How to Check Whether Your Employer Sponsors H-1B Visas

To check whether an employer has sponsored H-1B workers before, search the USCIS H-1B Employer Data Hub, then cross-check the employer in the Department of Labor’s (DOL) LCA disclosure files. Treat both as historical evidence, not a promise: a DOL filing is not a USCIS approval, and neither database confirms whether the employer will sponsor this particular job. Ask the recruiter or HR contact directly about the role, worksite, and your circumstances.

The useful question is not only “Does this company sponsor H-1B visas?” It is also whether the legal entity hiring you will sponsor this particular position, at this worksite, for your situation. Public records can help you prepare for that conversation, but they cannot replace a direct answer from the employer.

1. Search USCIS’s H-1B Employer Data Hub

The USCIS H-1B Employer Data Hub is the most direct public source for an employer’s historical H-1B petition activity and decisions. USCIS’s 2026 report on fiscal year 2024 describes the Hub as covering fiscal years (FY) 2009–2024 and being updated quarterly. That coverage is a historical range, not a forecast of future sponsorship.

  1. Open the USCIS H-1B Employer Data Hub and search the employer’s name.
  2. Try plausible name variants, such as a full legal name and a commonly used shortened name. If the Hub allows it, narrow results by fiscal year, North American Industry Classification System (NAICS) code, city, state, or ZIP code.
  3. Compare the result with the employer that is actually hiring you. USCIS identifies employers using the last four digits of tax identification numbers; a similar name alone does not establish that a record belongs to the same company.
  4. Review the relevant petition history and first decisions as historical records. Do not treat an employer’s presence in the Hub, or a count of prior petitions, as confirmation that it will file for a particular vacancy.

USCIS’s report describes the Hub’s dataset and limitations. For the range and update cadence, use the report’s stated coverage rather than assuming the displayed information represents current hiring policy.

When you search, start broad enough to catch naming differences, then narrow the results with the location and time period that make sense for the employer you are checking. A company may be known by a brand name while records use a formal legal name. Try the complete name from the job offer or company website, a familiar shortened version, and any clearly identified legal entity name. If one search returns a possible match, do not stop at the name: compare the available location information and employer identifier details before attributing the record to your prospective employer.

The Hub is valuable because it contains USCIS petition information and decisions, rather than simply a record that an employer took an earlier step in the process. Still, a historical record answers a limited question: whether petition activity associated with that employer appears in the covered data. It does not tell you whether the company has an open sponsorship policy, whether it sponsors every occupation, or whether it will sponsor you. A large historical count is not a personal probability estimate, and a small count does not tell you what the company plans to do with a current vacancy.

Keep the time range in view. USCIS’s FY 2024 characteristics report, published in 2026, describes Hub coverage from FY 2009 through FY 2024 and quarterly updates. Those dates help you understand what the cited report says about the Hub, but they are not a guarantee that every record is current through the day you search. Check the Hub and its accompanying information for its current coverage and details rather than assuming that the latest fiscal year in a report is the latest available record.

2. Cross-check DOL’s LCA disclosure files

Before an employer can proceed with the H-1B process, it submits a Labor Condition Application (LCA) to DOL. DOL’s Office of Foreign Labor Certification (OFLC) publishes LCA disclosure files and record layouts on its Performance Data page. These files can help you find labor-condition filings associated with an employer, but they show a different stage from USCIS petition decisions.

  1. Open DOL OFLC’s Performance Data page and locate the LCA disclosure files and their record layouts.
  2. Search the employer name and relevant filing year. As with USCIS, check for differences between the public-facing company name and the legal entity name.
  3. Read the file’s status or category fields using its record layout. Note whether a record is filed, certified, withdrawn, or otherwise categorized; do not treat every record as an approved petition.
  4. Compare the employer identity, location, and period with the USCIS results and with the job you are considering.

DOL’s page listed quarterly data, including FY 2025 files and FY 2026 Q3 data when accessed on October 9, 2026. The inventory changes as new data is posted, so check the page itself for the available quarters and years.

The record layouts matter because disclosure files are structured data, and a field or status should be read according to DOL’s definitions rather than guessed from a short label. Locate the layout associated with the file and year you are using. If you are reviewing records from more than one quarter, make sure you understand which period each file covers and whether its fields are presented in the same way. The published inventory may change as DOL posts new files, so use the Performance Data page to identify the appropriate file instead of relying on an old download or a third-party summary.

A DOL record can show that an employer engaged with the LCA stage, and its status can add context about that filing. It still cannot establish that a petition was filed with USCIS, that USCIS approved it, or that the employer would sponsor the position you are considering. The distinction is important even when a record is certified: certification allows the employer to proceed with the USCIS and Department of State process, but it is not itself a USCIS decision on a worker’s petition.

If you find a DOL record but no obvious USCIS match, treat that as a reason to investigate the entity name, timing, and filing stage—not as proof of either approval or failure. Likewise, a USCIS record without an immediately matching LCA result should not be resolved by guessing. The datasets are maintained by different agencies for different stages, and comparing them requires careful attention to employer identity and the period covered.

