How to Check Whether Your Product Qualifies for Lower Tariffs Under the India–US Trade Agreement

Start with the shipment’s direction, exact tariff classification, country of origin and the importing country’s current legal tariff schedule. A product’s appearance in a public summary of the February 2026 India–US framework does not, by itself, establish a lower rate for a particular shipment. As of the official materials reviewed through October 13, 2026, the framework had not been accompanied in those sources by a final product-by-product schedule and full origin procedures. Treat an individual shipment’s eligibility as unconfirmed until current official implementation materials support the claim.

What the India–US framework says—and what it does not establish

The White House joint statement of February 6, 2026 described the countries as having reached a framework for an interim agreement. It said the terms “will include” tariff changes and that the two countries “will establish rules of origin.” It also said they would work toward finalizing the interim agreement. Those descriptions identify intended terms; they are not a final tariff schedule or a complete procedure for claiming a preference.

The White House fact sheet of February 9 said the US reciprocal tariff on India would be lowered from 25% to 18% and that an additional 25% tariff would be removed by executive order. Tariffs can change through later executive action, so those announced figures should not be treated as the rate currently payable on a shipment without checking the current schedule and implementing notices.

USTR’s 2026 National Trade Estimate also describes the February announcement as a framework and says the parties would continue working toward finalization. USTR’s tariff-actions index lists the February 6 statement and February 9 fact sheet, but the reviewed index does not provide a later India product tariff schedule or final origin rules. The official materials reviewed through October 13, 2026 therefore do not settle whether a particular product can claim a specific preferential rate today.

First identify which country is importing the goods

The framework describes different treatment depending on the direction of trade. The tariff that matters for a shipment is generally the importing country’s tariff, so begin by identifying where the goods will be entered for customs—not simply where the seller is located.

Shipment direction What the February 2026 framework described What you still need to establish
US goods entering India India would eliminate or reduce tariffs on US industrial goods and a range of food and agricultural goods, including dried distillers’ grains, red sorghum for animal feed, tree nuts, fresh and processed fruit, soybean oil, wine and spirits. The current Indian tariff line and applicable measure, plus any conditions for the shipment. The framework-level category list does not determine the rate for a specific item.
Indian goods entering the United States The joint statement described an 18% reciprocal tariff for specified originating Indian categories, including textiles and apparel, leather and footwear, plastic and rubber, organic chemicals, home décor, artisanal products and certain machinery. The current US tariff schedule and implementing measures for the exact classification, origin and entry date. Do not assume the announced figure is the full duty or remains current.
Some Indian goods entering the United States The statement said reciprocal tariffs could be removed for a wider list, including generic pharmaceuticals, gems and diamonds, and aircraft parts, subject to successful conclusion of the interim agreement. It also described separate treatment for certain aircraft and aircraft parts, an automotive-parts tariff-rate quota, and pharmaceutical outcomes contingent on a Section 232 investigation. Whether the relevant conditional agreement, measure, quota or investigation outcome is in force, and whether the item and shipment satisfy its terms. These are not a general duty-free promise.

The Government of India’s February 9, 2026 backgrounder also reports category-level outcomes for Indian exports, including textiles, leather and footwear, gems and jewellery, home décor, toys, machinery and certain agricultural products. That is a government summary, not a substitute for the tariff classification or legal schedule that determines the rate charged at entry. For a US import, check the current US legal schedule; if it differs from the Indian summary, the US measure governs the US tariff charged at entry.

First collect the facts customs will actually test

Before searching a tariff database, assemble a product file. Include a precise description, technical drawings or photographs where useful, materials and percentages, principal function, dimensions, processing steps, packaging, intended use and the countries in which each production operation occurred. Keep the commercial invoice, bill of materials, purchase records and manufacturing flow available. Classification and origin decisions depend on these facts, not on a marketing name.

