How to Disclose AI-Generated Actors in Film and Video Credits

There is no universal rule in the sources covered here requiring every AI-generated actor to appear in a film’s end credits. Disclosure duties depend on what the AI did, where the work is distributed, and which laws, contracts, or collective-bargaining agreements apply. An audience notice is not the same as a performer credit, and neither substitutes for consent to use a real person’s likeness or voice.

Do AI-generated actors have to be listed in film credits?

Not as a universal requirement established by the legal and union sources discussed here. A credit names a person or contribution; a disclosure tells viewers that content was generated or manipulated. Some rules address disclosure, some address the use of a performer’s likeness, and union agreements may impose production obligations. None of those should automatically be described as a rule to put an AI actor in the end credits.

For a particular production, check the law that applies where it is made and distributed, the relevant contracts, and any collective-bargaining agreement. If none prescribes a credit format or placement, a production can still choose to disclose its use of AI as an editorial transparency measure.

How does the EU AI Act apply to fictional film and video?

Article 50 of Regulation (EU) 2024/1689 distinguishes between marking AI outputs and disclosing certain uses of AI to viewers. Providers of AI systems that generate synthetic audio, images, video, or text must ensure their outputs are marked in a machine-readable format and detectable as artificially generated or manipulated. Separately, a deployer using AI to generate or manipulate deepfake content must disclose that fact clearly and distinguishably.

For content forming part of an evidently artistic, creative, satirical, fictional, or analogous work or programme, Article 50 tailors the deployer’s obligation: the disclosure is limited to identifying the existence of generated or manipulated content in an appropriate manner that does not hamper the display or enjoyment of the work. The provision does not specify that the notice must be in the end credits.

The European Commission’s FAQ distinguishes the provider’s machine-readable marking obligation from the deployer’s disclosure obligation and discusses closed-loop industrial and product-development settings, including film production. The production process and the final work are not necessarily treated alike. Do not assume that every AI tool used behind the scenes requires an audience-facing credit, or that a production setting is automatically outside the rules; the facts and applicable implementation guidance matter.

Is a synthetic performer the same as a digital replica?

No. SAG-AFTRA distinguishes a synthetic, which resembles a person but is not recognizable as a specific individual, from a digital replica, which resembles a particular person. “AI actor” can blur that consequential difference: one case involves a generated character, while the other may involve a recognizable performer’s likeness or voice.

SAG-AFTRA’s 2026 TV/Theatrical contracts summary says producers may not use synthetics without first bargaining with the union and describes protections for digital replicas. These are obligations for productions covered by the agreements, not a general public-facing credit format. The union’s 2023 contract FAQ also distinguishes wholly synthetic performers from replicas based on actual performers and describes notice and bargaining requirements.

What if the AI uses a real performer’s likeness or voice?

Treat authorization as a separate question from audience disclosure. A notice in the credits does not supply consent or cure a missing contractual authorization.

California’s 2024 AB 2602 addresses contract terms and professional representation when a contract authorizes a digital replica of a living performer. AB 1836 addresses commercial use of deceased performers’ replicas, including in film and television. SAG-AFTRA said on March 20, 2026, that applicable contract and state law require estate consent to use a deceased performer’s digital replica in a motion picture. Other rights and agreements may also apply.

If a performer acted in a scene and AI tools altered or extended that performance, describe the contribution accurately. Do not present an authorized digital replica as though the person gave a new live performance, and do not credit a wholly synthetic character as if a particular human actor performed it. These are practical editorial distinctions, not an official universal credit taxonomy.

Do advertising disclosure laws apply to ordinary films?

Not on the basis of the advertising sources cited here. California SB 1050, signed September 16, 2026, requires explicit disclosure in audio or video advertisements using AI-generated performers to sell a product or service, according to the Governor’s announcement. SAG-AFTRA reports that New York’s synthetic-performer advertising law took effect in June 2026. Those materials concern advertising, not every narrative film or all online video. For a specific campaign, consult the operative statute for its definitions, thresholds, exceptions, effective dates, and enforcement.

How should a production disclose an AI performer?

When no applicable law or agreement specifies the wording or placement, choose a clear, accurate notice that viewers can reasonably encounter without unnecessarily interrupting the work. Depending on the format and distribution, that could be an on-screen notice, a production note, an end-credit statement, or more than one placement. These are options, not placements established as universally mandatory by the sources discussed here.

Make the wording match what happened. For example, a production might say “This character was created using generative AI” for a wholly synthetic character, or “This scene uses an authorized digital replica of [name]” when that is accurate and authorized. If AI altered a human performance, describe that alteration rather than calling the performer AI-generated. Use these as plain-language examples, not prescribed legal wording.

What should a production check before release?

  1. Audience transparency: Determine whether applicable law requires disclosure of generated or manipulated content, who has the duty, and what form and placement are appropriate. For EU questions, distinguish Article 50’s provider marking requirement from the deployer’s disclosure requirement.
  2. Performer rights: Identify whether the content uses a recognizable person’s voice or likeness. Confirm the necessary consent, contract terms, and any estate authorization before release; a credit is not authorization.
  3. Union coverage: Check whether a collective-bargaining agreement applies and whether it requires notice, bargaining, consent, or another process for the particular use.
  4. Credit accuracy: State whether the work uses a synthetic character, a digital replica, or an AI-altered human performance. Do not imply a human performed work they did not perform, or that a performer gave a new performance when a replica was used.

For legal compliance, confirm the current text and reach of the applicable rules and agreements. The California SB 1050 information cited here comes from the Governor’s signing announcement, and the New York law is summarized by SAG-AFTRA; those summaries are not substitutes for the operative statutory text.
