Open-weight does not mean unrestricted. Downloading a checkpoint gives you access to model parameters, but the publisher may impose a custom license, acceptable-use rules, attribution duties, user or revenue thresholds, geographic limits, or conditions on redistribution and hosted services. To determine whether you can use a model, identify the exact checkpoint and revision, read its model card, open the operative license or terms, follow every incorporated policy, and map each clause to your planned activity.
This workflow is practical due diligence, not a legal opinion. For a consequential commercial launch, have counsel review the current documents and your specific facts. Repository contents and publisher terms can change, so preserve the versions you reviewed and check them again before deployment or redistribution.

What “open-weight” tells you—and what it does not
An open-weight model is distributed with its trained parameters available to download or otherwise access. That describes an access method, not a complete permission set. “Open-weight” is not automatically synonymous with open source, unrestricted use, or permission for every commercial purpose. Code, training data, model weights, documentation, and outputs can each be subject to different rights or obligations.
A model hub’s license label is a useful starting point, but it is metadata supplied for a repository. The legally operative text may be a standard license, a publisher-specific community agreement, terms of use, or a set of documents incorporated by reference. A permissive-sounding identifier does not override a separate acceptable-use policy or a condition that applies only to a particular model family or company size.

Evaluate the exact artifact and the exact activity. Internal evaluation, fine-tuning, shipping weights to customers, embedding inference in an application, and offering a hosted API can trigger different clauses.
The checking workflow
1. Record the exact artifact
Start a review record before downloading anything. Capture:
- Publisher and repository owner.
- Model family, checkpoint name, and variant (for example, base versus instruction-tuned).
- Repository revision, tag, commit or release identifier, and the date you checked it.
- Where you obtained the files and which files you intend to use.
- Your proposed activities, such as research, commercial inference, fine-tuning, redistribution, or a hosted service.
“Version” matters. Meta’s Llama 3 model card identifies an April 18, 2024 release, while Llama 4 has a distinct community license. Do not assume that a later family, quantized file, or similarly named repository inherits the earlier version’s terms.
For a fine-tune, merge, distillation, adapter, or quantization, write down the stated base model as well as the derivative. A repository uploader’s label cannot establish that the uploader had authority to relicense upstream materials.
2. Read the model card and metadata
On Hugging Face, a model card is the repository’s README.md with metadata; license information is displayed on the model page. The platform’s guidance says a card should describe the model, intended uses, potential limitations, biases, and ethical considerations. Read the whole card, not only the badge or the first paragraph.
Look for:
- A named license and a link to its full text.
- Statements identifying the covered checkpoint, software, weights, or other materials.
- Intended-use and out-of-scope-use sections.
- Required notices, attribution language, naming rules, or links that must accompany a distribution.
- References to an acceptable-use policy, safety policy, export rule, registration step, or separate agreement.
- Lineage information for base models, datasets, adapters, or other components.
Hugging Face explains its model-card conventions at https://huggingface.co/docs/hub/model-cards and its repository license metadata at https://huggingface.co/docs/hub/en/repositories-licenses. These pages explain how the metadata works; they are not a substitute for the publisher’s operative terms.

3. Open the actual license or terms
Follow the card’s license link and open the complete document. If the repository contains a file such as LICENSE, LICENSE.md, or TERMS-OF-USE, compare it with the linked official version. Record the document title, version or date, URL, and the repository revision at which you found it.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesClassify what you find:
- Conventional license: for example, Apache 2.0 or MIT. Read whether the license actually covers weights, code, and documentation, because a repository can contain materials with different rights.
- Model-specific agreement: a community license or terms document may add prohibited uses, notices, eligibility requirements, or commercial thresholds.
- Custom or unknown license: treat the absence of familiar wording as a reason for closer review, not as permission.
Check the operative provisions for scope (which artifacts and versions are covered), grant of rights, restrictions, notices, attribution, naming, warranty and liability language, governing law, geography or eligibility, acceptance mechanism, amendments, and termination. Determine whether merely downloading, accessing, or using the model constitutes acceptance.
4. Follow every incorporated document
Search the agreement for phrases such as “incorporated by reference,” “acceptable use,” “safety policy,” “additional terms,” or “applicable laws.” Open each referenced document from the publisher’s current official location and save it with the agreement. A restriction in a separate policy can be just as important as a clause in the license itself.
Meta’s Llama 3 materials demonstrate this structure. The Llama 3 Acceptable Use Policy states: “If you access or use Meta Llama 3, you agree to this Acceptable Use Policy (“Policy”).” The policy is at https://dev.meta.ai/llama/llama3/use-policy. The Llama 3 model repository and card are at https://huggingface.co/meta-llama/Meta-Llama-3-8B-Instruct?library=transformers. This example does not establish rules for other model families; it shows why a model-page badge is not enough.
For every incorporated document, note its effective date, the models it covers, definitions, prohibited activities, reporting or enforcement provisions, and whether it can change independently of the main agreement.

