Do not rely on an AI legal answer until you have checked every material claim against current, primary authority for the correct jurisdiction and forum. A fluent response can contain a fabricated case, an outdated statute, a distorted holding, a wrong deadline, or filing instructions from another court. Use AI to organize questions or summarize documents, then verify the law independently and obtain qualified legal help when the decision could affect your rights, money, liberty, or a filing deadline.
Why a plausible legal answer can still be wrong
Generative AI predicts text; it does not guarantee that a citation exists, that a quotation is genuine, or that a rule applies to your court. It may combine fragments from different jurisdictions, rely on an old version of a rule, invent a case that sounds real, or state a real case’s facts while changing its holding. Confidence, detail, and citation-like formatting are not evidence.

Legal Aid NSW and Illinois Legal Aid Online both warn consumers that AI tools can produce false or misleading legal information. The National Center for State Courts (NCSC) tells legal practitioners: “Check every citation, case, statute, rule, and claim.” That standard is useful for anyone deciding whether an AI response is safe to use.
What kinds of errors matter most
- Fabricated authority: a nonexistent case, statute, regulation, quotation, court, or paragraph number.
- Mischaracterized authority: a genuine source whose facts, procedural posture, holding, or limits are described incorrectly.
- Wrong jurisdiction: a rule from a different country, state, province, court, tribunal, or commission.
- Outdated law: a provision that was amended, repealed, superseded, or affected by a later decision.
- False procedure: an incorrect form, service method, fee, filing location, deadline, or required disclosure.
- Unsupported factual assumptions: the response silently fills gaps in your timeline, contract, evidence, or relationship.
What the available accuracy evidence does—and does not—show
A 2024 study by Matthew Dahl, Varun Magesh, Mirac Suzgun, and Daniel E. Ho asked specific, verifiable questions about randomly selected federal court cases. It reported correct-answer rates of 58% with ChatGPT 4 and 88% with Llama 2 for that task. Those figures are not an accuracy rate for every model, current product, jurisdiction, or type of legal question. They demonstrate why a convincing answer must be checked rather than trusted.

Define the legal question before checking the answer
Verification starts by fixing the facts that determine which law applies. An answer that is correct in one forum can be wrong in another.
Record the place, forum, issue, and date
- Place: country and, where relevant, state, province, territory, or municipality.
- Forum: the named court, tribunal, commission, administrative agency, or arbitration process.
- Issue: the legal question, such as limitation period, tenancy notice, employment classification, evidence, or appeal.
- Relevant date: the date of the event, the date a notice was received, the filing date, and the law’s effective date.
- Case type and procedural stage: civil, criminal, family, immigration, administrative, small claims, appeal, enforcement, or another category.
Ask the AI to state the assumptions it made, but do not treat those assumptions as established facts. Write down corrections before you search official sources.
Separate facts from legal propositions
Copy the response into a working document and label each sentence as one or more of the following:

- A statute, regulation, court rule, policy, or quoted passage.
- A case citation or description of a holding.
- A deadline, fee, form, service method, or other procedural instruction.
- An interpretation, prediction, or recommendation.
Each label needs a different check. A factual timeline is tested against your records; a legal proposition is tested against current authority; a filing instruction is tested against the exact forum’s current instructions.
Use the right source for each claim
No single website answers every legal question. Choose the most authoritative, current source that addresses the precise proposition.
| Source | Best use | What to verify |
|---|---|---|
| Legislation or regulation published by the responsible government | Definition, legal test, entitlement, offence, power, or penalty | Jurisdiction, section number, version, commencement date, exceptions, and amendment history |
| Official court or tribunal decision | How a legal test was applied to facts | Case name and number, court, date, procedural posture, holding, relevant passage, and later history |
| Current court, tribunal, or agency rules and practice directions | Forms, filing, service, evidence, fees, formatting, disclosure, and deadlines | Exact forum, document type, effective date, local practice, and any emergency or transitional rule |
| Regulator or government guidance | Operational requirements, public processes, and official explanations | Issuing body, audience, date, legal status, and whether a binding instrument is also required |
| Legal-aid information | Plain-language orientation and referral options | Location, last-review date, scope, and links to the underlying authority |
| Professional commentary | Issue spotting and explanations of unsettled doctrine | Author’s jurisdiction, date, cited primary sources, and whether the text is commentary rather than a rule |
| AI output or an unsourced summary | Questions to investigate and documents to organize | Nothing is established until independently confirmed |
Legal Aid NSW, last updated in August 2026, advises: “Always verify any AI generated information using reliable legal sources such as official legislation websites.” Illinois Legal Aid Online, reviewed September 15, 2025, likewise urges caution with AI-produced legal information and privacy. Their guidance is consumer information from those locations, not a universal statement of every jurisdiction’s rules.

