How to claim input tax credit on foreign SaaS and cloud subscriptions in India

An Indian GST-registered business may have to pay IGST under reverse charge when it buys SaaS or cloud services from a supplier outside India. The usual import-of-services test is that the supplier is outside India, the recipient is in India, and the place of supply is in India. Once the reverse-charge tax is paid, input tax credit (ITC) can be claimed only to the extent the service satisfies the normal business-use, documentation, apportionment and blocked-credit rules.

Paying the foreign vendor in Indian rupees does not, by itself, remove the reverse-charge obligation. The contracting supplier, recipient registration, place of supply, service classification, tax rate for the relevant period and actual use must all be checked before you file.

When a foreign SaaS or cloud bill is an import of services

Start with the statutory facts, not the currency on the invoice or the location of the software servers. An import of services generally requires all three of these conditions:

  • Supplier outside India: The entity that contracts with and bills your business is located outside India.
  • Recipient in India: The GST-registered business receiving the service is in India.
  • Place of supply in India: The applicable place-of-supply rule puts the supply in India.

Cloud services are expressly included in the Integrated Goods and Services Tax Act’s definition of online information and database access or retrieval (OIDAR) services. That definition is a useful indicator, but it does not replace checking the specific supply and its place-of-supply rule. A hosted application, infrastructure subscription, storage plan, collaboration platform or other cloud arrangement should be analysed from the actual contract and billing documents.

Payment in rupees does not change the result

CBIC’s FAQ addresses the situation in which a GST-registered Indian firm buys foreign software and the overseas supplier accepts payment in Indian rupees. Its answer is that the currency used to pay the consideration is immaterial. A rupee bank transfer therefore is not a basis for treating an otherwise qualifying import as an ordinary domestic purchase or for skipping reverse charge.

Confirm who the contracting supplier is

The brand name shown on a login screen is not enough. Identify the legal entity named in the order form, master services agreement, invoice, tax form and payment record. Some products are sold by an overseas parent in one transaction and by an Indian subsidiary, distributor or merchant of record in another. The GST treatment follows the actual contracting and billing arrangement.

Transaction fact Likely starting point What to verify
Overseas entity contracts and invoices an Indian GST-registered business Analyse as a possible import of services and reverse-charge supply Place of supply, applicable reverse-charge notification, classification and rate
Indian entity issues a GST tax invoice Usually a domestic purchase rather than an import from the overseas group Supplier GSTIN, invoice compliance and tax charged
Recipient is not GST-registered This registered-business ITC process does not automatically apply Separate rules, including the OIDAR rules for non-taxable online recipients where relevant
Service is used outside the Indian business or for personal purposes ITC may be restricted or unavailable Business purpose, user population and section 17 restrictions

Check place of supply and service characterization

After identifying the parties, determine whether the place of supply is India under the rule applicable to the service and recipient. For many cross-border business services, the recipient’s location is central, but special rules can apply to particular categories. Do not assume that the country of the data centre, the vendor’s support team or the card issuer decides the place of supply.

Document the facts for recurring subscriptions

For a monthly or annual subscription, keep a short internal note that records:

  • the overseas legal entity named as supplier;
  • the Indian GSTIN and establishment receiving the service;
  • the subscription period and service description;
  • why the service is used in the Indian business; and
  • the place-of-supply conclusion and the rule relied on.

Use the same analysis for renewals only if the contracting entity, recipient, service and use remain unchanged. Recheck when the vendor changes its terms, billing entity, invoice format or product bundle.

Calculate the reverse-charge tax without assuming a universal rate

Reverse charge means the Indian recipient, rather than the foreign supplier, accounts for the applicable IGST. The sources available for this guide do not establish one rate that applies to every SaaS or cloud arrangement. Classification, bundled services, notifications, exemptions and the tax period can change the answer.

  1. Describe the service accurately from the agreement and invoice. Avoid selecting a classification merely because the product is called “software.”
  2. Check the current rate notification and any reverse-charge notification effective for the filing period.
  3. Determine the taxable value under the applicable valuation rules. Reconcile the invoice currency, exchange-rate method and any credits, refunds or taxes included in the charge.
  4. Compute IGST using the verified rate and value. Keep the working paper with the invoice and exchange-rate evidence.
  5. Pay the reverse-charge amount through the electronic cash ledger in the manner prescribed for the return period. Do not assume that an ITC balance can be used to discharge the reverse-charge liability before the tax is paid.

