How to Check Whether Your Job Offer Requires an H-1B Visa

By Freedom251 Team · · 16 min read

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A job offer alone does not tell you whether you need H-1B status or whether the employer will sponsor you. Check two things separately: whether your current U.S. work authorization covers the job and whether the employer will sponsor this specific role, for your circumstances and start date. If sponsorship is available, confirm which filing steps have actually happened; an offer or certified Labor Condition Application (LCA) is not final approval.

Start with two separate questions

“Does this job require H-1B sponsorship?” can mean either that you need an employer-sponsored immigration process to take the job, or that this employer is willing to sponsor you. Those are different questions, and the offer letter may not answer either one.

  • Do you need sponsorship for this job? That depends on your individual immigration status and work authorization, including whether it permits you to work for this employer in this role and on the planned start date. Do not assume that every noncitizen needs H-1B status.
  • Will the employer sponsor you? That is an employer-policy question for this specific position and your circumstances. Ask the recruiter or HR directly, preferably in writing.

An H-1B is an employer-led process for qualifying specialty-occupation employment. In general, the employer files an LCA with the Department of Labor (DOL), then may file a petition with U.S. Citizenship and Immigration Services (USCIS) after the LCA is certified. A worker outside the United States may also need a visa issued by the Department of State (DOS); a worker already in the country may instead need a change or extension of status through USCIS. The appropriate steps depend on the person’s situation.

Check your current work authorization before judging the offer

Whether an H-1B is necessary cannot be determined from a job title, an offer letter, or citizenship alone. First establish whether your existing authorization permits you to take this particular job and begin on the proposed date. Work authorization questions are individual-specific, so do not treat a general description of a visa category or someone else’s experience as a decision about your own eligibility.

If you are uncertain, identify what authorization you currently hold and whether it covers the proposed employer, role, and timing. Ask a qualified immigration attorney if the answer is unclear. This guide explains the general process; it cannot determine an individual’s immigration status or eligibility.

Keep the question focused: you are not only asking whether you can work in the United States in general, but whether your authorization permits this job with this employer at the time you expect to start. If the answer is yes, an H-1B may not be necessary for that job at that time. If the answer is no or uncertain, that still does not automatically establish that H-1B is the right or available route; the employer must be willing to pursue it, and the role and worker must meet the applicable requirements.

Ask the employer a precise sponsorship question

Generic answers such as “we hire international candidates” or “sponsorship may be available” do not establish that the employer will sponsor this role or meet your timeline. Ask about the position and your circumstances directly. For example:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does this position offer H-1B sponsorship for my circumstances and proposed start date? If so, will the employer file the Labor Condition Application and the USCIS petition, and what stage has the process reached?

Ask the recruiter or HR representative to confirm the answer in writing. If the employer says sponsorship is available, clarify whether that means it will consider sponsorship, intends to begin the process, has already filed something, or has completed a particular stage. Those statements are not interchangeable.

A useful follow-up is to ask the employer to be specific about the “who, what, and when”: who will handle the process, what filing the company expects to make for this position, and when it expects to begin. Ask whether the response applies to your particular circumstances rather than to company policy in general. An employer may have sponsored other workers without having decided to sponsor this particular opening.

If the answer is no, ask whether that is a firm policy for this role or a timing limitation. If the answer is conditional, ask what condition must be met and who will confirm it. These questions help you understand the offer; they do not obligate the employer to sponsor or guarantee that a filing will succeed.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Inspect the offer and job description for the facts that matter

Offer details can help you frame questions, but none establishes by itself that you need H-1B status, that the job qualifies, or that sponsorship has been approved. Read the offer alongside the actual job description and note:

  • Actual duties: What work will you perform, rather than just what the title says?
  • Education requirement: Does the employer specify a bachelor’s degree or equivalent in a particular specialty, and how does that requirement relate to the duties?
  • Work location: Where is the work intended to take place? Location is relevant to the LCA and its coverage.
  • Start date: Does the proposed date leave time for the applicable process, and does your current authorization permit you to work then?
  • Work-authorization language: Does the offer make employment contingent on authorization or sponsorship? If the wording is unclear, ask the employer what it means for your offer.
  • Pay: What wage is offered, and how will the employer address the applicable wage obligation for the occupation and area?

A job title is not enough to determine whether a position qualifies. DOL describes a specialty occupation as requiring specialized knowledge and at least a bachelor’s degree or equivalent in the specific specialty. USCIS reviews the petition, including whether the job meets specialty-occupation requirements and whether the prospective worker’s qualifications meet the requirements. The employer’s description of duties and degree requirements therefore matters more than a title considered on its own.

When you read the description, compare the stated education requirement with the work the employee will actually do. The relevant question is not simply whether the job sounds technical or professional, or whether people in similar titles often have degrees. DOL’s description ties the occupation to specialized knowledge and a degree or equivalent in the specific specialty. A broad title without a clear description leaves a question to resolve with the employer; it is not proof either way.

