Choose a cryptocurrency exchange by checking the exact legal entity that will serve you, what its contract says about custody and customer assets, how you can secure and recover your account, and whether you can withdraw when you need to. No registration, security feature, insurance claim, or proof-of-reserves report guarantees that your crypto is safe or available. Compare the same evidence across providers, and treat keeping crypto on an exchange and taking self-custody as different choices with different risks.
Start with the entity and service that will actually hold your assets
A brand may use different legal entities in different countries, and one entity may offer several services with different terms. Before depositing, identify the company named in the account agreement, where it is established, and which entity provides the specific trading or custody service you plan to use. Check the relevant regulator’s official register where applicable, and confirm that the listing covers that entity and service.

Authorization or registration is evidence of a particular legal status—not a universal safety score or a guarantee against loss. Protections vary by country, product, and the rules applying to the provider. A familiar brand name alone does not tell you which contract governs your account.

Read the custody terms before you compare security claims
In exchange custody, a provider or its custodian controls the private keys needed to move crypto. That can make trading convenient, but access depends on the provider’s systems and continued operation. The SEC’s Investor.gov retail custody bulletin describes the trade-off: third-party custody exposes access to risks such as hacking, shutdown, or bankruptcy, while self-custody makes the owner responsible for protecting keys and recovery information.

Look in the custody agreement, account terms, and asset-use policy for specific answers—not only reassuring labels such as “secure storage.” Establish what rights you have to the assets and what happens if the provider becomes insolvent. In particular, check:
- Whether customer assets are segregated from the provider’s own assets, and how the provider records each customer’s position.
- Whether the provider can lend, pledge, rehypothecate, or otherwise use deposited crypto for its own account; whether consent is required; and whether opting in changes your rights or risks.
- Whether assets are held by the exchange itself or a subcontracted custodian, and which entity is responsible for safeguarding and returning them.
- How the agreement describes ownership, claims in insolvency, and procedures for returning assets or access.
- Any insurance exclusions and the circumstances in which the provider says a customer could make a claim.
For crypto-asset service providers covered by the EU’s Markets in Crypto-Assets Regulation (MiCA), Article 70 sets out duties concerning safeguarding client ownership rights and preventing use of client crypto-assets for the provider’s own account. Article 75 includes custody-policy, segregation, client-record, return, and insolvency-related provisions. Those rules apply only where the entity and service fall within MiCA’s scope; check the relevant legal coverage rather than assuming every company serving an EU customer is covered.
Compare providers using the same evidence
Build a side-by-side comparison using the exact entity and service you would use. Prefer current agreements, policies, regulator records, and detailed reports over broad marketing statements. If a provider does not disclose a point, record it as unknown rather than assuming the most favorable answer.

What does proof of reserves actually prove?
A proof-of-reserves report is a disclosure about a particular assessment; it is not automatically a full financial-statement audit, proof of solvency, or a promise that withdrawals will remain available. A reserves snapshot may show information about specified assets at a specified time, but that alone does not establish that all customer liabilities were counted or that the provider can meet them in the future.
The SEC investor education staff’s Investor.gov alert warns that management discretion over an assessment’s scope, reserve determination, assurance, provider, and public disclosure weakens any claim that proof-of-reserves provides protections comparable to a financial-statement audit. It advises extreme caution when using such a report to conclude that an entity has enough reserves to meet customer liabilities.
When a provider publishes a report, inspect its date, covered assets and wallets, treatment of customer liabilities, methodology, exclusions, assurance level, and the qualifications and independence of the assessor. A Merkle-tree proof or attestation is not a substitute for answers about legal rights, asset use, and insolvency treatment.

Is crypto on an exchange insured?
Do not assume an exchange balance receives the same protection as an insured bank deposit or a protected brokerage security. The SEC alert discusses the limits of U.S. protections in the context of crypto-asset entities; it does not make every crypto account equivalent to a covered bank or securities account. Michigan’s Department of Attorney General likewise warns that customers of unregistered exchanges may lack specific protections and could lose assets if an exchange fails. Those statements are tied to their respective legal and factual contexts, not a universal rule for every country or provider.

1Clear out junk files and repair common Windows errors2Scan for outdated or missing drivers - takes under a minute3Repair Windows errors before they cause bigger problemsIf an exchange advertises insurance, establish exactly who holds the policy, what event triggers coverage, which assets and wallets are included, the limits and exclusions, and who may file a claim. A policy covering a company’s own loss or selected wallets does not necessarily insure each customer’s balance or protect against insolvency.
Check account defenses and withdrawal access
Custody design is only part of the decision. A stolen password or successful phishing attempt can expose an account even if the provider’s key-storage arrangements are strong. Investor.gov recommends strong passwords and multi-factor authentication. Use a unique password, enable the strongest practical MFA option, and be wary of messages that ask you to sign in or reveal recovery information.

Before transferring a meaningful balance, learn how account recovery works and whether you can add withdrawal protections, such as approval controls or new-device checks. Confirm the asset and network you intend to use: a coin may be supported on one network but not another. Review the provider’s stated withdrawal limits, holds, fees, and processing arrangements, then check current service status because interruptions and availability can change. For covered providers, MiCA Article 75 includes procedures to return client crypto-assets or means of access as soon as possible; confirm that the rule applies to your provider and service.

Keeping assets with an exchange can make trading and account access convenient, but you rely on that provider’s custody, operations, and legal arrangements. With self-custody, you control the keys, but you also take responsibility for protecting them and preserving recovery information. Losing or exposing a private key or seed phrase can mean losing access permanently.

Before choosing any device, verify that it supports the assets and networks you need and understand its recovery process. Investor.gov notes that physical cold-wallet devices typically cost money and involve key-management responsibilities.

There is no universally right storage choice. Decide how much convenience you need for trading, how much provider exposure you are willing to accept, and whether you can reliably manage keys and recovery yourself. Do not move assets to self-custody simply because the device sounds safer if you cannot protect and recover the keys.
A practical due-diligence sequence
- Identify the contract. Find the legal entity serving your country and the agreement for the exact service you plan to use.
- Check legal coverage. Verify the entity and service in relevant official regulator records, and determine which rules apply to your location. Treat authorization as a fact to evaluate, not a guarantee.
- Read custody and asset-use terms. Look for key control, segregation, lending or pledging rights, subcontractors, customer records, and insolvency treatment.
- Evaluate reserves evidence carefully. If a report exists, assess its scope, date, liabilities, methodology, assurance, exclusions, and assessor rather than relying on the headline claim.
- Verify access and recovery. Review MFA, account-recovery and withdrawal-approval options, network support, limits, fees, holds, and current withdrawal status.
- Check any insurance wording. Identify the policyholder, covered losses, exclusions, limits, and claims process; do not infer customer protection from a general insurance claim.
- Compare the same facts across providers. Record missing disclosures as unknown and decide whether the provider’s legal terms, access model, and service fit your needs.
For U.S. readers, a July 14, 2025 joint statement from the Federal Reserve, FDIC, and OCC discussed existing risk-management principles for banks’ crypto-asset safekeeping, reminded banks to operate safely and soundly and comply with applicable law, and said it did not create new supervisory expectations. It concerns banking organizations’ safekeeping activity; it is not an endorsement of crypto exchanges or a consumer guarantee.
