If you or someone with you has been arrested at a protest in India, first establish where the person is held, why the arrest was made, and when the person must be taken before a magistrate. Ask for the grounds of arrest, access to a lawyer, notification of a nominated relative or friend, and the recorded place of custody. A family member should contact the police station and district control room, then a local criminal lawyer or the District Legal Services Authority (DLSA) for the district of detention.
The Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS) has been the central criminal-procedure statute from 1 July 2024. The actual offence, validity of an arrest, bail prospects, protest restrictions and any special-law rules depend on the state, facts, documents and local orders. This is general information, not a substitute for a lawyer examining the FIR and arrest record.

What to do in the first hour
Speed matters because the next event may be questioning, a medical examination, production before a magistrate or a remand request. Keep the response organised rather than confrontational.
- Confirm custody. Call the police station most likely to have made the arrest and the district control room where appropriate. Ask whether the person is there, has been transferred, the time of arrest, the legal grounds recorded, and the FIR or case number if available.
- Write down every contact. Record the date and time of each call, the number dialled, the name and rank given, what was said, and any direction to another station or office. Preserve texts, notices and call records.
- Get legal help immediately. Contact a local criminal lawyer or the DLSA serving the district where the person is held. Say that the arrest arose from a protest and identify any imminent production, remand or bail hearing.
- Send counsel a usable timeline. Provide the protest location, approximate time, events before the arrest, officers or vehicles identified, notices received, witnesses and the current custody information. Send lawful photographs or scans of the arrest memo, FIR, medical record, remand paper or court document.
- Flag urgent needs. Tell counsel at once about injury, illness, pregnancy, disability, childhood, regular medication, an interpreter requirement or difficulty communicating. These issues may need to be raised with the police, a magistrate or another responsible authority.
- Protect the case record. Preserve messages, photographs, videos and witness details in their original form. Do not publish sensitive identity details or unverified accusations online; public posts can expose the arrested person or witnesses to further risk.
Do not obstruct an arrest, threaten officers or assume that asserting a right guarantees release. A lawyer must verify the applicable BNSS provisions, any state law, local order and any special statute.

What are my rights if I am arrested at a protest in India?
The BNSS is Act 46 of 2023 and, according to the India Code record, came into force on 1 July 2024. Older paperwork may refer to the Code of Criminal Procedure (CrPC); that does not by itself determine which provision governs a current case. Ask counsel to identify the law and section in the FIR, arrest record and remand papers.
Ask for the grounds of arrest
Ask the arresting authority to state the legal grounds and the alleged offence. Note the wording as closely as possible and tell your lawyer whether the grounds were explained in a language you understand. Do not sign a statement you do not understand. The statutory text hosted by the National Crime Records Bureau states: “No arrest shall be made except in accordance with the provisions of this Sanhita or any other law for the time being in force providing for arrest.” A lawyer must assess whether the particular arrest complied with that rule and with any other applicable law.
Request access to a lawyer
Say clearly that you want to consult a lawyer and ask how counsel can meet or communicate with you. If you cannot afford private representation, ask for legal-services assistance and tell the officer, magistrate and your family that you need the DLSA. Legal consultation does not mean police must release you immediately; it gives counsel a chance to address questioning, documents, medical needs, remand and bail.
Nominate a relative or friend
Give the name and contact details of a relative or friend whom the police should notify. Ask that the notification be made and that the place of custody be recorded. A family member should ask whether the person remains at the arresting station or has been moved to another station, lock-up, hospital or court-related facility.
Record health and accessibility needs
Report injuries, medication, pregnancy, disability, age and communication or interpreter needs at once. Request appropriate medical attention and tell counsel what was reported and when. Keep copies or photographs of medical papers obtained lawfully.
How long can police hold someone before taking them to a magistrate?
The general constitutional safeguard is production before a magistrate within 24 hours of arrest, excluding the time necessary for the journey. Detention beyond that period requires magistrate authority. The calculation is fact-specific: write down the arrest time, departure and arrival times, journey circumstances and every court appearance.

