In the United States, an AI data center does not automatically receive a different federal depreciation treatment simply because it runs AI workloads. Compare the tax treatment asset by asset under federal rules, then check the state and local incentives that apply to the specific project. The examples below are U.S. illustrations, not a guide to other countries or a determination of any facility’s tax liability.
What makes a fair comparison?
Compare the same kinds of costs, ownership arrangements, locations, and tax years. AI facilities may use different equipment mixes, require more power or cooling, or have different investment schedules than other data centers. Those differences can change the project’s tax result, but they do not by themselves establish a separate tax classification for AI.

The IRS depreciation rules discussed here apply according to the taxpayer, property, business use, dates, and applicable elections—not an AI label. This is a bounded conclusion about the reviewed federal depreciation rules, not a claim that AI can never matter under another tax provision or incentive.

Start with ownership and the asset, not the facility’s label
IRS Publication 946 (2025) says: “To be depreciable, the property must meet all the following requirements.” It identifies ownership by the taxpayer, business or income-producing use, a determinable useful life, and an expected useful life of more than one year. Land generally is not depreciable.

- PCI & HIPPA and EIA/ECA-310-E compliant
Build an asset register that separates land, buildings and structural components, servers and networking hardware, power and cooling systems, software, and later improvements. Do not assume every component in an electrical or cooling system gets the same recovery period or deduction. The reviewed IRS guidance gives general rules; it does not assign a universal tax life to every data-center component.
Check Section 179 separately
Section 179 is an elective deduction, not a blanket write-off for data-center construction or equipment. IRS guidance limits it to qualifying property and imposes eligibility, acquisition, business-use, annual-dollar, and business-income requirements. Qualifying categories include certain tangible personal property and some nonresidential real-property improvements. Determine whether each asset qualifies and whether the deduction is available to the taxpayer before including it in a comparison.
Test for Section 168(k) additional first-year depreciation
IRS Publication 946 (2025) says certain qualified property acquired and placed in service after January 19, 2025 may qualify for a 100% special depreciation allowance, subject to detailed rules. Qualified property includes tangible MACRS property with a recovery period of 20 years or less and specified computer software. That does not mean every building, project cost, or data-center asset qualifies.

The publication also describes an election for a 40% allowance for certain qualifying property in the first tax year ending after January 19, 2025. For each asset, record the acquisition and placed-in-service dates, establish whether it meets the property rules and any exceptions, and evaluate the applicable election. Check current IRS guidance for the relevant tax year rather than relying on a general description of bonus depreciation.
Why do state and local rules matter?
State and local rules can affect sales and use tax, electricity, property tax, and sometimes construction-related purchases. The Tax Foundation’s December 19, 2025 overview describes data-center tax burdens as heavily influenced by state and local choices about equipment sales and property taxation, and notes that equipment exemptions often have economic-development conditions. It is policy context, not proof that a particular facility qualifies; eligibility depends on the operative law and administering agency.
These state examples show why location-specific research is essential. They are illustrative, not an exhaustive survey, and do not establish that AI facilities qualify automatically or that ordinary data centers are excluded.

| Texas | Texas Comptroller guidance describes a state sales-tax exemption for qualifying data centers and qualifying large data-center projects. Covered items include specified tangible property and necessary mechanical, electrical, or plumbing systems. The guidance says the exemption applies to the 6.25% state sales tax. | Confirm current program eligibility and local tax treatment. Where one meter serves mixed use, check the Comptroller’s electricity-use allocation rules. |
| North Carolina | G.S. 105-164.13 addresses electricity used at a qualifying data center and “datacenter support equipment.” The statute defines support equipment by its capitalized tax treatment and enumerated operational purposes, including computer/server, storage, and network equipment. | Read the full current statute, definitions, and effective dates before applying the exemption. |
| Iowa | Iowa Department of Revenue guidance describes sales and use tax exemptions for listed purchases or uses by data-center businesses, including electricity. It distinguishes treatment of certain real-property-related items by an operating-date cutoff. | Check the current conditions and the project’s start or operating date against the applicable cutoff. |
| Alabama | Alabama Department of Revenue guidance describes abatements approved by local authorities for qualifying projects, including data processing centers, with limits on the taxes that can be abated and the duration. | Confirm local approval, project qualification, which taxes are covered, and the applicable term. |
How to compare two projects step by step
- Fix the jurisdiction and tax year. Record the country, state, county or city, tax year, and version or effective date of each relevant law.
- Identify who owns, buys, and uses each asset. Distinguish the owner, tenant, operator, lessor, and purchaser. Establish who bears a tax and who may claim depreciation or an incentive.
- Prepare a consistent asset register. List land, buildings and structural elements, server/GPU and network hardware, power and cooling equipment, software, and improvements. Determine tax classification for each item rather than relying only on accounting labels.
- Record the relevant dates and basis. Capture purchase or contract date, construction start, acquisition, installation, and placed-in-service date. Note whether property is new or used and any basis adjustments.
- Run the federal cost-recovery analysis. For each asset, assess ordinary MACRS treatment, Section 179 eligibility and limits, and Section 168(k) qualification, allowance, and election choices, including applicable exclusions.
- Check state and local incentives independently. Review sales and use tax, electricity, property tax, covered equipment and construction costs, investment or job thresholds, certification, reporting, local approval, duration, and expiration or sunset terms.
- Explain any difference in project terms. Identify whether a result changes because of higher-density AI compute, a different energy or cooling configuration, capital spending, ownership, location, or timing. Attribute a tax difference to AI only if the applicable jurisdiction’s rule actually makes that distinction.
What information is needed for a project-specific answer?
A reliable estimate or eligibility conclusion requires, at minimum, the project location; the owner, operator, and tenant structure; a detailed equipment and construction-cost list; acquisition and placed-in-service dates; and relevant investment, employment, and operating facts. Without those details, the comparisons above explain the framework but cannot determine a facility’s liability or incentive eligibility.
