Read the entire agreement, not just its “AI” section. Start with the grant of rights and definitions, then trace reservations, subsidiary rights, sublicensing, formats, territory, term, amendments and any artificial-intelligence language. Make a separate list of each proposed use—training a model, generating outputs, internal tools, consumer chatbot uploads, editing, summaries, retrieval systems, translation, narration and artwork—and mark whether the contract permits it, prohibits it, conditions it or leaves it unclear. A broad “all rights” or “all media now known or later devised” grant may be argued to reach a new technology, but that wording does not automatically answer the question under every contract or governing law.
What you are actually trying to determine
A publishing contract can grant different rights to different people for different purposes. “Does the publisher have permission to use my book for AI?” is therefore several questions, not one:
As an Amazon Associate I earn from qualifying purchases.
- Can the publisher use the work to train or improve a model?
- Can it put passages into a system that produces summaries, recommendations or other outputs?
- Can employees use a secured internal tool for search, marketing or sales work?
- Can the publisher upload an unpublished manuscript or your personal information to a consumer-facing chatbot?
- Can an editor use AI for substantive rewriting, or only ordinary spelling and grammar checks?
- Can the publisher license AI-related products such as retrieval-augmented generation (RAG), chat-with-a-book features, translations, audiobook narration or cover art?
Answer each use separately. A clause that addresses model training may say nothing about outputs, editing or a licensed chat product. The contract, its amendments, applicable law and the parties’ conduct control; advocacy guidance is not a ruling on your particular agreement.

- Read Before You Buy — No Video Output: These adapters support charging and USB 2.0 data transfer, but cannot transmit video signals. Except for standard USB webcams (which use USB data only), they are not compatible with HDMI/DisplayPort cables, video-capable USB-C hubs, or docking stations with video output.
- Convert USB-A Ports to USB-C: Designed to connect USB-C earphones, cables, flash drives, card readers, and other USB-C accessories to standard USB-A ports. Plug-and-play with no drivers or software required.
- Aluminum Alloy Housing: Built with a sturdy aluminum alloy shell that aids in heat dissipation and protects against daily wear and scratches. Designed to maintain a stable and secure connection.
- Compact & Travel-Friendly: The ultra-compact design allows the adapter to stay plugged into your device without blocking adjacent ports or adding bulk, reducing wear and tear on your original USB ports.
- 12-Month Warranty: Backed by a 12-month manufacturer warranty for peace of mind. Designed to meet strict quality control standards for reliable everyday performance.
- The signed publishing agreement and all schedules or exhibits.
- Side letters, negotiated amendments and any AI addendum.
- Policies or online terms that the agreement expressly incorporates.
- The parties’ legal names, signature status, signing date, governing law, territory and term.
Do not assume that an email, submission guideline or website policy is part of the bargain unless the contract incorporates it. If a later addendum conflicts with the original grant, flag the conflict instead of silently choosing the broader language.
Read the grant of rights and the reservations first
Find the operative grant
Locate the clause that says what rights the publisher receives. It may refer to copyright, publication, reproduction, distribution, public performance, display, adaptations or “all rights.” Definitions of Work, rights, electronic, digital, derivative work and similar terms can change the reach of that grant. The Authors Guild’s US-oriented model-contract commentary explains that the grant identifies what the publisher may exercise and what remains with the author.
Find what you kept
Read the reserved-rights language immediately alongside the grant. An express reservation of AI rights can be important in an “all rights” deal. The Authors Guild’s model-clause page states that, in such an arrangement, an author who does not want the publisher to exercise particular AI rights should expressly reserve them. This is model-contract guidance, not a universal rule that every broad grant has the same legal result.
Do these 3 things before closing this tab:

