Your business may be able to claim a GST refund when the tax rate on its inputs is higher than the rate on its taxable output supplies and eligible input tax credit (ITC) remains unutilised as a result. That does not make every unused credit refundable: the claim is subject to Section 54(3) of the CGST Act, applicable restrictions, and the maximum amount calculated under Rule 89(5).
Start with the three-part eligibility test
For a GST-registered business in India, an inverted-duty refund is a possible route to recover qualifying ITC that has accumulated because of a rate inversion. Check all three points before preparing a claim:
As an Amazon Associate I earn from qualifying purchases.
- There is a rate inversion. The relevant input tax rate is higher than the tax rate on the taxable output supplies connected with the accumulation.
- Eligible ITC is unutilised. Credit must have accumulated and remain available; a higher input rate by itself does not establish a refund amount.
- The claim is not barred or reduced by a rule or notification. The product classification, claim period, filing date, type of credit, and applicable Rule 89(5) formula all matter.
Section 54(3) of the CGST Act, 2017 provides the statutory basis for this category of refund, subject to its conditions and notified restrictions. Treat eligibility as specific to the products, supplies, and period in the claim—not as a general entitlement for every business with an unused electronic credit ledger balance.
What the rate comparison does—and does not—tell you
The core question is whether the difference between the rate on relevant inputs and the rate on taxable output supplies caused eligible credit to accumulate. Compare the rates that apply to the actual goods or supplies during the claim period, not just the rates that appear on a current price list or a general product description. Classification, the applicable notification, and the date of the transaction can affect the comparison.

A rate inversion is a starting point, not a complete approval test. It does not show by itself how much credit is refundable, whether the credit is included in Net ITC, whether a notified restriction applies, or whether the filed amount will be sanctioned. Those are separate checks. A business can have an input rate above an output rate and still need to establish the amount, the period, the source of its credit, and the applicability of the governing conditions.
Conversely, an unused ledger balance alone does not prove that the balance arose from an inverted structure. Trace the claim back to the relevant taxable output supplies and the inputs associated with the accumulation. If a business makes different kinds of supplies, do not assume that every supply or every balance in its ledger belongs in the same calculation.
Check rates, products, and the source of the accumulated credit
Identify the supplies and period first
Choose the relevant period for the proposed refund, then list the taxable output supplies for which you believe the rate difference caused credit to build up. Identify the inputs used for those supplies and confirm the applicable input and output rates for that period. Rates and classification must be correct for the actual goods and transaction; a broad product description or a rate remembered from another period is not enough.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesIf a product’s HSN classification is uncertain, resolve that before relying on an exemption, restriction, or rate comparison. The rate-inversion test depends on the proper classification of the relevant goods and supplies. A classification change or a notification that applies only from a particular date can alter the analysis for different portions of a business’s claim period.
For each output category, ask: What exactly was supplied? Which classification and rate applied on the relevant date? Which inputs and rates are being relied on to explain the accumulation? Is the output taxable at the rate used in the comparison? Keep those answers tied to the period instead of combining transactions from different periods without checking whether the same rates and restrictions applied.
Separate refundable input credit from other ledger credit
Rule 89(5) defines Net ITC for this calculation as ITC availed on inputs during the relevant period, with an exclusion for ITC for which a refund is claimed under Rule 89(4A), Rule 89(4B), or both. The relevant period is the period for which the refund application is filed. Reconcile the credit actually availed for that period and identify any credit covered by those other refund provisions before using a Net ITC figure.
Do not assume the full credit ledger balance is Net ITC. The ledger may include amounts that are not part of the Rule 89(5) calculation, including credit from outside the relevant period or credit covered by the stated exclusions. The refund formula also uses turnover and tax payable figures, so a ledger balance alone cannot establish the maximum claim.
Keep separate records of the period’s ITC availed on inputs, any credit associated with a refund claim under Rule 89(4A) or Rule 89(4B), and the figure ultimately used as Net ITC. The rule’s definition refers to inputs, so do not casually substitute a broader ledger total for the defined amount. If your accounting records group different kinds of credit together, reconcile them before calculating rather than attempting to explain a mismatch after filing.

