How to Check Whether a Costume or Character Reference Could Infringe a Trademark (U.S. Guide)

Short answer: A costume, character name, logo, image, or promotional reference creates trademark risk when its use could make buyers think the goods or services come from, are sponsored by, or are connected with someone else. The key question is likely consumer confusion, not whether the design is identical to an existing mark. Compare the entire commercial impression, the relatedness of the goods or services, and the marketplace context, then obtain professional clearance for consequential or close commercial uses.

This is general information about U.S. trademark law, not a legal opinion about a particular costume or campaign. Trademark analysis does not resolve copyright, rights of publicity, licensing, or other claims that may apply to a character or image.

What trademark infringement means in this situation

The USPTO defines trademark infringement as “the unauthorized use of a trademark or service mark on or in connection with goods and/or services in a manner that is likely to cause confusion, deception, or mistake about the source of the goods and/or services.” USPTO guidance also discusses confusion about sponsorship, affiliation, or some other connection.

That standard focuses on the buyer’s probable understanding in the real marketplace. A mark can be a word, phrase, symbol, design, character name, image, or combination of elements. Federal registration is not the only source of rights; a party may assert rights in an unregistered mark. Conversely, finding a registration in a database does not by itself prove infringement.

Identity is not required

Marks do not have to be identical. Similarity can arise from appearance, sound, meaning, or the overall commercial impression. A different spelling, color palette, typeface, or product label may still leave a similar impression. Those comparisons matter only within the relevant goods, services, purchasers, and trade channels; a visual resemblance alone does not answer the legal question.

The goods and services must be considered together with the marks

Courts examine whether the goods or services are related or close enough that buyers could reasonably expect a common source, sponsorship, or connection. Goods may be related when they are used together, sold to the same purchasers, advertised together, compete with one another, or are commonly offered through similar channels. A costume reference used on a product, event, advertisement, or service therefore has to be assessed in its actual commercial setting.

Trademark is only one part of a character-use review

A character name or image can identify a character in a book, game, film, or other creative work without functioning as a trademark for the work. The Trademark Manual of Examining Procedure section 1202.10 discusses decisions involving a game-character image, character names in a book series, and a frog illustration on a book cover. Those examples show why neither of these shortcuts is reliable: “character references are always free” and “any character likeness is trademark infringement.”

The separate trademark question is whether your particular use functions as a source identifier, or is likely to make consumers think the trademark owner approved, sponsored, or supplied your goods or services. Copyright may restrict copying of artwork, costume designs, dialogue, or other expression even when trademark confusion is uncertain. A living person’s name or likeness can raise publicity or privacy issues. A license, contract, platform rule, or advertising law may create additional obligations. A trademark screen cannot clear those separate rights.

A six-step preliminary trademark check

Use the following process to organize facts before you spend money on production or promotion. It is a screening method, not a legal clearance or a prediction of what a court will decide.

  1. Describe every proposed element. Write down the exact wording, character or brand name, spelling variants, logo, image, colors, costume pieces, slogans, tags, packaging, product listing, social profile, and advertisement. Save sketches and screenshots. For each element, record where it appears and whether it looks like a brand or source cue, rather than merely part of a costume or depiction. A name printed as a prominent product label raises a different question from a small descriptive reference in explanatory text.
  2. Define what is being sold or promoted. Identify the product or service, its price and format, the intended purchasers, and the places where buyers will encounter it. Note whether the owner of the suspected mark is known for related merchandise, entertainment, events, memberships, education, or services. Relatedness is evaluated in context; calling something a “costume” does not end the analysis if it is marketed with entertainment or event services.
  3. Search federal trademark records. Search the USPTO trademark database for the wording and plausible spelling, phonetic, plural, and singular variants. Search design records when an image, emblem, or character drawing is involved. Review both pending applications and registrations, and read the listed goods and services, owner information, status, and specimens where available. A search can reveal records you need to investigate, but it cannot establish that no one has enforceable rights or guarantee that your use is safe.
  4. Compare the complete commercial impression. Examine appearance, sound, meaning, dominant features, and the way the elements are presented together. Then compare the relevant goods and services, advertising methods, sales platforms, geographic reach, purchaser groups, and purchasing conditions. A different product label or a change in one color does not automatically eliminate relatedness or confusion. Document both similarities and meaningful differences instead of relying on a single visual feature.
  5. Check marketplace signals. Review the package, listing title, URL or account name, hashtags, search keywords, point-of-sale display, influencer or event promotion, and any statement suggesting an official connection. Consider how carefully buyers are likely to shop, whether the purchase is impulse-oriented or expensive, and whether there is evidence of actual confusion. Keep records of questions, mistaken orders, messages, takedown notices, or corrections. Also assess whether the presentation appears deliberately designed to evoke another source; intent can be relevant, but it is not a substitute for the rest of the analysis.
  6. Escalate a close or consequential use. If the product launch, advertising spend, inventory, event, or reputation makes a mistake costly, ask a qualified trademark attorney for a comprehensive clearance review. The USPTO recommends comprehensive searching for clearance work. Tell counsel exactly what will be sold, where, under which name, with which artwork, and through which channels. Do not describe a basic database search as comprehensive clearance, and do not treat an attorney’s preliminary view as an absolute guarantee.

How to compare a proposed reference with an existing mark

Use a written comparison so that you do not overvalue one resemblance while overlooking the commercial context. The factors below are nonexclusive. Courts give them different weight depending on the evidence and the dispute.

