There is no single yes-or-no answer. For a residential construction transaction in India, service-tax treatment depends on when the service and consideration fell, what the provider agreed to do, whether the property was intended for sale, and the law and exemptions in force on the relevant dates. The key periods are the change effective 1 July 2010, the declared-service framework from 1 July 2012, and the start of GST on 1 July 2017. Construction supplies after the GST transition must be examined under GST, not treated as new service-tax periods.

Start with the dates and the transaction

Before asking whether tax applied, identify the relevant construction service and the dates connected with it. Service-tax rules changed during the period, and the date of a contract alone may not settle the treatment. Record when work or the relevant service was provided, when invoices were issued, and when each payment or other form of consideration was received. Then identify the legal version and notifications that applied to those facts.

Also separate the different contractual relationships. A builder’s arrangement with a prospective flat buyer is not automatically the same service as a contractor’s construction work for that builder. A landowner’s arrangement with a developer may raise a further, separate question. For every leg, identify who promised what to whom, who received the service, and what the provider received in return.

Which service-tax period applies?

Period Relevant framework What to establish
Before 1 July 2010 The earlier taxable-service category included construction of a new residential complex or part of one, as described in the Comptroller and Auditor General of India’s 2015 account of the regime. Check the precise statutory and notification text in force for the service and the transaction dates. Do not apply a later test retrospectively.
From 1 July 2010 to 30 June 2012 The construction-related rules were amended to address complexes intended for sale before completion. Verify the amendment’s effective-date mechanics and the contemporaneous rules against the actual dates and documents. The precise transitional details are not established here.
From 1 July 2012 to 30 June 2017 The negative-list and declared-service framework applied. Construction intended for sale was included in a declared-service entry, with a specific completion-certificate and consideration-timing exception. The service portion of a works contract was also a declared service. Apply the exact Finance Act and notification versions for the relevant date, and classify the contract and consideration correctly.
From 1 July 2017 GST became the distinct indirect-tax framework. The CGST Act has a separate construction-for-sale rule and its own completion-certificate or first-occupation test. Analyze post-transition supplies under GST law and notifications. Do not import the service-tax test or exemptions into GST, or vice versa.

The CAG’s 2015 historical account describes the 1 July 2012 transition and declared-service categories. CBIC’s ACES returns FAQs records Notification No. 25/2012-ST as effective from 1 July 2012. These are useful starting points, but a particular dispute requires the operative statutory and notification text for its dates.

For the 2012–2017 construction entry, apply the completion-and-payment test

Under the post-1 July 2012 construction entry, the relevant category covered construction of a complex, building, civil structure or part intended for sale, wholly or partly. It excluded the stated case in which the entire consideration was received after issuance of the completion certificate.

  • Intended for sale: establish whether the construction was undertaken for sale, rather than assuming that every residential building falls within the entry.
  • Completion certificate: identify the certificate’s issue date and the authority that issued it. Use the service-tax law applicable at the time to determine what certificate qualified; do not assume the GST definition is interchangeable.
  • Entire consideration: establish when all consideration was received, including any non-cash consideration. If any part was received before the relevant certificate, the stated exception for receipt of the entire consideration after certification may not be met.

This is a statutory timing exception, not a blanket rule that every completed home is exempt. Nor does the timing test by itself establish the tax result: classification, other provisions, the applicable version of the law, and any exemption must still be checked.

Classify the work before treating it as taxable

Builder or developer selling a flat

For a builder’s agreement with a prospective buyer, determine whether the relevant construction was intended for sale and whether the completion-and-consideration rule applies for the period in question. A project’s label or the fact that it is residential does not settle those questions.

Contractor building for a developer or owner

Analyze the contractor’s work order separately from the builder’s sale agreement. Identify the contractor’s recipient, scope of work, and consideration. Under the framework effective from 1 July 2012, a works contract’s service portion was a declared service; the full contract value should not automatically be treated as service value. The applicable valuation and tax mechanism depend on the contract and the rules then in force.

Single dwelling, residential complex, or mixed project

Record what was built, how many units it involved, the units’ intended use, and whether the project included commercial or mixed-use elements. A single residential unit and a residential complex may be treated differently under relevant provisions or exemptions, but the unit count alone does not establish an exemption. The precise service-tax exemption conditions and amendment history must be verified for the relevant date.

Check exemptions and calculation rules for the exact date

Notification No. 25/2012-ST took effect on 1 July 2012, but the title of a notification or a general reference to an exemption does not establish eligibility. Check its text as amended on the transaction date against the actual work, parties, project, and contract. Do not rely on a GST exemption for pure labour on a single residential unit as proof of a service-tax exemption; they belong to different tax regimes.

If the transaction falls within a potentially taxable category, a final liability calculation may also depend on rate, valuation, abatement, point-of-taxation rules, and allocation of liability. Those details vary by period and contract type. No universal rate or amount can be derived without the applicable instruments and transaction records.

Use this document checklist to reach a case-specific answer

  1. Build a date line: list service or construction dates, invoice dates, payment dates, and dates when any non-cash consideration was transferred.
  2. Map each contractual leg: collect the sale agreement, construction contract or work order, and any tripartite, landowner, or development-rights documents. Note each provider, recipient, undertaking, and form of consideration.
  3. Describe the property and project: record whether the work concerned a single dwelling, a complex, a partial building, or a mixed-use project, and whether it was intended for sale or for the owner’s use.
  4. Verify completion evidence: obtain the completion certificate, its issue date, and the issuing authority. For GST-period analysis, separately record first occupation where relevant.
  5. Match the law to the facts: consult the Finance Act version and amendments, notifications, and any valuation or point-of-taxation instruments effective on the relevant dates.
  6. Reconcile tax records: review invoices, registration and return records, claimed exemptions, and any valuation or abatement treatment before reaching a conclusion.

What can and cannot be concluded without those records

Without the dates, contract documents, completion evidence, and applicable historical legal text, the sound conclusion is a framework—not a taxpayer-specific finding. In particular, a reliable answer cannot be inferred solely from the words “residential flat,” “single house,” or “completed property.” A live assessment or dispute calls for review by a qualified Indian indirect-tax professional using the exact Gazette text and amendments applicable to the transaction.
