Choose the provider that is legally authorized and acceptable for your project, can issue the exact guarantee wording your contract requires, and has the financial capacity to pay the stated penal sum. Compare the trigger for payment, project experience, claims remedy, collateral, total cost, and coverage through the warranty period. Have construction counsel check the final obligee, governing law, notice rules, expiry and warranty language before anyone signs.
Start with the contract, not the provider’s sales pitch
A construction guarantee is useful only when two conditions are met: the issuer is acceptable under the contract and the instrument responds to the risk the project owner is trying to protect. A highly rated provider can still be the wrong choice if the owner rejects its license, the bond names the wrong obligee, the call deadline is too short, or the bond expires before the warranty period ends.

“Guarantee” is an umbrella term. A performance bond, payment bond, warranty bond and bank guarantee protect different parties and are triggered in different ways. Do not substitute one for another because a provider offers a lower premium.

| Instrument | Primary protection | Typical trigger | What to verify |
|---|---|---|---|
| Performance bond | Owner or other obligee | Contractor fails to fulfill requirements under the construction contract | Default definition, notice, cure rights, takeover or completion remedies, penal sum and expiry |
| Payment bond | Qualifying labor and material suppliers | Required payments are not made | Who is protected under the applicable law, notice deadlines, claim evidence and statutory form |
| Warranty or maintenance bond | Owner during the defined post-completion period | Covered defects or unresolved warranty obligations | Whether it extends the initial construction bond, covered defects, response period and final release |
| Bank guarantee | Beneficiary named in the guarantee | Usually the stated call mechanism, often without the proof required by a conditional bond | Call documents, presentation location, demand wording, expiry, counter-guarantees, bank authorization and governing law |
Performance bonds
A performance bond secures fulfillment of the contractor’s requirements under the contract. The U.S. General Services Administration and Acquisition.gov define it in FAR Part 28 in those terms. In Texas Department of Insurance’s plain-language explanation, “Performance bonds pay if a contractor doesn’t do the work outlined in the contract.” The bond does not automatically guarantee every cost the owner incurs; liability is controlled by the bond form, the contract, the penal sum and applicable law.
Ask what the surety may do after a valid default. Remedies can include financing the existing contractor, arranging a replacement contractor, taking over completion, or paying up to the penal sum. The precise options and the owner’s duties must be written into the bond and coordinated with the underlying contract.
Payment bonds
A payment bond assures payments required by law to people supplying labor or material for the work. It is not a second performance bond and it does not necessarily protect every unpaid party. Eligibility, notice and filing rules depend on the governing statute and project type. Confirm which subcontractors, suppliers and laborers qualify, how they must notify the principal or surety, and when a claim becomes barred.
Do these 3 things before closing this tab:
1Repair Windows errors before they cause bigger problems2Fix the driver behind crashes, sound loss and screen glitches3Clear out junk files and repair common Windows errorsWarranty bonds
Warranty bonding secures defined post-completion obligations. Federal Highway Administration guidance describes the usual practice as an extension of the initial construction bond used to assure resolution of deficiencies during the warranty period. Check whether the extension is automatic or requires a new instrument, whether the penal sum changes, and exactly when the surety’s obligation ends.
Bank guarantees and surety bonds
A surety bond normally involves a principal (the contractor), an obligee (the owner or authority) and a surety that guarantees the principal’s contractual performance. A bank guarantee is issued by a bank under its own guarantee terms. The commercial effect varies by jurisdiction and form: some guarantees require evidence of default, while on-demand forms pay when the beneficiary presents the documents specified in the guarantee.
Compare the actual text rather than relying on the label. A bank that is acceptable for one project may not satisfy a public owner’s surety or treasury-eligibility rule, and a surety bond that is acceptable in one jurisdiction may be rejected elsewhere.
Conditional versus on-demand protection
Conditional bonds generally require proof of a serious breach and compliance with notice and other conditions before payment. On-demand bonds include the trigger and mechanism for calling on them in their terms and conditions. Because an on-demand call can create a faster and less evidentiary payment obligation, it is usually more expensive and places greater pressure on the contractor’s liquidity and indemnitors.
GOV.UK Cabinet Office guidance states that on-demand bonds should be considered mainly where the risk justifies them, such as high-risk or high-value projects, and that contracting authorities should seek professional advice on the best choice and drafting. A project owner should not demand an on-demand form merely because it is familiar; a disproportionate requirement can increase bids and reduce small-firm participation.

