How to Correct an Unreported Foreign Account on a U.S. Tax Return (2026 Guide)

Correcting a forgotten foreign account usually requires more than adding the account to one tax form. First determine whether the omission involved taxable interest, dividends or gains; a late or missing FBAR (FinCEN Form 114); Form 8938; or another international information return. Each obligation has different thresholds, filing systems and penalty rules.

Use the facts for each year to select a correction path. The IRS lists Streamlined Filing Compliance Procedures, Delinquent International Information Return Submission Procedures and the Criminal Investigation Voluntary Disclosure Practice. Eligibility depends on issues such as willfulness, residence, whether original returns were filed, and whether the IRS has already contacted you. The following is general information current to October 13, 2026, not an individualized legal or tax determination.

Start by separating the obligations

A foreign account’s existence does not automatically tell you which U.S. forms were required. The answer depends on the account type, maximum value, ownership or signature authority, income earned, transactions, residence and other facts. Review every affected year rather than assuming one filing fixes everything.

Taxable income on the federal return

Interest, dividends, capital gains, rental income and other income connected with a foreign account generally belong on the U.S. income tax return when the income is taxable. If income was omitted, an amended federal return may be needed, together with additional tax and statutory interest. An information form by itself does not replace reporting the underlying income.

FBAR (FinCEN Form 114)

The general FBAR trigger is an aggregate value of more than $10,000 in foreign financial accounts at any time during a calendar year. The total combines all reportable foreign accounts, not just the account that was forgotten. FBAR is filed electronically through FinCEN’s BSA E-Filing System. It is not attached to Form 1040 or another federal income tax return.

Form 8938

Form 8938, Statement of Specified Foreign Financial Assets, is an IRS information return with its own asset definitions and threshold tests. When required, it is attached to the federal income tax return. Its thresholds are not the $10,000 FBAR threshold, and filing an FBAR does not substitute for Form 8938.

Other international information returns

Ownership or transactions can trigger additional forms, including Forms 3520, 3520-A, 5471, 5472, 926 or 8621. For example, a foreign trust, foreign corporation, transfer of property to a foreign person, or ownership of a passive foreign investment company can create a separate filing requirement. Do not infer that every form applies merely because an account was not listed.

What you need to establish before filing

Build a year-by-year file before choosing a procedure. Collect original returns, wage and investment statements, account-opening documents, monthly or annual statements, currency-conversion records, ownership agreements and correspondence with the financial institution. Ask the institution for historical maximum balances if statements do not show them clearly.

  1. List every foreign financial account. Record the institution, country, account number or identifying description, account type, owners, joint owners, signatories and the dates the account was open.
  2. Find the highest value for each calendar year. FBAR reporting uses the maximum aggregate value during the calendar year. Keep the exchange-rate method and source used for each conversion into U.S. dollars.
  3. Reconstruct income and transactions. Identify interest, dividends, gains, foreign taxes withheld, distributions, transfers and currency effects. Match those figures to each original income tax return.
  4. Map every potential form. Test the facts against FBAR, Form 8938 and any applicable trust, corporation, partnership, transfer or passive-investment form. A professional can help when classification is uncertain.
  5. Check your procedural status. Note whether the IRS or FinCEN has sent a notice, opened an examination, requested records, or referred a matter for investigation. Some delinquent procedures are unavailable after contact.

FBAR and Form 8938 require different corrections

How to file a late or amended FBAR

File each delinquent FBAR electronically in the BSA E-Filing System. Use the calendar year for which the report was due and provide the account information and maximum values requested by FinCEN. If an FBAR was already filed but contains an error, submit a new FBAR with the corrected information and mark it as amended according to the current electronic filing instructions.

Keep a written explanation of why the report is late and documents supporting the explanation. IRS guidance says a properly reported late account may avoid a penalty when the IRS finds reasonable cause. That outcome is fact-sensitive; timely payment of tax on the account’s income does not automatically establish reasonable cause for a late FBAR.

How to correct Form 8938

If Form 8938 was required and omitted, attach the completed form to an amended income tax return for the affected year, unless a specialized procedure directs a different submission. If a filed Form 8938 has incorrect information, file an amended return with a corrected form. The form covers specified foreign financial assets under its own definitions and threshold rules, so an account may be reportable on one form but not the other.

