Then compare shortlisted services at the exact product, tier and endpoint level for processing locations, transfers, retention, training use, subprocessors, security evidence and exit rights.
Why “compliant AI provider” is not a universal category
Compliance attaches to a particular deployment. The same model can create different obligations when used for customer support, employee screening, medical advice, credit decisions or internal drafting. Your legal entity, the people affected, the data categories, the countries involved and your contractual role all change the analysis.

A provider may supply useful controls and documentation, but it cannot remove your duties as a deployer, controller, processor, employer or regulated-sector operator. Conversely, a service that cannot meet your required region, transfer mechanism or audit terms may be unsuitable even if its marketing uses broad compliance language.
Recommended Free Tools
- Jurisdiction: identify every country or regional regime that can reach the service, including where your organization, users, provider, support staff and subprocessors are located.
- Purpose and risk: document what the system does and whether an output affects a person’s access to employment, credit, education, healthcare, public services or another consequential right.
- Data: classify personal, sensitive, confidential, regulated, copyrighted and business-secret information before it enters prompts, files, fine-tuning jobs or logs.
- Roles: establish who determines the purpose, who operates the system, who supplies the model and who can access the data.
These facts determine whether a rule applies and which controls are proportionate. Treat a provider’s compliance page as evidence to verify, not as a legal conclusion.

Build a jurisdiction-and-use-case map before comparing vendors
List the entities, people and locations
Create a one-page inventory for the proposed service. Record your contracting entity, affiliates that will use it, user and subject locations, the provider’s contracting and support entities, inference regions, storage regions and every known subprocessor location. Include remote administrators and support personnel because access from another country can matter even when primary storage is local.
Classify the system and your role
Describe the model or application, not just the supplier’s brand. Note whether you are consuming a general-purpose model through an API, deploying a provider’s finished application, fine-tuning a model or building a system that makes or recommends decisions. State whether your organization is a provider, deployer or both for each activity. The same company can occupy different roles in different projects.
Describe the decision impact
Write down what happens after an output is generated. A draft marketing paragraph and a recommendation used in hiring do not carry the same risk. Identify human review, appeal routes, error tolerance, monitoring and any people who could be adversely affected. This record helps determine whether a high-risk classification, impact assessment or sector rule is triggered.
Make a data-flow diagram
Trace prompts, uploaded documents, retrieved records, outputs, telemetry, abuse-monitoring content, support tickets, backups and deletion requests. Mark each flow’s source and destination country, legal basis, retention period, encryption boundary and access group. Ask whether the provider can change any of these paths without notice.
Apply the EU framework without treating it as a global rulebook
Check whether the EU AI Act can reach your deployment
The Act can cover providers or deployers established outside the European Union when an AI system is placed on the Union market or its output is used in the Union. Therefore, a non-EU organization may still need an EU analysis if its system serves EU users or its outputs are used there. Scope and obligations depend on the system’s category and the party’s role.

For a high-risk system, the European Commission’s navigation material describes obligations that can include conformity assessment, a quality-management system and registration in an EU database. Do not assume that every generative-AI API is high risk; classify the actual system and intended purpose first.
Keep the AI Act and GDPR analysis together
The AI Act does not replace EU data-protection law. If your prompts, context, outputs or logs contain personal data, GDPR duties can apply alongside AI Act requirements. That can mean documenting purpose and legal basis, minimizing data, honoring data-subject rights, setting retention limits and conducting a data-protection impact assessment where required.

Understand the general-purpose AI obligations
The European Commission’s GPAI FAQ identifies obligations that began applying on 2 August 2025, including technical documentation, information for downstream providers, a copyright-compliance policy and publication of a sufficiently detailed summary of training content. A provider established outside the EU must appoint an authorized representative before placing the model on the EU market.
The FAQ describes compute above 1023 FLOP together with specified generative capabilities as an indicative criterion for identifying certain general-purpose AI models. It is a classification indicator with exceptions, not a universal bright-line test for every model or service. Ask the provider how it has classified the model and what documentation it supplies to downstream customers.
Analyze GDPR transfers, including onward transfers
GDPR Article 44 requires transfers of personal data to third countries or international organizations—including onward transfers—to meet the conditions in Chapter V. Article 45 allows transfers based on an adequacy decision. Other lawful mechanisms may be relevant depending on the facts, but the correct route is not determined by a data-center label alone.

