How to Choose a Replacement Cultural Resources Management Firm

By Freedom251 Team · · 11 min read

Choose a replacement cultural resources management (CRM) firm by first confirming the project’s legal review path and unfinished obligations with the responsible agency reviewer. Then give several firms the same performance-based scope, compare the named people—not just company names—and verify discipline-specific qualifications, local experience, deliverable quality, availability, fees, and references. A directory listing or attractive proposal is only a lead; it is not proof that a consultant is qualified for your project.

The right choice depends on the project’s location, state or federal nexus, undertaking, review agency, required disciplines, procurement rules, and current stage. A consultant can perform technical work, but the client agency generally retains its legal responsibility for environmental review and approvals. Treat replacement as a controlled transition, not a brand-new study.

What a replacement CRM firm must take over

Cultural resources management work can include archaeological survey, architectural history, historic-property evaluation, tribal or community consultation support, effects analysis, mitigation, data management, curation, and preparation of reports for agency review. The exact package varies by undertaking and jurisdiction. Before contacting firms, identify what has already been completed, what the reviewer accepted, and what remains open.

A replacement may inherit partially completed fieldwork, draft reports, GIS layers, artifact collections, consultation correspondence, unresolved agency comments, commitments in permits, and deadlines tied to construction or funding. If the new firm repeats accepted work because records were not transferred, the project can lose time and incur avoidable cost. If it assumes an old conclusion is still acceptable after the scope or design changed, the project can face a new review problem.

Make a written division of responsibility among the client, the outgoing consultant, the incoming consultant, the reviewing agency, and consulting parties. State who may make technical recommendations, who communicates with the agency, who approves scope changes, and who signs or submits each deliverable.

Step 1: Map the project before seeking proposals

Create a project-status file that a prospective firm can understand without guessing. Obtain permission from the client’s contract and records owners before sharing confidential or protected material. At minimum, assemble:

  • The incumbent contract, amendments, invoices, schedules, and termination or transition provisions.
  • The approved scope of work, maps, project limits, alternatives, design changes, and construction schedule.
  • All submitted reports, data tables, GIS files, photographs, field notes, laboratory results, artifact inventories, and curation records.
  • Agency letters, review comments, concurrence or determination documents, permit conditions, and meeting minutes.
  • The consultation record, including tribal, local-government, landowner, and public contacts where applicable.
  • A list of open comments, promised commitments, mitigation measures, deadlines, and decisions awaiting approval.
  • Information about ownership, custody, access restrictions, personally identifiable information, and transfer rights for records and collections.

Ask the incumbent for a document index and a statement of work completed, in progress, and not started. Record the date of the latest agency communication and whether the reviewer has accepted any methodology, inventory, eligibility recommendation, or effects finding. Do not assume that payment for a deliverable means the agency approved it.

Step 2: Confirm the governing requirements with the reviewer

The governing process should be settled before you issue a request for proposals. Pennsylvania’s State Historic Preservation Office advises developing a clear scope in coordination with the appropriate reviewer. That conversation should identify the applicable federal or state process, the undertaking, required disciplines, expected report format, consultation steps, and review milestones.

Ask the responsible agency reviewer these questions in writing:

  • Which law, regulation, permit condition, or funding requirement controls the work?
  • Is there a federal nexus that triggers Section 106, and which agency is lead?
  • Which resources and disciplines must be addressed: archaeology, architectural history, tribal consultation, cultural landscapes, or others?
  • Are there approved-person lists, state registrations, agency training, examinations, report templates, or data standards?
  • Will the replacement firm need to preserve an existing area of potential effects, research design, survey method, or consultation protocol?
  • What must be resubmitted, and what can be incorporated by reference?
  • Who receives drafts, how many review rounds are expected, and what constitutes acceptance?

Oregon Department of Transportation illustrates why this check matters. For covered Oregon DOT Section 106 documentation, qualifications attach to people performing the work, and the person overseeing the work must complete program training and pass an examination. That is an Oregon DOT program condition, not a universal rule for every CRM contract. Other states and agencies can use different standards.

Step 3: Write a performance-based replacement scope

A good scope tells firms what outcome they must deliver and the conditions under which it will be judged. Avoid a vague request for “completion of cultural resources work.” Include:

  • Required coordination meetings, response times, escalation procedures, and points of contact.
  • Acceptance criteria, review rounds, correction obligations, and the process for approving a changed scope.

Give every candidate the same scope and background package. If information is uncertain, identify the uncertainty and ask bidders to state an assumption and a priced option. This produces proposals that can be compared rather than a collection of incompatible guesses.

