How to Choose a Private AI Assistant for Sensitive Work

The safest choice is not the assistant with the strongest “private” marketing claim. It is the exact product and account configuration whose training use, retention, deletion, human and administrator access, connected tools, encryption, contractual terms and regional controls match your threat model. A consumer chat, a company-managed workspace and an API from the same vendor can have materially different rules.

Before anyone pastes confidential material, identify the service context, classify the data, read the applicable terms and admin settings, obtain the required contract or regulatory approval, and test with non-sensitive content. “Not used for training” is only one control: it does not by itself prove that prompts are not logged, retained, reviewed or visible to an administrator.

What “private” must mean for an AI assistant

Privacy is a set of separate questions, not a product category. For each assistant, ask:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Training and improvement: Are prompts, files, outputs or feedback used to train or improve models? Is use the default, an opt-in, or controlled by an administrator? Can a safety review create an exception?
  • Retention: How long are chats, uploaded files, prompts, outputs, search queries and technical logs kept? Are history and logging controls separate?
  • Deletion: What does “delete” remove, when does removal occur, and which legal, safety, abuse-prevention or backup exceptions apply?
  • Access: Can provider personnel inspect content? Can your employer or workspace administrator read conversations, exports or audit logs?
  • Data movement: Do browsing, search, connectors, extensions, agents or third-party tools receive the data under different terms?
  • Security and governance: Is data encrypted? Are single sign-on, multifactor authentication, role-based access, audit logs, data residency and contractual commitments available for your exact plan?

An assistant can satisfy one of these tests and fail another. For example, a service may exclude business prompts from model training while still retaining them for service operation, logging searches, or allowing an administrator to export conversations.

Start with the exact account and product context

Write down the signed-in identity, product name, plan, deployment route and region before comparing privacy claims. Use the following as distinct categories, not interchangeable labels.

Context Questions to record Why it changes the decision
Personal or consumer chat Who owns the account? Are training controls opt-in or opt-out? Are chats, feedback and safety reviews retained? Consumer terms may permit improvement use or longer storage than a commercial agreement.
Organization-managed workspace Which business or education plan? What can administrators see, export or delete? Which retention policy is configured? Workspace controls and employer access can apply even when model training is disabled.
API Which endpoint, model, region and cloud platform? Is zero data retention (ZDR) available and eligible for the specific feature? API logging and ZDR rules are often feature-specific and can differ from an interactive interface.
Regulated deployment Is the use covered by a data-processing agreement, business associate agreement where applicable, residency commitment and internal authorization? A public privacy page is not a substitute for the operative contract or a compliance assessment.

Build a threat model before comparing assistants

  1. Classify the material. Separate public information, internal business data, confidential customer or employee data, trade secrets, credentials, health information, financial records and data subject to export or residency rules.
  2. List realistic recipients. Consider the provider, its support and safety teams, your administrators, connected services, cloud platforms, contractors and anyone who obtains an export or compromised account.
  3. Describe the consequence. A leaked marketing draft is not equivalent to exposed credentials or regulated records. State whether the impact is reputational, financial, legal, operational or personal.
  4. Set a minimum control. Examples include no model-improvement use, a defined deletion window, no administrator content access, a specific country for storage, or a written zero-retention arrangement.
  5. Decide what is prohibited. If policy forbids a category of data in any cloud assistant, do not try to compensate with a privacy toggle.

This exercise prevents a common mistake: choosing a product first and then stretching the threat model to fit its advertising.

Compare the controls that actually matter

Training, feedback and safety review

Find the precise rule for prompts, outputs, files, thumbs-up or thumbs-down feedback and conversations flagged for safety. “Not used for training” can be limited to a named plan, a signed-in work account or foundation-model training; it may not cover abuse detection, human review or product analytics. Record whether a user or administrator can opt in, opt out or restrict particular projects.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Anthropic’s consumer privacy FAQ, dated March 16, 2026, says consumer chats may be used to improve models when a user opts in, when a conversation is flagged for safety review, or through another explicit opt-in. It says Incognito chats are not used to improve Claude. The same page says feedback can cause the related conversation to be stored for up to five years. Those statements apply to consumer products and should not be generalized to commercial products. Read the current wording at Anthropic’s consumer training FAQ.

Retention, deletion and exceptions

Ask separately about chat history, prompt and output logs, uploaded files, abuse-monitoring records, search queries, backups and compliance exports. A deletion promise needs a time period and a scope. Check whether deletion is immediate or scheduled, whether it covers derived logs, and whether law, security, safety or service-protection needs permit longer storage.