Twenty-four hours is not a promise of automatic release, a finding that the arrest was unlawful or a guarantee of bail. If the deadline appears to have been missed, tell counsel immediately and give the magistrate the recorded times. The lawyer can examine the arrest memo, station diary, transit records, medical timing and remand application.
At production or a remand hearing
- Tell counsel whether you received the grounds of arrest and were able to contact a lawyer.
- State any assault, injury, untreated condition, medication problem or inability to understand the proceedings.
- Provide the exact time and place of arrest and any transfer.
- Ask counsel to check the FIR, arrest memo, seizure documents and proposed custody period.
- Do not guess about facts. If you do not know or do not remember, say so.
The court decides custody and bail under the applicable law. A local lawyer can explain whether police custody, judicial custody, notice, regular bail, interim relief or another remedy is being sought in that case.
How can I find out which police station has my family member?
Start with the station nearest the protest or the place where officers made the arrest, then ask the district control room for the responsible station. Use calm, specific questions:
- “Is [full name] in your custody, or has the person been transferred?”
- “What time is recorded as the arrest time?”
- “What offence or legal grounds have been recorded?”
- “What is the FIR or case number, if one exists?”
- “Where is the person physically held now, and where will production take place?”
- “Who is the officer handling the case, and how can counsel contact that officer?”
If an officer will not provide an answer, record the refusal and the time. Ask the next station or control room where to direct the request. Give the same information to counsel and the DLSA. Do not enter a restricted area, interfere with police work or rely on social-media claims about a transfer.
Can I get a free lawyer while in police custody?
Yes, a person arrested or called for questioning can seek free legal aid through the early-access framework. The National Legal Services Authority (NALSA) states in its FAQ that “persons called for questioning i.e. suspects and persons arrested by the police can also avail free legal aid.” NALSA also says a person facing criminal trial in police or judicial custody is entitled to free legal aid regardless of financial status or social standing.

Who is covered by legal-aid eligibility rules?
NALSA’s information on section 12 of the Legal Services Authorities Act, 1987 identifies, among others, people in custody, members of Scheduled Castes or Scheduled Tribes, women, children, people with disabilities, industrial workmen and people in specified circumstances of underserved want. The early-access route also covers suspects and arrested people who need assistance before or during remand. The authority assesses the application and the circumstances; do not promise that a particular lawyer or result will be assigned.
What can free legal services include?
Depending on eligibility and the case, legal services can include representation, legal advice, drafting and preparation of legal documents, and certain process or case expenses. Availability may involve a panel lawyer, legal-services counsel or another arrangement at the police-station, magistrates’ court, sessions-court or higher level. Ask the DLSA what is available for the immediate hearing and how to submit the required information.
Private lawyer or free legal services?
Neither route guarantees release or a favourable result. Choose based on urgency, access and the needs of the case.

1Fix the driver behind crashes, sound loss and screen glitches2Repair Windows errors before they cause bigger problems3Scan for outdated or missing drivers - takes under a minute| Practical question | Private criminal lawyer | DLSA/NALSA legal services |
|---|---|---|
| How to start | Call a local lawyer and provide the arrest and hearing details. | Contact the DLSA in the detention district, the SLSA or NALSA’s current official channel. |
| Cost | Fees and expenses are agreed with the lawyer. | Services are provided under the legal-aid system subject to the authority’s assessment and rules. |
| Urgency | Ask whether the lawyer can attend the station or the next court listing. | State the exact production, remand or bail deadline so the authority can route the request. |
| Jurisdiction | A lawyer familiar with the state, district and court handling the case is usually the practical choice. | The DLSA for the district of detention is the first access point; it can explain the appropriate level. |
| Expertise and language | Ask about protest-related criminal cases, the relevant statute and language or accessibility needs. | Ask what panel counsel, interpretation or accessibility support is available for the person’s circumstances. |
Free legal aid is not a lesser legal right, and paying a lawyer does not guarantee a better outcome. What matters immediately is that competent counsel receives the documents and can attend the relevant authority or court.
What documents should I give the lawyer after a protest arrest?
Send what you can obtain lawfully, labelled with the date and source. Do not delay urgent contact while collecting a complete file.
- Arrest memo, notice, summons or any paper given before or during the arrest.
- FIR or case number, sections invoked and the name of the police station.
- Remand application, custody order, bail order or other court document.
- Medical examination record, prescriptions, photographs of injuries and information about regular medication.
- Identity and contact details for the arrested person and the nominated relative or friend.
- A timeline of the protest, arrest, transfers, questioning and court appearances.
- Names and contact details of witnesses, legal observers or others who directly saw events.
- Original photographs, videos, messages and location information, with notes explaining when and how each item was obtained.
Keep the originals unchanged and make a separate working copy. Tell counsel if a file was forwarded, edited, compressed or recorded by someone else. Do not contact or pressure witnesses, delete messages or post accusations while the facts are being checked.