Record the limits attached to the grant:
| Boundary | Questions to answer |
|---|---|
| Formats | Does the grant cover print, ebook, audio, databases, software or unspecified future formats? |
| Territory | Is the right worldwide, country-specific or divided by market? |
| Language | Are translation rights included or separately reserved? |
| Term | When does the licence start and end, and what happens after reversion? |
| Subsidiary rights | Which additional rights may be licensed to another company? |
| Sublicensing | Can the publisher pass on only rights it actually received, or does the clause purport to go further? |
A sublicensing clause does not create rights absent from the initial grant. Its practical effect depends on the scope and limits of that original grant.
Search for specific and broad wording
Use your PDF’s search function, then read the surrounding paragraphs and any definitions. Search for:

Searching is a locating technique, not a legal conclusion. A contract can cover a use without using the word AI, and the absence of an AI clause does not by itself prove permission or prohibition. Broad language should be put to an agent or lawyer who can apply the governing law to the whole agreement.

| Training or improving a model | Does the grant expressly permit training, fine-tuning or development? May a third party receive the work? Is author approval required? |
| AI-generated outputs | Does the contract cover outputs made from the work, including summaries, recommendations, answers or other transformations? |
| Internal publisher tools | Which employees, tools and purposes are inside “internal”? Can a vendor retain prompts or use data for its own training? |
| Consumer-facing chatbot upload | Can an unpublished manuscript or personal information be uploaded? Are written permission, retention limits and a third-party training opt-out required? |
| AI editing | Is substantive editing allowed, or only basic spelling and grammar checking? Who approves the resulting text? |
| Separate products | Are RAG, chat-with-a-book, summaries, translation, narration, cover art or other products named, licensed and accounted for? |
For each row, label the result permitted, prohibited, conditioned or unclear. Quote the exact wording and note any definition or cross-reference that changes it.
Keep the crucial distinctions separate
Training is not the same as generating outputs
Training or improving a model is one stated purpose. Feeding text to a system that produces a summary, answer or recommendation is another. The Authors Guild’s model language addresses both; a contract that blocks training may still leave output-generating uses unresolved. Check both verbs and any sublicensing language.
Internal operations are not an outside licence
The Guild’s model approach leaves room for a carefully defined exception for AI-powered tools used in ordinary publisher operations such as marketing, sales or distribution. The boundary matters: identify the approved tools, users, purposes, vendors, retention rules and whether submitted material can be reused for a provider’s model training. An “internal” label should not be assumed to cover a public product or an unrestricted third-party service.
A consumer chatbot is not a secured internal system
In a statement published April 16, 2026 and updated April 22, 2026, the Authors Guild recommended prior written permission before uploading a manuscript or an author’s personal information to a consumer-facing AI system. Where permission is given, its proposed language calls for ensuring that third-party AI companies do not use the manuscript for training, including by opting out in the service’s settings. That is a Guild recommendation and sample clause, not a term automatically present in publishing contracts.

Publisher rights are different from author duties
A contract may give the publisher certain rights while separately requiring you to disclose AI-generated material. Read the author-obligations section for disclosure rules, limits on generated text and any promise that you will not be compelled to use generative AI. The Guild’s model includes disclosure language, a bracketed limit for AI-generated text and a statement that an author cannot be required to use generative AI. The bracketed percentage is drafting text, not an industry statistic.