Also record the importer of record, planned port, expected entry date and whether the goods will be entered for consumption, warehoused or used under a special procedure. The same article can face a different legal measure depending on the date or use. If the shipment is a composite set, unfinished article or kit, explain how the pieces are packaged and sold together; do not assume that a single retail description produces a single tariff result.

Use this six-step check for a particular shipment

  1. Write down the importing country and entry date. Record whether the goods are entering India or the United States and when the customs entry is expected. The framework’s measures differ by direction, and the applicable tariff can change over time.
  2. Get the importing country’s tariff classification. Identify the exact tariff line using the product’s material, function, composition and other relevant customs facts. A broad label such as “machinery,” “textile” or “food” is not a tariff-line determination. Do not rely on a marketing name or a sector heading alone.
  3. Check the current official tariff schedule and notices. For that tariff line, verify the ordinary duty and every additional, preferential or other measure that could apply on the entry date. Check the current implementing notice as well as the schedule; an announcement or summary of a framework does not prove that a change has taken effect.
  4. Establish customs origin from the production history. The shipment route and seller’s address do not, by themselves, establish origin. USTR explains that rules of origin determine whether a good is originating and qualifies for preferential tariff treatment under a free trade agreement. Apply the final agreement’s origin rule to the product and its production facts; the joint statement’s promise to establish rules is not itself that rule.
  5. Read every condition attached to the measure. Confirm whether the applicable rule requires an origin declaration or certificate, supporting production and input records, a quota allocation or limit, a particular end use, or compliance with exclusions or another claim condition. Follow the requirements in the current official rule rather than assuming that category membership is enough.
  6. Resolve uncertain classification or origin before claiming a preference. A customs broker or trade-compliance adviser can help when the product facts or rule are complex. If the importing country’s customs authority offers a binding ruling process, check that country’s procedure to see whether a ruling is appropriate. No single procedure or provider applies to both countries.

How to classify the product without relying on a sector label

Classification is often the first point at which an apparent preference disappears. “Machinery” can cover products with different functions, materials and tariff lines. “Textile,” “food,” “aircraft part” or “plastic product” is only a starting description. The importing authority may distinguish finished goods from parts, retail sets from individual articles, or products by composition and principal use.

Describe what the item is, what it does and how it is made. For a textile article, identify fiber content, construction and finished use. For a chemical, identify composition and concentration. For a machine, identify its function, operating principle and whether it is complete or presented as a part. For an agricultural product, identify whether it is fresh, processed, blended or packaged for a particular use. These details help the classification analysis; they do not guarantee a result.

Do not select a tariff line because it produces the lowest duty. Keep the classification analysis separate from the preference analysis. First determine the legally correct line, then test the rate and any India–US measure attached to that line. If two reasonable classifications remain, document the alternatives and obtain advice or a binding ruling where available.

How origin differs from shipping route

A good shipped from India is not automatically Indian-origin, and a US seller’s invoice does not automatically make goods US-origin. Origin is determined by the applicable legal rule and the production history. The relevant facts can include where materials were obtained, where substantial processing occurred and whether the final rule imposes a tariff-shift, value, processing or other test.

The joint statement says the countries will establish rules of origin “that ensure that the benefits of the Agreement accrue predominately to the United States and India.” That is an intended policy description, not a usable calculation. Until the operative rule and its documentation procedure are published, an exporter should not invent a regional-value percentage, transformation test or certificate format.

Map every significant input and operation. Identify imported components, intermediate processing, assembly, testing, repacking and labeling. A simple change of packaging or a sale through an Indian or US distributor should not be treated as proof of originating status. Retain supplier declarations and production records if the eventual rule requires them, and make sure the records can be tied to the specific shipment and tariff classification.

What proof of origin may be needed

The exact proof depends on the current implementing measure. It may call for an origin declaration, a certificate, specified data elements on a commercial document or records kept by the exporter and producer. The February framework materials do not provide the final form, issuing authority, validity period or retention period. Therefore, do not copy a certificate from another trade agreement or assume that a chamber-issued document will satisfy the India–US rule.

