India’s nil-rate GST treatment for seeds is tied to both classification and use. HSN 1209 covers “seeds, fruit and spores, of a kind used for sowing,” but the entry expressly excludes seeds meant for any other use. To check a supply, identify the actual goods, verify the correct HSN, examine evidence of represented and intended use, and apply the rate notification in force on the transaction date. A generic description such as “seeds” or a seed’s ability to germinate is not, by itself, conclusive.
The short answer
- Seeds, fruit and spores properly classifiable under HSN 1209 and of a kind used for sowing are listed at a nil GST rate in the CBIC goods-and-services rate table.
- The same entry says: “This entry does not cover seeds meant for any use other than sowing.”
- Notification No. 9/2021-Central Tax (Rate), dated 30 September 2021, inserted that explanation into entry 86 of the Central Tax (Rate) exemption notification, with effect from 1 October 2021.
- Seeds sold for another purpose must be classified and rated separately. The CBIC table gives tamarind seeds meant for a use other than sowing as an example: 2.5% central tax plus 2.5% state tax, or 5% total for an intra-State supply.
- The exemption is not restricted only to seeds used for agricultural crops. A PIB FAQ describes the scope as seeds meant for sowing, while the goods must still fit the relevant tariff entry.
These rules make the decision fact-sensitive. The correct question is not simply “Is this called a seed?” It is “What are these goods, how are they classified, and what use do the product and transaction records show?”

What the HSN 1209 entry actually covers
Classification and use work together
HSN 1209 is the tariff heading for “seeds, fruit and spores, of a kind used for sowing.” The nil-rate listing applies when the goods fall within that description and the sowing-use condition is satisfied. A product cannot be placed in the nil-rate entry merely because a seller or buyer uses the word “seed” in ordinary language.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
Classification starts with the goods themselves: species or variety, physical form, condition, treatment, processing and commercial description. The use represented in the sale then determines whether the HSN 1209 sowing entry is available. If the goods are supplied for food, industrial processing, extraction, feed, planting-material production or another non-sowing purpose, the explanatory wording takes them outside this particular entry; the applicable heading and rate must then be determined separately.

The exclusion is explicit
The explanation added by Notification No. 9/2021-Central Tax (Rate) states: “This entry does not cover seeds meant for any use other than sowing.” The notification is dated 30 September 2021 and took effect on 1 October 2021. For a historical transaction, check the notification and rate schedule applicable on that date rather than automatically applying today’s wording.
Scope is broader than agricultural crops, but not broader than the tariff entry
Official PIB FAQ material says the sowing exemption applies to all seeds meant for sowing and is not limited to seeds used for agricultural crops. That guidance addresses the crop-versus-non-crop distinction; it does not remove the need to establish that the goods are of the kind covered by the relevant tariff description. Ornamental, horticultural or other planting seeds may therefore require the same use-and-classification analysis.
A step-by-step GST check
1. Identify the actual goods
Write down the species or variety, grade, form and condition. State whether the supply contains whole seeds, treated seeds, coated or pelleted seeds, processed material, fruit, spores or a different seed-related product. Record whether anything has been crushed, split, extracted, blended, heat-treated or otherwise altered.

2. Confirm the tariff heading
Check whether the goods belong under HSN 1209 or another heading in the current CBIC rate table. The nil-rate sowing entry is not a blanket exemption for every item that contains a seed or is commercially called seed. Seed-quality goods under other headings can have different descriptions and treatments.
Do not choose HSN 1209 solely because it produces a preferred rate. The classification should follow the product’s objective characteristics and the tariff language. Where processing or condition changes the character of the goods, obtain a classification view based on those exact facts.
3. Establish represented and actual use
Examine what the seller represents and what the transaction shows the buyer intends to do. Useful evidence can include:
- retail or wholesale packaging and labels;
- the product catalogue, technical sheet or specification;
- invoice wording that identifies sowing or another purpose;
- the buyer’s purchase order, contract or written use declaration;
- marketing material and instructions supplied with the goods;
- the surrounding transaction, including the buyer’s business and the channel in which the goods are sold.
These records are practical evidence to review, not a statutory safe-harbour checklist. Their weight depends on whether they are consistent, contemporaneous and specific to the goods in the disputed supply.

4. Review quality and certification material where relevant
Germination information, seed-testing reports, lot records, certification documents and quality specifications can help explain the product’s condition and commercial character. They may support a conclusion that the goods are planting material, but no single certificate automatically decides the GST treatment.
The official GST Council Authority for Advance Ruling listings show that disputes can involve seed quality, processing, condition, intended use and classification together. Treat those listings as fact-specific examples, not as a universal test or automatic rule for every supplier.
5. Apply the use boundary
If the evidence supports that the goods are of a kind used for sowing and the classification fits HSN 1209, the nil-rate entry may apply. If the evidence shows another intended use, the explanation excludes the goods from that entry. At that point, identify the correct heading and rate for the actual product; do not substitute a general assumption that all non-sowing seeds carry the same percentage.
6. Record the conclusion
Keep the classification basis, product description and use evidence with the transaction records. Note the notification or rate-table wording relied on and the supply date. For unusual, dual-purpose, processed or high-value goods, document the uncertainty and obtain advice on the exact facts before issuing invoices or finalising returns.

