How to Choose a HIPAA-Compliant AI Platform for a Healthcare Organization

Choose a HIPAA-compliant AI platform by starting with the workflow and data, not a vendor’s marketing label. Identify every place protected health information (PHI) will go, determine which providers are business associates, execute the right business associate agreements (BAAs), verify the exact products and features covered, and then validate your configuration and governance. A BAA or “HIPAA compliant” badge does not make your application compliant.

The best platform is the one whose contractual scope, technical controls, integration model, operational resilience, and governance requirements fit your documented risk analysis. No official source establishes a universal winner among AWS, Microsoft Azure, Google Cloud, OpenAI, or any other provider.

What HIPAA requires from an AI platform

HIPAA applies to covered entities—such as healthcare providers, health plans, and clearinghouses—and to business associates that handle PHI for them. A technology company becomes a business associate because of what it does with PHI on your behalf, not because it uses a particular product category or calls itself “HIPAA ready.”

The U.S. Department of Health and Human Services (HHS) specifically describes an AI chatbot on a provider’s patient portal as a potential business associate when it performs PHI-related symptom assessment, reminders, or scheduling. A cloud provider that stores or processes electronic PHI (ePHI) can also be a business associate even when the data is encrypted and the provider cannot decrypt it. In that situation, the BAA and applicable HIPAA obligations still apply.

The HIPAA Security Rule requires reasonable and appropriate administrative, physical, and technical safeguards. It is technology-neutral and scalable: the controls should reflect your organization’s size, structure, capabilities, and risks rather than a prescribed cloud architecture or a certification badge. Your organization remains responsible for its own risk analysis, policies, configuration, workforce practices, and continuing evaluation.

Start with the use case and data boundary

Write down the intended workflow before comparing platforms. “Generative AI” is too broad for procurement. A documentation assistant, patient-portal chatbot, internal knowledge search, analytics pipeline, care-coordination tool, and administrative summarizer create different risks and integration requirements.

Define the task and users

  • Name the business or clinical task and the people who may use it.
  • State whether the system gives information, drafts content, recommends an action, or takes an action in another system.
  • Identify required human review, approval, and escalation points.
  • Document accuracy, latency, availability, language, accessibility, and audit requirements.

Inventory every data element

Determine whether identifiable PHI or ePHI enters prompts, uploaded files, embeddings, model inputs, model outputs, application databases, logs, monitoring systems, support tickets, backups, or connected tools. Include data created by the model: a generated summary can contain PHI even if the original prompt did not.

Also identify indirect identifiers, free-text notes, images, audio, device data, and metadata. A workflow that appears administrative may still involve PHI once it connects to a patient record or portal. Separate test data from production data and prohibit production PHI in testing unless the use has been assessed and covered contractually.

Clinical safety, FDA oversight, state privacy laws, professional-practice rules, and records-retention requirements depend on the particular use case. HIPAA analysis does not answer those questions by itself; assign them to the appropriate legal, compliance, clinical, and security owners.

Map the complete vendor and subcontractor chain

Do not assess only the model company. Draw a data-flow diagram from the user interface to every service that creates, receives, maintains, or transmits PHI.

Include these components

  • Cloud hosting, virtual machines, containers, and serverless functions.
  • Model APIs, managed model platforms, fine-tuning or customization services, and retrieval systems.
  • Object storage, databases, vector stores, caches, queues, and backups.
  • Identity providers, single sign-on, key-management systems, and network services.
  • Orchestration, connectors, electronic health record integrations, analytics, monitoring, and logging.
  • Customer support channels, remote administration, incident-response tooling, and subcontractors.

HHS treats cloud providers and downstream subcontractors that handle ePHI for a regulated organization as potential business associates. Encryption, including a design in which the provider cannot see the key, does not automatically remove business-associate duties. Every downstream party that receives PHI needs appropriate contractual coverage before data is sent.

Secure the BAA and contract before production use

A BAA is necessary when a provider is acting as your business associate, but it is not a compliance certificate for your application. Read the BAA together with the service terms, product documentation, data-processing addendum, and service-level agreement.

Contract questions to resolve

  • Are the legal parties correctly named, and does the agreement cover the healthcare entity, affiliates, and the exact purchasing account?
  • Which products, regions, endpoints, model features, storage services, and support channels are in scope?
  • What uses and disclosures are permitted? Is provider training, customization, abuse monitoring, or human review allowed for your data?
  • What security-incident and breach notifications are required, by whom, and within what time?
  • Which safeguards does the provider operate, and which must your organization configure?
  • Can you obtain, amend, or delete records when required? What happens to backups and replicated copies?
  • What are the retention and deletion rules at termination, suspension, or account closure?
  • Which subcontractors may access PHI, where are they located, and how are changes communicated?
  • Do availability, maintenance, support-access, and service-level provisions conflict with HIPAA duties or your continuity plan?