For example, OpenAI’s enterprise privacy page says administrators control retention for Enterprise, Edu and Healthcare workspaces, and deleted conversations are removed within 30 days unless legal retention applies. For Business, it says deleted or unsaved conversations are removed within 30 days, subject to longer retention required by law or reasonably necessary to protect services or others. The page also describes API inputs and outputs being retained for up to 30 days for service provision and abuse identification, with zero data retention available for eligible endpoints and qualifying cases. These are different contexts, so do not convert “30 days” into a universal promise. See OpenAI’s enterprise privacy terms.

Anthropic’s API documentation describes six-year retention for some Compliance API activity feeds and session transcripts. That is a distinct compliance and logging context, not a universal chat-retention period. ZDR eligibility is feature-specific; confirm it in the applicable arrangement at Anthropic’s API retention documentation.

Provider, human and administrator access

Determine when provider personnel may inspect content, which teams can do so, whether access is logged, and whether your organization can request records. Then ask what an administrator can see: live chats, deleted chats, files, prompts sent through connectors, exports, usage metadata or audit events. An employee’s expectation of a private conversation may be wrong in a managed workspace.

OpenAI states that Business workspace administrators can view, access, export and delete end-user conversations. That makes administrator permissions a design decision: create appropriate roles, document who may use them, and avoid placing highly restricted material in a workspace whose administrators are not authorized to see it.

Microsoft says work or school Copilot Chat logs prompts, Bing queries triggered by prompts and responses, and that an IT administrator can use Microsoft search and audit tools to view the logged information. Its statement concerns the work or school product and account context, not every product carrying the Copilot name. Read the product-specific explanation at Microsoft’s work or school Copilot Chat privacy page.

Connected tools and data movement

List every path a prompt can take: web search, retrieval connectors, cloud drives, browser extensions, plug-ins, code execution, agents, meeting transcripts and external APIs. For each, identify the recipient, purpose, retention period, location and legal role. A private model does not make a connected search engine or third-party processor private.

Microsoft specifically warns that Bing search operates separately and has different data-handling practices. Anthropic notes that Amazon Bedrock and Google Cloud’s Agent Platform have separate provider policies. Anthropic’s described ZDR arrangement excludes consumer products, Claude Team and Enterprise interfaces (apart from a separate Claude Code Enterprise arrangement), various integrations and some named models or features. Confirm eligibility for the exact route instead of inferring it from a plan name.

Encryption, identity and contractual controls

Look for encryption in transit and at rest, identity federation, MFA, role-based permissions, audit logs, customer-managed retention, residency, incident notification and export or deletion procedures. Ask whether each control is available on your edition and in your region, rather than accepting a platform-wide statement.

OpenAI’s business-data documentation reports AES-256 encryption at rest and TLS 1.2 or higher in transit, retention controls for qualifying organizations and eligible data-residency regions. It also states: “We don’t train our models on your organization’s data by default.” The statement covers the listed ChatGPT Business, Enterprise, Edu, Healthcare, Teachers and API offerings; verify your plan, configuration, eligibility and contract on OpenAI’s business data page.

What the official product statements establish

The table is a starting point for verification, not a privacy ranking. The products use different account types and documentation scopes, so their rows are not a like-for-like laboratory test.

Service context Training or improvement statement Retention and access details Important qualification
OpenAI business offerings and API Business-data documentation says organization data is not used to train models by default, including inputs and outputs for the named business, education, healthcare, teachers and API offerings. AES-256 at rest and TLS 1.2 or higher in transit are reported. Certain workspace conversations and API inputs or outputs can be retained up to 30 days under the separate enterprise-privacy terms. Business administrators can view, access, export and delete end-user conversations. Retention, residency and ZDR depend on plan, endpoint, configuration, eligibility and legal or service-protection exceptions.
Anthropic consumer products Consumer chats may be used for improvement after opt-in, safety flagging or another explicit opt-in; Incognito chats are stated not to be used to improve Claude. Feedback can result in related conversation storage for up to five years. The consumer FAQ does not establish the terms for commercial interfaces or API use.
Anthropic API Retained data is not used for training without express permission under the described arrangements. ZDR exists for eligible arrangements and features. Some Compliance API activity feeds and session transcripts have six-year retention. ZDR does not automatically cover consumer products, Team or Enterprise interfaces, various integrations or all models and features. Bedrock and Google Cloud’s Agent Platform follow separate policies.
Microsoft Copilot Chat for work or school Microsoft says prompts, work content in prompts and responses are not used to train foundation models when the user is signed in with a work or school account. Prompts, Bing queries triggered by prompts and responses are logged; IT administrators can use Microsoft search and audit tools to view them. Bing has separate data-handling practices. Confirm that the user is in the work or school product, not a different Copilot experience.