Keep a copy of the posting and the offer as you ask questions. If their descriptions differ—for example, if one gives a work location and the other gives another, or the duties have changed—request clarification about which details describe the position the employer would use for the filing. The materials are useful for identifying questions, but they are not a substitute for the employer’s filing or USCIS’s review.

Understand what the employer must do—and what each stage means

DOL and USCIS have different roles in the employer-led process. DOL’s Employment and Training Administration receives the employer’s LCA. The employer attests to program conditions, including wage requirements. After certification, the employer may file Form I-129 with USCIS. A certified LCA is a step before that petition; it is not a USCIS approval.

Stage What happens What it does not establish
Employer decision The employer decides whether it will sponsor this worker for this role and timeline. A general company policy or recruiter’s informal comment does not show that the employer has filed anything.
DOL LCA The employer submits the LCA and attests to program conditions, including wage requirements. DOL reviews it before a possible USCIS petition. Certification is not approval of the USCIS petition, a visa issuance, or a determination that you can begin work.
USCIS petition After LCA certification, the employer may file Form I-129. USCIS reviews the petition and relevant information, including the role and the worker’s qualifications. An LCA alone does not show that USCIS approved the petition.
Visa or status step A qualifying worker outside the United States may need a visa from DOS. Someone already in the United States may instead need a USCIS status action, such as a change or extension of status, depending on the circumstances. A petition filing or approval should not be confused with visa issuance or the status action applicable to a person already in the country.

When an employer says “the paperwork is underway,” ask which stage that refers to and what remains. Ask whether the LCA has been submitted or certified, whether the petition has been filed or decided, and whether you will need a visa or a status action. Do not treat a projected start date as proof that all required steps will be completed by then.

It also helps to ask for the status of each step separately rather than using a general word such as “approved.” For example, “Has the LCA been certified?” is different from “Has the USCIS petition been filed?” and both are different from asking whether a visa has been issued or an applicable status action has been completed. The agency and step matter because each answers a different question.

Check how the wage and work location fit the filing

The wage obligation is not resolved by comparing your offer only with a broad salary average. DOL states that the required wage rate must be the higher of the actual wage for comparable employees or the prevailing wage for the occupational classification in the area of intended employment. The offered wage, occupation, comparable workers, and intended work area are therefore relevant questions for the employer. The available information here does not calculate the applicable wage for an individual job.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Confirm the work location as well as the job duties and pay. The LCA relates to the intended area of employment, so a location in the offer or job description is useful information to verify with the employer. If the role’s location, work arrangement, or wage is unclear, ask for clarification rather than assuming that the offer alone settles the issue.

For a practical conversation, ask how the employer identifies the occupational classification and intended area of employment, and how it addresses the required-wage rule. The DOL’s FLAG LCA program page describes the wage as the higher of the actual wage rate for comparable employees or the prevailing wage for the occupation and area. That rule is not the same as a general comparison with a salary website or a market average. This article cannot calculate the appropriate rate from an offer alone.

Do not infer sponsorship from a job advertisement

A job posting can offer a clue about employer policy, but its wording alone does not decide whether sponsorship is available for you. Nor does the absence of a request to recruit U.S. workers prove that a role cannot be sponsored. DOL says most employers are not required to recruit U.S. workers before seeking H-1B workers; special rules apply to H-1B-dependent employers and certain willful violators. For your decision, ask the employer about this particular role instead of drawing a conclusion from generic posting language.

In the same way, a posting that says “sponsorship available” is not the same as a commitment to sponsor every candidate or an indication that a filing has begun. A posting that says sponsorship is unavailable does not answer whether some other authorization you already hold permits you to take the job. Treat posting language as a prompt for a direct question, not as an individual eligibility determination.

Use this checklist before accepting or planning a start date

  1. Identify your authorization question. Determine whether your current work authorization permits this job and the proposed start date. If you do not know, seek qualified, case-specific guidance.
  2. Get the role details. Save the job description and confirm duties, required degree or equivalent, work location, offered wage, and proposed start date.
  3. Ask about sponsorship in writing. Ask whether the employer will sponsor this role for your circumstances and timing—not merely whether the company sponsors some employees.
  4. Ask what the employer will file. If the answer is yes, confirm whether the employer will submit the LCA and petition and who will handle communications about each step.
  5. Confirm the actual stage. Distinguish an intended filing from an LCA submission or certification, a USCIS petition filing or decision, and any visa or status step that applies to you.
  6. Clarify timing and conditions. Ask how sponsorship relates to the offer’s conditions and planned start date. Do not assume a filing or agency review will be completed by a particular date.
  7. Get case-specific advice when needed. If your current authorization, the role’s requirements, or the offer’s conditions are unclear, consult a qualified immigration attorney.

