Check the answer for your physical location, the specific platform, and the kind of contract you want to trade. Then verify both the platform’s current access rules and the latest official regulatory and court records. Being able to open an account or see a market shows practical access at that moment; it does not, by itself, settle whether that product is legal in your state.
Check these four details first
“Prediction market” is a broad label, not a state-by-state legal answer. Availability and legal challenges can differ by operator and by contract category. Before checking, write down:

- Your location: the state where you are physically located when you plan to use the platform.
- The operator: the exact platform you want to use.
- The market category: for example, sports, politics, or another event-contract type.
- The date: access rules and legal proceedings can change, so a conclusion needs a date.
Sports contracts have been a frequent focus of state challenges, so do not assume a platform’s status for one category answers the question for all of its markets.
Verify the platform’s current access rules
- Open the platform’s current state-eligibility or location information and check the rules for your physical location.
- Use its location or geolocation check, if available, and note whether it permits access to the specific market category you have in mind.
- Read the relevant contract terms and exchange rulebook. A platform may make access or restrictions depend on the contract, not just the state.
- Record the date you checked. Recheck before relying on the result, because practical availability can change.
A successful sign-up, an available market, or a passed location check is evidence of what the platform permits at that time. It is not a court ruling or a guarantee that a state regulator will agree with the platform’s legal position.

Check federal, state, and court records
Federal records
Look for relevant Commodity Futures Trading Commission (CFTC) materials, including registration information, product filings, releases, and court filings. The CFTC’s March 2026 proposed rule describes a federal framework in which a venue offering swaps or futures to the general public must register as a designated contract market (DCM) and be overseen by the agency. That description does not decide whether every platform or event contract fits the framework. Read the CFTC proposed rule.
In an April 2026 fact sheet, the CFTC stated its position that federally regulated prediction markets can operate in all 50 states and advised reviewing exchange rulebooks and contract terms. Attribute that nationwide claim to the agency: it is the CFTC’s position, not a resolution of every state dispute. Read the CFTC fact sheet.

State and court records
Search the state gaming regulator and attorney general for actions involving the specific operator and contract category. Then check the court docket or order itself. For each action, identify who brought it, when and where it was filed, what products or conduct it covers, and whether any order is temporary, stayed, appealed, or final.
A lawsuit or cease-and-desist letter is not a final ruling on the merits. A regulator’s position, a platform’s interpretation, and a judge’s decision are different kinds of evidence; do not present one as another.

Understand what the current disputes do—and do not—establish
The legal dispute involves competing positions. The CFTC asserts federal authority over qualifying registered event-contract markets, while some state authorities have challenged offerings under state gambling laws. The agency has also sued states over actions against registered markets. The existence of these competing claims means a platform’s access screen alone cannot settle the legal question.
For example, in a June 12, 2026 release, the CFTC said New Mexico had sued Kalshi over sports-related event contracts and that the Commission had filed a federal lawsuit seeking declaratory and injunctive relief. The release describes the agency’s position and the litigation posture on that date; it is not a final nationwide ruling. Read the CFTC’s New Mexico release.

Separately, an April 2, 2026 CFTC release describes the agency’s suits challenging actions by Arizona, Connecticut, and Illinois against registered markets. Its assertions about federal authority are the agency’s litigating position. Check the relevant court records for rulings and later developments rather than treating the release as a judicial decision. Read the CFTC’s April 2 release.

A state-by-state tracker can help you find potential access differences or active disputes, but it is secondary reporting and may not reflect the latest platform rules or court orders. CBS Sports published a state-by-state sports-market review dated October 10, 2026. Use it to identify issues to verify, then confirm the platform’s current information and the relevant official filings. Do not turn a tracker into a percentage of states where a platform or every contract category is legally available. See the CBS Sports review.
Write a conclusion that matches the evidence
For a useful, date-stamped answer, separate practical access from legal status:
- State whether the platform’s current location information permits the user’s state and the market category checked, and give the date.
- Summarize any relevant regulator action or court order, naming the authority, date, scope, and procedural status.
- Say when the records do not resolve the user’s particular product or situation. Do not describe a contested agency position as settled law.
