First identify the exact product—spot margin, listed futures, or perpetual futures—then read that product’s current eligibility page and terms. Check your state of residence, where you are physically located when using the service, account-verification level, customer classification, and any suitability screening. Finally, confirm the legal entity providing the product and read its risk disclosure. Access to one leveraged product does not prove that another is available to you.
No single, permanent state-by-state list covers every exchange and every leveraged product. Rules differ by product, entity and customer type, and exchange pages can change. The process below gives you a defensible way to verify eligibility on the date you intend to trade.
What “leverage” can mean on a crypto exchange
Exchange marketing often uses one word for several legally and technically different services. Treat each as a separate availability question.

Spot margin
Spot margin lets you borrow assets or cash to buy or sell an underlying cryptocurrency. The position is generally tied to the spot market, and the exchange’s margin agreement controls collateral, interest, liquidation and eligible assets. A state may permit a customer to use spot margin while that same customer cannot open a futures or perpetual-futures position.
Listed futures
Futures are standardized contracts with an expiry or settlement schedule. They are commonly offered through a regulated derivatives entity rather than the company that holds ordinary spot balances. Eligibility can include account verification, customer classification, a suitability review and location restrictions.

Perpetual futures
Perpetuals are futures-style contracts without a conventional expiry. Funding payments, leverage limits and liquidation rules differ from listed futures. Some services offer perpetuals only outside the United States or exclude people who are physically in the United States, even when their residence or citizenship is elsewhere.
Why the distinction matters
Each product can have a different provider, agreement, onboarding flow and geographic footprint. A trading screen showing a leverage setting is not proof that every leveraged product is lawful or available in your state. Record the exact product name before you begin checking.

The six-part eligibility check
Use this sequence for one exchange and one product at a time. Save the page title, terms version or effective date, and the date you checked so you can repeat the process later.
- Name the product precisely. Write “spot margin,” “listed futures” or “perpetual futures,” plus the contract or market if relevant. Do not accept a general “leverage available” statement as an answer.
- Open the official eligibility page. Use the exchange’s own help center, product page and customer agreement. Search the page for
state,location,residence,United States,margin,futuresandeligibility. Read linked terms and disclosures, not just the summary paragraph. - Separate residence from physical location. Note your legal residence and the place from which you will actually connect. A rule may use either, or both. A person who moves temporarily, travels, or uses a cross-border account should not assume that residence alone controls.
- Check account and customer requirements. Confirm the required identity-verification tier, age and account status. Look for retail-versus-professional or eligible-contract-participant categories, self-certification language, minimum financial information and any trading-experience questions.
- Identify the contracting entity. Read the agreement or disclosure to find the company that provides brokerage, clearing or custody for the product. An exchange brand can operate several services through different legal entities, each with its own permitted jurisdictions.
- Verify inside the account, then read the risk disclosure. A verified account that displays an order ticket is a practical signal that onboarding has accepted you; it is not a replacement for the current terms. Before placing an order, read liquidation, margin-call, funding, settlement and loss provisions.
Build a product-specific record
A short record prevents you from mixing rules for different services or relying on an old comparison. Use one row per product.

If a source does not state a state list, write “not stated” rather than inferring availability from a neighboring state, a social-media post or another product.
Residence, physical location and state boundaries
“Available in your state” can describe at least two tests: whether your declared residence is in an allowed state and whether you are physically located in an allowed place when you access the service. Some products apply a third test to citizenship or “US person” status.

- Residence: The address on your verified account, tax records or other proof of residence.
- Physical location: Your actual location at login or order time. A service may block a connection from a restricted jurisdiction even if your account address is elsewhere.
- US-person or customer status: A contractual definition that can include citizens, residents, entities or other categories. Read the definition used by that product instead of assuming it means only your state address.
Do not use a VPN, false address or another person’s account to bypass a location control. That can breach the agreement and may interfere with liquidation, compliance reviews or the return of funds.
Verification and customer classification
Identity verification is often a prerequisite, but it is only one layer. Exchanges can require proof of address, source-of-funds information, trading experience or a suitability assessment. A customer classified as retail may receive a narrower margin product than an eligible-contract-participant or professional customer.
For example, Kraken’s materials describe separate derivatives services for non-US customers and US customers. They also describe margin eligibility for US retail clients and a broader international margin product for US eligible-contract-participant customers who self-certify. Those examples show why you must match the rule to both product and customer category; they are not a complete state-by-state answer.
When an application asks experience or financial questions, answer accurately. A passed questionnaire does not remove the obligation to understand the product’s risks, and an incomplete answer can result in a later restriction.
Confirm the provider and legal entity
Find the entity named in the customer agreement, rulebook, clearing disclosure or account statement. Look for phrases such as “provided by,” “brokerage services,” “clearing,” “counterparty” and “balances held with.” Keep the entity name with the product in your record.
Kraken identifies NinjaTrader Clearing, LLC as the provider of its US derivatives brokerage. Coinbase identifies Coinbase Financial Markets for US derivatives balances and distinguishes spot balances held with Coinbase, Inc. These are product-specific disclosures: they do not mean every service under either brand has the same state coverage.

