How to Check Whether a GST Notification Applies to Your State or Business

Do not assume that a document called a “GST notification” applies to your state or transaction. First identify its notification number, issuing authority and governing tax Act; then read the authenticated Gazette text, check its commencement date and later amendments, and match every condition to your supplier, recipient, goods or services, locations and dates. A Central Tax notification is not automatically a notification under the SGST, IGST or UTGST Acts.

Why the notification’s identity comes first

“GST notification” is a description, not a complete legal citation. The same subject can be dealt with under Central Tax, a State GST law, Integrated GST or Union Territory GST. Each tax head has its own legal instrument and scope. CBIC’s sectoral FAQ expressly states that separate notifications are issued under the SGST, IGST and UTGST Acts. Therefore, a Central Tax notification should not be treated as automatically operating under those other Acts.

Before interpreting the substance, write down the document’s full notification number, tax head, issuing authority, issue date, publication date, subject and stated effective date. A number without the tax head can lead you to the wrong index or the wrong Act.

Step 1: Capture the exact document details

Use the official CBIC notification indexes or the relevant government tax portal to locate the instrument. The central and integrated tax indexes list notification numbers, dates, subjects and document links, which makes them useful discovery tools. Record the following in a case file:

  • Full number and series: Preserve prefixes, slashes, years and any “Central Tax,” “Integrated Tax” or similar designation.
  • Governing tax head: Note whether it is Central Tax, SGST, IGST, UTGST or another levy.
  • Issuing authority: Identify the authority named on the instrument, rather than assuming it from a search result.
  • Dates: Separate the date signed or issued, the Gazette publication date and the date on which the provision takes effect.
  • Subject and operative provision: Copy the title and identify whether the notification grants an exemption, changes a rate, prescribes a procedure, extends a deadline or does something else.

Keep a PDF or official printout with those details. An index entry can help you find the document, but it is not a substitute for reading the instrument itself.

Step 2: Identify the correct GST legal layer

Determine which Act supplies the legal authority for the notification. CBIC describes SGST as a State tax and IGST as applying to inter-State supplies. The tax head therefore affects both the authority issuing the notice and the transactions to which it can apply.

Tax head or law What to establish Why it matters
Central Tax (CGST) Confirm that the notification is made under the Central GST Act and appears in the central notification record. Its legal authority is the Central GST framework; it should not be presumed to amend or operate under another GST Act.
State GST (SGST) Identify the particular state Act and the state instrument issued under it. State-specific wording, territory and a separate notification may control the result.
Integrated Tax (IGST) Check the IGST notification and the inter-State or place-of-supply issue it addresses. The IGST framework applies to inter-State supplies, so the supplier and recipient facts can be decisive.
Union Territory GST (UTGST) Verify the applicable Union Territory Act and its own notification. A central notification is not automatically a UTGST notification; the separate instrument must be checked.

If a measure appears to require action under more than one Act, find each corresponding instrument. The absence of a matching state, integrated-tax or Union Territory notification is a material fact, not a detail to fill in by assumption.

What “applies in my state” actually asks

State applicability can refer to different legal questions. It may ask whether a State GST notification was issued under the law of that state, whether a Central or Integrated Tax rule affects a transaction connected with the state, or whether a business establishment in the state satisfies a condition. Those questions must be separated before you search for an answer.

  • A notification may be territorial, covering a named state or Union Territory.
  • It may instead be transaction-based, turning on whether a supply is intra-State or inter-State.
  • It may identify a class of suppliers, recipients, goods or services without naming every state.
  • It may depend on the location of a warehouse, branch or accounting records rather than only the registered head office.

Consequently, “my office is in State A” is not a complete applicability test. Write the legal question in full: which Act, which taxpayer, which supply, which territory and which tax period. This prevents a Central Tax measure from being mistaken for a state notification or an IGST rule from being applied without analysing place of supply.

Step 3: Read the authenticated Gazette text

The Central Goods and Services Tax Act defines a “notification” as one published in the Official Gazette. That makes the Gazette-published instrument the legal text to verify when the legal effect matters. A search snippet, news report or index description can omit provisos, definitions, footnotes and commencement language.

In the authenticated text, read the opening authority clause, the operative paragraphs, schedules, explanations, provisos and footnotes. Check whether the instrument says that it takes effect on publication or on a later date. Also check whether it applies retrospectively or only to supplies, returns, applications or events occurring after a specified date.

Save the version you relied on and note the Gazette publication reference. If the portal offers a document link, confirm that the downloaded file is the notification itself and not merely an index page. Where the PDF contains a scanned signature or seal, retain the complete file, including its first and last pages, because the authority clause and publication details may be separated from the operative table.