Before filing a claim, check who may make the declaration, whether the importer must possess it at entry, whether electronic records are accepted, how corrections are handled and how long records must be retained. Confirm whether the producer, exporter and importer have separate responsibilities. If the rule is not published, the safest description is that proof requirements remain to be confirmed.

How to evaluate the product lists without overreading them

Category inclusion is a lead, not an eligibility decision

A public list can help you identify a measure worth checking, but it does not establish the product’s tariff line, origin, effective date or compliance with shipment conditions. For example, “tree nuts” in the India-facing list does not tell an importer which tariff line applies to a particular nut product or whether a specific entry qualifies. Likewise, “textiles and apparel” in the US-facing list does not show that every textile item receives the same treatment.

Keep distinct measures distinct

The framework describes different mechanisms: reductions or eliminations on some tariffs, an announced reciprocal tariff for specified categories, conditional removal for a wider list, a tariff-rate quota for automotive parts, and pharmaceutical outcomes contingent on a Section 232 investigation. A quota can limit the amount receiving a specified treatment; a conditional outcome may depend on an event or implementing action. Do not merge these into a single claim that a sector is “duty-free.”

Separate the agreement from other tariff actions

The announced 18% reciprocal figure may be only one component of the duty calculation. An article can also be subject to an ordinary tariff, an additional trade measure, a quota rate or a product-specific action. The fact sheet’s reference to removing an additional 25% tariff by executive order must be checked against the order and current schedule applicable on the entry date. A rate quoted in a news report may describe one layer rather than the importer’s total liability.

Compare the whole tariff picture before estimating savings

Build a comparison showing the ordinary duty, any additional measure, the potential preferential or reduced rate, the effective date and the conditions for each. Record whether the rate is ad valorem, specific or compound, and whether a quota changes the rate after a limit is reached. Include customs value assumptions and other entry charges separately from the tariff percentage.

Do not use India’s national average to price a shipment. USTR’s 2026 National Trade Estimate reports India’s average applied most-favoured-nation tariff rates using 2024 data: 16.2% overall, 13.0% for non-agricultural goods and 36.7% for agricultural goods. Those averages describe the tariff environment across many products; they do not identify the rate for a particular tariff line or predict the savings on an individual entry.

Likewise, the Government of India’s February 9, 2026 backgrounder reports USD 86.35 billion in exports to the United States in 2024. That is useful trade context, not evidence that a particular exporter or product qualifies. A large export category can contain many tariff lines and different origin or quota outcomes.

Special issues for conditional categories

Automotive parts: the joint statement refers to a tariff-rate quota. Confirm the quota quantity, period, allocation method, entry procedure and rate inside and outside the quota. Do not assume that every automotive part receives the same treatment or that a quota remains open for the entire calendar year.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Pharmaceuticals: the statement ties outcomes to a Section 232 investigation. Check whether the investigation has produced an operative measure and whether the product is within its scope. A generic pharmaceutical label alone does not establish eligibility.

Aircraft and aircraft parts: the statement describes separate treatment for certain aircraft and parts. Determine whether the article is covered by the specific provision, rather than relying on the broad phrase “aircraft parts.”

Gems, diamonds and other listed goods: a reference to possible reciprocal-tariff removal is expressly conditional on successful conclusion of the interim agreement. Verify that the condition has occurred and that the final legal text covers the exact classification and origin.

When you can treat eligibility as confirmed

Do not treat the answer as confirmed until the importing country’s current official materials let you match all the relevant facts to an operative measure. A useful shipment file should support each of these checks:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • The direction of trade and expected customs-entry date are clear.
  • The exact tariff classification used by the importing country is supported by the product facts.
  • The current schedule or implementing notice identifies the applicable tariff treatment for that classification.
  • The applicable origin rule covers the product’s production history, and the shipment meets it.
  • Required declarations, certificates and supporting records are available in the form the current rule requires.
  • Any quota, end-use, exclusion, investigation-related condition or other limitation has been checked.
  • The person making the claim has authority to do so and understands the record-retention and correction requirements.