Step 4: Invite several firms and require named teams

Request bids from multiple firms, as Pennsylvania SHPO recommends. Require each bidder to identify the actual people who will perform and supervise the work. A corporate résumé can show capacity, but it cannot establish that the proposed principal investigator, architectural historian, tribal liaison, GIS specialist, or report author has the needed experience or availability.

Ask for role-specific curricula vitae, a responsibility matrix, comparable project examples, current workload, proposed subcontractors, and a transition plan. Permit substitutions only with client approval and require replacements to meet the same qualification standard. A senior person listed in a proposal should not quietly become an occasional reviewer while less-qualified staff perform the core work.

How to compare replacement proposals

Review area What to request How to test the answer
Named personnel and credentials Names, roles, discipline-specific CVs, education, training, and relevant experience Match each person to the tasks they will perform and verify documentation against the applicable standard
Relevant project experience Examples with the same geography, resource types, review agency, and compliance process Ask what was actually delivered, who reviewed it, and how unresolved issues were handled
Scope and deliverables Task-by-task approach, products, data formats, quality control, and subcontractor roles Compare line items with your scope and identify omitted work, duplicated work, or unpriced assumptions
Schedule and availability Start date, milestone dates, staff availability, dependencies, and escalation path Check the plan against agency review windows, access restrictions, and construction deadlines
Fees and commercial terms Fee basis, labor categories, expenses, assumptions, exclusions, contingencies, and change-order triggers Ask what event changes the price and who must authorize additional work
References and past performance Recent clients for comparable assignments and permission to contact them Ask about report quality, responsiveness, schedule, budget control, and agency coordination
Continuity and handoff Plan for receiving records, validating prior work, and preserving consultation history Require an initial records review and a written gap list before new fieldwork is authorized

Use a written evaluation matrix so every bidder is judged on the same evidence. Keep mandatory requirements separate from preferences. For example, an agency-mandated qualification is a pass-or-fail condition; a particular software workflow may be a scored preference if it genuinely improves delivery.

Verify qualifications by discipline and role

Secretary of the Interior (SOI) qualification standards address education, training, and experience in specific preservation fields. They are not a general badge for an entire company. Kentucky Heritage Council guidance asks firms submitting reports for review to keep curricula vitae documenting the relevant experience of the qualified professional responsible for fieldwork, reports, recommendations, and curation.

For every proposed discipline lead, verify:

  • Education and concentration relevant to the work, not merely a generic degree title.
  • Training and supervised experience appropriate to the resource type and methods proposed.
  • Comparable work performed personally, including the role and decision authority.
  • Experience producing the report, data, maps, consultation materials, or curation package required here.
  • Any agency-specific training, examination, registration, or approved-person requirement.
  • Current availability for the dates in the proposal.

Do not treat SOI qualification alone as proof of local knowledge, good judgment, responsive communication, or successful past performance. Qualification is a threshold; the project record and references establish whether the person can deliver this assignment.

Check local and agency-specific experience

Local experience can affect access, site conditions, tribal relationships, archival sources, and familiarity with a reviewer’s preferred format. Ask candidates to distinguish between work in the same state, the same county or cultural region, and the same agency program. A firm that has conducted surveys nearby may still lack experience with your undertaking type or review pathway.

For each comparable example, request the project location, resource types, legal trigger, agency, person’s role, deliverables, approximate schedule, and whether the agency accepted the work. “We have worked nationwide” is not a substitute for a relevant example tied to the named staff.

Where consultation is sensitive, ask how the team will protect confidential information, maintain a contact log, document government-to-government communications, and obtain client direction before making commitments. Clarify whether the firm is supporting consultation or is authorized to speak for the client on a particular matter.

Use references as evidence, not ceremony

Contact references who can discuss the exact team and assignment, not only the firm’s general reputation. Ask:

  • Were drafts technically accurate and usable by the reviewer?
  • Did the firm meet agreed milestones, and how did it report slippage?
  • Did the named personnel do the work?
  • How quickly and clearly did the firm answer agency and client comments?
  • Were assumptions and change orders explained before costs were incurred?
  • Did the firm preserve records, consultation commitments, and institutional knowledge when staff changed?

Missouri’s May 2026 consultant directory states that it describes disciplines and services but does not verify qualifications or recommend listed firms. Washington’s Department of Archaeology and Historic Preservation likewise cautions that directory inclusion is not proof that the agency has vetted a professional. Use directories to build a candidate list; perform your own verification before award.

