To check whether a stablecoin appears to meet the EU’s MiCA requirements, identify its legal issuer and token category, then verify the issuer’s authorization and the current white paper in ESMA’s public MiCA register. Also check who is offering the token or seeking its admission to trading in the EU. A register entry or white paper is useful evidence, not a guarantee that every activity involving the token complies or that it is safe to buy.
What “MiCA-compliant” means for a stablecoin
MiCA divides stablecoins into two categories: e-money tokens (EMTs), which reference one official currency, and asset-referenced tokens (ARTs), which reference another value or right, or a combination. A token’s marketing label is not enough to determine its category; use its disclosed features and reference asset. MiCA Article 51 sets out white-paper information for EMTs.

For ARTs and EMTs offered to the public or admitted to trading in the EU, MiCA generally requires authorization under Article 16(1) for ARTs and Article 48(1) for EMTs. Titles III and IV have applied since 30 June 2024, subject to the Regulation’s terms and transitional provisions, including Article 143(4) and (5) for certain ARTs. The European Commission answer published by ESMA on the scope of public offering says the rules can also apply when someone other than the issuer makes the offer or seeks admission to trading. Whether a particular activity qualifies can depend on the facts.

Check a stablecoin in seven steps
- Pin down the exact asset. Record its name, ticker, issuer’s legal name and, if available, the blockchain and contract address. Distinguish it from similarly named tokens and wrapped versions.
- Classify its reference. Use the issuer’s disclosures to determine whether it references one official currency (EMT) or another value or right, or a combination (ART). Do not rely on branding alone.
- Search ESMA’s register. Look up both the issuer and token in ESMA’s MiCA Article 109 register. Match the legal entity and asset, not just a similar name or ticker. Article 109 provides for issuer identity and authorization information and crypto-asset white papers, including modified versions. The register is regularly updated; outdated white papers are archived and marked out of date.
- Read the current white paper. Confirm that it identifies the same issuer and token you are checking. For an EMT, compare the issuer’s identity, token characteristics, offer or admission details, rights and obligations, technology, risks, and environmental-impact disclosures. Article 51 also calls for information about the consensus mechanism’s principal adverse environmental impacts.
- Verify authorization. Compare the register and white paper with information on the issuer’s website. If the authorization route or status is unclear, check the relevant national competent authority’s website. The EBA also identifies the white paper, issuer, offeror or trading-platform website, ESMA register and competent authority as places to check.
- Identify who is offering or admitting the token. Check the EU-facing offer or trading context and which party is making the offer or seeking admission. Do not assume that an issuer’s status alone settles whether a platform or another intermediary’s activity meets MiCA requirements.
- Resolve discrepancies before relying on a compliance claim. Missing records, a different legal entity, conflicting details or an outdated white paper are reasons not to conclude that the token is MiCA-compliant on the evidence available. Seek current confirmation from the competent authority or qualified legal counsel.
How to interpret the evidence
ESMA’s register is a practical starting point because Article 109 provides for issuer and authorization details as well as white papers. It is not a stand-alone certification of every offer, admission or service involving a token. Check the underlying documents, their current status, and whether they match the actual asset and parties involved.

The EBA warns that MiCA safeguards do not apply where the relevant ART or EMT offer or admission is not carried out in accordance with MiCA, and advises consumers to be extremely cautious about acquiring such crypto-assets. A missing or mismatched entry should prompt caution and further verification; it is not, by itself, a complete legal determination of a token’s status.
