How to Check Whether a GST Demand or Show-Cause Notice Is Valid in India

A GST demand or show-cause notice is not validated by its appearance in the portal or by a short electronic summary. Check the complete communication, the issuing authority, the statutory section, the tax period, limitation dates, service record, computation, evidence and your opportunity to reply and be heard. The period is decisive: the amended sections 73 and 74 apply to periods through financial year 2023–24, while section 74A governs later periods. A missing record or mismatch is a reason to investigate and raise a specific objection, not automatic proof that the notice is void.

What “valid” means in a GST notice

In this context, validity is a set of separate questions rather than a single yes-or-no test. A notice may have a genuine reference number but still contain a wrong tax period, an unsupported calculation, an expired limitation period or a defective opportunity to respond. Conversely, a portal mismatch or clerical error may require correction without automatically cancelling the proceedings.

  • Identity and authenticity: Is this the complete communication from the stated GST authority, and can you match it to the portal and service record?
  • Authority and legal route: Is the named officer acting under the relevant law, and does the cited section fit the allegation and procedural stage?
  • Substance: Does the notice explain the alleged tax shortfall, erroneous refund, input-tax-credit issue or other breach, with facts, legal grounds and evidence?
  • Time: Was it issued and is the proposed order within the limitation rules for the relevant tax period?
  • Fair procedure: Did you receive the notice, enough time to respond, and the hearing opportunity required by law?
  • Amount and scope: Do the tax, interest and penalty calculations stay within the allegations and evidence set out in the notice?

Only a review of the full notice, attachments, portal history, service evidence, returns and underlying records can answer those questions for a particular case. The checklist below is a screening method, not a substitute for case-specific advice.

Step 1: Preserve and authenticate the communication

Create a notice file immediately

Save the original PDF or other complete document, every attachment and schedule, the email, SMS or other service message, and a screenshot or download of the portal record. Keep the envelope or electronic timestamp if the notice arrived through another channel. Do not rely on a printout of only the summary screen.

Record these particulars in a working sheet:

  • GSTIN and the taxpayer’s legal name
  • Issuing office, officer’s name or designation and jurisdiction, if shown
  • Reference number, communication number and any document identification shown
  • Date of issue and the date and method on which it was served
  • Tax period or financial year covered
  • Act, section and rule cited
  • Reply deadline and any hearing date
  • Whether the document is described as a notice, statement, intimation, order or recovery communication

The materials available for this guide do not establish one universal portal menu path or a universal document-identification-number validation rule for every GST communication. Use the current portal record and the issuing authority’s official communication channels to confirm what you received; do not treat the absence of one particular validation screen as conclusive.

Check that the document is complete

A short portal entry may be an electronic summary rather than the operative notice. Look for the factual allegations, legal grounds, computation, relied-on documents and annexures. If an attachment is missing, note exactly what is absent and request it promptly while protecting the reply deadline. A notice that cannot be understood because its essential allegations or calculations are missing raises a procedural objection, but the legal effect depends on the full record and the applicable statute.

Step 2: Read the notice and its electronic summary together

Identify the allegation

Mark every proposed component separately:

  • tax allegedly unpaid or short-paid;
  • tax said to have been refunded incorrectly;
  • input tax credit alleged to be wrongly availed or utilised;
  • interest, penalty or any other amount; and
  • the transactions, returns, invoices, suppliers or periods used to support the allegation.

Then identify the factual narrative and the legal reason for each component. A label such as “fraud,” “wilful misstatement” or “suppression” is an allegation to examine, not proof that the enhanced fraud-related route applies.

Match the Rule 142 form to the stage

For covered proceedings, rule 142 uses standard electronic summaries. A demand show-cause notice is accompanied by FORM GST DRC-01. A statement specified in the rule uses FORM GST DRC-02. A taxpayer’s representation or reply is filed in FORM GST DRC-06, and the electronic summary of an order is FORM GST DRC-07.

Communication or form What it generally represents How to use it in the validity check
Demand show-cause notice with DRC-01 Proposed demand and the case the taxpayer must answer Read the underlying notice and schedules; the summary alone is not enough.
Specified statement with DRC-02 Statement used where rule 142 provides that route Confirm why a statement, rather than a standard notice, was issued and what allegations it contains.
DRC-06 Reply or representation by the taxpayer Keep the filed copy, upload receipt and date; these prove that the response was made.
Order summary with DRC-07 Electronic summary of the adjudication order Obtain and read the full order. DRC-07 is treated as a notice for recovery, so an order may have immediate consequences.

If the summary and the full document differ, preserve both versions and identify each difference in the reply. Do not assume the summary silently replaces the detailed notice or order.