If an official schedule or origin procedure is not available, or the product facts do not clearly meet its terms, the responsible answer is that eligibility has not been established. Do not make a preferential-rate claim based only on the February framework announcement or a government category summary.

Common mistakes that create duty exposure

  • Using the seller’s location as origin: distribution and invoicing do not replace the production-history test.
  • Applying the announcement percentage to every product: the 18% figure concerns specified originating Indian categories and may not be the full duty.
  • Ignoring the entry date: executive actions, schedules and quotas can change after a quotation is prepared.
  • Treating a category as a tariff line: “food,” “machinery” or “textiles” is too broad for a customs claim.
  • Missing conditions: a quota, end-use rule, exclusion or investigation can change the result even when the product appears on a list.
  • Using an unverified certificate: a form from another agreement may not satisfy the eventual India–US procedure.
  • Calculating savings from averages: national tariff averages and trade totals do not determine an importer’s bill.
  • Claiming first and investigating later: wait until classification, origin, rate and documentation are supported by current official material.

Official sources to check before an entry

The relevant official materials identified for this framework are the White House joint statement of February 6, 2026; the White House fact sheet of February 9, 2026; USTR’s 2026 National Trade Estimate and tariff-actions index; the Government of India’s February 9, 2026 backgrounder; and USTR’s guidance on rules of origin. The USTR 2026 annual report also summarizes the framework but does not supply a final schedule. Because these sources are announcement and summary materials rather than a complete shipment-level procedure, check the current implementing material from the customs or trade authority in the importing country before relying on a rate.

For a US entry, the current US tariff schedule and implementing notices control the US duty collected at entry. For an India entry, consult the current Indian tariff and customs measures. If a government summary and a later legal schedule differ, use the operative schedule for the importing country and retain the summary only as background.

Frequently Asked Questions

Does my product qualify for lower India–US tariffs if it is on the February 2026 list?

Not automatically. A list is a starting point. You must match the exact tariff classification, importing country, country of origin, entry date and all conditions in the current implementing measure.

How do I check the tariff on an India–US shipment?

Identify the importing country, obtain its exact tariff classification, check the current legal schedule and notices, and compare ordinary, additional and preferential measures for the expected entry date.

What proof of origin do I need?

The required form depends on the operative India–US rule. It may involve a declaration, certificate or specified records, but the February framework materials do not establish the final format or procedure. Follow the current official rule rather than reusing a document from another agreement.

Is the announced 18% rate the total duty on Indian goods entering the United States?

Do not assume so. The statement describes an 18% reciprocal tariff for specified originating Indian categories. Ordinary duties, other measures, quotas, exclusions and later executive actions may also affect the amount due.

Are Indian pharmaceuticals, gems or aircraft parts automatically duty-free?

No. The statement describes possible removal or separate treatment for some of these goods, with conditions including successful conclusion of the interim agreement and, for pharmaceuticals, a Section 232 investigation. Verify the operative measure for the exact tariff line.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can a customs broker confirm eligibility?

A broker or trade-compliance adviser can help analyze complex classification and origin facts, but the claim still must meet the importing country’s current legal requirements. Ask what source and documentation support the advice.

What should I do if the final origin rules are not published?

Treat preferential eligibility as unconfirmed. Use the current ordinary and other applicable tariff treatment, monitor official implementation notices and avoid making a lower-rate claim until the origin procedure is available and the shipment meets it.

The Bottom Line

Bottom line: Do not infer a lower India–US tariff from a product name, seller location or February announcement. Confirm the trade direction, exact importing-country tariff line, production-based origin, current legal rate, effective date and every documentation, quota, end-use or conditional requirement. The February 6 and 9, 2026 materials describe a framework, not a complete product-level entitlement; until current implementation rules support the claim, treat shipment eligibility as unconfirmed.