| Question | Conditional form | On-demand form |
|---|---|---|
| What starts a payment obligation? | Usually a defined default plus the notice and evidence required by the bond | The stated call documents and mechanism, subject to the text and governing law |
| Owner’s evidence burden | Generally higher; serious breach and procedural compliance must be established | Generally lower if the demand meets the stated conditions |
| Contractor’s cash-flow exposure | Usually lower before a validated claim | Usually higher because a compliant call may be paid before a merits dispute is resolved |
| When proportionate | Routine projects where default can be assessed through the contract process | Higher-risk or higher-value work where rapid, reliable liquidity is worth the added cost |
Who may issue the guarantee
Potential issuers include an admitted or licensed surety insurer, a bank authorized to provide the relevant guarantee, or another institution expressly permitted by the procurement rules. The contract may require a particular form of admission, a minimum financial rating, statutory or treasury eligibility, reinsurance support, or participation in an approved program.
Verify all of the following in writing:
- The issuer is licensed, admitted or otherwise authorized in the project jurisdiction.
- The owner, public agency, lender and other obligees will accept that issuer.
- The issuer can write the required penal sum without exceeding its single-risk or aggregate capacity.
- The proposed form satisfies mandatory statutory language and the contract’s governing-law clause.
- The person signing the instrument has authority, and any power of attorney or bank mandate is current.
Do not treat a broker’s statement that an issuer is “market accepted” as proof. Ask the obligee or contracting officer to confirm acceptability before the bond is executed, especially on public work.
How to compare providers step by step
-
Extract the requirement set
Create a one-page schedule from the contract showing instrument type, required penal sum, principal, obligee, effective date, completion date, warranty or maintenance period, governing law, notice address, call documents and required issuer qualifications. Include any requirement for an original, electronic delivery, language, notarization or legalization.

Confirm legal authorization and acceptance
Check the issuer’s license or admission with the relevant regulator and obtain written confirmation from the obligee that the carrier or bank is acceptable. For public contracts, check the procurement rule for statutory or treasury eligibility rather than relying on a commercial rating alone.
-
Test financial strength and capacity
Request current financial ratings, statutory information where relevant, reinsurance arrangements and confirmation that the issuer can support the full penal sum. Ask how the provider handles aggregate exposure if the contractor has several projects running at once.
-
Match construction experience
Ask for relevant experience by project type, contract size, delivery method and jurisdiction. A provider experienced with vertical building may not understand the default and warranty risks of a highway, design-build, energy or public-infrastructure contract. Confirm that it has handled the required warranty period, not just the initial mobilization bond.
-
Compare identical wording
Give every candidate the same owner-drafted form where possible. Compare the definition of default, notice and cure periods, defenses, beneficiary names, governing law, cancellation, extension, partial release, set-off, arbitration and the surety’s completion remedies. A lower quote on a materially different form is not a lower cost for equivalent protection.
Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy. -
Decide the call standard
Have counsel classify the form as conditional or on-demand and identify every condition to payment. For a conditional bond, list the evidence and notices required to prove serious breach. For an on-demand form, list the exact demand language, signatures, certificates, delivery channel and deadline. Ask whether a disputed call can be restrained and under what law.

Map the claims process
Obtain the claims address, named contact, business-hours and emergency channels, acknowledgement target, investigation stages, required records, escalation route and available remedies. Ask whether the surety can arrange completion or finance a replacement contractor, and how those options interact with the penal sum.
-
Calculate total cost and collateral
Compare the premium or bank fee, broker fee, taxes, collateral, indemnity, credit-line usage, amendment charges, extensions, renewals and release conditions. Include the cost of keeping cash or securities pledged until final discharge. Ask for a written quote that states whether the price is one-time or recurring.
-
Check timing and execution
Confirm underwriting lead time, information requirements, approval authority, electronic-delivery rules and the date the original must reach the obligee. Build time for corrections; a technically correct bond delivered after the contract deadline can still be a default.