Make the fee comparison meaningful

A low total can reflect omitted tasks, fewer review rounds, junior staffing, or assumptions that do not fit the project. Compare the labor mix and the conditions behind the number. Require bidders to separate:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Base services included in the stated scope.
  • Optional tasks, unit rates, travel, laboratory, curation, and specialty subcontracting.
  • Number of anticipated agency or consultation review rounds.
  • Client-furnished information and access assumptions.
  • Events that trigger a change order, such as expanded boundaries, additional sites, redesign, or new agency requirements.
  • Invoice timing, retainage if any, and payment for accepted portions during a multi-stage transition.

Ask for a written process for notifying you when an assumption is failing. A change-order request should identify the cause, affected deliverables, schedule impact, and alternatives before extra work begins.

Contract for continuity and accountability

The replacement contract should make the handoff measurable. Include a kickoff meeting with the client, outgoing firm if available, incoming team, and agency contact where appropriate. Require an early records review that produces a register of received files, missing items, accepted work, open comments, commitments, and deadlines.

Document the client’s continuing role. Pennsylvania SHPO notes that an agency may delegate compliance responsibilities to a consultant while remaining legally responsible for completing environmental review. The contract can assign preparation and coordination, but it should not imply that the consultant holds the client’s approval authority or legal accountability.

Interview questions for the finalist

  1. Which named person is responsible for each discipline and deliverable, and who supervises that person?
  2. Which education, experience, SOI, state, or agency-specific requirements apply to each role?
  3. What training, examination, registration, or approved-person evidence will you provide before work starts?
  4. Which comparable projects involved this geography, resource type, review agency, and compliance process?
  5. What work will subcontractors perform, and how will you control their quality, records, and continuity?
  6. What assumptions, exclusions, review rounds, schedule dependencies, and fee triggers are included?
  7. What do you need from the incumbent and client to avoid duplicating accepted work or losing consultation history?
  8. Who will communicate with the agency and consulting parties, and which decisions remain with the client?
  9. How will you identify an incomplete record, conflicting prior conclusion, or missed commitment?
  10. What will you deliver during the first transition milestone so the client can see that takeover is under control?

Common replacement mistakes and their fixes

Choosing the corporate name instead of the working team

Why it fails: The firm may have an impressive portfolio while the proposed staff lack the required discipline or local experience.

Fix: Evaluate named personnel, require CVs, and obtain approval rights over substitutions.

Relying on a directory as a qualification check

Why it fails: Government directories can disclaim verification and endorsement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: Treat the listing as a lead, then verify credentials, comparable work, availability, and references independently.

Issuing an underspecified request

Why it fails: Firms price different scopes, making totals impossible to compare and increasing change-order risk.

Fix: Coordinate the scope with the reviewer and state deliverables, boundaries, review cycles, assumptions, and acceptance criteria.

Assuming one jurisdiction’s rules apply everywhere

Why it fails: Oregon DOT’s person-level training and examination requirements illustrate an agency-specific program, not a nationwide rule.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: Ask the responsible reviewer for the requirements that govern this project before award.

Starting over without checking the record

Why it fails: Accepted work may be duplicated while unresolved comments or commitments remain hidden.

Fix: Require a documented records transfer, gap analysis, and agency-confirmed path for unfinished items.

Letting the contract blur legal responsibility

Why it fails: Delegating technical work does not necessarily transfer the client agency’s environmental-review responsibility.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Fix: State approval, decision, consultation, and submission authority explicitly in the contract and project plan.

A practical award checklist

  • The applicable review process and agency contact are confirmed.
  • The current scope, accepted work, open comments, commitments, and deadlines are documented.
  • Several firms received the same performance-based request.
  • The proposal names the people who will perform and supervise each discipline.
  • Credentials and any agency-specific requirements are verified for those people.
  • Comparable local and project-type experience is demonstrated.
  • Subcontractors, deliverables, data formats, review cycles, schedule, and acceptance criteria are explicit.
  • Fee assumptions, exclusions, rates, and change-order triggers are understandable.
  • References have been contacted about quality, responsiveness, schedule, and budget control.
  • The transition plan covers records, data, artifacts, consultation history, commitments, and missing information.
  • The contract preserves the client’s approval and legal responsibilities.

Where professional standards are changing

The Association of Consulting Archaeologists’ December 2023 position supports retaining professional standards while improving clarity, consistency, practical-experience pathways, and recognition of the broader CRM field. An association position is not government policy. Use it as context when discussing qualification pathways, but follow the current requirements issued by the agency with authority over your project.

Because standards, agency programs, and procurement rules can change, obtain the current instruction from the responsible reviewer and contracting authority before issuing the request or signing the replacement agreement.