| Activity | Questions to answer | Evidence to save |
|---|---|---|
| Internal research or evaluation | Is access limited to eligible users or regions? Are prohibited-use rules still binding during testing? Do you need to display notices? | Eligibility clause, acceptable-use policy, access terms |
| Commercial inference in your product | Is commercial use granted? Are company size, revenue, user count, registration, or separate-license triggers present? What notices must reach users? | Grant, thresholds, notice and attribution clauses |
| Fine-tuning or other modification | Are modifications, adapters, merges, distillation, and quantization allowed? Must you identify the base model or preserve notices? | Modification grant, derivative definitions, upstream terms |
| Redistributing weights | May you provide original or modified weights? Must recipients accept terms, receive a copy, or get a notice? Are mirrors or downloads restricted? | Redistribution and pass-through provisions |
| Embedding in software | What attribution, naming, trademark, or documentation must ship with the application? Are outputs or user prompts addressed? | Notice, naming, trademark and output clauses |
| Hosted API or managed service | Does “use” include offering inference to third parties? Are there service-specific restrictions, abuse controls, or reporting duties? | Definitions of service, user, distribution and prohibited use |
Record an answer of “not stated” when a document does not address a question. Do not convert silence into a permission assumption; ask counsel or the publisher when the issue is material.
6. Check thresholds, notices, and pass-through duties
Some agreements grant broad rights until a defined threshold or require extra steps for large operators. Meta’s 2024 Llama 3 Community License includes an additional commercial term when the relevant products or services exceeded 700 million monthly active users in the preceding calendar month on the Llama 3 version release date; the agreement then requires a separate license request. This is a condition of that agreement, not a general limit on open-weight models.
The Llama 4 Community License Agreement contains a comparable 700 million monthly-active-user release-date threshold for its own license. Read the current text and confirm that its definitions and applicability fit your organization. It also states: “Your use of the Llama Materials must comply with applicable laws and regulations (including trade compliance laws and regulations) and adhere to the Acceptable Use Policy for the Llama Materials…” The agreement is at https://dev.meta.ai/llama/llama4/license.
Other terms may require a copyright notice, attribution text, a specific model name, a link to the license, or a copy of the terms for downstream users. Treat these as release requirements: put the exact wording in your product documentation, distribution archive, or service terms where required.
7. Investigate upstream and derivative terms
A derivative has more than one compliance question. Identify the base model and every material component, then read each upstream license. A fine-tune may add a new license for your changes while leaving the base model’s restrictions in force. A quantization or merge may still be redistribution of the original weights under the upstream agreement.
Check whether the derivative publisher:
- Names the base model and its revision.
- Provides the upstream license and required notices.
- Had authority to distribute the resulting files.
- Imposes additional terms that are compatible with the upstream grant.
- Explains which files are original changes and which remain upstream material.
If lineage, authority, or compatibility is unclear, flag the uncertainty. Do not select the most permissive license label and assume upstream restrictions vanished.

8. Save evidence and schedule a recheck
Create a dated compliance packet containing the model card, license or agreement, incorporated policies, repository revision, download location, and your activity-by-activity analysis. Preserve stable links and, where permitted, copies or hashes of the documents. Note who reviewed each issue and which questions remain open.

Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. How to read common license patterns
Standard open-source license
Apache 2.0 and MIT are familiar examples, but first confirm what the repository actually licenses. Code may be under one license while weights or documentation are under another. Standard licenses commonly address copying, modification, redistribution, notices, and disclaimers; they do not automatically settle acceptable-use, export, privacy, or model-specific safety rules appearing elsewhere.
Community or model-specific license
A custom agreement can grant copying and modification while adding prohibited uses, attribution, naming, eligibility, or a threshold for large deployments. Read definitions carefully: “Llama Materials,” “products,” “services,” “monthly active users,” or “distribution” may have specialized meanings that control when a clause applies.
Modified permissive license with a commercial condition
Mistral’s help-center guidance dated August 12, 2026 says most of its open models use Apache 2.0, while certain models use a modified MIT license with a revenue-related condition. It says qualifying companies with more than $20 million USD in monthly revenue must obtain a commercial license or use Mistral Studio for those affected models. The guidance does not apply that condition to every Mistral model; check the exact model card and terms at https://help.mistral.ai/en/articles/347393-under-which-license-are-mistral-s-open-models-available.

Comparing two candidate models
When choosing among models, build a side-by-side record. A license family name alone cannot answer every operational question.

Common mistakes and how to correct them
Relying on the hub badge
Problem: You see “Apache-2.0,” “MIT,” or a custom label and stop reading. Correction: open the full license, model card, and every incorporated policy; verify that each applies to the exact revision.
Confusing weights with the entire repository
Problem: You assume a license for code also covers weights, tokenizer files, documentation, or datasets. Correction: inventory the files you will ship and identify the rights for each material component.
Assuming a derivative is cleanly relicensed
Problem: A fine-tune or quantized upload displays a permissive label. Correction: trace the base model, preserve upstream notices, and verify the distributor’s authority and compatibility.
Answering only “Can I use it commercially?”
Problem: You overlook prohibited uses, user-count thresholds, attribution, hosted-service language, or geographic restrictions. Correction: assess the concrete product, users, deployment regions, modification method, and distribution path separately.
Keeping no versioned evidence
Problem: A web page changes and you cannot show which terms you relied on. Correction: save dated links, revisions, document copies or hashes where allowed, and the written decision for the proposed use.
A release checklist
- Confirm the publisher, repository, checkpoint, variant, revision, and date checked.
- Read the model card, intended-use limits, metadata, and lineage statements.
- Open the complete license or terms; record scope, version, acceptance, geography, amendments, and termination.
- Open every linked acceptable-use, safety, trade-compliance, or supplemental policy.
- List your actual activities: evaluation, commercial inference, modification, redistribution, embedding, and hosted service.
- For each activity, record permissions, conditions, notices, thresholds, and unresolved questions.
- Trace all base models and material components in a derivative.
- Prepare required attribution, naming, license copies, and downstream notices.
- Obtain legal review when the deployment is high-stakes, large-scale, cross-border, or contractually uncertain.
- Archive the evidence and schedule a review before launch and whenever the model or terms change.
Following these steps turns an “open” label into a documented, checkpoint-specific decision. The result may be permission to proceed, a requirement to change distribution or notices, a request for an additional license, or a decision not to use that model. What matters is that the conclusion is tied to the actual text and the actual way you plan to operate it.