HHS advises customers using cloud services to understand the cloud environment, perform their own risk analysis and risk management, and ensure that the service-level agreement is consistent with the BAA and HIPAA requirements.

Verify exact product and feature eligibility

Never infer that an entire company or brand is covered because one service is listed as eligible. Eligibility can vary by product, endpoint, region, retention mode, account type, and connected feature. Recheck the provider’s current documentation whenever you add a model, connector, storage system, or major feature.

AWS

Amazon Bedrock and Bedrock AgentCore appear in the AWS HIPAA Eligible Services Reference, which was last updated September 3, 2026. AWS requires customers to have an AWS BAA before using listed services with PHI and states that customers remain responsible for configuring services consistently with HIPAA. Confirm that every adjacent service in your architecture is covered; an eligible model service does not automatically cover your logs, databases, monitoring, or third-party integrations.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Microsoft Azure

Microsoft states that its HIPAA BAA is provided through Product Terms and the Data Protection Addendum for covered customers and services. Microsoft also states that the BAA does not automatically make a deployed solution compliant and that it does not inspect or approve customer applications. The referenced documentation was last updated April 6, 2023, so procurement teams should verify the current contract, service list, and feature conditions before signing.

Google Cloud

Google Cloud requires customers to review and accept its BAA and use services identified as in scope. Google places responsibility for building the compliant solution and implementing required controls on the customer. Validate the precise services used for model calls, storage, identity, logging, data processing, and support rather than relying on a general cloud-level statement.

OpenAI

OpenAI states that an executed BAA is required before using its API with PHI. API use also requires Modified Retention unless a documented exception applies. OpenAI lists specific HIPAA-eligible products and functionality and warns that availability of a feature does not establish BAA coverage for a connected third-party service. Check the live eligibility terms for the exact API, account configuration, retention mode, and tools you intend to use.

These provider examples are evaluation inputs, not endorsements or a complete market survey. Availability, contract language, and feature scope can change; preserve the version and date of the evidence used in your procurement file.

Build a requirements matrix

Use the same questions for every shortlisted platform. Mark each item as provider-controlled, customer-configured, shared responsibility, or unresolved. Require written evidence for “yes” answers.

Comparison axis Evidence to request or verify
BAA scope Signed or accepted BAA, correct contracting parties, and named covered services and features.
PHI data path Prompts, files, inputs, outputs, logs, support channels, connectors, storage, backups, regions, and subprocessors.
Safeguards and configuration Role-based access, least privilege, authentication, encryption, key management, audit logs, incident response, and the controls your team must operate.
Retention and deletion Service-record retention, training or customization data, log retention, backup handling, deletion controls, and termination procedures.
Workflow and integration Fit with the intended clinical, operational, or administrative task; APIs, identity integration, data export, human review, and precise service scope.
Governance and evidence Risk-analysis artifacts, audit reports, change notifications, configuration history, approval workflow, ownership, and escalation contacts.
Commercial and operational burden Pricing model, implementation effort, regional requirements, support model, availability targets, recovery options, and staffing needs.

Pricing and performance are highly architecture- and usage-dependent. The available evidence does not establish comparable prices, latency, or reliability rankings, so obtain a workload-specific quote and test plan during procurement rather than treating a public estimate as a guarantee.

Validate technical and operational safeguards

Identity and access

  • Use unique user identities, strong authentication, and single sign-on where appropriate.
  • Apply least privilege separately to end users, developers, service accounts, support staff, and automated agents.
  • Separate development, test, and production accounts and restrict production PHI from lower environments.
  • Review access regularly and revoke it promptly when roles change.

Data protection and isolation

  • Confirm encryption in transit and at rest, key ownership, rotation, and recovery procedures.
  • Use private connectivity or network isolation when the risk analysis requires it.
  • Restrict outbound connections and connectors to approved destinations.
  • Understand whether prompts and outputs are retained, indexed, used for customization, or exposed to support personnel.

Logging, monitoring, and incident response

  • Capture administrative actions, authentication events, data access, model calls, configuration changes, and connector activity without creating unnecessary PHI copies in logs.
  • Define alert thresholds, investigation ownership, evidence preservation, and breach-assessment procedures.
  • Confirm how the provider reports security incidents and how your team obtains relevant records.
  • Test alerting and escalation before production launch.

Resilience and recovery

  • Set recovery objectives for the workflow and verify backup, restore, regional-failure, and provider-outage procedures.
  • Document a manual or alternate process for patient care and critical operations.
  • Test restoration and failover; do not assume a provider’s availability statement equals your application’s resilience.

