There is no universally safe cryptocurrency exchange. Before depositing, verify the exact legal entity serving you and its authorization where you live, read how it holds and returns customer assets, and check the withdrawal terms for the specific asset and network you need. Registration, reserve disclosures and a successful test withdrawal can inform your decision, but none guarantees that you can recover funds during a disruption or insolvency.
Start with the entity that will hold your assets
An exchange brand may serve customers through different companies in different countries. Identify the legal entity named in the account agreement for your location; that entity, not just the brand name, determines which regulator and contractual terms may apply.

- Find the legal entity in the platform’s account or custody terms. Note its registered name, address and the law named in the agreement.
- Search the relevant regulator’s official register for that exact entity. Confirm that its authorization covers the service you intend to use and your location, rather than relying on a logo, marketing claim or registration in another jurisdiction.
- Check the regulator’s notices and the platform’s own disclosures for changes to permissions or service availability. Recheck before opening an account because authorizations and operating terms can change.
Registration is a compliance check, not a finding that a company is financially sound or that your assets are guaranteed. Michigan’s Attorney General puts it plainly: “Note that registration alone isn’t a guarantee that the exchange is safe or stable.” Its guidance is specific to Michigan and should not be treated as a single licensing rule for all US crypto activity: Michigan Attorney General consumer guidance.

Read the custody terms and failure provisions
When crypto remains on an exchange, the platform or a custodian generally controls the keys needed to move it. The agreement should make clear who holds the assets, whether customer holdings are segregated, whether the provider can lend or otherwise reuse them, which law applies, and what the contract says happens if the provider fails. Look for specific answers rather than assuming that a “custodial” label or a reserve disclosure settles these questions.

- Genuine Check: confirm your signer is authentic during setup with the Ledger Wallet app.
- Protect your signer: keep it in mint condition at all times with a bespoke Pod or Case to avoid scratches and everyday wear and tear.
- Segregation and records: Does the provider distinguish your assets from its own, and how are your positions recorded?
- Lending or reuse: Can the provider lend, pledge or rehypothecate customer assets? If so, under what conditions and with what implications for return?
- Insolvency: Which entity owes the return obligation, what law governs it, and what does the agreement say about access if that entity becomes insolvent?
- Custody location: Is custody handled by another company or in another country, and what legal arrangements apply?
Rules vary by jurisdiction. In the EU, MiCA Article 75 sets requirements for covered crypto-asset service providers offering custody, including a custody agreement, client position records, a custody policy, segregation and procedures to return assets or access as soon as possible. For providers in scope, position statements must be available at least once every three months and on request. Read the ESMA MiCA Article 75 text alongside the contract; it is not a global rule for every exchange.
Cross-border custody can complicate the outcome. FINMA said on 12 January 2026 that custody abroad can raise additional legal issues, especially if a custodian becomes insolvent, and emphasized the responsibility of authorized Swiss financial institutions when they use providers. Its statement reflects Swiss supervision, not the law that applies to every customer elsewhere: FINMA’s custody-risk announcement.
Check withdrawals as a separate service
Being able to buy or trade a coin does not establish that you can withdraw it on the network you need. Before funding an account, check the platform’s current withdrawal screen and terms for the exact asset and network. Record the fee, minimum, limits, any address or account restrictions, identity checks, review conditions and whether withdrawals are temporarily suspended.

- Confirm that withdrawals—not merely deposits or trading—are available for your chosen network.
- Check that the receiving wallet or service supports the same asset on the same network. Sending on an incompatible network can make recovery difficult or impossible.

- Check how the exchange announces service interruptions and how to contact support if a withdrawal is pending.
In an EU MiCA interpretation published by the European Commission through ESMA on 18 February 2026, “return crypto-assets held” means returning the same type of crypto-asset held when the client made the request; a provider cannot require the client to accept equivalent fiat or another token instead. Conversion may be offered only if the client requests it at withdrawal, and the conversion service must be authorized where applicable. The custody agreement can specify technical requirements, fees and account or address limits, but these must not make return difficult for most clients. This interpretation is specific to MiCA and does not establish a worldwide withdrawal rule. See ESMA’s Article 75 page and linked Q&A.
If feasible, a small test withdrawal can reveal whether the ordinary process works for your account, asset and network at that moment. It cannot prove that larger withdrawals will be available later, that the platform has sufficient liquidity, or that access will continue during stress.
Evaluate transparency, interruptions and support
Look for clear, accessible explanations of custody, withdrawal procedures, fees and service interruptions. Michigan’s consumer guidance identifies hard-to-find reserve or wallet information, a history of frozen or interrupted withdrawals, and weak customer support as warning signs. Treat a past interruption as a reason to investigate, not proof by itself of misconduct or insolvency.

If withdrawals have been suspended, ask which assets and networks were affected, why service stopped, how customers were notified, what conditions apply to reopening, and how account-specific cases are handled. A prior record of successful withdrawals is useful context, but it cannot guarantee future access.
Interpret proof-of-reserves and insurance narrowly
Published wallet addresses or proof-of-reserves may add transparency about assets included in a disclosure. They do not, by themselves, establish the full amount of customer claims, legal segregation, available liquidity or how assets would be treated in insolvency. Read what was measured, when, which entities and assets were included, and whether liabilities were assessed. Do not treat a reserve snapshot as proof that all customer balances are recoverable.
If an exchange advertises insurance or another protection, verify who provides it, what losses it covers, which assets and account types qualify, and in which jurisdictions it applies. Do not assume that a policy covers crypto held on the platform simply because the word “insured” appears in marketing.

Compare exchanges on the same terms
For each candidate, compare the same service, legal entity and jurisdiction. A brand-level reputation score can conceal important differences in the company serving you, its permissions or its withdrawal terms.
| What to compare | What to verify |
|---|---|
| Entity and authorization | Exact contracting entity, regulator, jurisdiction and scope of permission for the activity and location. |
| Custody and insolvency | Custodian identity and location, segregation, lending or reuse rights, governing law and contractual treatment if the provider fails. |
| Withdrawals | Supported assets and networks, current availability, fees, minimums, limits, account or address restrictions and review conditions. |
| Transparency and support | Accessible custody and reserve information, interruption notices, complaint routes and a usable support channel. |
| Costs | Trading, deposit and withdrawal charges for the service and route you expect to use. |
Do not rank platforms as universally safest without current, comparable evidence for the relevant country and legal entity. The right comparison is the one that matches your own intended asset, network, custody needs and jurisdiction.
Account for the limits of UK rules
In the UK, the FCA says it published final rules and guidance for cryptoasset firms on 30 June 2026. The page states that these will apply to cryptoasset firms granted permission to operate under FSMA on or after 25 October 2027. That future application date does not mean the rules already apply to every UK exchange. Check a firm’s present status and the regime timeline in the FCA cryptoasset standards information.

Decide how much to leave on an exchange
Exchange custody is convenient for trading, but it leaves control of the private keys with the platform or its custodian. Keep the amount held there proportionate to your actual need to trade, taking account of the possibility of delays, restrictions or a provider failure. No checklist can eliminate those risks.
After a successful withdrawal, self-custody is an option for people willing to manage their own private keys. A hardware wallet may help keep keys under your control, but it cannot make an exchange process a withdrawal or release assets still held there. Self-custody shifts responsibility: protect the recovery backup, understand how restoration works, and recognize that loss or exposure of the keys can put the assets at risk.