The IRS Form 8938 instructions state: “The determination of whether a failure to disclose a specified foreign financial asset on Form 8938 was due to reasonable cause and not due to willful neglect will be determined on a case-by-case basis, taking into account all pertinent facts and circumstances.” A reasonable-cause position is therefore an explanation supported by the facts, not an automatic waiver.

Choose the correction route before assembling a package

The IRS describes three principal paths for prior foreign-asset failures. The table shows the decision factors; it is not a substitute for checking the current forms, instructions and eligibility rules.

Route Who it is designed for Typical filings or payment Important limits
Streamlined domestic offshore procedures U.S.-resident taxpayers whose failures were non-willful and who meet the procedure’s filing requirements Amended returns for the most recent three tax years whose due dates have passed, required information returns, six years of delinquent FBARs, tax, interest and a Title 26 miscellaneous offshore penalty Requires previously filed original returns for each covered year; not the route for filing missing original income tax returns
Streamlined foreign offshore procedures Eligible taxpayers who satisfy the IRS non-residency test and whose failures were non-willful Delinquent or amended returns and required information returns for the most recent three due years, six years of delinquent FBARs, tax and interest No specified Title 26 miscellaneous offshore penalty for compliant eligible participants, but eligibility and documentation are strict
Delinquent International Information Return Submission Procedures Taxpayers who are not under civil examination or criminal investigation and have not been contacted about the delinquent returns Delinquent international information returns; most forms are attached to an amended income tax return, with a reasonable-cause statement when appropriate Penalties may be assessed; Forms 3520 and 3520-A have special submission treatment
Criminal Investigation Voluntary Disclosure Practice Cases involving possible willfulness or significant criminal exposure that do not fit streamlined relief Disclosure package and tax, interest and penalties under the program’s current terms Terms and eligibility differ from streamlined procedures; obtain qualified legal advice before contacting the IRS

Streamlined procedures: the eligibility questions that matter

Non-willful conduct

Both streamlined programs require that the failure resulted from non-willful conduct. The IRS describes non-willful conduct as negligence, inadvertence, mistake or a good-faith misunderstanding of the law. Your certification should explain what you knew, what you did, why the omission occurred and when you discovered it. A statement that simply says “I did not know” may not address the facts the IRS expects.

Residence and filing history

The domestic and foreign programs use different residence tests. A person living in the United States generally cannot use the foreign procedure merely because the account is overseas. Review the current IRS non-residency test for each year, including physical-presence and tax-home requirements, before selecting the foreign program.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Domestic streamlined package

The domestic procedure generally covers the most recent three tax years whose return due dates have passed and the most recent six FBAR years whose FBAR due dates have passed. It requires that an original income tax return was filed for each of the three covered years. You generally submit amended returns, required international information returns, delinquent FBARs, the non-willful certification and the payment required by the procedure.

The domestic package includes tax and interest plus a Title 26 miscellaneous offshore penalty. The calculation is not simply 5 percent of every foreign account. Under the IRS streamlined domestic FAQ, the penalty uses a defined base involving certain accounts and assets, valued at year end for each covered tax year, with the highest aggregate amount used. The current Form 14654 instructions and FAQ control the calculation and exclusions.

Foreign streamlined package

An eligible foreign resident generally submits delinquent or amended returns and required information returns for the most recent three due tax years, six years of delinquent FBARs, a non-willful certification and payment of tax and interest. The IRS states that compliant eligible participants are not subject to the specified Title 26 miscellaneous offshore penalty or the listed failure-to-file, failure-to-pay, accuracy-related, information-return or FBAR penalties under the procedure. Tax and statutory interest still apply, and an incorrect eligibility claim can create serious exposure.

When delinquent information-return procedures fit

The IRS delinquent international information-return guidance is aimed at taxpayers who are not under civil examination or criminal investigation and have not already been contacted about the delinquent returns. Most delinquent international information returns other than Forms 3520 and 3520-A are attached to an amended income tax return. Include a reasonable-cause statement when the facts support one.

The IRS may assess a penalty before considering the reasonable-cause explanation for many forms. If a notice arrives, respond by the deadline with the explanation and supporting records rather than assuming the original submission closed the matter. Forms 3520 and 3520-A have separate filing instructions, so follow the current instructions for those forms instead of attaching them automatically to an amended return.