What the two databases can—and cannot—tell you

Question USCIS H-1B Employer Data Hub DOL OFLC LCA disclosure files
Agency and stage USCIS petition data and first decisions. DOL employer LCA applications and attestations.
Best use Check historical petitions and decisions. Find labor-condition filings and details in disclosure files.
Published scope described by the cited agency source FY 2009–2024 in USCIS’s FY 2024 characteristics report, published in 2026; the Hub is described as updated quarterly. Quarterly files; DOL’s Performance Data page listed FY 2025 quarters and FY 2026 Q3 when accessed on October 9, 2026.
Key limit Past decisions do not establish whether a future role will be sponsored. An LCA filing or certification is not the same as a USCIS petition approval.

An LCA is a required labor-condition step in the process. DOL explains that a certified LCA allows the employer to proceed with the USCIS and Department of State process. It does not establish that USCIS received or approved a petition for a worker. Read the DOL and USCIS records as separate pieces of history, not interchangeable proof.

In practical terms, USCIS is the better place to look for historical petition activity and first decisions; DOL’s files are useful for finding LCA activity and details tied to labor-condition applications. The two sources complement each other, but neither is a live directory of employers currently willing to sponsor. The USCIS Hub does not answer whether a particular open position qualifies under an employer’s internal policy, while an LCA record does not prove that the company completed the later petition step.

Use a result as a lead, not as a conclusion. A USCIS result associated with the same legal employer can be evidence of historical petition activity. A DOL result can be evidence of an LCA filing at an earlier process stage. If the employer names, locations, or time periods do not line up, record the mismatch and ask the employer to explain it. Avoid combining separate records into a claim about the job in hand unless the identity and stage are clear.

3. Match the record to the company that is hiring

Search results can be difficult to attribute when an employer uses an abbreviated name, operates through subsidiaries, or has been acquired. A parent company’s filing is not automatically a filing by its subsidiary, and a record for a similar company name is not proof that the hiring entity sponsored anyone.

  • Compare the legal employer name shown in the job offer or recruiting materials with the names in the records.
  • Check available identifiers and the location details rather than relying on a name match alone. USCIS uses the last four digits of tax identification numbers to identify employers in the Hub.
  • If the names do not line up, ask the recruiter which legal entity would employ and petition for you, if sponsorship is offered.
  • If the records remain ambiguous, ask the employer to clarify whether the filing belongs to its hiring entity, a parent, or an affiliate.

A name that does not appear in a search is not proof that the company has never sponsored an H-1B worker. The entity may appear under another name, and these public records have defined coverage and filing stages.

Make the identity check part of your search rather than an afterthought. The organization whose name appears on a careers page, the brand used in recruiting, and the legal entity that would employ you may not be identical. For your own notes, keep the exact name you searched, the location or time filters you used, and the name shown in any likely result. This makes it easier to ask a focused follow-up question without presenting a tentative match as fact.

Acquisitions and affiliate relationships can also create a misleading impression. A record for a parent, subsidiary, or related organization may be relevant context, but it does not automatically establish that the hiring entity has sponsored workers or will take responsibility for a new petition. Ask which legal entity would employ you and, if applicable, which entity would file. If the recruiter confirms that a related entity handles filings, ask them to clarify the relationship rather than inferring it from similar names.

Be just as careful with a search that returns nothing. A no-result search may reflect a different legal name, spelling, abbreviation, or entity relationship, or may relate to the coverage and filing stages of the records. The appropriate conclusion is that you have not identified a matching record through that search—not that the employer has never sponsored anyone. Try reasonable name variations and then ask the employer directly if the answer matters to your application or offer.

4. Ask whether this specific job is eligible for sponsorship

Government databases document past filings and outcomes; they do not publish an employer’s current policy for every open role. Ask the recruiter or HR contact directly, preferably before you rely on an offer or make plans around sponsorship.

  • Does this specific role and worksite support new H-1B sponsorship?
  • Does the employer sponsor this job family, or only certain positions?
  • Does the employer consider H-1B transfers as well as new petitions?
  • What timing or candidate-specific conditions apply?
  • Which legal entity would employ you and, if applicable, file the petition?

These questions distinguish a company’s general history from the decision that matters: whether it will support your role and circumstances. A record of prior petitions can inform the conversation, but it cannot answer those questions for the employer.

Be specific when you ask. “Does the company sponsor?” can produce a general answer that does not cover your opening. Refer to the job title, the worksite or location, and whether you are asking about a new petition or a transfer. Ask whether the answer applies to this role and job family, rather than assuming that a past filing for another position means the same policy applies. The research steps can tell you what happened in the past; recruiting or HR is the right place to confirm the employer’s current position for this vacancy.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

If a recruiter says the employer sponsors, clarify what that means for your case: whether the company supports a new H-1B petition or a transfer, what timing considerations apply, and whether there are conditions tied to the candidate or role. The employer’s answer may depend on the exact circumstances, so do not treat a broad statement as a commitment for every worker or position. If the answer is unclear, ask for confirmation in writing or request to speak with the appropriate HR contact. Keep the conversation factual and tied to the specific job rather than arguing from a database result.