A practical six-step selection process

  1. Write the data and threat model. Name the sensitivity category, possible recipients and consequence of disclosure. Include whether a human reviewer, administrator or connected service is an unacceptable recipient.
  2. Check organizational permission. Ask security, privacy, compliance or a data owner whether that category may be entered into the proposed assistant. A technical control cannot override a prohibition.
  3. Identify the complete configuration. Record product, plan, account identity, region, model, API or interface, enabled features and every connector. Capture the date because vendor documentation changes.
  4. Read operative terms and settings. Save the relevant privacy notice, DPA, BAA where applicable, retention schedule, residency commitment and administrator policy. Document training use, safety and legal exceptions, provider access, administrator access, logs and subprocessors.
  5. Obtain written assurance for high-risk work. Ask procurement, security and legal for contractual commitments, audit evidence and any required ZDR arrangement. A marketing page cannot replace the agreement governing your data.
  6. Run a controlled pilot. Start with synthetic or already-public material. Verify account identity, history controls, exports, deletion behavior, connector permissions and audit records before authorizing real sensitive data.

Configure the assistant for least exposure

  • Use organization-managed identities rather than personal accounts for company work.
  • Enable SSO and MFA, limit administrator roles, and review membership and service accounts regularly.
  • Disable connectors, browsing and agent actions unless each destination is approved. Grant the minimum folders, repositories and scopes required.
  • Set the shortest approved history and retention period, but confirm what technical and compliance logs remain outside chat history.
  • Separate projects or workspaces by sensitivity so an administrator or connector authorized for one category cannot automatically reach another.
  • Establish a deletion and incident process: who can request removal, who confirms it, what evidence is retained and how a compromised token is revoked.
  • Train users not to paste passwords, private keys, unrestricted customer exports or regulated records into an unapproved interface. Redaction and minimization reduce exposure but do not replace authorization.

Test the claims without using sensitive content

A pilot should answer observable questions while using fictional names and synthetic files:

  1. Sign in with the intended identity and confirm the displayed plan and tenant.
  2. Submit a harmless marker, then check chat history, activity dashboards and available export tools.
  3. Use the deletion control and record the stated completion window; check whether the marker remains in search, audit or compliance views.
  4. Send a second marker through each proposed connector and determine which service receives it.
  5. Ask an authorized administrator to verify what can be viewed, exported and audited. Do not assume a user-level setting overrides administrator policy.
  6. Review provider documentation and contract language against the observed configuration. Escalate any mismatch before production use.

Common mistakes and how to correct them

Mistake: treating “no training” as “no storage”

Correction: obtain separate answers for model improvement, operational logs, safety review, deletion and backups. Record the retention period and exceptions for each data type.

Mistake: comparing plan names instead of features

Correction: compare the exact account, interface, endpoint, model and connector. ZDR, residency and retention controls may be unavailable for a neighboring product or feature.

Mistake: ignoring the employer’s visibility

Correction: ask what administrators can inspect or export and whether audit tools include prompts, responses, searches and files. Tell users that a managed workspace is not necessarily a private diary.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Mistake: assuming deletion erases every copy immediately

Correction: look for legal, abuse-prevention, safety, backup and compliance exceptions. Treat a stated 30-day or five-year period as tied to its exact context, not as a universal standard.

Mistake: overlooking search and integrations

Correction: make a data-flow inventory. Approve each processor, destination, permission scope, retention policy and geographic route independently.

Mistake: using a public privacy page as the contract

Correction: obtain the DPA, BAA where relevant, residency and audit commitments, and written ZDR terms if required. Have the appropriate internal authority approve the final configuration.

A decision rule for sensitive work

Choose an assistant only when every required control is true for the exact deployment: the organization permits the data category; training and improvement use match policy; retention and deletion are acceptable; provider and administrator access are authorized; connectors and searches are mapped; encryption and identity controls are enabled; and contractual, regulatory and regional requirements are documented. If one material answer is unknown, keep sensitive content out and use a non-sensitive pilot while the gap is resolved.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

There is no defensible market-wide privacy ranking from the official statements above. The right choice depends on your jurisdiction, contract, configuration, model and feature eligibility, and the consequences of disclosure. Recheck volatile vendor pages and settings before each major deployment or policy change.

Frequently Asked Questions

Can my employer or the provider see my AI chats?

Possibly. In a managed workspace, administrator permissions and audit tools may expose conversations, prompts, responses or exports; providers may also permit limited human access for safety, abuse prevention or support. Confirm the exact product policy and administrator settings before entering confidential material.

Does turning off model training delete my conversations?

No. Training use and storage are separate controls. A service can stop improvement use while retaining chats or logs for operations, safety, legal compliance or a configured history period. Check the deletion scope, timing and exceptions independently.

Is zero data retention automatic with an API plan?

No. ZDR is generally limited to eligible arrangements, endpoints, models and features. Confirm eligibility and obtain the applicable written terms; integrations and alternate cloud platforms may follow separate policies.