Step 3: Confirm the statutory section and tax period

Periods through financial year 2023–24

The amended text of sections 73 and 74 is limited to earlier periods through FY 2023–24. Section 73 covers cases that do not involve the specified fraud-type grounds. Section 74 is the route where the department alleges fraud, wilful misstatement or suppression of facts to evade tax. Check whether the notice’s facts actually support the section it invokes and whether the period falls within this framework.

Later periods: examine section 74A

The Finance (No. 2) Act, 2024 introduced section 74A for later tax periods and limited sections 73 and 74 to the earlier periods. Do not carry an old section 73 or 74 deadline into a later period. Read section 74A as enacted and check its commencement, amendments and any applicable notifications for the period in question. The specific 74A dates and procedural details are not interchangeable with the earlier rules.

Separate the procedural stage

Identify whether you are looking at:

  • a pre-adjudication intimation or payment communication;
  • a demand show-cause notice;
  • a statement under the rule 142 procedure;
  • an adjudication order; or
  • a recovery communication following an order.

These stages have different legal effects and response routes. A demand proposal is not the same thing as a final order, and a final order is not the same thing as a recovery step. Treating all portal messages as “the notice” can lead to a missed deadline or the wrong remedy.

Step 4: Work out limitation from statutory dates

Use the event specified by the section

Limitation is not a universal number of years counted from the day you happened to discover the notice. For the applicable earlier-period provisions, the current text provides a three-year order limit under section 73 and a five-year order limit under section 74. The calculation uses the statutory annual-return due date or, where relevant, the date of the erroneous refund, rather than the date of portal discovery.

Write down the triggering date, the applicable section, the order deadline and the notice’s issue and service dates. Then check whether the notice was issued sufficiently before the order deadline in the manner required by that section. Record any period-specific extension, stay, exclusion, notification or amendment that could affect the calculation. A deadline calculation for a section 74A period must use section 74A’s own rules; a number taken from sections 73 or 74 is not a safe substitute.

Build a date table

Date or event What to record Why it matters
Relevant financial year or refund event Tax period and, for an erroneous refund, the refund date Identifies the statutory starting event.
Annual-return due date, where applicable The due date specified by the law for that period Section 73 or 74 calculations use this statutory event, not discovery.
Notice issue date Date printed or electronically generated on the notice Tests whether the notice was issued in time under the applicable section.
Actual service date When and how you received access to the communication Controls the practical reply period and proves any service dispute.
Order deadline Deadline under the section after accounting for legally effective extensions or exclusions Shows whether adjudication can still be completed lawfully.
Reply and hearing dates Dates stated in the notice and any later rescheduling Shows whether a reasonable opportunity was provided.

If your calculation suggests expiry, state the calculation precisely in the reply and attach the source records. Do not simply write “time-barred” without identifying the period, triggering event, statutory section and dates.

Step 5: Test the authority and legal grounds

Check the issuing authority

Confirm that the notice identifies an officer and office acting under the relevant GST law. Compare the jurisdiction and taxpayer details with your registration records. If the document names a different taxpayer, GSTIN or period, flag the mismatch immediately and preserve the original communication.

A jurisdictional concern can be important, but it may depend on delegation, allocation orders or state-specific provisions that are not visible on the first page. Ask for clarification and obtain professional advice before treating the notice as void.

Test the section against the facts

For a section 74 notice, look for concrete particulars supporting the alleged fraud, wilful misstatement or suppression intended to evade tax. General statements, unexplained assumptions or a bare label should be challenged as inadequate reasons, while recognising that the final legal assessment depends on the evidence and statute. For a section 73 notice, check whether the department has nonetheless inserted fraud-related language or penalties that belong to another route.

For a later-period notice, verify why section 74A is cited and whether the alleged conduct and dates fit its enacted framework. Do not infer that section 74A has exactly the same thresholds, deadlines or consequences as section 73 or 74.

Step 6: Reconcile the department’s computation with your records

Reperform the arithmetic

Make a line-by-line reconciliation of the proposed tax, interest and penalty. Tie each line to a return, invoice, credit ledger, refund document or other evidence. Check whether the department has:

  • counted the same invoice or period twice;
  • treated a tax-paid transaction as unpaid;
  • used the wrong tax rate, place of supply or tax period;
  • rejected credit without identifying the specific document or statutory condition;
  • calculated interest for a period that does not match the alleged liability; or
  • added a penalty without explaining the legal provision and facts relied on.

Prepare your own schedule showing the department’s figure, your figure, the difference and the supporting document. If part of the amount is accepted, identify that part separately from the disputed balance.

Check scope and new grounds

Compare the final order, if one has already been issued, with the allegations in the notice. An order that introduces a new factual ground or increases the amount beyond what was proposed may raise a separate procedural issue. Identify the exact new ground, amount and paragraph; then assess it against the full statute and record. Do not assume that every difference is fatal, but do not let a material expansion go unchallenged.

