How to Choose a European Cloud Provider for Privacy, Compliance and Portability

By Freedom251 Team · · 12 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Choose a European cloud provider by scoring the exact service—not by accepting “European” as a compliance label. Confirm where production data, backups and support records are handled; who owns and controls the provider; which laws and access procedures apply; what security and privacy evidence covers your workload; and whether you can export, restore and operate the workload elsewhere. Then put those requirements, test results and exit assistance into the contract.

The European Commission’s cloud-sovereignty work and its 2026 procurement provide useful starting points, but neither is a universal product ranking. A provider can satisfy a sovereignty requirement for one service and scope while a different service, region, subprocessor or contract fails your requirements.

Start by defining what “European” must mean for your workload

“European cloud” can describe several different properties. Write each one as a measurable procurement requirement before you look at provider names. The relevant questions are location, ownership and control, legal jurisdiction, operations, technology supply chain and technical suitability.

Data location

Specify the country or region required for each copy of data, not just the provider’s headquarters. Include production storage, replicas, backups, disaster-recovery copies, logs, telemetry, support tickets and temporary files. Ask whether a service can guarantee those locations contractually and whether a failover event changes them.

Ownership and control

Identify the contracting entity, its parent companies and who can direct the operation. A provider incorporated in Europe may have non-European ownership or dependencies. Conversely, a service using non-European technology may still be operated by European companies under controls that satisfy a particular sovereignty framework. Treat ownership, control and technology origin as separate tests.

Legal jurisdiction and lawful access

Record which company signs the contract, where it is established and which courts and laws govern it. Ask how the provider receives, challenges and reports government or law-enforcement requests, and what notice is possible. EU location does not by itself remove every foreign-law or national-security question.

Operational control

Find out who administers the platform, where privileged staff work, how remote support is approved and whether customer data or metadata can be viewed during troubleshooting. Require a current subprocessor and support-access list, with notice and objection procedures for changes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Technology and supply chain

Map critical dependencies: hypervisors, hardware, identity systems, key-management services, networking, observability, managed databases and support tools. A sovereign objective may concern control of the whole chain, not merely the data-centre address. Ask the provider to identify material non-EU dependencies and the controls that limit their access or failure impact.

Workload fit

Define the compute, storage, database, network, availability, latency, support and recovery capabilities your application actually needs. No sovereignty label substitutes for evidence that the exact service can meet those requirements. Require service-specific documentation rather than a group-level brochure.

The Commission’s 2026 Cloud Sovereignty Framework is useful because it assesses strategic, legal and jurisdictional, data and artificial-intelligence, operational, supply-chain, technological, security and compliance, and environmental objectives. Use those categories as a checklist, but perform your own risk assessment for the workload.

Does EU data residency make a service GDPR compliant?

No. Keeping servers in the EU can help satisfy a location requirement, but GDPR compliance depends on the processing operation, roles, instructions, safeguards, people, subprocessors, retention and incident handling. The customer remains responsible for deciding whether the proposed processing is lawful and appropriately governed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Classify the data before selecting a region

Separate personal data, non-personal data and mixed datasets. EU guidance describes personal data as information relating to an identified or identifiable person. Mixed datasets are common; where personal and non-personal parts are inextricably linked, the GDPR rules apply to the dataset in the circumstances described by the guidance.

BUFFALO LinkStation 210 2TB 1-Bay NAS Network Attached Storage with HDD Hard Drives Included NAS Storage that Works as Home Cloud or Network Storage Device for Home
  • Value NAS with RAID for centralized storage and backup for all your devices. Check out the LS 700 for enhanced features, cloud capabilities, macOS 26, and up to 7x faster performance than the LS 200.
  • Connect the LinkStation to your router and enjoy shared network storage for your devices. The NAS is compatible with Windows and macOS*, and Buffalo's US-based support is on-hand 24/7 for installation walkthroughs. *Only for macOS 15 (Sequoia) and earlier. For macOS 26, check out our LS 700 series.
  • Subscription-Free Personal Cloud – Store, back up, and manage all your videos, music, and photos and access them anytime without paying any monthly fees.
  • Storage Purpose-Built for Data Security – A NAS designed to keep your data safe, the LS200 features a closed system to reduce vulnerabilities from 3rd party apps and SSL encryption for secure file transfers.
  • Back Up Multiple Computers & Devices – NAS Navigator management utility and PC backup software included. NAS Navigator 2 for macOS 15 and earlier. You can set up automated backups of data on your computers.

