To check whether your seafarer income is taxable in India, first determine your Indian tax residence for the relevant tax year, then assess where your salary accrued and the details of your employment and voyages. Your days in India, citizenship and qualifying reason for leaving can affect the residence test; an NRE account, foreign-currency payment or “foreign salary” label does not decide the salary question by itself.
India’s Income Tax Department guidance and the 2026 rules provide important tests and filing context, but they do not settle every seafarer’s salary-tax position without the person’s full facts. This guide reflects official material checked on 7 October 2026; it is general information, not an individual tax opinion.

Start with the tax year
The governing law depends on when the tax year begins, even if you deal with the return or assessment later. The Income Tax Department says the Income-tax Act, 1961 continues to determine residence for tax years beginning before 1 April 2026. Tax years beginning on or after 1 April 2026 fall under the Income-tax Act, 2025. The Department says the basic residence conditions have not changed, although the governing statute and section references have.

| Tax year begins | Residence law to check |
|---|---|
| Before 1 April 2026 | Income-tax Act, 1961 provisions applicable to that year, according to the Income Tax Department’s Non Resident FAQs. |
| On or after 1 April 2026 | Income-tax Act, 2025 and the current rules. |
Use the provisions and return instructions applicable to the specific year you are checking; do not carry a section number or filing rule over from a different year without verifying it.

Check your Indian tax residence
The Department describes the basic individual residence tests as presence in India for 182 days or more during the relevant year, or presence for 60 days or more in that year together with 365 days or more in the preceding four years. Statutory modifications can change how these tests apply, so the thresholds should not be treated as a complete answer for every person.
Check whether the seafarer-related threshold applies
The Department says an Indian citizen leaving India for employment outside India, or as a crew member of an Indian ship, is regarded as resident only if present in India for at least 182 days during that year. Do not assume this treatment applies to every seafarer: citizenship, the reason for leaving and qualifying crew status matter, and the statutory conditions must be checked for the relevant year.
Build a reliable day count
- Choose the tax year and make a dated list of each arrival in and departure from India during that year.
- Total the days in India for that year and gather the corresponding totals for the preceding four years.
- Compare those totals with the applicable residence tests, checking for statutory exceptions or modifications that fit your circumstances.
- Keep the records used to establish the dates. Do not assume that time at sea, transit, vessel flag or the job title “seafarer” automatically changes the statutory count.
Passport and immigration movement records, tickets and travel documents can help reconstruct the timeline. Where a day-count edge case could change the result, confirm the applicable legal counting rule rather than relying on a rough estimate.

Residence is one part of the analysis, not a complete answer about salary. Identify the employer and contract, the vessel and its routes, where you performed your duties, how and when salary accrued, who paid it, and how it was credited. Then assess whether the income accrues or is deemed to accrue in India under the law applicable to that tax year.
- Do not treat an NRE account as a salary exemption. Official FAQ material discusses conditions for exemption of interest on eligible NRE accounts. That is a separate interest rule, not a general exemption for salary paid into the account.
- Do not rely on the currency or description of the payment. A foreign-currency payment or a label such as “foreign salary” does not by itself establish the source or tax treatment of the income.
- Do not apply a blanket rule to shipboard work. The available official guidance does not establish that all salary from a foreign ship is tax-free whenever a seafarer is non-resident, or that salary is taxable merely because it is remitted to India.
The facts may also require checking a relevant tax treaty and any foreign tax paid. The Income Tax Department describes its non-resident guidance as an overview that is not exhaustive, so a personal conclusion may require advice based on the complete statute and employment facts.

Keep records that support your position
Preserve documents that establish both your movements and the income arrangement. Useful records include:
- Passport, immigration movement history, tickets and other travel records;
- Continuous Discharge Certificate (CDC), vessel details and voyage records;
- Employment agreement and any documents describing the employer, duties and pay terms;
- Payslips, payment statements and bank-credit records; and
- Foreign tax certificates, if tax was paid outside India.
The 2026 rules include a specific eligible-voyage provision whose text describes international carriage of passengers or freight between an Indian port and a foreign port, and refers to the sign-off date entered in the CDC. That definition belongs to the rule in which it appears; it should not be generalized into a universal definition of a seafarer’s voyage or tax status.
Check the return and disclosure requirements
The correct return form depends on your full profile, including residence, total income, income heads and other eligibility conditions. The Income Tax Department’s ITR-2 manual says residents report foreign-source income in Schedule FSI and describes Schedule FA requirements according to residential status. Under that manual, non-residents and RNORs need not fill Schedule FA. Confirm the notified form and instructions for the particular year rather than assuming that one form or disclosure rule applies to every seafarer.
When to get individual advice
Consider consulting a qualified Indian tax adviser if your day count is close to a threshold, the seafarer-related exception may or may not apply, your employment or voyage facts are mixed, or you need to determine salary sourcing, treaty relief or return obligations. Take the year-by-year travel record, CDC and voyage details, contract, pay records and foreign-tax documents so the advice can address the actual facts.
