How to Check Whether a Tax Deduction or Exemption Is Allowed Under Indian Tax Law

To check whether an Indian tax deduction or exemption is allowed, first identify the tax period and the law that applies to it. Then check the taxpayer’s status and tax regime, read the provision’s eligibility conditions and limits, gather supporting evidence, and report the claim in the correct return schedule. A payroll estimate, prefilled record or generic tax-saving list is not a legal determination.

1. Start with the tax period

Write down the financial or tax year, the assessment or tax year shown on the return, and the date of the payment or event behind the claim. Those details determine which version of the law, rules, amendments and transition provisions to consult.

The Income-tax Act, 2025 generally came into force on 1 April 2026: section 1 says, “Save as otherwise provided in this Act, it shall come into force on the 1st April, 2026.” CBDT’s 1 April 2026 press release says the 2025 Act replaces the Income-tax Act, 1961, and that the Income-tax Rules, 2026 were notified on 20 March 2026.

That change does not mean every return filed after 1 April 2026 should be checked under the 2025 Act. The Department’s AY 2026-27 filing guidance still gives salary and return instructions under the 1961 Act for the period covered by those instructions. For an earlier period, use the law and transition rules that apply to that period; do not transfer a new Act’s section number or an old guide’s limits without checking.

2. Establish who is claiming and which regime applies

Eligibility can depend on whether the claimant is an individual, HUF, business or professional taxpayer, their residence status, the kind of income involved, and their tax regime. A rule relevant to a salaried resident individual may not apply in the same way to another taxpayer.

For AY 2026-27, the Department describes the new regime as the default for eligible taxpayers. Its regime and return guidance says non-business cases can choose annually in the return by the applicable due date; eligible taxpayers with business or professional income use Form 10-IEA to opt out and face additional restrictions on switching back. These are year-specific instructions, so verify the procedure and deadline for the return you are filing.

Regime choice can change whether a claim is available. The Department’s regime FAQ says HRA exemption under section 10(13A) is unavailable in the new regime and Chapter VI-A deductions are generally restricted there, with specified exceptions including sections 80CCD(2), 80CCH and 80JJAA under the cited section 115BAC rules. Some answers in that FAQ concern earlier assessment years; treat it as a warning to check regime sensitivity, not as an automatic ruling for another year.

3. Read the provision, not just its label

Find the provision in the official Act applicable to the period, then check relevant rules, notifications and official guidance. Confirm the effective date and whether later amendments affect the claim. A departmental FAQ can help locate an issue, but for a significant claim or a year-specific question, verify the underlying legal text.

Turn the provision into a checklist before deciding whether the claim fits:

  • Claimant: who is eligible, including any status or relationship conditions?
  • Qualifying basis: what payment, income, investment or event qualifies?
  • Calculation: what limit, formula or base applies for this period?
  • Exclusions: what transactions or circumstances are left out?
  • Procedure: is a certificate, form, identifier, election or deadline required?
  • Reporting: where must the claim appear in the return, and what other claims or income does it interact with?

A heading such as “insurance,” “rent” or “donation” is not enough to establish entitlement. For example, the Department says not all donations qualify for a 100% deduction; the treatment depends on the recipient category and the applicable conditions.

4. Assemble evidence that matches the claim

Keep records that substantiate the facts the provision requires. The Department’s salary and return help pages identify examples such as insurance, donation, rent and tuition-fee receipts, loan details, policy identifiers and prescribed forms. Which documents matter depends on the particular claim and return year; examples are not a universal checklist.

For salaried employees, the Department describes Form 12BB as the employee’s claim particulars furnished to the employer, and Form 16 as a certificate containing salary, deductions or exemptions, and TDS information. Its salary guidance also describes Form 26AS as tax deducted or collected information and AIS as including TDS/TCS, specified financial transaction information, tax payments, demands, refunds and other information.

Return instructions can ask for claim-specific details. The Department’s ITR-2 help gives examples of supporting proof for claims under sections 80C, 80D, 80G and 80GG, and says Form 10BA must be filed before claiming section 80GG in that guidance. Its ITR-1 FAQ describes further fields for specified claims, including policy or insurer details, loan information and relevant form-filing details. These requirements are return- and year-specific; check the instructions for the form and period you are actually using.

5. Reconcile the claim before filing

Compare the return against Form 16, Form 26AS, AIS and the original records. Check that income and tax credits are reported correctly, that the deduction or exemption is under the right provision and schedule, and that any required additional information or form has been supplied.

Employer TDS treatment is not the final legal decision on your claim. Form 16 records salary-related information and TDS computation; the taxpayer must still report income and claim tax credit in the return, while satisfying the law’s eligibility conditions for the relevant period. A prefilled return entry or a record in AIS is evidence to reconcile, not proof that a particular deduction is legally available.

6. When you cannot settle the question from the documents

If a condition is ambiguous, the claim crosses the 2026 law transition, or the amount is material, ask a qualified Indian tax professional to assess the actual year, taxpayer status, income, regime and supporting documents. The general verification steps cannot decide an individual case.