Step 4: Check whether the rule is still in force

An original notification may no longer describe the current rule. The central notification index contains examples of amendments, corrigenda, rescissions and superseding entries. Search the notification number, subject and relevant Act for every later instrument.

Amendments

An amendment can replace a rate, date, condition, table entry or definition. Read the amending notification together with the original and produce a consolidated list of the words that changed. Do not apply an old table merely because the original PDF is easier to find.

Corrigenda

A corrigendum can correct a typographical error, a number, a date or other published wording. Determine whether the correction changes the condition you are relying on and record its publication date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Rescission and supersession

A rescinding instrument can withdraw the earlier measure. A superseding notification can replace it with a new set of terms. Search for both explicit language and later entries on the same subject.

Commencement changes

Later instruments may alter the date from which a provision operates. Keep the issue date, Gazette date and effective date in separate columns; they are not interchangeable.

The CGST Act PDF available from CBIC is marked amended as of 1 January 2022. For a present-day determination, use the latest applicable Act, Gazette materials and subsequent instruments rather than relying on that dated compilation alone.

Step 5: Match the notification to the real facts

Applicability is a fact-and-wording test. A state name by itself rarely answers it. Extract each operative condition and test it against the transaction and the business as it actually existed on the relevant date.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Fact to test Questions to answer Evidence to retain
Supplier and recipient Who made the supply, who received it, and are they the persons or classes named in the notification? Registration details, contracts, invoices and customer records.
Goods or services Does the item match the notification’s description, classification, schedule or defined expression? Invoice description, classification records, technical specifications and the notification’s definitions.
Territory Does the instrument cover the state, Union Territory or transaction territory in question? Registered addresses, branch records and the territorial wording of the notification.
Place of supply Where is the supply treated as taking place under the applicable rules, and is it intra-State or inter-State? Shipping documents, delivery terms, recipient location and the relevant IGST analysis.
Business location Which premises or establishment is relevant to the condition? Registration certificate, lease, warehouse records and accounting records.
Thresholds and dates Are turnover, value, quantity, time window or filing-date limits satisfied? Ledger extracts, returns, invoices and a date-by-date calculation.
Conditions and exclusions Are certificates, payment methods, end-use requirements, recipient categories or exclusions triggered? Declarations, certificates, payment proof and supporting correspondence.

The CGST Act definition of “place of business” includes, among other locations, a warehouse or a place where the taxpayer keeps accounts. Do not limit the analysis to the registered head office if the notification’s wording points to another business location. The Act separately refers to place of supply under the IGST Act, so “place of business” and “place of supply” should not be treated as interchangeable terms.

Build a fact matrix before reaching a conclusion

Create one row for every condition in the notification and columns for the exact wording, the relevant fact, supporting evidence, the applicable date and the result. Mark each row yes, no or unresolved. An unresolved row is not permission to assume the condition is met; it identifies the next document or legal question to resolve.

Use the facts that existed during the notification’s operative period. A later change of branch, recipient status, product classification or documentation cannot automatically prove what was true on an earlier date. If a condition refers to a defined expression, copy that definition into the matrix and test the facts against the definition rather than ordinary business usage.

Step 6: Compare potentially overlapping notifications

When two instruments seem relevant, compare them side by side before deciding which one controls. Use the same headings for each document:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
Comparison axis What to record
Authority and Act Issuing authority, governing Act and tax head.
Territorial reach State, Union Territory, inter-State or other territory named.
Covered persons and supplies Supplier, recipient, goods, services, sector or transaction type.
Conditions and exclusions Thresholds, documentation, end use, deadlines and exceptions.
Publication and commencement Gazette date, operative date and any retrospective wording.
Later history Amendments, corrigenda, rescission or supersession.

For each cell, quote or accurately paraphrase the operative wording and identify the document page or paragraph. If a value is not stated in one instrument, mark it as “not stated” rather than inferring it from the other document. A similar subject does not establish that one notification modifies the other; the authority clause and amendment language must show that relationship.

A repeatable ten-step checking workflow

  1. Define the question. State the exact supply, taxpayer, state or Union Territory, tax period and benefit or obligation you are testing.
  2. Find the document. Search the official central or integrated tax index, or the relevant state or Union Territory source, using the notification number, subject and date.
  3. Confirm the tax head. Write down the Act under which the instrument was issued.
  4. Obtain the Gazette text. Download or print the authenticated notification and preserve its publication details.
  5. Extract the rule. Mark definitions, operative clauses, tables, provisos, exclusions and commencement language.
  6. Build the amendment trail. Search for amendments, corrigenda, rescissions, superseding notifications and date changes.
  7. Classify the supply. Establish supplier, recipient, goods or services, place of business, place of supply and intra-State or inter-State character.
  8. Test every condition. Make a checklist for territory, dates, thresholds, documents, categories and exclusions; mark each item yes, no or unresolved.
  9. Check parallel Acts. If the measure could involve SGST, IGST or UTGST, locate and read the separate instrument instead of extending the Central Tax wording by analogy.
  10. Write a dated conclusion. State which notification applies, to which transaction and period, why each condition is met or failed, and what uncertainty remains.