Secure warranty-period coverage
Set a calendar reminder for every extension, inspection, maintenance certificate and final release. Ensure the provider remains obligated through the contractually required warranty or maintenance period and that release requires the correct owner certificate, not merely substantial completion.
Financial strength, capacity and collateral
Financial strength matters because a guarantee is a promise to provide money or a completion remedy when the contractor is already in trouble. Review current ratings from recognized agencies, statutory or treasury eligibility where applicable, reinsurance and the provider’s demonstrated capacity for the required penal sum. A strong rating does not replace checking authorization or wording.
Sureties commonly underwrite the contractor as a whole, not just one job. Expect requests for financial statements, work-in-progress schedules, bank lines, references, ownership information, prior claims and an explanation of the project’s schedule and subcontracting plan. The resulting indemnity may make owners, directors or related companies responsible for losses.
Collateral can include cash, letters of credit or other security. Ask when it is posted, how it is valued, whether it earns interest, when it is released and whether a claim or extension can increase it. A provider with a lower premium but heavy collateral may consume more working capital than a higher-priced alternative.

| Cost item | Questions to ask |
|---|---|
| Premium or guarantee fee | Is it calculated on contract price or penal sum? Is it one-time, annual or payable on renewal? |
| Broker and issuance charges | Are underwriting, courier, electronic-delivery, amendment or cancellation fees separate? |
| Collateral and indemnity | What security is required, who signs indemnity, and when is security released? |
| Extensions and warranty | What does an extension through completion or warranty cost, and can the provider refuse it? |
| Credit impact | How much bank or surety capacity is reserved, and does that reduce the contractor’s ability to bid other work? |
| Claim and completion exposure | Could a disputed call, investigation or completion arrangement create additional financing costs? |
Bond costs are ultimately reflected in bids. Owners should balance protection against requirements so that the guarantee does not unnecessarily exclude smaller, otherwise capable contractors.
SBA support for eligible U.S. small businesses
Eligible U.S. small businesses can ask participating sureties about the Small Business Administration Surety Bond Guarantee program. The SBA’s current program information states that it charges a 0.6% fee of contract price for all performance and payment bond guarantees. Confirm eligibility, participating-provider status, contract limits and current program terms directly with the SBA or the surety; the fee does not eliminate the provider’s underwriting, premium, collateral or indemnity requirements.

For U.S. federal construction contracts, FAR Part 28 sets specific thresholds. The rule applies to federal procurement and does not automatically govern private, state or foreign projects.