EU rules generally allow storage and processing anywhere in the EU. National laws can create limited exceptions on public-security grounds, so check the countries involved and any sector-specific rule that applies to your organization. A “EU-only” setting is not a substitute for that legal analysis.

Request evidence for the exact service

For every shortlisted service, obtain and review:

  • the data-processing agreement, controller/processor roles and processing instructions;
  • production, backup, disaster-recovery, log and support-data locations;
  • the complete subprocessor list, change-notice process and transfer safeguards;
  • privileged-access, remote-support and customer-approval procedures;
  • independent security, audit and penetration-test evidence, including scope and date;
  • retention, deletion, return and legal-hold terms;
  • incident notification timelines, contact paths and cooperation duties; and
  • the process for handling lawful authority requests and notifying the customer where permitted.

Read the exclusions and service boundaries. A certification or framework score may cover infrastructure while excluding a managed database, support operation or marketplace component that your application uses.

Account for cross-border access

The European Commission says the Data Act does not prohibit cross-border data flows. It provides safeguards for access requests by foreign public bodies to non-personal data held in the Union and describes measures such as encryption and audits. That is not a promise that data can never be accessed from abroad. Ask which data is encrypted, who controls the keys, where administrators are located and how an exceptional request is assessed.

Use the Cloud Sovereignty Framework without overreading its levels

The Commission’s June 2026 explanation says the framework combines a Sovereignty Effectiveness Assurance Level (SEAL) with an overall score based on 48 specific criteria in eight categories. Its thresholds distinguish:

Level What the Commission associates with it How to use it in procurement
SEAL-2 Data sovereignty Check that the assessed scope addresses your locations, access and legal requirements.
SEAL-3 Technological autonomy Examine operational control, dependencies and the precise technology and service boundaries.
SEAL-4 Full sovereignty Demand evidence for every relevant criterion; do not infer that an entire provider portfolio has this level.

These are framework levels, not proof that every product from a provider is suitable or certified. Ask which criteria were assessed, the evidence date, audit scope, exceptions, dependencies and the service version covered. The Commission encourages public and private organizations to use the framework to strengthen digital sovereignty and resilience; it remains your responsibility to connect the assessment to your threat model and contract.

The Commission’s cloud policy information also describes work on a European cybersecurity certification scheme for cloud services (EUCS). Treat that as development status, not as a finalized certificate held by every provider. Verify the current scheme status and the actual certificate, scope and validity period before relying on it.

What the 2026 EU Commission procurement tells you—and what it does not

In April 2026, the Commission announced four contracts or provider groupings for EU institutions and related Union entities. The named groupings were:

Provider grouping named by the Commission Reported SEAL level in the awarded scope Interpretation for a private or public buyer
Post Telecom with CleverCloud and OVHcloud SEAL-3 Investigate the exact services, regions, operating model and evidence; the award is not a portfolio-wide rating.
STACKIT SEAL-3 Request service-level scope, dependencies, contract terms and current assurance documents.
Scaleway SEAL-3 Validate the specific workload’s location, support access, resilience and export path.
Proximus with S3NS, Clarence and Mistral SEAL-2 Check which components are included and whether data-sovereignty evidence meets your requirement.

The Commission reported that eligible providers had to reach SEAL-2. It also said the Proximus environment uses technology based on Google Cloud and is operated exclusively by EU companies. This illustrates that non-European technology can meet a minimum sovereignty level under an appropriate framework; it does not settle every jurisdiction, supply-chain or portability question.

The procurement is a current, evidence-backed shortlist for investigation, not a universal league table. It does not establish that every listed service is available in every country, has identical controls, is GDPR-compliant for every processing activity, or offers the right price, latency or uptime for your workload. Confirm the service, region, contracting entity, scope and evidence at the date you sign.

Build a provider scorecard that can survive procurement review

Score only after defining pass/fail requirements. A weighted score can help compare finalists, but a provider that fails a mandatory legal or location requirement should not win by compensating with a high feature score.