Evidence: what each record can and cannot prove
| Record | What it can help establish | Important limitation |
|---|---|---|
| Label and packaging | How the goods are represented, including planting instructions or another stated use | A label can be inaccurate, incomplete or inconsistent with the actual supply |
| Invoice and purchase order | The parties’ stated description and commercial purpose | Boilerplate wording does not override the product’s actual characteristics |
| Catalogue or technical specification | Species, variety, treatment, condition and intended market | Generic catalogue language may not identify the particular lot |
| Germination, testing or certification records | Quality, viability and suitability information relevant to characterization | Biological ability to germinate is not conclusive proof of the intended use |
| Buyer and transaction context | Whether the sale is directed to planting or another use | Business activity alone does not prove the use of every product sold |
No cited official source provides one exhaustive document list that conclusively proves sowing intent in every case. The strongest file is a consistent set of product, label, contract and transaction records that all point to the same use.
Rates and dates illustrated by the official table
| Goods and condition | Classification or description | Tax treatment stated in the official material |
|---|---|---|
| Seeds, fruit and spores of a kind used for sowing | HSN 1209, subject to the sowing-use wording | Nil rate |
| Tamarind seeds meant for a use other than sowing | Listed separately under HSN 1209 | 2.5% central tax plus 2.5% state tax, or 5% combined for an intra-State supply |
| Sowing-use explanation in the exemption entry | Notification No. 9/2021-Central Tax (Rate) | Inserted on 30 September 2021; effective from 1 October 2021 |
The tamarind example demonstrates why HSN alone is insufficient. It also should not be treated as a universal rate for every seed supplied for a non-sowing purpose. Other products may fall under different headings or rate entries.

Clearly labelled planting seed
A product identified by species and variety, sold with planting directions and supported by an order for sowing, presents a stronger case for the HSN 1209 nil-rate entry, assuming the physical goods fit that heading. Quality records can reinforce the description but do not replace the classification and use analysis.

Where the label, contract and transaction show that the buyer will use the seeds for a purpose other than sowing, the HSN 1209 sowing entry is excluded. The tamarind example in the CBIC table carries 5% total tax for an intra-State supply, but the correct rate for another product must be checked independently.

Generic “seed” description with conflicting records
If packaging says “for planting” but the purchase order requests material for processing, or if the invoice and catalogue use different descriptions, stop and resolve the inconsistency. A nil-rate claim made on one document while the surrounding evidence indicates another use is vulnerable to challenge.
Dual-purpose or altered goods
Some goods may be capable of germination but also commonly traded for food, extraction or industrial use. Others may have been treated or processed in a way that affects classification. In these cases, compare the objective product condition, represented use, buyer instructions and supply date, and seek a fact-specific opinion before applying a nil rate.
What advance-ruling examples tell you
Recent GST Council listings of Authority for Advance Ruling matters show that applicants have disputed products by referring to intended use, seed quality, processing, condition and tariff classification. These decisions are tied to the applicant’s facts and the applicable jurisdiction. They can help identify issues to investigate, but they should not be converted into a binding nationwide checklist without reading the underlying ruling and confirming that the goods and transaction are materially comparable.

Practical controls for sellers and buyers
Before invoicing
- Obtain a precise product description, including species or variety and condition.
- Confirm the proposed HSN against the current CBIC rate table.
- Ask the buyer to state the intended use where that fact affects the rate.
- Check that labels, catalogue text, purchase orders and invoice wording agree.
- Attach or retain relevant quality and certification records where they explain the product’s character.
When records do not align
- Pause the nil-rate treatment rather than relying on the word “seed” alone.
- Investigate whether the goods are actually being sold for a non-sowing purpose.
- Recheck whether processing or condition places them under another heading.
- Document the unresolved question and obtain advice for unusual or material transactions.
For the transaction file
Retain the product specification, label or packaging image, invoice, order, relevant buyer communication, classification reasoning and the rate notification considered. Include the transaction date because GST schedules can change. This file helps explain why the nil-rate entry was or was not used if the supply is later reviewed.
Common mistakes to avoid
- Relying on the word “seed.” Ordinary commercial language does not establish HSN 1209 or sowing intent.
- Assuming germination settles the issue. A seed may germinate and still be supplied for another use.
- Treating certification as decisive. Certification is supporting evidence, not an automatic GST exemption.
- Applying the tamarind rate to every non-sowing seed. The 5% intra-State example is product-specific; other goods require separate classification.
- Ignoring processing and condition. Treated, processed or altered goods may need a different tariff analysis.
- Using a current rate for an old supply without checking the date. The sowing-use explanation took effect on 1 October 2021, and later amendments may also matter.
- Generalising from an AAR. Advance rulings are fact- and jurisdiction-specific.
When to obtain specialist advice
Get a classification and GST opinion when the goods are dual-purpose, processed, sold under conflicting descriptions, supplied in significant value, or supported by weak evidence of use. Advice should address the exact product, HSN, intended use, documents, place and date of supply, and the rate notification then in force. The official material establishes the sowing-use boundary but does not provide a universal bright-line test for every commercial situation.
Quick Recap
Decision checklist
- Have you identified the species, variety, form and condition?
- Have you tested HSN 1209 against the current tariff wording rather than choosing it from the invoice description?
- Do the label, catalogue, order and invoice consistently indicate sowing?
- Could the buyer’s actual purpose be food, processing, extraction, feed or another non-sowing use?
- Are quality or certification records being used as supporting evidence rather than treated as conclusive?
- Have you checked the notification and rate applicable on the supply date?
- Is the reasoning recorded well enough to explain the nil-rate decision later?