| Contract value | Federal protection described in FAR Part 28 | Practical check |
|---|---|---|
| Exceeding $150,000 | Performance and payment bonds are generally required | Confirm the required penal sums, approved form and issuer eligibility in the solicitation and award |
| More than $35,000 and no more than $150,000 | The contracting officer selects at least two specified alternative payment protections | Read the solicitation to see which alternatives are permitted; do not assume a payment bond is mandatory |
| $35,000 or less | The cited threshold provision does not impose the same federal requirement | Check the solicitation, agency rules and any separate contractual guarantee clause |
Thresholds are not a substitute for reading the particular solicitation. An agency, statute or contract can impose additional conditions, and a non-federal project may follow an entirely different rule.
Read the bond and guarantee wording line by line
Have a lawyer experienced in construction and surety law review the final instrument. The following clauses deserve a marked-up comparison:
- Parties and definitions: Verify the exact legal names of principal, obligee, surety or bank, affiliates and any joint venture.
- Penal sum: Confirm the amount, currency, whether it is fixed or reducing, and whether interest, costs or attorney fees are inside or outside that cap.
- Effective date and term: Match commencement, substantial completion, final completion, maintenance and warranty dates. Check whether expiry is automatic, certificate-based or extendable.
- Default and notice: Identify what constitutes default, who must give notice, where it must be delivered, how much cure time applies and whether notice can be electronic.
- Call conditions: For on-demand instruments, reproduce the required demand, certificate, signature, presentation place and deadline exactly. For conditional bonds, list proof and investigation requirements.
- Defenses and disputes: Note defenses available to the surety or bank, the effect of amendments, waivers, acceleration, insolvency and disputes under the underlying contract.
- Remedy: Confirm whether the provider may finance, take over, arrange a replacement or pay money, and how the owner must cooperate.
- Cancellation and extension: Check whether the issuer can cancel, whether advance notice is required, and who may request an extension.
- Governing law and forum: Ensure the jurisdiction is workable for the project and does not conflict with mandatory local law.
Claims: test the remedy before you need it
Ask the provider to walk through a hypothetical claim from first notice to final remedy. The exercise should identify the responsible contact, acknowledgement time, investigation documents, site access, expert reports, meetings with the contractor, decision authority and escalation path.
For a performance claim, ask what happens if the contractor abandons the site, becomes insolvent, disputes the default or refuses access. For a payment claim, confirm how supplier eligibility and statutory notices are checked. For a warranty claim, establish how defects are documented, who approves corrective work and how the bond is released.
Obtain the maximum liability and remedy in writing. A promise to “work with the owner” is not a substitute for a defined obligation to investigate, finance completion, arrange a contractor or pay the penal sum.
Best Value
Common selection mistakes and how to prevent them
Choosing the cheapest quote
A low premium can conceal narrower wording, heavier collateral, annual renewal charges or an issuer the obligee will reject. Compare complete cost and equivalent forms.
Accepting an unapproved issuer
Approval after signing is risky. Verify admission, licensing, statutory or treasury eligibility and obligee acceptance before execution.
Confusing payment and performance protection
A payment bond addresses qualifying labor and material claims; it does not ensure that the project will be completed. A performance bond does not automatically pay every supplier. Obtain each instrument required by the contract.

An on-demand call can create immediate cash exposure and higher fees. Use it when the project’s risk and value justify rapid payment, and ensure the call mechanism is operationally clear.
Ignoring the warranty period
Ending the bond at substantial completion can leave the owner unprotected when defects appear. Align expiry and release with the contractual warranty or maintenance obligation.
Relying on a rating without checking capacity
A provider can be financially strong yet unable or unwilling to support the required penal sum, aggregate exposure or unusual project type. Obtain written capacity confirmation.
Leaving notice mechanics vague
Missed notice addresses, deadlines or presentation formalities can defeat an otherwise valid claim. Put every delivery requirement into the project administration checklist.

- Principal, obligee, project description and contract number exactly match the award.
- Issuer authorization and obligee acceptance are documented.
- Penal sum, currency, effective date and expiry are correct.
- Warranty or maintenance extension is included where required.
- Conditional or on-demand status is identified and approved by counsel.
- Default, notice, cure, call and presentation requirements are workable.
- Governing law, forum, cancellation and extension provisions are consistent with the contract.
- Claims contacts, escalation path and completion remedies are written down.
- Premium, fees, collateral, indemnity, renewals and credit-line effects are understood.
- Required powers of attorney, signatures, seals, originals and delivery method are ready.
- Release conditions and the date for final discharge are calendared.
A practical decision rule
Reject any provider that fails the legal-acceptability or wording test, even if its price is attractive. Among providers that pass, rank them on financial strength and penal-sum capacity, relevant construction experience, claims remedy, warranty-period coverage, collateral and total cost. Use speed as a tie-breaker, not as a reason to skip authorization or legal review.
The final choice should leave the owner with an enforceable, correctly triggered remedy and the contractor with a proportionate requirement that does not consume unnecessary working capital. GOV.UK Cabinet Office guidance captures the professional standard: “Contracting authorities should seek professional advice on the use, best choice, and drafting of bonds.”
