Choose an electronic signature platform by testing it against the bank’s actual workflows—not by relying on a vendor’s general claim that its product supports e-signatures. First map legal and consumer-disclosure requirements for each workflow, then assess authentication, records, integration, resilience, and vendor oversight with the teams responsible for those risks.
Start with the bank’s workflows and legal requirements
There is no single e-signature configuration that automatically fits every bank document or customer journey. Before comparing products, list the transactions in scope, who signs, what information is delivered, what records must be retained, and which bank systems are involved. Have legal and compliance teams assess the applicable federal and state rules, the bank’s charter and policies, and the specific record types.

Under E-SIGN, a covered signature, contract, or record generally cannot be denied legal effect, validity, or enforceability solely because it is electronic. That rule does not remove other legal requirements or require a person to accept electronic records or signatures. E-SIGN also contains exceptions, and state law may affect the analysis. (15 U.S.C. § 7001(a))

These include affirmative consent and prior, clear and conspicuous disclosures addressing paper delivery, withdrawal, the scope of consent, how to obtain paper copies, and relevant hardware and software access information. The consent method must reasonably demonstrate that the consumer can access the electronic form. A bank should determine how those conditions apply to each covered consumer journey; a platform’s signing feature alone does not establish that the whole journey meets them.

Make the workflow map concrete enough to evaluate, for example:
- Which customer or employee action triggers the document?
- Is the document a contract, a required consumer disclosure, or another record type?
- Who must receive, review, sign, or retain it?
- What paper alternative or consent-withdrawal process applies, if required?
- Which systems provide the document and signer information, and where must the completed record go?
- How long must the bank retain the record under the requirements applicable to that document?
Set risk-based signer authentication and access controls
Match authentication to the risk of the transaction and the signer’s role. The FFIEC’s 2021 authentication guidance addresses risk-management principles and practices for customers, employees, third parties, and access to financial institution systems. It supports risk assessment and layered security; it does not select or certify an e-signature product.

Ask each candidate to show what the bank can configure for each workflow, who administers those settings, and what evidence the bank can keep to demonstrate the selected controls. Compare controls for different transaction risks and signer types rather than assuming one profile is suitable for every use. Include administrative access as well as signer access in the review.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesVerify the record the bank can retrieve and retain
E-SIGN § 7001(d) permits required records to be retained electronically when they accurately reflect the information and remain accessible to people legally entitled to access them for the required period, in a form that can be accurately reproduced later. The statute does not set one retention period for all bank documents.

Test the completed record and its associated evidence, not just the signing screen. Determine whether the bank can retrieve and export the documents and evidence it needs, preserve accurate and reproducible copies, and make them accessible through the applicable retention period. Include records management in those tests and account for the bank’s own retention requirements.
Compare platforms using the same evidence requests
Give each candidate the same workflows and ask for current product documentation and demonstrations in the bank’s environment. Score actual evidence against bank-defined requirements. The following scorecard turns the legal and risk considerations into procurement questions; it is not a list of features mandated universally by the cited guidance.

| Evaluation area | What to establish | Evidence or test |
|---|---|---|
| Workflow and consumer consent | Can the bank configure the required notices, consent capture, paper alternatives, and withdrawal process for each applicable use case? | Walk through the actual consumer journey, including how notices are presented and how the bank records consent. |
| Signer identity and access | What authentication options and access controls are available, and can they vary by risk and signer type? | Demonstrate configuration and administration for representative workflows; identify what evidence can be retained. |
| Record integrity and export | Can the bank retrieve completed records and associated evidence in accurate, reproducible form? | Complete a transaction, then test retrieval, export, and reproduction using the bank’s recordkeeping process. |
| Integration and operations | How does the platform fit the bank’s document, identity, case-management, and core-system architecture, and what operational dependencies result? | Map data and document flows, system dependencies, and the teams responsible for operating them. |
| Security and resilience | What information can the vendor provide for the bank’s security, incident-handling, continuity, and service-resilience review? | Request evidence relevant to the bank’s review and determine how service dependencies affect the workflow. |
| Contract and ongoing oversight | Can the bank perform due diligence, define responsibilities and access, manage changes, and carry out ongoing oversight under its third-party risk process? | Review the proposed responsibilities and oversight arrangements with procurement, risk, security, and legal stakeholders. |
| Migration and total operational cost | What work and costs are associated with implementation, operating the service, and moving records or workflows if circumstances change? | Ask for the candidate’s current documentation and assess against the bank’s expected operating model; do not infer costs from feature lists. |
Evaluate the vendor as a third party
Platform procurement is also a technology-acquisition and service-provider decision. The FFIEC’s Development, Acquisition, and Maintenance booklet, announced on September 29, 2024, addresses acquisition planning, governance and risk management, maintenance and change management, and third-party service-provider relationships. The OCC’s community-bank digitalization resources point to information-security safeguards and cloud risk-management resources; the OCC also states that it is technology neutral and does not endorse a particular digitalization strategy.
Involve the people who will own the decision and its continuing operation: business workflow owners, legal, compliance, information security, records management, procurement, and relevant technology teams. Use the bank’s established third-party risk and change-management processes to assess dependencies and define responsibilities. The cited guidance informs that oversight; it is not blanket approval of any e-signature vendor.

Make the selection decision workflow by workflow
Choose a platform only after the bank has tested its proposed configuration against the use cases it intends to deploy and documented how each requirement will be met. A candidate that fits one low-risk internal workflow may not be suitable for a consumer disclosure journey or a higher-risk transaction without different controls. If a requirement cannot be evidenced or tested, treat it as unresolved rather than assuming the product supports it.