Obtain the provider’s transfer terms, subprocessor list, access locations, government-request process and supplementary safeguards. Confirm who can access support tickets, logs and backups, not only where the main inference job runs.
Compare providers by the real service configuration
Evaluate the exact product, plan, region and endpoint you intend to buy. A provider’s enterprise contract may offer controls unavailable on a consumer plan; a location-specific endpoint may behave differently from a global endpoint.
| Comparison axis | Questions to ask | Evidence to retain |
|---|---|---|
| Jurisdiction and reach | Which laws apply to our entities, users, subjects and output locations? Can an extraterritorial rule apply? | Legal applicability memo and product scope statement |
| System category and roles | How is the system classified? Are we provider, deployer, controller or processor? | Use-case description, role allocation and classification rationale |
| Data and purpose | Are personal, sensitive, confidential or copyrighted data processed? What decision does the output influence? | Data inventory, purpose specification and impact assessment |
| Processing and storage | Where do inference, storage, logs, backups, support and abuse monitoring occur? | Current architecture and regional-processing documentation |
| Transfers | What Chapter V mechanism applies? Where can subprocessors or support staff access data? | Data-processing agreement, transfer addendum and subprocessor list |
| Retention and training | Are prompts and outputs retained? Used for training? Can administrators set deletion windows? | Contract clauses, console settings and deletion procedure |
| Security and incidents | What encryption, identity controls, testing, audit reports and notification deadlines are offered? | Security documentation, audit reports and incident-response terms |
| Availability and contract | Is the required region available for this tier and endpoint? Can terms change? | Order form, service description, version and availability confirmation |
| Portability and exit | Can prompts, files, fine-tuning data, configurations and logs be exported and deleted? | Export format, deletion certificate process and transition assistance |
Does AI data residency make a provider compliant?
No. Residency can reduce a transfer or localization risk, but it does not establish lawful purpose, appropriate security, correct role allocation, model governance or compliance with a high-risk obligation. “Stored in the EU” may still leave support access, telemetry, backups or subprocessors outside the EU.
Distinguish global, multi-region and location-specific endpoints
Google Cloud’s Gemini Enterprise Agent Platform documentation says requests sent to a global endpoint may be processed in any Google Cloud location worldwide and therefore provide no data-residency guarantee. The same documentation describes an EU multi-region endpoint covering EU member states and location-specific endpoints that constrain processing to an associated broader geographic area. Check the current product documentation for the endpoint you will actually call; do not infer behavior from the provider’s general cloud-region map.
Verify what “regional” covers
Ask separately about prompt and output inference, persistent storage, logs, safety review, abuse monitoring, support tickets, backups, model improvement, fine-tuning jobs and administrative access. Require the answer in writing for the selected model, endpoint, account type and contract. A regional guarantee that covers only data at rest may not cover processing or human access.

What to verify in regional-processing offerings
Example: documented controls for eligible services
OpenAI’s residency announcement describes at-rest data residency for eligible API customers and for new ChatGPT Enterprise and Edu workspaces across a listed set of regions. For eligible API customers, it also describes choosing regional processing for eligible endpoints. Those statements are limited to the products, customers, endpoints and data categories named in the current documentation.
Before relying on such a control, obtain confirmation of eligibility, the exact endpoint list, whether processing is regional or only storage, the treatment of logs and support access, and any contractual exclusions. Do not extend an assurance for one plan or product to every service from the same provider.
Turn documentation into a testable requirement
- Write the requirement precisely, such as “personal data in prompts and outputs must be processed and stored within EU member states; remote support access must be EU-based unless an approved transfer mechanism applies.”
- Ask the provider to identify the technical feature, endpoint and contract clause that satisfy it.
- Run a controlled request with non-sensitive test data and inspect the account’s region, audit events and retention settings.
- Record exceptions, fallback routing, service outages and support procedures.
- Make the requirement a renewal and change-notification condition, not merely a presales answer.
Contract, security and operational evidence
Data-processing and transfer terms
Ensure the agreement identifies processing purposes, data categories, instructions, confidentiality, security measures, subprocessors, assistance with rights requests, deletion or return, audit rights and breach notification. The transfer addendum should identify the mechanism, applicable safeguards and process for evaluating government access and onward transfers.
Retention, training and deletion
Set a default retention period that matches your purpose. Clarify whether prompts, outputs, embeddings, uploaded files, safety samples and diagnostic logs are retained, and whether any are used to improve models. Confirm that disabling training is effective for every endpoint and workspace involved. Test deletion, including backups and replicated stores, and request the provider’s completion evidence.

