, eligibility exception, safety concern or confidence threshold.
  • Give an expected next step rather than an unsupported promise of immediate service.
  • Record the AI output and relevant context so the reviewer can investigate what the customer saw.

If no person is available for a particular service, say so and provide the available complaint or correction process. A clear limitation is less damaging than a promise that fails when the customer needs help.

Give customers a real challenge route

A challenge route should be usable without arguing with the bot. Provide a button or command to request review, identify the information the customer should supply, and explain whether the review can change the decision. For a denial, price, eligibility result or safety-related answer, specify the authority that makes the final decision. Preserve an audit trail so the organization can compare the disputed output with its source data and policy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Make data-use statements accurate and specific

Customers usually need four facts:

  1. What is collected: For example, chat text, account identifiers, attachments, device information or voice recordings.
  2. Why it is used: Distinguish providing the requested service, fraud prevention, quality review, analytics and model training.
  3. How long it is kept: Give a period or a clear retention rule, not “for as long as necessary” alone.
  4. Who receives it: Explain relevant processors, human reviewers or model providers where that information is material.

Keep the conversational notice short, then link or route to the full privacy explanation. The short statement and the policy must agree. If conversations are used to improve a model, say that plainly. If they are excluded from training, ensure logs, sampling tools and vendor settings do not quietly contradict that promise. The FTC’s warning about secret training or model-updating purposes makes this consistency especially important.

Separate service consent from optional improvement

Do not make a customer accept model-improvement use merely to receive support unless there is a lawful and clearly explained reason. Where an optional setting exists, label it separately and state what opting out changes. Obtain any consent required for recordings or sensitive information before collection, not after the AI has processed it.

A step-by-step implementation plan

  1. Inventory every customer-facing AI interaction. Include chat, voice, email, search, recommendation, document generation and systems that classify emotion or biometrics.
  2. Classify the use and jurisdiction. Mark direct interaction, generated or manipulated content, deepfake creation, public-interest text and emotion-recognition or biometric-categorisation use. Record where customers are located and which rules apply.
  3. Write the first-interaction notice. Identify AI, state its job and one consequential limitation. Keep it visible before the first substantive answer.
  4. Map capabilities and prohibited decisions. List what the system may answer, what requires verification and what it must never decide.
  5. Document human oversight. Define escalation triggers, reviewer authority, service levels and the evidence retained for review.
  6. Verify data handling. Reconcile the notice with retention schedules, access controls, vendor contracts, logging and model-training settings.
  7. Build recourse into the interface. Add a human-handoff control, correction or appeal path, and a way to report harmful or inaccurate output.
  8. Label generated material. Apply visible labels and any required machine-readable marking to regulated or easily misidentified content.
  9. Train staff and contractors. Teach them not to impersonate a bot as a person, repeat unsupported claims, or promise review that does not occur.
  10. Test before release and after changes. Use realistic conversations, including a customer asking whether the assistant is human, disputing an answer and requesting deletion or escalation.

Measure whether the disclosure is working

No directly applicable publisher-owned statistic establishes that one wording increases customer confidence by a particular percentage. Avoid inventing a lift. Evaluate whether people understand the interaction and can act on the information.

Useful measures

  • Whether customers can correctly identify that they spoke with AI in a comprehension check.
  • Time and number of steps required to reach a person.
  • Escalation completion rate, abandonment during escalation and unresolved complaint rate.
  • Corrections, appeals and refunds linked to AI outputs.
  • Contradictions between the notice and observed data handling.
  • Frequency of staff or system messages that imply a human authored an AI response.

Review results by channel, language, accessibility mode and customer vulnerability. A high rate of “no escalation” is not automatically success; customers may be unable to find the control. Qualitative interviews and complaint text can reveal whether the notice is trusted, confusing or perceived as evasive.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common mistakes and how to fix them

Mistake Why it fails Correction
“You may be interacting with AI.” It is vague when the customer is definitely speaking to an AI system. Say directly, “You’re chatting with our AI assistant,” at the start.
Disclosure only in terms The customer cannot calibrate reliance during the conversation. Repeat a short notice in the interface and retain the detailed policy separately.
Human-sounding persona or name It can imply a person is responding. Use an unmistakable AI label and explain any human review accurately.
“A human is always reviewing” when sampling is occasional The promise is false and undermines confidence when discovered. Describe the real sampling or escalation process.
Generic privacy reassurance “Your data is safe” does not answer training, retention or access questions. Name the data use and retention rule that apply.
No way to challenge an answer Customers are trapped with an output that may affect them. Add a human route and explain how correction or appeal works.
One script for every AI feature Direct chat, deepfakes and biometric systems have different risks and duties. Use a disclosure matrix tied to the system’s function and jurisdiction.
Changing the model without updating the notice Capabilities, data use or oversight may no longer match the statement. Make disclosure review part of model, vendor and policy change control.

A decision framework for choosing the right level of disclosure

Use these questions before approving copy:

  1. Is the customer directly interacting with the system? If yes, disclose at the first interaction unless a narrowly interpreted context makes AI obvious.
  2. Could the output affect money, access, safety, employment, eligibility or reputation? Add the limitation, verification requirement and challenge route that matter for that consequence.
  3. Could a reasonable person mistake generated or manipulated material for authentic human-created content? Add a clear label and any required machine-readable signal.
  4. Does the system infer emotion or classify biometrics? Treat it as a distinct regulated use rather than hiding it under a general chatbot notice.
  5. Does the organization use customer information to train or improve models? State that use, its controls and retention accurately; do not rely on a broad security claim.
  6. Can a person intervene? If yes, explain when and how. If no, provide the available correction or complaint mechanism without implying human oversight.

The result should be proportionate: a short notice for a low-risk product FAQ can be expanded with a single limitation and handoff, while a system producing consequential decisions needs specific evidence, review authority and appeal instructions.

What customers should hear, in one sentence

The minimum honest message is: “You are interacting with AI, here is what it can and cannot do, here is what happens to your information, and here is how to reach a person or challenge the result.” Put that message where the interaction begins, keep every supporting policy consistent with it, and update it whenever the system or its data practices change.