A safe calculation format is: reverse-charge IGST = taxable value determined under the applicable rules × notified rate for the service and tax period. Replace the variables only after the classification and current notification have been checked.

Report the liability and credit in GSTR-3B

The reverse-charge liability and the resulting ITC are separate reporting events. The prescribed GSTR-3B includes table 3.1(d) for inward supplies liable to reverse charge. Enter the import-of-services liability there for the relevant period, together with the other required return disclosures.

GSTR-3B area Purpose Practical check
Table 3.1(d) Report inward supplies liable to reverse charge, including a qualifying import of services Reconcile the amount to the reverse-charge working paper and cash payment
Table 4(A)(2) Separate ITC field for import of services Use when the current form and instructions classify the transaction as import-of-services ITC
Table 4(A)(3) ITC for other inward supplies liable to reverse charge Use the field applicable to the transaction and period; current portal guidance can direct RCM credit here for a covered case

Return formats and portal instructions can change. Before filing, read the instructions displayed for the relevant tax period and ensure that the liability in 3.1(d), cash payment and ITC entry are reconciled. Do not rely on an older screenshot, spreadsheet template or a field remembered from a previous year.

When can the credit be taken?

CBIC has stated that tax paid by the recipient under reverse charge can be credited, including in the same month, subject to the normal conditions. That statement does not create an unconditional right to full credit. You still need to satisfy section 16 conditions and apply the restrictions in section 17 and related rules.

Business use and taxable supplies

The service must be used, or intended to be used, in the course or furtherance of business. A development team’s code repository, a customer-support platform or cloud infrastructure used to provide taxable services will generally have a clearer business connection than an account used for an owner’s personal activity. Keep evidence that connects the subscription to the Indian business and its taxable operations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Exclusive business and taxable use

Where the service is used wholly for eligible business activities and taxable supplies, the eligible portion can be claimed after the reverse-charge tax is paid and the other statutory conditions are met. “Wholly” should be supported by the actual user list, cost centre, project records or access controls rather than by a blanket accounting policy.

Mixed taxable, exempt and non-business use

If one subscription supports taxable supplies, exempt supplies and non-business activity, apportion the credit as required. Establish a reasonable, consistently applied basis using available usage, user, revenue or project data and retain the calculation. Review the allocation when the user base or product use changes.

Blocked categories and other restrictions

Section 17 and the related rules restrict credit for specified categories and for non-business or exempt-supply use. A SaaS label does not override those restrictions. Check whether the subscription is connected with an excluded expense, a personal benefit, or another blocked category before posting the credit.

Registration and tax-period conditions

The analysis in this guide is for a GST-registered recipient. Ensure that the GSTIN belongs to the establishment receiving and using the service and that the credit is claimed within the permitted time and return process for the relevant tax period. If registration has been cancelled, suspended or changed, obtain advice on the period-specific consequences instead of assuming the ordinary workflow remains available.

A practical month-end workflow

  1. Collect the source records. Save the invoice or billing statement, contract or order form, supplier legal-name evidence, payment record, subscription dates and the GSTIN of the Indian recipient.
  2. Classify the supplier relationship. Decide whether the bill is from an overseas contracting entity or an Indian supplier. Escalate mismatches between the invoice entity, payment beneficiary and contract entity.
  3. Test import status. Record supplier location, recipient location and place of supply. Confirm that the service description and OIDAR characterization fit the transaction.
  4. Verify the current tax treatment. Check the classification, reverse-charge notification, exemption and rate that apply to the filing period. Never carry forward a rate from an unrelated product or old period.
  5. Prepare the calculation. Convert the foreign-currency value using the applicable method, adjust for credits or refunds and calculate the IGST. Have a second reviewer approve unusual bundles or annual prepayments.
  6. Pay the reverse-charge tax. Discharge the amount through the prescribed cash-ledger process and retain the challan, electronic-liability record or other payment evidence.
  7. File the return entries. Report the liability in GSTR-3B table 3.1(d). Enter eligible ITC in the import-of-services or other RCM field indicated by the current form instructions, commonly 4(A)(2) for import of services and 4(A)(3) for other inward RCM.
  8. Apply apportionment. Remove non-business, exempt-use and blocked portions before finalising the credit. Record the method and supporting usage data.
  9. Reconcile and retain. Match the vendor ledger, bank or card statement, reverse-charge calculation, cash payment and return figures. Preserve the file for the statutory retention period and for any audit query.