You can also use a careful question to resolve a record mismatch: “I found a filing under a related company name; which legal entity would employ me and handle any petition for this role?” That invites clarification without claiming that the record proves sponsorship. If you cannot get a clear answer about whether the role supports sponsorship, do not fill the gap with an assumption based on historical counts or LCA activity.

5. If you need more detail about an LCA

DOL’s H-1B Advisor explains that a worker or member of the public may inspect LCA materials at the employer’s principal place of business or at the worksite within one working day of filing. This is a way to inspect LCA materials; it does not turn an LCA into proof of a USCIS petition approval. If a record’s employer identity or status is unclear, request clarification rather than inferring a sponsorship commitment from the filing alone.

This public-access option is specifically about LCA materials. It can be useful if you need to inspect the filing itself or clarify details that are not apparent from a disclosure-file search. It is not a shortcut to a USCIS decision or a way to confirm the employer’s current policy for your job. Keep the distinction between access to a labor-condition record and evidence of a petition outcome clear.

If you are considering this step, identify the filing and employer you are asking about so the request is concrete. DOL’s guidance describes access at the principal place of business or worksite within one working day of filing. If you are not sure whether the record relates to the entity hiring you, first ask the recruiter or HR contact to clarify the legal employer and the filing’s connection to it.

Common misreadings to avoid

  • “There is an LCA, so USCIS approved a worker.” An LCA is a DOL labor-condition filing, not a USCIS petition decision.
  • “The company has sponsored before, so it will sponsor me.” Historical filings do not show current intent for a particular role or candidate.
  • “This similarly named business is the same employer.” Verify the legal entity and available identifiers, especially where affiliates or subsidiaries are involved.
  • “No search result means no sponsorship history.” A missing match does not prove the employer has never sponsored; naming and entity differences can complicate searches.
  • “A general verification-program listing proves H-1B sponsorship.” E-Verify enrollment is a separate employment-verification program, not evidence of H-1B sponsorship.

Another common mistake is to treat a high volume of historical records as evidence that sponsorship is automatic. Counts describe activity in the data, not an individual applicant’s prospects or the employer’s policy for a particular job. Similarly, a record’s presence in one agency’s files should not be described as approval by another agency. State what the record actually shows, check the relevant source and period, and confirm the current role-specific answer with the employer.

Third-party sponsor lists may be convenient starting points, but USCIS and DOL are the primary sources for the records discussed here. When a summary conflicts with an agency record, or leaves out the entity and filing stage, rely on the agency material and verify the match. Do not treat E-Verify enrollment as a substitute: it concerns a separate employment-verification program and does not show that an employer sponsors H-1B workers.

Frequently Asked Questions

How do I check if a company sponsors H-1B?

Search the USCIS H-1B Employer Data Hub for historical petition activity and decisions, then check DOL OFLC’s LCA disclosure files for labor-condition filings. Compare legal entity names and available identifiers, and ask recruiting or HR whether the specific role and worksite support sponsorship.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Can I find out whether an employer has sponsored H-1B workers before?

The USCIS H-1B Employer Data Hub is the most direct public source for historical employer petition activity and decisions. DOL LCA files can provide a separate historical signal, but an LCA filing or certification is not proof that USCIS approved a petition.

Does an LCA mean the employer’s H-1B petition was approved?

No. An LCA is a Department of Labor labor-condition filing. DOL explains that a certified LCA allows the employer to proceed with the USCIS and Department of State process; it does not establish that USCIS received or approved a petition.

Does an employer’s past H-1B sponsorship mean it will sponsor this job?

No. Past filings and decisions are historical evidence, not a promise about a current vacancy. Ask the recruiter or HR contact whether this specific role and worksite support a new petition or transfer and what timing or candidate conditions apply.

What if I cannot find the employer in the databases?

A missing result does not prove that the employer has never sponsored. Try reasonable name variants and compare the legal entity, location, and available identifiers. If the match remains unclear, ask which entity would employ and petition for you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

How can I tell whether a record belongs to the company hiring me?

Compare the legal employer name in the offer or recruiting materials with the record, and check available identifiers and location details. USCIS identifies employers in the Hub using the last four digits of tax identification numbers. A parent, affiliate, subsidiary, or similarly named company should not automatically be treated as the hiring entity.

Can I inspect an employer’s LCA materials?

DOL’s H-1B Advisor says a worker or member of the public may inspect LCA materials at the employer’s principal place of business or worksite within one working day of filing. Access to LCA materials does not prove a USCIS petition approval.

Does E-Verify enrollment show that an employer sponsors H-1B visas?

No. E-Verify is a separate employment-verification program and is not evidence of H-1B sponsorship.

The Bottom Line

Use the USCIS H-1B Employer Data Hub to check historical petition activity and decisions, and DOL OFLC’s LCA files to check the earlier labor-condition filing stage. Verify that any result belongs to the legal entity hiring you. Then ask recruiting or HR whether this exact role and worksite support a new H-1B petition or transfer. Past records can inform the question, but only the employer can clarify its current policy for your job.
