For passenger motor vehicles approved to carry up to 13 people, including the driver, Section 17(5) of India’s CGST Act generally blocks ITC unless the vehicle is used for a specified taxable activity: further supply, passenger transportation, or driving instruction. Motor vehicles used to transport goods are treated separately. Even when a vehicle fits an exception, the business must satisfy the other applicable ITC conditions.
First check the vehicle’s seating capacity and use
Start with the vehicle’s approved seating capacity, counting the driver, and the activity for which it is used. Under Section 17(5) of the CGST Act, ITC is generally blocked for motor vehicles designed to carry people with approved seating capacity of no more than 13. The Act provides exceptions tied to specified taxable supplies; ordinary internal business use is not one of them. Read Section 17(5) of the CGST Act.

| Vehicle or use | How the rule applies |
|---|---|
| Passenger vehicle with approved capacity of up to 13, including the driver, used for ordinary company work | ITC is generally blocked; business use alone is not an exception. (CGST Act, Section 17(5)) |
| Passenger vehicle used to make taxable supplies of further vehicle sales, passenger transport, or driving instruction | Falls within a stated exception to the passenger-vehicle restriction, subject to other ITC conditions. (CGST Act, Section 17(5)) |
| Motor vehicle used to transport goods | Section 17(5) treats goods-transport vehicles separately from the passenger-vehicle restriction. Check the vehicle’s classification and the remaining ITC conditions. (CGST Act, Section 17(5)) |
| Equipment such as a tipper or dumper | Classification depends on the relevant statutory definition and facts. CBIC’s mining-sector FAQ discusses particular earth-moving equipment and a goods-transport use; it is not a blanket ruling for every machine or business. (CBIC Sectoral FAQ on Mining) |
When can ITC be claimed on a passenger vehicle?
For a vehicle within the 13-person threshold, the relevant question is whether it is used to make a taxable supply covered by the statutory exceptions—not merely whether it helps the business operate.

Further supply of the vehicle
A business supplying such vehicles may fall within the exception. CBIC has also clarified the treatment of dealer demo vehicles: Circular 231/25/2024-GST explains that demo vehicles used to promote further supply of similar vehicles are not blocked on that basis. The clarification distinguishes that use from vehicles used to transport staff or management. Read Circular 231/25/2024-GST.

Taxable passenger transportation
The Act separately includes motor vehicles used to make taxable supplies of passenger transportation. This is an important exception beyond the short answer in CBIC’s general FAQ, which mentions supplying cars and driving training. Whether a particular service qualifies depends on the supply and the applicable GST treatment.
Driving instruction
A vehicle used for imparting driving training is among the stated exceptions. The business should be able to connect the vehicle’s use to that taxable activity and meet the other ITC requirements.

How goods-transport vehicles differ
The passenger-vehicle block is framed around vehicles designed to carry people within the specified seating threshold. Section 17(5) separately addresses motor vehicles used for transportation of goods. Do not assume that a vehicle is covered merely because a business calls it a goods vehicle: verify its statutory classification and actual use.
CBIC’s mining-sector FAQ discusses tippers and dumpers as examples of earth-moving equipment outside the motor-vehicle definition referenced there, and describes credit in the mining-company goods-transport context. That fact-specific answer should not be extended to unrelated equipment, uses, or businesses without checking the law and circumstances. See CBIC’s sectoral FAQs.

What to verify before taking the credit
Passing the vehicle-use test does not by itself establish entitlement. Section 17(5) operates alongside the Act’s other ITC requirements, including rules relevant to business and non-business use and payment. Confirm the current provisions and the taxpayer’s facts before entering a claim. The CBIC-hosted Act copy linked above is amended up to 1 January 2022, so it should not be treated as a consolidated statement of every amendment or filing rule in force in October 2026. For current compliance, check the latest law, applicable forms and filing rules, and obtain advice for uncertain classifications or mixed-use cases.
CBIC’s general FAQ says capital-goods ITC is generally available when used in the course or furtherance of business, but specifically cautions that credit is not available on cars unless the business imparts driving training or supplies such cars. Read that as general guidance, not a complete list of the statutory exceptions: Section 17(5) also covers taxable passenger transportation. See CBIC’s Frequently Asked Questions, question 127.