Check safeguards, control and money
Permission without conditions can be materially different from permission with limits. For every allowed use, write down:
- Who may exercise the right and whether a sublicense is allowed.
- Which tools, vendors, employees and geographic markets are covered.
- Whether the publisher must give notice or obtain your prior written approval.
- Security requirements, access controls, deletion and retention periods.
- Whether the material may train a third-party system or be used to improve its service.
- Attribution, records, audit rights and the frequency of accounting.
- Compensation, royalty rate, minimum guarantee and whether income is credited against an advance.
- What happens when the publishing term ends or rights revert.
The Authors Guild’s model commentary says income from AI subsidiary-rights licences would typically be applied against an advance unless the parties specify otherwise, and suggests direct payment or accounting for the value of those rights. Treat that as negotiation guidance; your contract may use a different formula.
What the Authors Guild’s current model guidance adds
The Guild describes its AI provisions as a menu that can be negotiated or added by amendment. Its updated materials distinguish training, RAG, AI summaries, chat-with-a-book applications and other uses rather than treating them as one right. CEO Mary Rasenberger summarized the need for that approach: “There is a great need for clarity in the industry around what rights are implicated by the different types of AI uses, how these rights should be framed in contracts, and what AI uses authors and publishers can make.”
The Guild also publishes proposed language stating: “Publisher agrees and warrants that it will not use AI to substantially edit a manuscript (excepting the use of basic spelling and grammar-checking applications).” This is suggested contract text. It does not establish that every publisher follows the restriction.
If the agreement says nothing about AI
Silence is a prompt for closer reading, not an answer. Review the definitions, the breadth of the grant, reserved rights, derivative-work language, digital and electronic formats, and any clause covering media “now known or later devised.” Then ask whether the proposed activity is an ordinary exercise of an expressly granted right or a new exploitation that should be separately licensed. Different jurisdictions and contracts can treat the same wording differently, so do not present a general phrase as conclusive.
Ask the publisher to describe the proposed use in concrete terms: the model or tool, the material supplied, whether the material is retained, whether it trains the provider, who sees the result, whether the public can access it, and how long the use lasts. A written description often reveals that “AI use” actually involves several distinct rights.

How to compare two contract proposals or an amendment
Put the versions side by side and compare more than the headline royalty. Check:
- Scope: Does one version cover training, outputs, RAG, summaries, chat applications, translation, narration or artwork that the other reserves?
- Control: Is your prior written consent required, or does the publisher have unilateral discretion? Is consent needed for each use or only for a category?
- Recipients: Can the publisher use affiliates, contractors, platforms or an unlimited class of sublicensees?
- Safeguards: Are encryption, access controls, deletion, retention and third-party-training opt-outs stated?
- Economics: Is there a defined royalty or fee, separate accounting, an audit right and a clear rule for crediting income against an advance?
- Time and geography: Do the AI rights end with the publishing term, territory or reversion, or continue indefinitely?
- Your process: Does the proposal require disclosure of your own AI use, impose a percentage limit, or allow the publisher to require AI assistance?
A clause that appears narrow can become broad through its definitions or a sublicensing provision. A clause that appears generous can be limited by territory, term, approval conditions or a reserved-rights section.
Questions to resolve in an AI addendum
Before signing an amendment, request plain-language answers to these points and have the answers reflected in the document:
- What exact text, files, metadata or personal information may be submitted?
- Is the purpose training, evaluation, retrieval, generation, editing, marketing, accessibility or a separate commercial product?
- May the provider retain inputs, prompts, embeddings or outputs, and for how long?
- Can the provider use the material to train its own or another customer’s model?
- Who owns or controls generated outputs, and are they licensed onward?
- What notice, approval, takedown, deletion and breach-notification rights do you have?
- How are revenue and expenses defined, reported and audited?
- Does the permission survive termination, reversion, insolvency or a change of publisher ownership?
Do not rely on a marketing description such as “private AI” or “secure model.” The contract should identify the permitted system and the enforceable safeguards.
Follow this review workflow
- Inventory documents. Gather the signed agreement, incorporated policies, amendments, side letters and AI addenda. Record governing law, term, territory and parties.
- Mark the grant. Highlight the rights clause, definitions, reservations, ownership language and any “all rights” wording.
- Map the reach. Note formats, languages, territories, duration, reversion, subsidiary rights and sublicensing.
- Run the keyword search. Search for AI terms and broad digital, electronic, derivative-work and future-media phrases. Read every cross-reference.
- List actual uses. Separate training, outputs, internal tools, consumer uploads, editing and licensed products.
- Classify each use. Mark it permitted, prohibited, conditioned or unclear, with the exact clause and the party who controls the decision.
- Record protections and economics. Capture approval, notice, security, retention, third-party training, accounting, compensation and advance treatment.
- Prepare focused questions. Ask what tool, data, purpose, duration, recipient and payment the proposed use involves.
- Escalate before consenting. Send the complete document set—not isolated excerpts—to your agent or a lawyer familiar with publishing contracts and the governing jurisdiction.
Red flags that merit professional review
- An “all rights” grant with no clear reservation of AI-related rights.
- Conflicting clauses about digital rights, derivative works, sublicensing or amendments.
- A new addendum that grants training, output or product rights without compensation or accounting.
- A request to upload unpublished work or personal information to a consumer-facing system.
- Permission for a vendor to retain prompts, reuse content or train its own model.
- Substantive AI editing that could change the manuscript, voice or attribution.
- No approval, notice, deletion, audit or reversion mechanism.
- Unclear treatment of AI income, royalties or deductions from an advance.
Do not sign, upload or consent while a material point remains unclear. A professional needs the whole agreement and the facts of the proposed use; a single search hit cannot settle the issue.