Practical search and verification tips

Search by more than a phrase. Combine the notification number with the tax head, year, subject and issuing authority. If a result shows only a subject line, use it to locate the document, then verify the number and date on the PDF itself. Search the index for the exact number again after finding the document; later amendments often repeat that number or identify the original in the description.

Keep a dated research log showing the portal used, search terms, files downloaded and the date checked. This matters when a portal is redesigned or a link later points to a revised file. Do not treat a cached copy, social-media post or commercial summary as proof that the Gazette instrument remains in force.

When a notification refers to another section, rule, schedule or definition, open that cross-reference and read it as well. The operative condition may be incomplete without it. Likewise, if a table has multiple entries, identify the exact serial number that covers the supply; a broad heading may conceal an exclusion in a note or proviso.

  • a condition-by-condition table showing evidence and outcome;

  • a short statement of assumptions, unresolved wording and the person who approved the conclusion.

Record the conclusion as time-specific. A result that was correct for one tax period can change after an amendment, a corrigendum or a new effective date.

Common mistakes and how to correct them

“It says GST, so it covers every GST Act”

Why it fails: The Acts have separate legal layers and notifications. Correction: identify the tax head and locate the corresponding instrument under the relevant Act.

“The index title is the rule”

Why it fails: An index may omit a proviso, exclusion or later amendment. Correction: read the Gazette-published text and its amendment history.

“The state where my office is located decides everything”

Why it fails: The transaction may involve another location, a warehouse, a recipient in another state or an IGST place-of-supply rule. Correction: document all relevant business locations and classify the supply under the applicable rules.

“The original notification still applies because nobody mentioned a repeal”

Why it fails: A rescission, supersession or corrigendum may appear in a later index entry. Correction: search the notification number and subject through the current period and read every later instrument.

“A similar business received the benefit”

Why it fails: Small differences in goods, dates, recipient status, documentation or territory can change the result. Correction: apply the text to your own facts and retain evidence for each condition.

When to obtain professional advice

Escalate the issue to a qualified Indian GST professional when the notification uses an undefined or disputed expression, when two Acts appear to overlap, when a retrospective or amended date affects liability, or when the tax amount, penalty exposure or filing position is material. Provide the professional with the complete notification trail and your fact checklist rather than only a screenshot or search result.

CBIC describes its portal material as public facilitation and disclaims liability for consequences of its use. Treat the portal as an important official source, but verify the current Gazette text and obtain case-specific advice where the wording or interaction of the Acts is uncertain.

What a sound answer should look like

A final memo or internal note should be narrow and explicit: “Notification [full number], issued under [Act/tax head], applies to [named person, supply and territory] for [period] because [conditions]. It does not establish applicability under [other Act] without a separate notification. The conclusion is based on the Gazette text published on [date] and the later instruments checked through [date].” That format prevents a general “GST applies” statement from hiding the actual legal basis and limits.

Frequently Asked Questions

Does a Central Tax notification automatically apply under SGST, IGST or UTGST?

No. CBIC’s sectoral FAQ states that separate notifications are issued under the SGST, IGST and UTGST Acts. Identify the relevant Act and locate the corresponding instrument instead of extending Central Tax wording by assumption.

Is an entry in the CBIC notification index enough to prove applicability?

No. The index is a discovery aid. Verify the notification published in the Official Gazette and read its authority clause, operative text, definitions, provisos, schedules and commencement language.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Which date controls: issue date, Gazette date or effective date?

They can be different. Record all three and apply the date stated in the notification, including any later instrument that changes commencement or gives retrospective effect.

How can I tell whether an old notification is still in force?

Search the notification number and subject for amendments, corrigenda, rescissions, superseding notifications and effective-date changes. Read each later instrument with the original and prepare a current, consolidated version of the rule.

Does my registered office state determine whether a notification applies?

Not necessarily. Applicability may depend on the supplier, recipient, goods or services, warehouse or accounting location, place of supply, intra-State or inter-State character, territory, thresholds and exclusions. Test every condition against the actual facts.

What should I give a GST professional if the answer is uncertain?

Provide the complete Gazette notification trail, index entries, issue and effective-date timeline, fact matrix, contracts, invoices, registrations, declarations, calculations and a list of unresolved wording or cross-references.

The Bottom Line

Verify the exact tax Act, Gazette text, effective date and amendment history before deciding that a GST notification applies. Then test every territorial, transactional and documentary condition against the facts for the relevant tax period; when the wording or financial exposure is material, obtain qualified Indian GST advice.