Before making a decision, make sure you can answer three plain questions: what authorization would let you begin the job, whether the employer will sponsor this exact role if needed, and what steps remain before the planned start. If one answer is unknown, mark it as unknown and ask for clarification rather than treating an assumption as a completed step.

If you are comparing two offers

Compare the details that affect your ability to take each job, not just whether either employer has sponsored workers before. The same person may have different practical questions for two roles because employer policy, duties, location, pay, timing, and current authorization can differ.

Question Offer A Offer B
Will the employer sponsor this specific worker and role? Confirm directly with the employer. Confirm directly with the employer.
Do the duties and degree requirement plausibly fit a specialty occupation? Review the actual job description and stated education requirement. Review the actual job description and stated education requirement.
What work location is intended for the LCA? Confirm the location with the employer. Confirm the location with the employer.
How does the offered wage relate to the applicable wage obligation? Ask how the employer addresses the actual-wage and prevailing-wage framework. Ask how the employer addresses the actual-wage and prevailing-wage framework.
What filing stage has been reached, and what remains? Record the stage the employer confirms and the steps still needed. Record the stage the employer confirms and the steps still needed.
Does your current authorization permit the planned start date? Assess based on your own authorization and circumstances. Assess based on your own authorization and circumstances.

These questions help organize a comparison; they do not substitute for a candidate-specific eligibility determination. Do not assume that the offer with the earlier start date is more feasible simply because its employer has sponsored before. The present status of your authorization and the specific filing stage for that role are more useful facts to verify.

Keep cap and timing figures in context

DOL’s program overview lists an annual statutory cap of 65,000, plus a 20,000 advanced-degree exemption. Those figures are context, not a test for whether your offer requires sponsorship. Not every case is subject to the cap, so the figures do not establish whether a particular worker or position will be counted against it. Cap rules and registration details can change; check current agency guidance for the circumstances that apply.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

DOL says LCAs are reviewed within seven working days for completeness and obvious errors or inaccuracies. That is a statement about LCA review, not a guaranteed timeline for USCIS petition action, visa issuance, or a status change. It does not promise that a worker can start by a particular date.

Use those figures narrowly. The 65,000 cap and 20,000 advanced-degree exemption are program context, not a prediction that a particular petition will be filed, counted, or approved. Likewise, seven working days is the DOL’s stated LCA review period for completeness and obvious errors or inaccuracies; it is not the duration of the whole process. Ask the employer which steps apply to your situation and consult current agency guidance for details that can change, including cap and registration rules.

Common misreadings to avoid

  • “I received an offer, so sponsorship is included.” An offer does not by itself confirm the employer’s sponsorship decision.
  • “The job title tells me whether it qualifies.” The duties and specific degree requirements matter; a title alone does not settle specialty-occupation eligibility.
  • “The LCA is certified, so the case is approved.” The LCA is an earlier DOL step. The employer may then file a petition with USCIS, and further visa or status steps may apply.
  • “I am not a U.S. citizen, so I must need H-1B.” Do not assume that: whether another existing authorization covers the job is an individual question.
  • “The company sponsors, so it will sponsor this opening.” Ask whether sponsorship is available for this role, worker, and timeline.
  • “A seven-working-day LCA review means I can start in a week.” The stated review period is limited to DOL’s LCA review for completeness and obvious errors or inaccuracies, not the entire process.

Does a job offer automatically mean I need an H-1B?

No. An offer by itself does not establish that you need H-1B status. The answer depends on whether your current work authorization permits you to take that job and on whether the employer will sponsor the position if sponsorship is needed.

How do I know whether an employer will sponsor my visa?

Ask the recruiter or HR directly, in writing, whether the employer will sponsor H-1B status for your circumstances, this specific role, and your proposed start date. If the answer is yes, ask whether the employer will file the LCA and petition and which stage, if any, has already happened.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does my offer letter prove that the employer is sponsoring me?

Not by itself. Review any work-authorization or sponsorship language, but ask the employer what it means for your offer. An offer letter does not establish that an LCA has been filed or certified, that USCIS has approved a petition, or that a visa or status step is complete.

Can I work in the United States without H-1B sponsorship?

Possibly, if your existing work authorization permits you to work for this employer in this role and at the planned time. That is individual-specific. Do not assume that every noncitizen needs H-1B status, and get qualified advice if you cannot determine what your authorization allows.

Does an approved or certified LCA mean my H-1B is approved?

No. The employer submits the LCA to DOL before it may file the petition with USCIS. LCA certification is not USCIS petition approval, visa issuance, or proof that you may begin work.

The Bottom Line

A job offer does not tell you on its own whether you need H-1B status or whether the employer will sponsor you. Verify that your current work authorization covers the job and start date, ask the employer in writing about sponsorship for this exact role, and identify whether the process is at the LCA, USCIS petition, or visa/status stage. Treat an offer, job ad, or certified LCA as a prompt to confirm details—not as final approval.