Limits of any contract checklist
No checklist can determine your rights without the actual wording, negotiated amendments, governing law and surrounding facts. The Authors Guild materials are practical advocacy and drafting resources. They are valuable for spotting issues and proposing language, but they are not a universal legal rule or a legal opinion about your agreement. If a publisher proposes a new AI use, ask for the purpose and safeguards in writing and obtain qualified advice before agreeing.

Frequently Asked Questions
Does an “all rights” clause automatically let my publisher train AI on my book?
No automatic answer follows from that phrase alone. Read the definitions, reservations, derivative-work language, digital and future-media wording, sublicensing terms and governing law together. The Authors Guild advises expressly reserving AI rights an author does not want to grant, but that is model-contract guidance rather than a universal legal rule.
If my contract bans AI training, can the publisher still make summaries or a chat-with-a-book product?
Possibly, depending on the wording. Training a model and using text to generate summaries, answers, recommendations or retrieval results are different purposes. Check whether outputs, RAG, summaries, chat applications and subsidiary licensing are separately addressed.
Can a publisher paste my unpublished manuscript into ChatGPT or another consumer chatbot?
Look for a clause covering uploads, confidentiality, personal information, vendors and AI tools. The Authors Guild’s April 16, 2026 statement, updated April 22, recommends prior written permission and an opt-out from third-party training when permission is granted. That recommendation is not automatically part of every contract.

The relevant contract should define the users, systems and purposes. A narrowly drafted exception might cover ordinary marketing, sales, search or distribution operations, while excluding public products and unrestricted vendor use. Check retention, security and whether the vendor may train its own model.
Can my editor use AI to rewrite my manuscript?
Do not assume so. Check author-approval, editing, confidentiality and AI clauses. The Guild has proposed language barring substantial AI editing while allowing basic spelling and grammar-checking applications; it is suggested language, not a universal term.
How should AI income be paid?
Look for a defined royalty or fee, accounting schedule, audit rights, deductions and a rule stating whether subsidiary-rights income is credited against an advance. The Guild’s model commentary says such income would typically be applied against an advance unless the parties agree otherwise, but your negotiated contract controls.
Do AI permissions end when my book rights revert?
They may or may not. Check term, territory, reversion, termination, survival and sublicensing provisions. Ask whether existing licenses can continue after reversion and whether new uses are prohibited once the publishing term ends.

Who should review a confusing AI clause?
Give the complete signed agreement, amendments and the proposed use to your agent or an attorney familiar with publishing contracts and the governing jurisdiction. A contract-review service may be another option, but confirm its current eligibility, terms and pricing directly before relying on it.
The Bottom Line
Bottom line: Treat “AI rights” as a set of specific permissions, not a single switch. Trace the grant, reservations, definitions, formats, territory, term, sublicensing and amendments; map training, outputs, internal tools, uploads, editing and products separately; then check approval, security, retention, accounting, compensation and reversion. If the wording is broad, conflicting or silent about a material use, pause and obtain advice on the complete agreement before signing, uploading or consenting.