AWS describes capabilities including encryption, identity-based policies, PrivateLink, monitoring, and CloudTrail. Those are provider features, not proof that your deployment is configured correctly. Validate the resulting controls against your risk analysis and retain configuration evidence.

Compare workflow and governance fit

Security controls are necessary but not sufficient. Run the same representative tasks on each candidate using approved, de-identified or synthetic data until contractual coverage is complete. Measure whether the platform supports your real process without creating hidden data copies or manual workarounds.

Questions for workflow evaluation

  • Can it integrate with the systems clinicians or staff already use without duplicating records?
  • Can a qualified person review, edit, approve, and trace generated content before it affects a patient or record?
  • Are model selection, prompts, system instructions, retrieval sources, and output versions controlled and auditable?
  • What happens when the model is unavailable, uncertain, biased, or produces an unsafe answer?
  • Can administrators limit use by department, role, data type, geography, or feature?
  • How are model, endpoint, connector, and retention changes approved and communicated?

Assign named owners for security, privacy, clinical safety, procurement, user training, incident escalation, vendor management, and periodic reassessment. The HIPAA Security Rule calls for regular evaluation; treat a new model, connector, data source, or retention setting as a change requiring review.

A practical selection procedure

  1. Write the use-case brief. Describe the task, users, intended output, human review, systems involved, regions, and acceptable failure modes.
  2. Classify the data. Mark every input, output, log, embedding, attachment, backup, and support artifact as PHI, sensitive non-PHI, or approved test data.
  3. Draw the data-flow map. Include the application, model service, cloud account, storage, identity, monitoring, connectors, support paths, and subprocessors.
  4. Determine business-associate relationships. Use the actual functions performed, including storage-only or encrypted processing, and identify every downstream recipient.
  5. Collect contractual evidence. Obtain the BAA, service terms, product list, data-processing terms, retention rules, incident process, subcontractor information, and service-level agreement.
  6. Check product eligibility. Match every API, model, endpoint, region, feature, connector, and retention mode to the provider’s current in-scope documentation.
  7. Complete the risk analysis. Evaluate confidentiality, integrity, availability, misuse, re-identification, model error, prompt injection, unauthorized access, and operational failure.
  8. Score shared responsibilities. For each required control, record whether the provider supplies it, your team configures it, or both must operate it.
  9. Run a controlled pilot. Use approved data, enforce access controls, log activity, test human review, measure workflow outcomes, and exercise incident and outage procedures.
  10. Approve production and reassess. Obtain sign-off from privacy, security, legal, clinical, and operational owners; then schedule reviews after material changes and at a defined recurring interval.

Common mistakes and how to avoid them

Treating a badge as a risk analysis

“HIPAA certified” or “HIPAA compliant” marketing language does not replace your risk analysis, BAA, configuration review, policies, or monitoring. Require evidence tied to your actual workflow.

Checking only the model vendor

Storage, logs, identity, analytics, support, connectors, backups, and subcontractors can all handle PHI. Include them in the data-flow and contract review.

Assuming encryption removes HIPAA duties

A provider that maintains encrypted ePHI may still be a business associate even without access to the decryption key. Analyze the function performed and execute the required agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Assuming every feature shares one coverage boundary

Eligibility is service- and feature-specific. A covered API may not cover a plug-in, third-party connector, logging product, or new agent capability.

Leaving configuration to the vendor

Cloud and AI providers can supply strong controls, but your organization chooses permissions, retention, network paths, prompts, integrations, monitoring, and user policy. Document and test those decisions.

Ignoring operational and clinical failure

An answer can be technically secure and still unsafe or unusable. Define human review, correction, escalation, downtime, model-change approval, and record-reconciliation procedures before launch.

Procurement checklist

  • Use case and data inventory approved.
  • Complete data-flow diagram, including subprocessors and support access.
  • Business-associate determination documented for every relevant provider.
  • BAA executed before PHI enters production.
  • Exact products, features, endpoints, regions, and retention modes confirmed as in scope.
  • Access, encryption, keys, logging, deletion, backup, and network controls configured and tested.
  • Incident notification, evidence access, and escalation contacts documented.
  • Human review, clinical-safety, downtime, and rollback procedures approved.
  • Training, acceptable-use rules, and periodic evaluation scheduled.
  • Change-control trigger defined for new models, connectors, data sources, and contract changes.

Bottom line

Choose the platform that can be contractually covered and demonstrably governed for your specific workflow. Start with the PHI boundary, map the entire service chain, verify the exact eligible features, implement shared controls, and keep evaluating the deployment. A provider’s BAA and security features are inputs to compliance—not a substitute for the healthcare organization’s own safeguards and accountability.