If the terms name an entity you did not expect, stop and read that entity’s agreement and disclosures. The entity—not the logo on the trading screen—may determine which regulator, customer protections and geographic restrictions apply.
What official exchange examples show
Kraken
Kraken’s derivatives eligibility materials separate Kraken Derivatives (non-US) from Kraken Derivatives US. The materials describe verification and geographic eligibility for derivatives and list restrictions for the non-US service. A separate margin-eligibility page distinguishes US retail access from access available to US eligible-contract-participant customers who self-certify. Use these pages as a model for separating products and customer categories, not as a universal list of states.

Coinbase’s US derivatives information describes a US-regulated derivatives service, names Coinbase Financial Markets for US derivatives balances, and says customers must pass standard eligibility and suitability checks. It separately describes spot balances held with Coinbase, Inc. The information does not establish the complete current state availability of every leveraged product, so check the exact contract and your account’s eligibility.
Gemini
Gemini’s perpetuals eligibility information says availability depends on residence or incorporation in a supported country and excludes people physically located in the United States or otherwise treated as US persons for the referenced service. This illustrates why both residence and physical location must be checked. It is not a state-by-state list for US residents.
How to verify access in the account
- Finish the exchange’s required identity and address verification.
- Open the product-specific onboarding or trading page, not just the general spot dashboard.
- Read each location, customer-category and suitability attestation before accepting it.
- Check whether the order ticket identifies the same product and provider you recorded from the terms.
- Look for a clear notice that your state or location is restricted. A missing notice is not proof that the product is permitted.
- Download or save the applicable agreement and disclosure, noting the date and version.
If the platform shows “not eligible,” capture the exact message and contact support through the authenticated account channel. Ask whether the decision concerns residence, physical location, verification, customer category or product availability. Request the answer for the named product and your state, and keep the response with its date.
When the official materials do not answer your state
Many pages list countries, regions or broad US restrictions without naming every state. Do not turn silence into approval. Use this escalation path:

- Check the product terms, eligibility page, rulebook and risk disclosure for the same service.
- Search the authenticated help center for your state abbreviation and the full state name.
- Ask support a narrowly worded question: “May a retail customer whose state of residence is [state], and who is physically located there, open [exact product] through [named entity]?”
- Ask whether a temporary physical location, US-person definition or customer classification changes the answer.
- Save the written response and re-check the terms immediately before trading.
If the provider will not give a clear answer, treat eligibility as unresolved and do not open the leveraged position. A state list from an old blog, an affiliate page or another exchange cannot establish this provider’s current permission.

Eligibility answers whether you may access a product; it does not answer whether the trade is suitable for you. The Coinbase Derivatives rulebook states: “Futures trading is not suitable for all investors, and involves the risk of loss.” It also explains that futures are leveraged because only a percentage of a contract’s value is required, so losses can exceed the amount deposited for a futures position.
Before trading, locate the provisions covering:
- Initial and maintenance margin, margin calls and liquidation triggers
- Whether the provider can close positions without your advance approval
- Funding payments for perpetuals and settlement or expiry for listed futures
- Fees, spreads, collateral conversion and treatment of negative balances
- Market-disruption, trading-halt and force-majeure procedures
- How disputes, complaints and withdrawals are handled by the named entity
Do not assume that a small initial deposit caps your loss. The rulebook’s warning concerns the contract’s full exposure, not merely the amount shown as margin.
Common mistakes and how to correct them
Using a general leverage page
Problem: A marketing page lists leverage without identifying the product or jurisdiction. Correction: follow the link to the exact eligibility page and agreement for the contract you intend to trade.
Confusing spot margin with futures
Problem: Margin appears in the dashboard, so the user assumes futures are allowed. Correction: record each product separately and verify its provider and terms.
Checking only the account address
Problem: The user lives in an allowed state but is traveling in a restricted location. Correction: read physical-location and US-person language and ask support how temporary travel is treated.
Treating verification as approval
Problem: Identity checks pass, but suitability or customer-category screening later blocks derivatives. Correction: complete product-specific onboarding and retain the result.
Relying on a historical comparison
Problem: A state was listed months ago, but the provider changed entities or coverage. Correction: re-check the official terms and in-account status on the date of use.
Bypassing a restriction
Problem: A VPN, borrowed account or false residence is used to reach a blocked product. Correction: stop, contact the provider and use only an account and location that comply with the agreement.
Compare products without mixing their rules
When comparing two products or exchanges, use the same six axes for each row:

The reviewed official materials do not support ranking providers or publishing a complete state matrix for all leveraged products. A comparison is useful only when every row refers to the same product type and the same date.
A repeatable date-of-use checklist
- Exact product and contract written down
- Current official eligibility page opened
- State of residence checked
- Physical-location and US-person rules checked
- Verification tier and customer category confirmed
- Suitability or onboarding screening completed
- Provider and contracting entity identified
- Terms, rulebook and risk disclosure saved with date or version
- Authenticated account shows eligibility for that same product
- Support answer obtained if the state question remains unclear
- Loss, liquidation and negative-balance provisions understood before funding
Repeat the checklist after moving, changing account status, switching products, or returning from a restricted location. Exchange eligibility pages and terms are operational documents, not permanent guarantees.
