How to Check Whether a Vehicle Purchase Qualifies for GST Input Tax Credit in India

In India, buying a vehicle in a business’s name does not by itself make its GST eligible for input tax credit (ITC). Eligibility depends first on the vehicle’s legal classification and seating capacity, then on its actual use in making specified taxable supplies. Ordinary cars used for staff or executive travel are generally blocked; passenger vehicles may qualify when used for further supply, taxable passenger transport or driving instruction, while the law separately provides an exception for transportation of goods. The registered buyer must also meet the general ITC conditions.

Start with the vehicle and its actual use

For passenger motor vehicles with approved seating capacity of not more than 13 persons, including the driver, GST ITC is generally blocked unless the vehicle is used to make one of the specified taxable supplies. The relevant exceptions are further supply of such vehicles, transportation of passengers, and imparting driving training. The law also provides an exception for transportation of goods. Check the current enacted wording of the Central Goods and Services Tax (CGST) Act before applying it to a specific purchase. CBIC’s CGST Act page is a reference, but its linked bill-text material may not reflect every later amendment.

The test concerns the use connected to the taxpayer’s outward taxable supply—not merely whether the vehicle is useful to the business. A company car used for general business travel does not become eligible just because it appears in the company’s accounts or is used by employees.

Check eligibility in this order

  1. Identify the registered claimant and buyer. Confirm that the claimant is GST-registered, that the supply was made to that person, and that the vehicle was purchased and received by the claimant. The invoice should support the claim in that registered person’s name. The general ITC rule concerns input tax on supplies to a registered person for use or intended use in the course or furtherance of business. See the CBIC-hosted Act material.
  2. Establish the vehicle’s legal classification and approved seating capacity. Record the vehicle type and approved capacity, including the driver. Do not assume that every machine used at a worksite is legally a motor vehicle for this rule. CBIC’s sectoral FAQ, for example, discusses tippers and dumpers as earth-moving equipment outside the motor-vehicle definition used in its example. Read CBIC’s sectoral FAQ.
  3. Document the intended taxable outward supply. If the vehicle is a passenger motor vehicle within the 13-person threshold, identify which statutory exception applies: further supply, taxable passenger transportation, or driving instruction. Keep evidence that the vehicle is actually used for that activity; a general business purpose is not one of these exceptions.
  4. Assess goods transportation separately. The Act provides an exception for transportation of goods. Apply it to the vehicle or conveyance’s legal classification and its actual use. CBIC’s mining example involving qualifying earth-moving equipment is not a blanket rule for all equipment or all worksite use. CBIC’s example and discussion.
  5. Check the ordinary ITC requirements and other blocks. Verify the prescribed tax document, receipt of the vehicle, applicable tax-payment and return requirements, business use, and any other restriction under Section 17. The rules address documents and apportionment; personal consumption is separately listed as blocked credit. CBIC’s CGST Rules and Act material are relevant references.
  6. Check depreciation on the GST component. ITC is not allowed on the tax component of capital-goods cost if depreciation has been claimed on that same component. Check the taxpayer’s income-tax treatment and the current enacted provision before claiming credit. CBIC-hosted Act material.
  7. Apply the demo-vehicle clarification where relevant. Authorized motor-vehicle dealers should assess their facts against CBIC Circular 231/25/2024-GST, which addresses demo vehicles under the further-supply exception, including vehicles capitalized as assets.

How the rule applies to common vehicle purchases

Purchase or use Practical direction
Ordinary car for executives or staff Generally blocked under the passenger-vehicle rule unless a specified taxable-supply exception applies. CBIC’s FAQ uses a vehicle for executive directors as an example and describes the relevant passenger/goods transport or driving-training businesses. CBIC sectoral FAQ.
Vehicle used to transport passengers for taxable consideration Potentially within the passenger-transport exception. Confirm the outward supply is taxable, the vehicle classification fits, and the general ITC requirements are met. Act material.
Vehicle used for driving instruction Potentially within the driving-training exception where the vehicle is used to provide the relevant taxable service and the other ITC requirements are met. Act material.
Authorized dealer’s demonstration vehicle Review the facts and conditions in Circular 231/25/2024-GST. The circular describes demo vehicles maintained under dealership norms for trial runs and demonstrations to potential buyers, and clarifies their treatment in the context of further supply of similar vehicles. Read the circular.
Goods-transport vehicle or equipment The law provides a goods-transport exception. Confirm that the item’s legal classification and actual use satisfy the provision; CBIC’s discussion of tippers and dumpers is a specific example, not a general equipment exemption. CBIC sectoral FAQ.
Vehicle with business and personal use Business use alone does not overcome a blocked-vehicle rule, and personal consumption is separately blocked. Check any applicable attribution or apportionment rules against the actual facts. CBIC’s CGST Rules.

What to keep with the ITC decision

Before claiming credit, assemble records that answer the legal test rather than relying on the vehicle’s make, price, or business label:

  • GST registration and purchase documents showing who bought and received the vehicle.
  • Vehicle records identifying its type and approved seating capacity, including the driver.
  • Evidence of the intended and actual outward taxable supply, such as passenger-transport, driving-instruction, further-supply, or goods-transport records as applicable.
  • Tax invoices or other prescribed documents, along with records needed to establish applicable tax and return compliance.
  • Accounting and income-tax records showing how the vehicle and its GST component were treated for depreciation.
  • For a dealer demo vehicle, records and facts relevant to the conditions in Circular 231/25/2024-GST.

Verify the current law before filing

The CBIC-hosted Act page cited here links to bill-text material and may not show every later amendment to the vehicle wording or current procedural requirements. Check the latest enacted consolidated CGST Act, rules, relevant notifications, state law where applicable, and GST portal requirements. The exact time limit for claiming ITC on a new vehicle invoice is not stated here; confirm the current deadline rather than relying on an assumed date. For mixed-use, unusual equipment, or dealer-demo cases, a GST practitioner or chartered accountant can assess the documents and facts against the current provisions.
