EU airline passenger rights and travel insurance are separate protections: airline rules may provide rerouting, reimbursement, care or fixed compensation for eligible flight disruption, while an insurer pays only for losses covered by the specific policy. They can both be relevant to the same trip, but neither replaces the other—and you should not assume you can recover the same loss twice. Check whether the flight and operating carrier fall within the rules, then compare your policy schedule and full wording against your itinerary, health needs and planned activities.
First check whether EU air-passenger rules apply to your flight
Eligibility depends on the route and operating carrier, not your citizenship or a general sense that you are travelling in Europe. The European Commission says the rules apply to flights within the EU operated by EU or non-EU airlines; flights departing the EU to a non-EU country operated by either; and flights arriving in the EU from outside when operated by an EU airline. The rules also extend to Iceland, Norway and Switzerland. A traveller who has already received benefits under relevant non-EU law may be subject to a caveat. See the Commission’s air-passenger rights guidance for scope and claim routes.

What an airline may owe when a flight is disrupted
Cancellation
For a qualifying cancellation, passengers generally choose between reimbursement of the ticket, rerouting at the earliest opportunity, or rerouting at a later convenient date subject to comparable conditions and seat availability. Assistance at the airport may also be due. If the airline gives less than 14 days’ notice, fixed compensation may apply; the carrier can avoid that compensation by proving qualifying extraordinary circumstances that could not have been avoided even if reasonable measures had been taken. Reimbursement, rerouting and care are distinct from fixed compensation, so assess each separately.

Delay
Arrival at the final destination at least three hours late may qualify for compensation, subject to exceptions including extraordinary circumstances. Assistance during a departure delay depends on the delay’s duration and flight distance. A departure delay of at least five hours is the point at which the Commission guidance describes a right to reimbursement and a return flight. A delay can therefore trigger care or reimbursement rights without necessarily producing compensation.
Fixed compensation is not an insurance limit
The Commission’s guidance, accessed in 2026, describes these statutory compensation bands, subject to conditions and permitted reductions:

How airline baggage liability differs from baggage insurance
The Commission says an airline is liable for checked baggage that is lost, damaged or delayed, with a liability ceiling of approximately €1,300. This is a cap, not an automatic payout: actual recovery depends on the applicable rules, the circumstances and the evidence for the claim. Passengers can arrange a higher airline liability limit in advance, for a fee, no later than check-in. Separate private cover may be useful for valuable items if the airline limit is insufficient.

For written complaints, the Commission gives deadlines of seven days for lost or damaged checked baggage and 21 days after receiving delayed baggage. Follow the airline’s required process and keep the baggage report, receipts, purchase evidence and correspondence. Hand luggage is treated separately; the airline is liable for its damage if the airline was responsible. See the Commission’s baggage guidance.
What travel insurance can cover that airline rules do not
Insurance is a contract, not a general promise to compensate every travel problem. Depending on the policy, it may cover eligible emergency medical costs, evacuation or repatriation, cancellation or curtailment for listed reasons, and baggage losses subject to limits. It may also exclude or restrict particular circumstances. Compare the actual schedule and full wording rather than relying on a “comprehensive” label or a comparison-site summary.
- Medical treatment and transport: Check emergency treatment, hospital expenses, ambulance, medical evacuation and repatriation. Confirm whether private or state treatment is covered and what assistance service you must call before arranging care.
- Health disclosures: Read the terms for pre-existing conditions, including conditions under investigation, required declarations, acceptance criteria and exclusions. EIOPA’s 2019 thematic review reported that around 70% of its respondents excluded pre-existing medical conditions from offered cover; this was a respondent result from that review, not a current estimate for every insurer or country. EIOPA cautioned: “When it comes to travelling with pre-existing medical conditions, it is very important that consumers are aware of the coverage they have and understand the limits of their travel insurance policy.” See the EIOPA 2019 thematic review.
- Cancellation and curtailment: Check which reasons are insured, the maximum trip cost, when cancellation cover starts and what exclusions apply. A flight cancellation that entitles you to an airline remedy does not automatically satisfy an insurance policy’s trigger.
- Baggage and valuables: Compare the overall benefit, per-item caps, excess, proof requirements and any declaration or security conditions. A policy’s baggage limit can differ substantially from an airline’s liability cap.
- Trip eligibility: Check destination and transit countries, total trip length, annual-policy limits per trip, age restrictions, residency eligibility and whether planned activities or sports are covered.
- Costs and exclusions: Note the excess or deductible and whether it applies per person, claim or benefit section. Read exclusions for alcohol or drugs, travel against official advice, known events and other circumstances relevant to your plans.
The UK Foreign, Commonwealth & Development Office advises UK travellers to check all intended destinations, including transit, trip length, emergency care, evacuation and repatriation, health conditions and planned activities. It says EHIC and GHIC cards are not substitutes for travel insurance because they do not cover private healthcare, repatriation or additional costs such as mountain rescue. This is practical UK government guidance, not EU legislation or advice tailored to every country of residence. Read the terms applicable to your own policy and jurisdiction: FCDO foreign travel insurance guidance.

A package holiday can add a separate route of protection: the organiser’s responsibilities and package cancellation rules may apply in addition to airline rights and any insurance. Package-travel rights are independent of cancellation-insurance terms, and not every flight booking is a package. The Commission explains the distinction in its package travel guidance.
A qualifying traveller may have both an airline claim and an insurance claim, but the policy’s coordination terms and the nature of the loss matter. Do not assume that two claims mean two payments for the same expense; ask the insurer how to declare an airline reimbursement or compensation.
How to pursue a disruption or baggage claim
- Record the facts: Save the flight number, itinerary, scheduled and actual arrival times, airline notices, receipts for reasonable expenses and all communications.
- Write to the operating airline: Set out the disruption or baggage problem and request the remedy you believe applies. For baggage, meet the written complaint deadlines and keep the property irregularity report and purchase evidence.
- Escalate if needed: If the airline’s response is unsatisfactory, consult the national enforcement body or another dispute-resolution route listed in the Commission’s claim guidance.
- Notify the insurer separately: Follow the policy’s notification deadlines, provide requested evidence and ask what approvals or assistance procedures apply. Do not arrange treatment or other services contrary to policy instructions without checking where practicable.
Check the effective date of the revised EU rules
As of the Commission’s 28 July 2026 update, revised air-passenger rules had been adopted in July 2026 and were expected to enter into force the following summer; the Commission said existing rules would remain applicable until then. The Council reported final clearance on 13 July 2026. The Commission described expected changes including clearer baggage allowance information, faster claim procedures, better rerouting and support for cancellations or significant delays, and improved connecting-journey protections. These are future changes, not protections to rely on before commencement. Check the Commission’s dated announcement on revised air-passenger rights for the effective date and details before travelling.