Use the correct Rule 89(5) formula for the filing date
For applications governed by the current Rule 89(5) text, the maximum refund amount is:
Maximum Refund Amount = (Turnover of inverted-rated supply of goods and services × Net ITC ÷ Adjusted Total Turnover) − tax payable on such inverted-rated supply of goods and services
In practical terms, the formula apportions Net ITC using the turnover of inverted-rated supplies relative to adjusted total turnover, then subtracts tax payable on those inverted-rated supplies. It sets a ceiling for the refund calculated under the rule; it is not a promise that the amount will be sanctioned. The meanings and treatment of the formula’s components depend on the applicable rule text, so use the full Rule 89(5) version that governs the application rather than substituting an informal spreadsheet formula.

Before entering figures, make a working sheet with a row or clearly traceable total for each formula component: turnover of inverted-rated supplies, Net ITC, adjusted total turnover, and tax payable on those supplies. Record the relevant period and the source of each figure. This is especially useful where a business has several output categories or transactions spanning more than one rate or notification period. The formula is a maximum, so a result should be checked against the claim amount and the rest of the eligibility analysis rather than treated as automatic payment.
Applications filed on or after 5 July 2022
CBIC Circular 181/13/2022-GST, dated 10 November 2022, says the Rule 89(5) amendment is prospective from 5 July 2022. The amended formula applies to applications filed on or after that date. CBIC states: “The said amendment is not clarificatory in nature and is applicable prospectively with effect from 05.07.2022.”
Applications filed before 5 July 2022
For an application filed before 5 July 2022, the circular says to use the formula as it existed before the amendment. The filing date—not simply the tax period for which a claim relates—determines which formula version applies under this clarification. Do not apply the current formula retroactively to an earlier-filed application; consult the historical Rule 89(5) text applicable to that filing instead of trying to reconstruct it from the current formula.
| Application filing date | Formula treatment described by CBIC | What to check |
|---|---|---|
| Before 5 July 2022 | Rule 89(5) formula as it stood before the amendment | Use the historical rule text applicable to the filing. |
| On or after 5 July 2022 | Amended Rule 89(5) formula | Use the applicable amended rule text and its definitions. |
The effective-date treatment above is stated in CBIC Circular 181/13/2022-GST, dated 10 November 2022. For a claim, confirm the current statutory and notification text as well as the filing-date rule version.

Two dates matter for different reasons. The relevant period is the period for which the application is filed; it informs the period-specific credit and turnover data used in the calculation. The filing date determines which formula treatment applies under CBIC’s clarification. A claim relating to an earlier period is not automatically governed by the earlier formula if the application itself is filed on or after 5 July 2022. Write both dates down at the start of the review and check each against the relevant rule or notification.

Check whether a notified product restriction applies
CBIC Circular 181/13/2022-GST also explains that Notification 09/2022-Central Tax (Rate), effective 18 July 2022, specifies goods falling under Chapters 15 and 27 for which refund of unutilised ITC is not allowed when accumulation results from input tax rates exceeding output rates. The circular describes the restriction as prospective.
This is not a blanket statement that every product classified in Chapter 15 or Chapter 27 is excluded. Check the exact entry in the notification against the product’s correct classification and the claim period. If classification is uncertain, the chapter number alone cannot settle the question. For a claim spanning different periods, check whether the restriction was in effect for the relevant supply and period rather than applying it indiscriminately to the whole claim.
In practice, the comparison should be product-specific. Match the goods in the claim to the notification’s precise description and classification entry; then confirm that the entry is relevant to the supply and period at issue. Do not infer an exclusion merely because a product appears to belong generally to one of those chapters, and do not assume that the absence of an obvious match means no restriction without checking the full schedule. The classification and the operative dates are both material.
Concessional-notification supplies need a separate check
CBIC’s circular index identifies Circular 173/05/2022-GST, dated 6 July 2022, as a clarification about inverted-duty refund claims where a supplier supplies goods under a concessional notification. The index entry alone does not establish the result for an individual supply. If your output supply relies on a concessional notification, consult the circular and the applicable notification for that specific case before deciding whether the rate comparison supports a claim.
This is a distinct question from whether a product appears in the Chapters 15 or 27 restriction. A concessional notification may affect the rate analysis for a particular supply, while a notified product restriction concerns whether refund is allowed for specified goods and circumstances. Identify which issue is relevant to your facts, and check each applicable instrument rather than treating one clarification as a substitute for the other.
Estimate the claim without treating the cap as approval
Once the rate comparison and restrictions are checked, calculate the maximum under the correct formula version using figures for the relevant period. Reconcile each input to the records from which it came, including eligible Net ITC, turnover of inverted-rated supplies, adjusted total turnover, and tax payable on those supplies. If you are preparing a spreadsheet, keep the source and period for every figure visible so that a reviewer can trace the calculation.
- If the calculated maximum is zero or negative: the formula does not support a positive refund under that calculation. Recheck classifications, period allocation, exclusions, and data entry before concluding the claim is nil.
- If the proposed claim exceeds the calculated maximum: reduce the claim to no more than the applicable cap, subject to the rest of the eligibility and scrutiny process.
- If the proposed claim is below the maximum: the cap does not itself show that the amount claimed is admissible; eligibility, evidence, and applicable restrictions still have to be considered.
These are calculation checks, not a substitute for the complete rule or the application requirements. The actual amount payable is determined through the prescribed process.