Comparison area Questions to ask Why it matters
Sound Would the names be pronounced alike or heard as the same phrase in an advertisement or conversation? Auditory similarity can matter even when spelling differs.
Appearance How do the lettering, silhouette, emblem, image, arrangement, and prominent features look when encountered at normal buying distance? Buyers often see a quick overall impression rather than inspect every detail.
Meaning Do the terms or images suggest the same idea, character, affiliation, or theme? Similar meaning can contribute to a similar commercial impression.
Overall commercial impression What source would a reasonable purchaser think the complete presentation identifies or references? The law does not isolate one element when the combined presentation creates a different impression.
Goods and services Are they used together, competitive, commonly offered by the same businesses, or otherwise related? Related goods make source or sponsorship confusion more plausible.
Trade and advertising channels Do the offers appear in the same stores, marketplaces, social channels, events, search results, or promotional media? Overlapping channels expose the same buyers to both presentations.
Purchasers and care Who buys, how expensive is the transaction, and how much attention do buyers normally use? Careful, informed purchasing can affect the likelihood of a mistake, but it is not a universal defense.
Strength and recognition How distinctive and commercially recognized is the earlier mark in the relevant market? A stronger mark may be encountered as a source or sponsorship signal more readily.
Actual confusion Are there credible reports of mistaken inquiries, orders, affiliation assumptions, or complaints? Actual confusion can be useful evidence, although its absence does not automatically resolve the issue.
Intent Did the presentation appear selected to benefit from another source’s recognition, or was it independently chosen? Intent may inform the analysis, but courts still evaluate the other circumstances.

Reading USPTO search results without overclaiming

What a record can tell you

A record can show the wording or design, the listed goods and services, filing and registration status, owner, and related prosecution history. Compare those details with your proposed use. A registration covering unrelated goods may present a different risk from one covering the same merchandise, event, or advertising service. Pending applications still deserve attention because they can reveal an earlier user’s claimed scope and may mature into registrations.

What a record cannot tell you by itself

The USPTO’s examination search is part of the registration process, not a court’s infringement determination. A database may not resolve common-law rights, marketplace use, geographic scope, unregistered marks, or the factual question of likely confusion. A “no results” search is therefore not proof that a name or image is available. A record that looks similar is a reason to investigate the goods, services, owner, and marketplace—not an automatic finding that your project infringes.

Character names, images, and costumes: questions to ask

Is the reference functioning as a brand?

Ask whether the name or image tells buyers who made, sponsored, or authorized the goods, or whether it simply describes the character being portrayed. Placement is important: a large emblem on a product label, storefront, or social account can operate differently from a factual sentence explaining that a costume is inspired by a fictional character. The same image can perform different functions in different uses.

Could buyers infer sponsorship or an official connection?

Look beyond the costume itself. Product titles, account names, packaging, promotional copy, event signage, hashtags, and statements such as “official,” “licensed,” or “authorized” can change the impression. Avoid language that suggests approval unless you actually have permission. A disclaimer may be one fact in the record, but it does not automatically cure a confusing presentation.

Are you copying expression as well as referencing a source?

Trademark analysis does not decide whether the costume construction, artwork, photograph, pose, dialogue, or other expressive material is protected by copyright. Nor does it decide whether a performer’s name or likeness is being used unlawfully. Treat those as separate clearance questions before commercial release.

Common assumptions that do not safely end the analysis

  • “It is not identical, so it is fine.” Similarity in sound, appearance, meaning, or overall impression can matter.
  • “I changed the colors.” A color change may leave the dominant wording, design, or impression intact; it is not an automatic safe harbor.
  • “I added a disclaimer.” Disclaimers can be considered with the rest of the presentation, but they do not automatically eliminate confusion.
  • “No one has complained.” Lack of known actual confusion may simply mean the use is new, small, or not yet noticed.
  • “It is parody.” A parody label does not categorically decide a trademark dispute. The message, audience, presentation, and likelihood of confusion still matter.
  • “The database is clear.” Federal-record searching is useful screening, not a promise of unrestricted use or a substitute for comprehensive clearance.
  • “It is only a character reference.” A character name or image may or may not function as a trademark in the particular use, and other intellectual-property rights may still apply.

A practical risk-triage worksheet

After completing the six steps, put the facts in one file and classify the project for next action. This is an internal triage tool, not a legal test.

Pattern in your facts Practical response
The wording or image is prominent, the goods or services are closely related, channels overlap, and the presentation suggests official affiliation. Pause public launch and obtain a professional clearance assessment before producing inventory or advertising.
Some elements resemble a known mark, but the goods, purchasers, channels, and presentation differ substantially. Preserve your comparison, investigate marketplace use and unregistered rights, and consider counsel if the project is commercially important.
The reference is incidental, clearly identifies a fictional character in context, and does not act as a source cue. Keep documentation showing the context, but separately evaluate copyright, publicity, licensing, and platform rules.
You cannot determine who owns the mark, what goods are covered, or how buyers will encounter the use. Do not treat uncertainty as permission. Gather the missing facts or obtain a clearance review.

When professional clearance is warranted

Consult qualified trademark counsel when the name, costume, character image, or logo will identify a product line, headline an event, drive paid advertising, appear on substantial inventory, or be used where a takedown, rebrand, or injunction would be expensive. Counsel can expand the search beyond federal records, evaluate common-law use and design similarity, review the actual marketplace presentation, and advise on narrowing, rebranding, permission, or licensing. No search service or lawyer can guarantee a particular outcome because the governing analysis is fact-specific and the evidence can change.

For a small, noncommercial personal costume, trademark confusion is less likely to be the central issue, but this guide does not grant permission and does not resolve copyright, publicity, or venue rules. Commercial use is where documenting the facts and obtaining advice before launch provides the greatest practical benefit.