Records that make the claim defensible

No single checklist can replace the statutory conditions, but the following file gives an auditor a coherent trail from contract to credit:

  • Master service agreement, order form or click-through terms showing the supplier’s legal entity;
  • invoice, renewal notice or billing statement with service period, value and currency;
  • evidence of the supplier’s location and the Indian recipient’s GST registration;
  • bank, card or payment-gateway record and exchange-rate support;
  • place-of-supply and service-classification memo;
  • rate and reverse-charge calculation, including treatment of discounts, refunds and bundled items;
  • proof of cash payment of IGST under reverse charge;
  • GSTR-3B workings and filed-return reconciliation;
  • user, cost-centre, project or access records supporting business use; and
  • apportionment schedules where use is mixed.

Depending on the facts and current rules, self-invoice or payment-voucher requirements may also need to be considered for an import from an unregistered overseas supplier. Confirm the documents required for the relevant period rather than generating forms mechanically for every subscription.

Common mistakes and how to correct them

“The card was charged in INR, so there is no RCM”

Currency is not the deciding test. Revisit the supplier, recipient and place-of-supply facts and correct the reverse-charge calculation if the transaction qualifies as an import.

“The vendor has a famous app, so it must be a domestic purchase”

A product’s public brand and server location do not identify the contracting supplier. Compare the legal entity on the invoice and agreement with the payment beneficiary and any Indian GSTIN.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“Every cloud bill gets full ITC”

Credit remains subject to business use, taxable-versus-exempt apportionment, blocked categories and section 16 conditions. Recalculate the eligible portion when users or purposes change.

“The same rate applies to all SaaS”

Do not use a universal percentage. Verify classification and the notified rate for the actual service and filing period, especially where support, implementation, advertising, storage or hardware-related charges are bundled.

“The liability and credit can be posted without a cash payment”

Reverse-charge tax must be accounted for and paid through the prescribed mechanism before relying on the resulting credit. Match the cash payment to the return liability before taking ITC.

“The old GSTR-3B template is still correct”

Field instructions and portal behaviour can change. Check the current return for the filing period, report the liability in 3.1(d), and use the import-of-services or other RCM ITC field directed by the current instructions.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Decision guide for recurring subscriptions

Question If “yes” If “no”
Is the named contracting supplier outside India? Continue the import-of-services analysis. Analyse the Indian supplier’s GST invoice and ordinary ITC rules.
Is the recipient a GST-registered Indian business? Assess reverse charge and ITC eligibility. Do not apply this registered-recipient workflow automatically.
Is the place of supply in India? Reverse charge may apply, subject to the notification and classification. Document the rule and determine whether Indian GST is due.
Is the service used for eligible business activity? Proceed to section 16 and section 17 checks. Exclude the non-business portion.
Is use partly exempt or otherwise restricted? Apportion or block credit as required. Claim only after all other conditions are met.
Have the current rate, return fields and payment evidence been verified? File the reconciled liability and eligible ITC. Hold the claim until the missing verification is complete.

What changes when the recipient is not registered?

This article addresses a GST-registered Indian business claiming ITC. A person or organisation that is not registered cannot simply copy the same RCM-and-ITC workflow. Separate provisions apply to OIDAR supplies made to non-taxable online recipients, and the supplier’s obligations can differ. Confirm the recipient’s status and the applicable OIDAR rules before drawing any conclusion.

Final review before filing

  • Supplier legal entity and country match the agreement, invoice and payment record.
  • Indian recipient GSTIN and establishment using the service are identified.
  • Place of supply is documented as India under the applicable rule, if that is the conclusion.
  • Classification, reverse-charge notification, exemption and rate are current for the tax period.
  • IGST is paid through the prescribed cash-ledger process.
  • GSTR-3B table 3.1(d) agrees with the calculation and payment.
  • ITC is entered in the current import-of-services or other RCM field indicated by the portal instructions.
  • Business-use evidence supports the amount claimed.
  • Exempt, non-business and blocked portions are removed or apportioned.
  • Contract, invoice, payment, calculation, return and reconciliation records are retained together.