Step 7: Verify service, reply and hearing rights

Calculate the real response period

Compare the date printed on the notice with the date you actually received or could access it. Preserve email headers, portal timestamps, SMS records, download logs and internal mail records. If service was delayed or the notice was inaccessible, explain the delay and request adequate time rather than waiting silently for the deadline to pass.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

File and prove the response

Use the channel specified for the proceeding and retain the submitted DRC-06 or other reply, upload acknowledgment, reference number and timestamp. A draft saved on a computer is not proof of filing. Attach the reconciliation, limitation calculation and documents supporting each factual denial or admission.

Request a hearing where appropriate

Section 75 requires consideration of the taxpayer’s representation and provides a reasonable opportunity of hearing in the circumstances specified there. If the amount is material, facts are disputed or the notice proposes an adverse order, make a clear hearing request and keep proof that it was made. Attend or seek a documented adjournment through the permitted channel; do not assume that a written reply alone resolves every hearing issue.

Notice, order and recovery: do not confuse the consequences

Stage What you should verify Immediate concern
Notice or statement Allegations, section, period, evidence, computation and reply deadline Submit a complete response before adjudication.
Adjudication order Whether every representation was considered and reasons address the notice and evidence Identify appeal or other statutory remedy deadlines.
DRC-07 summary Whether it matches the full order and correct amount It is treated as a notice for recovery; preserve the date and seek urgent advice if recovery is threatened.
Recovery action Underlying order, amount, service and statutory authority for the step Do not treat a recovery message as a fresh opportunity to ignore the original order.

If you have received an order or recovery communication rather than a proposed notice, move the matter to the front of your timeline. The available time for a statutory remedy can be shorter than the time used to investigate the original allegations.

Common warning signs and what they do—and do not—prove

  • Only a summary is visible: request or locate the complete notice and attachments. This raises a document-access issue; it does not by itself cancel the proceeding.
  • Portal and PDF show different amounts: preserve both, identify each discrepancy and ask for correction or clarification. Determine which document is legally operative.
  • Wrong GSTIN, legal name or tax period: raise the identity mismatch immediately and obtain advice on jurisdiction and rectification.
  • Fraud language appears without particulars: demand the factual basis and evidence for the allegation; do not accept the label as established.
  • Notice appears late: perform the statutory date calculation using the correct period and section, including any legally effective extensions or exclusions.
  • Reply was uploaded but no acknowledgment is visible: preserve the upload receipt, browser or email evidence and contact the proper office without abandoning the deadline.
  • Order contains a new allegation or higher amount: compare it line by line with the notice and raise the procedural and substantive objections separately.

Documents to assemble before seeking review

A GST practitioner or tax lawyer can assess the issue faster when the file is organised. Assemble:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • the complete notice, statements, summaries, orders and recovery communications;
  • all service evidence and portal downloads;
  • returns, amended returns, electronic liability and credit ledgers;
  • invoices, debit and credit notes, e-way or transport records where relevant;
  • refund applications and sanction documents, if an erroneous refund is alleged;
  • contracts, purchase and sales registers, reconciliations and payment proof;
  • prior correspondence, replies, hearing notices and acknowledgments; and
  • your issue list showing period, section, amount, dates and the remedy or clarification requested.

Keep an unedited archive and work from copies. Changing filenames or re-saving PDFs can remove metadata that helps establish when a document was received.

When to escalate urgently

Obtain prompt professional advice when the reply deadline is near, the amount is material, fraud or suppression is alleged, your limitation calculation appears expired, essential documents are missing, an order has already been issued or recovery has begun. A qualified GST practitioner or tax lawyer can apply the current central and state provisions to the complete record.

Central CGST rules are the framework discussed here. State GST enactments are generally aligned, but local rules, competent authorities, notifications and notices issued under another law must be checked separately. A state-specific or mixed-law notice should not be dismissed by applying a central provision mechanically.

A practical one-page validity checklist

  1. Download and preserve the complete notice, attachments, portal entry and service evidence.
  2. Record GSTIN, legal name, authority, officer, reference numbers, issue and service dates, period, section and deadline.
  3. Classify the communication as notice, statement, order, summary or recovery step.
  4. Read the full allegations and compare the document with DRC-01, DRC-02 or DRC-07 as applicable.
  5. Identify whether the period is through FY 2023–24 or a later period requiring section 74A analysis.
  6. Test the cited section against the alleged facts, especially any fraud, wilful-misstatement or suppression assertion.
  7. Calculate limitation from the statutory annual-return or refund event, not from discovery of the notice.
  8. Recompute tax, interest and penalty and reconcile every line with your records.
  9. Check actual service, reply time, hearing entitlement and proof of any DRC-06 or other submission.
  10. State each objection precisely, attach evidence, request missing documents or a hearing, and obtain urgent advice if the case is consequential.

This process identifies issues that deserve a formal objection. It cannot, without the complete file and current law, guarantee that a notice is legally invalid. Respond on time while the validity questions are being investigated.