Use a reconciliation before filing
A useful final comparison is between the proposed refund and three separate measures: the eligible Net ITC for the relevant period, the amount produced by the applicable Rule 89(5) calculation, and the amount that remains supportable after checking restrictions and the claim facts. These are not interchangeable. A large credit balance may be reduced by the formula; a formula ceiling may still not be payable if the claim is barred or the required factual basis is not established.

Where an amount looks unexpected, inspect the formula inputs rather than changing the result to match the ledger balance. Verify whether the relevant turnover has been included, whether the correct adjusted total turnover and tax payable figures were used, whether the formula version matches the filing date, and whether excluded refund credit was mistakenly counted in Net ITC. Keep a note of any correction so the submitted numbers and supporting records tell a consistent story.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Prepare the application and follow its status
Refund applications are made electronically through the prescribed GST process. Because the records required can depend on the nature of the claim and the live portal requirements, there is no universal supporting-document checklist established here. Prepare the period-specific data and records needed to substantiate your own calculation, classifications, rates, and turnover, and follow the application fields and document requirements shown for the claim.
Think of preparation in two layers. First, assemble the substance of the claim: the period, supply and input classifications, applicable rates, eligible ITC reconciliation, turnover data, formula version, and restriction analysis. Second, complete the live electronic application using the forms and information the process requires for that claim. The first layer helps you verify that the numbers make sense; the second ensures the filing follows the prescribed process. Do not treat a working paper or a ledger report as a substitute for the portal’s requirements.
Recommended Free Tools
- Fix the relevant period and filing date. Record both; the filing date determines which formula treatment CBIC’s 2022 clarification describes.
- Reconcile the claim inputs. Assemble eligible input ITC for the relevant period, identify Rule 89(4A) or Rule 89(4B) refund credit excluded from Net ITC, and compile the relevant turnover and tax payable figures.
- Confirm classification and restrictions. Check the applicable rates and the exact notification entries for the goods and period, including any relevant concessional-notification issue.
- Calculate and retain the working. Apply the correct Rule 89(5) version and keep the calculation and supporting records consistent with what is entered in the electronic application.
- Submit through the prescribed electronic process and monitor notices. Keep the application acknowledgement and watch for requests or notices from the proper officer.
Under the refund rules, an application found complete receives an acknowledgement in FORM GST RFD-02. If the proper officer considers a claim inadmissible or not payable, the rules provide for a proposed-rejection notice in FORM GST RFD-08 and a reply in FORM GST RFD-09 within the stated period, followed by a reasoned decision. The rules also provide that an application should not be rejected without a reasonable opportunity of being heard. Follow the period stated in the notice and the current procedural requirements; do not treat the acknowledgement as a decision approving the refund.
Read any notice carefully and connect the response to the issue raised. If the officer’s concern relates to classification, explain the classification basis and relevant notification entry; if it concerns the calculation, reconcile the formula inputs; if it concerns completeness, respond to the requirement identified in the notice. Preserve the application, acknowledgement, calculation, and correspondence together. The notice’s stated reply period matters, so monitor the application rather than assuming that filing ends the process.
Common mistakes to avoid
- Using the ledger balance as the claim amount. The formula is a cap based on defined Net ITC and turnover data, not a simple withdrawal of the electronic credit ledger balance.
- Using the wrong formula version. Check the application filing date. CBIC Circular 181/13/2022-GST says the amended formula applies prospectively to applications filed on or after 5 July 2022.
- Treating whole chapters as excluded. Notification 09/2022-Central Tax (Rate) identifies specified goods under Chapters 15 and 27. Verify the exact entry and product classification rather than applying a chapter-wide assumption.
- Ignoring other refund claims when determining Net ITC. Credit for which a refund is claimed under Rule 89(4A), Rule 89(4B), or both is excluded from Net ITC under Rule 89(5).
- Assuming the acknowledgement means approval. FORM GST RFD-02 acknowledges a complete application; the officer may still examine it and issue a proposed-rejection notice under the rules.
- Applying a concessional-notification point without checking the case. Circular 173/05/2022-GST is identified as addressing such claims, but the circular index alone does not resolve a particular supply.
Each of these errors can arise from mixing up a different decision point: eligibility, amount, restriction, timing, or procedure. Resolve them independently and retain the basis for each conclusion. If a material fact is unclear, especially the exact classification or relevant notification treatment, do not use an assumed answer to produce a precise refund estimate.
Use this decision checklist before filing
- Have you fixed the claim period and intended filing date?
- Have you verified that the relevant input rate is higher than the rate on the taxable output supplies for the applicable period?
- Have you established that eligible ITC accumulated and remains unutilised?
- Have you calculated Net ITC using input credit for the relevant period and excluded credit claimed under Rule 89(4A), Rule 89(4B), or both?
- Have you selected the formula version based on the application filing date?
- Have you checked the exact product classification and any applicable notified restriction, rather than assuming an entire chapter is excluded?
- Have you considered whether a concessional notification affects the specific supplies in the claim?
- Does the amount proposed stay within the maximum under Rule 89(5), and can you trace the calculation to supporting records?
- Are you ready to monitor the electronic application and respond to any officer notice within its stated period?
If a material answer is unknown—especially the correct classification, applicable rate, formula version, or notification treatment—resolve it before relying on a refund estimate. The governing framework is national, but the outcome depends on the facts and claim period of the business. CBIC’s official materials accessed on 9 October 2026 explain the framework; verify the current statutory text, notifications, and portal requirements when filing.