Axis Evidence to compare Typical decision question
Location Named regions; production, backup, log, support and recovery locations; national restrictions. Can every required copy remain in the permitted geography during normal and failover operations?
Legal and jurisdictional control Contracting and parent entities; governing law; access-request and challenge procedures. Who can be compelled to act, and what can the provider disclose to us?
Privacy and compliance Processing terms, subprocessors, purposes, security evidence, retention and incident clauses. Does the evidence cover our processing and the exact service, not merely the company?
Sovereignty and supply chain Framework criteria and level, operating control, non-EU dependencies, exceptions and evidence date. Which dependencies could change the risk or invalidate the claimed level?
Technical fit Compute, storage, databases, networking, APIs, support, performance and recovery capabilities. Can the service meet our workload’s measured requirements?
Portability Export completeness, formats, interfaces, dependencies, tested restore, assistance and exit terms. Can we operate the application elsewhere within the required time?
Resilience Failure domains, redundancy, backups, recovery objectives and tested failover. What happens when a zone, region, identity system or provider control plane fails?
Total cost and contract Usage, support, transfer, assistance, minimums, notice, price-change and switching terms. What will normal operation and an emergency exit cost on the transaction date?
Sustainability Energy and environmental evidence relevant to your policy; the framework includes environmental sustainability. Can the provider document the measures your organization must report?

Mark each row as verified, partially verified, unverified or failed. Attach the document title, version, date, owner and affected service. This prevents a marketing statement about a provider group from being mistaken for evidence about your purchased SKU.

How to assess portability before signing

Portability is both a legal right and an engineering property. The Data Act’s cloud-switching chapter applies to providers of data-processing services, including cloud and edge services. The Commission says switching data includes customer input and output data and associated metadata generated through use, subject to exclusions for provider intellectual property and trade secrets.

Understand the service model

For SaaS and PaaS, providers must make open interfaces available and, at minimum, export data in a commonly used, machine-readable format. For IaaS, providers must facilitate materially comparable outcomes for shared features when a customer switches to a service of the same type; the Commission gives movement across virtualization technologies as an example. Providers must remove obstacles to switching or using multiple services at the same time.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Those obligations do not make every workload one-click portable. A database export may omit indexes, extensions or transaction behavior. An object-store copy may not reproduce lifecycle rules. A managed identity service, queue, observability pipeline or proprietary API can require redesign even when the underlying data is downloadable.

  • Value NAS with RAID for centralized storage and backup for all your devices. Check out the LS 700 for enhanced features, cloud capabilities, macOS 26, and up to 7x faster performance than the LS 200.

  • Back Up Multiple Computers & Devices – NAS Navigator management utility and PC backup software included. NAS Navigator 2 for macOS 15 and earlier. You can set up automated backups of data on your computers.

Inventory dependencies

  • List every managed database, cache, queue, search engine, identity integration, API gateway, scheduler, logging and monitoring service.
  • Record proprietary APIs, infrastructure-as-code resources, network policies, encryption-key dependencies and vendor-specific data formats.
  • Identify data that is generated by the service, including metadata, audit trails, version history and configuration.
  • Map external connections, DNS, certificates, secrets, software licenses and user-device assumptions.

Request and inspect an export

Ask for a representative export, not a statement that export is supported. Document schemas, metadata, timestamps, permissions, encryption keys, audit logs, deleted records and objects that are excluded as intellectual property or trade secrets. Check whether the format is documented and whether an independent tool can read it.

Restore somewhere else

Create a separate environment and restore representative production data. Run application tests, reconciliation checks and security controls. Measure transfer volume, preparation time, downtime, reconfiguration, data transformation, validation and any manual work. Test an alternate service that supports the required behavior, not merely one that accepts a file.

Maintain an exit runbook

Assign an owner, define a recovery cadence and set a maximum acceptable time for migration. Keep current architecture diagrams, export scripts, infrastructure definitions, credentials and dependency maps outside the provider. Re-test after major application, provider or regulatory changes.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The Interoperable Europe Portal identifies low interoperability and portability as mechanisms that can lock customers into a provider. A contractual export right is therefore not equivalent to an operationally tested migration.

Put switching rights and assistance in the contract

Before signature, negotiate clauses that answer these questions:

  • What data, metadata, configurations and logs will be returned, in which formats and through which interfaces?
  • How much notice is required, how long does the export window remain open and can the provider throttle it?
  • What migration assistance, documentation, engineering hours and response times are included?
  • Which charges apply to transfer, support, conversion, storage during the exit and deletion certification?
  • When are replicas, backups and support copies deleted, and how is deletion evidenced?
  • What happens if the provider suspends service, suffers an outage or changes a subprocessor during migration?
  • Can you run two providers in parallel, and are there technical or contractual limits?
  • How will price, service, region, subprocessors and terms change during the contract?