Contract for a practical incident-notification deadline, information updates, cooperation with regulators and preservation of evidence.
Best Value
Auditability and model documentation
Require version identifiers, change notices, evaluation results relevant to your use case, known limitations, content provenance information where available and records of human oversight. For downstream use of a general-purpose model, ask how the provider supplies the technical information needed for your own documentation and risk controls.
Portability and switching are compliance controls
Procurement should cover the day you leave. Inventory what must move: prompts and templates, conversation histories, uploaded source files, retrieval indexes, embeddings, fine-tuning datasets, safety configurations, evaluation sets, logs and audit records. Define export formats, API access during transition, deletion deadlines and assistance with re-platforming.
The European Commission’s Data Act explainer describes minimum requirements for cloud-service contract content and an objective of supporting switching between data-processing services. Treat those provisions as a reason to examine exit clauses, not as proof that a particular provider offers frictionless portability. Verify the contract, applicable law, technical format and any charges for transition.
A practical selection procedure
- Freeze the use case. Describe users, affected people, decisions, human review and prohibited uses.
- Map data. Mark personal and sensitive fields, retention needs, training restrictions and deletion requirements.
- Map geography. List entities, users, subjects, provider locations, support access and subprocessors.
- Identify laws and roles. Analyze the EU AI Act and GDPR where relevant; add current primary sources for every other jurisdiction or sector that applies.
- Write pass/fail controls. Include endpoint, region, transfer mechanism, retention, security, audit, incident and exit requirements.
- Shortlist only configurations that can meet the controls. Exclude a provider if the required region or contract is unavailable, rather than assuming a future roadmap will solve it.
- Validate technically. Test routing, logs, deletion, access controls and failure behavior with representative but non-sensitive data.
- Contract the result. Attach the service description, region commitments, subprocessor process, transfer terms and change-notification obligations.
- Govern after launch. Monitor model and endpoint changes, new subprocessors, incidents, regulator guidance, data flows and the continued suitability of human review.
Common mistakes and how to correct them
- Choosing by a logo or certification alone: certifications may cover a company or control set, not your endpoint and purpose. Tie evidence to the deployed configuration.
- Equating an EU region with GDPR compliance: residency does not establish a lawful basis or answer access and onward-transfer questions. Complete the Article 44 analysis and document safeguards.
- Assuming every endpoint behaves alike: global, multi-region and location-specific endpoints can have different routing. Name the endpoint in the order form and test it.
- Ignoring logs and support: prompts may be copied into diagnostics or tickets. Include these paths in the data-flow map and retention schedule.
- Applying the EU AI Act to the model in isolation: classification depends on intended purpose, system context and role. Analyze the finished system and its use.
- Generalizing from one country’s example: the EU framework is not a complete US federal, state or worldwide matrix. Identify the actual laws and sectors affecting your organization and obtain current local advice where needed.
- Leaving exit planning until an incident: negotiate export and deletion before production data accumulates.
When no provider passes every requirement
First decide whether the requirement is legally mandatory, contractually required by a customer, or an internal risk preference. If a mandatory control is unavailable, do not disguise the gap with a policy statement. Consider narrowing the data, keeping sensitive processing in a controlled environment, using a regional gateway, adding human review, or selecting a different architecture. Document residual risk, approval authority, compensating controls and a reassessment date.
For lower-risk drafting or summarization, you may be able to remove identifiers, limit retention and prohibit consequential use. For a system that influences a person’s rights, those measures may be insufficient; pause deployment until classification, documentation, oversight and legal requirements are satisfied.
Decision checklist
- Have all entities, users, affected people, data categories and countries been listed?
- Is the system’s purpose, risk category and provider/deployer role documented?
- Do the chosen product, tier, model and endpoint provide the required processing and storage location?
- Are logs, backups, support, abuse monitoring and subprocessors included in the location analysis?
- Is the GDPR Chapter V mechanism—and any onward-transfer path—documented where relevant?
- Are retention, training use, deletion and administrator-access settings contractual and testable?
- Do security, audit, model documentation and incident terms match the use case?
- Can you export required assets and complete deletion if you switch?
- Is there an owner and review date for regulatory, provider and model changes?
Frequently Asked Questions
Is a provider outside the EU automatically excluded from an EU deployment?
No. The EU AI Act can apply to providers or deployers outside the Union when a system is placed on the Union market or its output is used there. Eligibility depends on the system, role, data and controls, not the provider’s headquarters alone.
Should a global endpoint be used for regulated data if storage is regional?
Only after the provider documents where processing, logs, support access and onward transfers occur and your legal analysis accepts them. A global endpoint may process requests worldwide, so regional storage by itself is not a residency guarantee.
What should be renewed when a provider changes its model?
Recheck the model’s classification, documentation, data flows, endpoint behavior, retention and training settings, evaluation evidence, subprocessors and contract commitments before approving the changed version.