Can I claim a GST refund just because my electronic credit ledger has a balance?
No. An unused ledger balance alone does not establish an inverted-duty refund. The claim requires a qualifying rate inversion, eligible ITC accumulated and remaining unutilised, and a calculation under Rule 89(5), subject to applicable restrictions.
Best Value
How do I check whether my business has an inverted duty structure?
For the relevant claim period, identify the taxable output supplies and the inputs connected with the accumulation, confirm their correct classifications and applicable rates, and establish that the input rate is higher than the output rate. Then check whether eligible ITC remains unutilised.
Does the claim use the formula in force for the tax period or the filing date?
CBIC Circular 181/13/2022-GST says applications filed on or after 5 July 2022 use the amended Rule 89(5) formula, while applications filed before that date use the earlier formula. Keep the claim period and filing date distinct.
Are all goods in Chapters 15 and 27 barred from an inverted-duty refund?
No. Notification 09/2022-Central Tax (Rate), effective 18 July 2022, specifies goods under those chapters for which the refund is restricted. Check the exact notification entry, correct product classification, and relevant period; do not assume a whole chapter is excluded.
The Tool Desk
Outbyte Driver Updater FREEFix the driver behind crashes, sound loss and screen glitchesFind Drivers →Outbyte PC Repair FREERepair Windows errors before they cause bigger problemsFix Now →Is the Rule 89(5) maximum the amount I will receive?
No. It is a cap calculated using turnover, Net ITC, adjusted total turnover, and tax payable on inverted-rated supplies. A result within the cap is not itself approval; eligibility, restrictions, evidence, and officer scrutiny still apply.
What happens after I submit an inverted-duty refund application?
The prescribed process is electronic. An application found complete receives FORM GST RFD-02 acknowledgement. If the officer considers the claim inadmissible or not payable, the rules provide for a proposed-rejection notice in FORM GST RFD-08, a reply in FORM GST RFD-09 within the stated period, and a reasoned decision.
What records should I prepare for an inverted-duty refund?
There is no universal supporting-document checklist for every claim. Prepare the period-specific ITC and turnover data, classification and rate basis, formula working, and records that substantiate your claim, then follow the live portal’s fields and document requirements.
The Bottom Line
Bottom line: You may have a valid inverted-duty refund claim only if a rate inversion caused eligible ITC to accumulate and remain unutilised, the product and period are not subject to a relevant restriction, and the requested amount stays within the applicable Rule 89(5) maximum. Check classification, filing date, formula version, and the electronic process before treating an estimate as a claim.