The Commission describes the Data Act’s objective this way: “The Data Act will make switching free, fast and fluid.” It also states: “All providers are required to remove obstacles that their customers may face when they want to switch to another provider or use several services at the same time.” These statements describe the policy direction and obligations; your architecture and contract still determine how difficult your particular move will be.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Support on Ko-Fi

Understand the switching-charge timetable

The Commission says switching charges, including egress charges, will be entirely removed from 12 January 2027. Until that date, EU guidance allows limited switching or egress costs subject to the stated limitation that they reflect the provider’s costs of enabling the switch. Check the law and contract effective on the date of your transaction; do not assume that every transfer is already free.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Budget separately for engineering work, data transformation, parallel operation, testing, new licenses, temporary storage and specialist assistance. Removal of a provider fee does not remove those workload costs.

Check resilience, security and operations alongside sovereignty

A location promise is incomplete without recovery evidence. Ask for the service’s failure domains, redundancy model, backup frequency, recovery-point and recovery-time objectives, restoration procedures and recent failover-test scope. Confirm whether backups are encrypted, immutable where required and stored in the same permitted geography.

Review identity and privileged-access controls, key ownership, hardware-security modules, vulnerability management, patch windows, logging, alert delivery and incident escalation. Determine which controls are customer-managed and which are provider-managed. A high sovereignty level cannot compensate for an untested recovery process or an identity design that leaves administrators with excessive access.

Use a repeatable selection process

  1. Write the workload profile. List data classes, users, regulators, regions, recovery objectives, integrations, service dependencies and mandatory certifications or contractual controls.
  2. Set non-negotiable gates. Define permitted locations, legal entity, access model, retention, incident terms, minimum recovery capability and export requirements.
  3. Create a longlist. Include the Commission procurement groupings as candidates where relevant, plus other providers that can supply evidence for your gates.
  4. Issue the same evidence request. Require service-specific documents, scope, dates, exceptions, subprocessors, locations and contract terms from every candidate.
  5. Run a portability proof. Export, restore and test representative data and application functions in an independent environment.
  6. Score the finalists. Use the comparison axes, record uncertainty and reject any candidate that fails a mandatory gate.
  7. Negotiate the exit. Attach the export specification, assistance plan, deletion evidence, notice periods and charge rules to the agreement.
  8. Approve and re-test. Name an evidence owner and repeat location, access, subprocessor, security and migration checks after material changes.

Common mistakes that produce a false sense of sovereignty

Choosing a headquarters instead of a service

A European registered office does not prove EU-only operations, support or data handling. Require region and access evidence for the SKU you will buy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Treating a framework level as a blanket certification

SEAL levels and scores apply to an assessed scope. They do not automatically cover every product, region, subprocessor or future version.

Equating encryption with jurisdictional control

Encryption reduces exposure, but ask who controls keys, who can administer the system and how lawful requests are handled.

Testing only a data download

A successful export can still leave you dependent on proprietary APIs, identity, queues, schemas or operational tooling. Restore and run the application elsewhere.

Assuming legal switching rights eliminate lock-in

Rights to open interfaces and machine-readable data improve the baseline, but service-specific behavior and architecture determine the engineering effort.

Using preliminary market statements as product evidence

The Commission’s June 2026 preliminary DMA statement identifies AWS and Azure as the largest and second-largest cloud-computing services in the EU and discusses possible gatekeeper designation. That is a preliminary, market-level characterization—not a finding about privacy, compliance or portability for an individual workload.

What a defensible decision record contains

Keep a decision file that another reviewer can reproduce. It should contain the workload and data map; mandatory requirements; provider responses; contracts and processing terms; region and subprocessor evidence; framework or audit scope; portability test results; recovery-test results; cost assumptions; unresolved risks; accepted exceptions; and the person responsible for revalidation.

This record lets a procurement team explain why a provider was selected without claiming that “European” alone proves compliance. It also gives engineering a concrete exit plan instead of an unenforceable promise to migrate someday.

Product prices and availability are accurate as of the date/time indicated and are subject to change. Any price and availability information displayed on Amazon at the time of purchase will apply.