When voluntary disclosure deserves legal advice

The Criminal Investigation Voluntary Disclosure Practice is listed for undisclosed foreign assets, but it is not interchangeable with streamlined filing. Possible willfulness, repeated concealment, false answers, use of nominees, cash movements designed to avoid reporting, or an active IRS inquiry can change the analysis. Do not submit a streamlined non-willful certification if the facts may support willfulness.

Speak with a qualified cross-border tax attorney before making a disclosure when criminal exposure is possible or an examination or investigation is underway. Counsel can evaluate privilege, sequencing, amended returns, FBARs and the current voluntary-disclosure terms.

How penalties and reasonable cause interact

Domestic streamlined penalty

The domestic streamlined miscellaneous offshore penalty is procedure-specific. The IRS describes a 5-percent rate applied to the highest aggregate amount under its defined calculation for the three covered years. The base can include specified accounts and assets and can exclude amounts for years in which relevant accounts or assets were compliant. Use the current Form 14654 instructions rather than applying 5 percent to every account balance.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Foreign streamlined treatment

The foreign procedure does not impose that Title 26 miscellaneous offshore penalty on eligible, compliant participants, but it does not erase tax or interest. The taxpayer must still correctly report taxable income and pay the resulting liability.

Ordinary delinquent filings

Outside streamlined relief, delinquent information returns may carry their own statutory penalties. FBAR penalties and reasonable-cause treatment depend on the year, the violation, the facts and the authority in effect for that period. Avoid relying on a single penalty maximum copied from a different year or filing type.

A practical filing sequence

  1. Finish the inventory. Reconcile account names, owners, maximum balances, income and transactions for every affected year.
  2. Prepare corrected income tax returns. Add omitted income, foreign tax amounts and required schedules. Attach Form 8938 and other information returns when applicable.
  3. Prepare FBARs separately. File delinquent or amended FBARs through FinCEN’s BSA E-Filing System; do not mail them with Form 1040.
  4. Select and document the procedure. Confirm residence, non-willfulness, original-return history and IRS-contact status before using streamlined or delinquent-return procedures.
  5. Calculate and pay the required amounts. Include additional tax, statutory interest and any procedure-specific penalty. Preserve payment confirmations.
  6. Keep a complete record. Retain statements, exchange-rate calculations, certifications, amended returns, FBAR filing confirmations and correspondence for the relevant limitation and record-retention periods.

Common mistakes that make the correction worse

  • Filing only an FBAR. This does not amend omitted interest or complete Form 8938 or another required information return.
  • Attaching the FBAR to Form 1040. FBAR is a separate electronic FinCEN filing.
  • Using the $10,000 figure for Form 8938. Form 8938 has different thresholds and asset definitions.
  • Choosing streamlined filing without testing non-willfulness. The certification is factual and significant; it is not a general late-filing amnesty.
  • Using the foreign procedure without meeting the residence test. Foreign account location does not establish foreign-resident eligibility.
  • Submitting delinquent forms after IRS contact without checking eligibility. Contact, examination or investigation can remove a procedure from consideration.
  • Applying 5 percent to every account. The domestic streamlined penalty has a defined base and calculation.
  • Ignoring other entities or assets. A foreign account connected to a trust, corporation or passive investment can trigger additional forms.
  • Guessing at historical values. Obtain records and document exchange rates instead of using unsupported estimates.

If a previous streamlined submission was wrong

The IRS foreign streamlined FAQ says a taxpayer may correct an error in a previous submission with amended returns and/or an amended certification when the prior filings are not under examination. Explain the facts and circumstances that caused the error, identify the corrected items and follow the current labeling and submission instructions. A new submission should reconcile every changed number with the earlier package.

When professional help is warranted

Consider a qualified cross-border CPA or tax attorney when several years are involved, records are incomplete, the account was jointly owned or held through an entity, a trust or corporation is involved, income was omitted, the taxpayer may have acted willfully, or the IRS has made contact. Professional advice is especially important before signing a non-willful certification or making a voluntary disclosure.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Before filing, verify the current IRS forms, instructions, deadlines and electronic-system requirements. Administrative procedures can change, and only the IRS and FinCEN can determine how a particular filing and set of facts will be treated.