Special situations that need immediate notice
Child or young person
Tell counsel the person’s exact age and provide age documents if available. Different child-protection procedures may apply, so do not assume an adult custody process is correct.
Injury, illness, pregnancy or medication
Give the name and dose of medication, the last dose taken and any diagnosis or pregnancy information. Request medical attention and preserve records. Counsel can raise an untreated condition with the appropriate authority or court.
Disability, language or interpretation
Explain the communication method, interpreter requirement or accessibility barrier. Ask counsel to ensure that the person understands the grounds, documents and hearing.
Possible special statute or local order
Protest cases may involve state offences, public-order provisions or a special statute in addition to the BNSS procedure. A local criminal lawyer must identify the exact sections and any restriction or preventive order; a national checklist cannot decide whether those provisions were properly used.

| Waiting for an FIR copy before seeking counsel. | Give counsel the arrest time, station, names and hearing deadline first; send papers as they become available. |
| Arguing that the 24-hour rule automatically ends the case. | Record arrest and journey times and ask counsel to raise any apparent breach with the magistrate. |
| Posting names, faces or allegations online. | Preserve evidence privately and share it with counsel or the legal-services authority. |

What a lawyer needs to determine
Only a lawyer with the actual record can assess whether the arrest complied with the BNSS or another law, whether notice or arrest was authorised, which court has jurisdiction, whether a local protest order applies, and what bail or other remedy is available. The lawyer will normally need the FIR, arrest memo, custody and remand papers, medical information and a reliable timeline. Facts from a different state or protest cannot be used as a prediction for this case.
How to contact the DLSA without losing time
- Identify the district in which the person is physically detained or is due to be produced.
- Find that district’s DLSA through the current official NALSA or SLSA directory or court information.
- State the person’s name, police station, arrest time, FIR or case number, next hearing and urgent health or accessibility needs.
- Ask how to make an urgent legal-aid request, whether counsel can attend the station or court, and which documents are required.
- Record the application or reference details and the name or designation of the person who received the request.
If the first contact cannot resolve the issue, provide the same written summary to the SLSA and follow the current escalation instructions. Continue trying to identify the next court appearance and keep private counsel informed if one is also being contacted.

Frequently Asked Questions
How quickly should a family member contact a lawyer after a protest arrest?
Immediately, especially if questioning, medical examination, production, remand or bail may occur soon. Give the lawyer the arrest time, station, case number and next hearing first; documents can follow.
Does missing the 24-hour production deadline automatically release the arrested person?
No. The general rule excludes necessary journey time and detention beyond the period requires magistrate authority. Record the times and ask counsel to raise any apparent breach.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Can someone be denied free legal aid because they have no proof of poverty?
NALSA says suspects and arrested people can seek early-access legal aid, and a person facing criminal trial in police or judicial custody is entitled regardless of financial status or social standing. The legal-services authority still processes the request under its rules.
Which DLSA should the family contact?
Start with the DLSA serving the district where the person is held or will be produced, then use the relevant SLSA or NALSA’s current official directions if the case has moved.
The Bottom Line
Confirm the place and grounds of custody, request counsel and notification of a nominated relative, track the 24-hour magistrate-production rule, and contact the detention district’s DLSA or a local criminal lawyer without delay. Only a lawyer reviewing the actual FIR, arrest and remand records can advise on legality and bail.