A step-by-step verification workflow
1. Preserve the original response and its context
Save the exact prompt, the answer, the date, and any files or links supplied by the tool. Record the model or service if shown. This prevents a later change in wording from hiding what you actually relied on and lets a lawyer see the source of an error.
What’s actually slowing this PC down?
Pick the symptom - the matching free tool is one click away.
2. Build a claim checklist
Number every material assertion. Include apparently minor details: a “30-day” period, a paragraph number, a statement that a form is mandatory, or the claim that a document can be filed online. Mark each item as unverified until a source supports it.
3. Find the primary authority
Search the official legislation database, court or tribunal decision repository, rule book, or regulator website for the relevant jurisdiction. Start with the citation supplied by the AI, but do not assume the citation is real. Search by case name, neutral citation, section heading, distinctive quotation, and subject terms. If the authority cannot be found in an official or reliable legal database, treat it as unverified and do not quote it.
4. Read the provision, not just the heading
Open the complete section or rule and read definitions, exceptions, cross-references, schedules, and commencement provisions. Check the version in force on the date that matters. A heading or search snippet may omit a condition that changes the result. Note whether the text is legislation, a regulation, a procedural rule, guidance, or a nonbinding explanation.
5. Test the proposition against the exact language
Write the AI’s claim in one sentence, then ask: “Where, exactly, does the source say this?” A provision may authorize a court to do something without requiring it, or create a discretion rather than an automatic right. If the source supports only part of the sentence, narrow the statement to that part and identify what remains uncertain.

For each case, confirm the court, date, citation, parties, and procedural history. Read the passages surrounding the quoted language. Check that the court actually decided the issue, rather than mentioning it in argument, summarizing another decision, or leaving it unresolved. Confirm that the facts match your situation closely enough to be relevant and identify differences that could change the outcome.

Then check subsequent history where available: appeal, rehearing, overruling, distinguishing decisions, statutory changes, or a later order limiting the decision. An appellate-practice article from the American Bar Association recommends finding quoted language in the decision itself and checking subsequent history. That is professional commentary, not a single rule binding every lawyer or court, but it is a sound reliability check.
7. Verify deadlines and filing instructions separately
Deadlines are especially dangerous because a small error can remove an appeal or defence. Confirm the triggering event, counting method, holidays, extensions, service requirements, time-zone rule, and whether the period is jurisdictional. Use the current instructions for the named court or tribunal, not a general legal calendar. Check the fee, approved form, filing channel, number of copies, signature or certification, and required attachments immediately before filing.
8. Check the forum’s AI and disclosure rules
Search the court or tribunal’s current practice directions, filing guide, and orders for artificial-intelligence provisions. Rules may govern whether AI can draft or reword evidence, whether authorities must be certified, whether an AI-use disclosure is required, and whether a closed system is mandated. These requirements can differ between courts in the same country and can change without the AI tool’s knowledge.
9. Document what you verified
For every claim you retain, record the source title, issuing body, section or paragraph, version or date, and a short note explaining why it supports the claim. Record unresolved questions separately. This audit trail helps a lawyer review your work and prevents an unverified sentence from slipping into a filing or letter.
10. Escalate before acting when the stakes are high
If the answer affects a limitation period, criminal exposure, immigration status, child safety, housing, employment, significant money, a settlement, or a court filing, consult a qualified lawyer or local legal-aid service before relying on it. Bring the original AI response, your claim checklist, the primary sources you found, and the facts and dates you can document.
How to check common types of AI legal claims
“The law says I have this right”
Locate the provision that creates the right and check its eligibility conditions, exclusions, remedies, and enforcement route. Determine whether the right is automatic, subject to an application, or dependent on a decision-maker’s discretion. Check whether a contract, collective agreement, local ordinance, or special regime changes the analysis.

“This case proves my position”
Read the actual decision and identify the legal issue the court had authority to decide. Distinguish the holding from observations, a summary of a party’s argument, or a hypothetical example. Compare the material facts, burden of proof, remedy, and procedural stage. A favorable quotation from a different jurisdiction or an overturned decision is not reliable support.

Find the rule that sets the period and identify when the clock starts. Confirm whether the day of service counts, how weekends and public holidays are treated, whether electronic service changes the calculation, and whether an extension is available. If the AI gives no source for the number, do not use it as a working deadline.
“This is the correct form”
Use the official form library for the exact court, tribunal, case type, and procedural stage. Check the form’s revision date, filing method, signature requirements, exhibits, translations, accessibility format, and fee waiver process. A generic form from another court can be rejected even when the legal issue is similar.
“The court allows AI-generated evidence or documents”
Look for a current order, practice direction, or filing guide that addresses the specific document. Rules may distinguish evidence, pleadings, legal submissions, correspondence, and administrative forms. Never assume that permission to use an AI tool for brainstorming permits generated text in a sworn statement or other evidence.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Forum-specific AI rules: why local instructions control
Legal Aid NSW reports that some New South Wales courts prohibit AI use to write or reword specified evidence documents. It also notes that other documents may require a statement confirming that cited authorities exist and are relevant. Australian federal courts have their own requirements concerning closed-AI use and accuracy, and the Federal Court may require disclosure in specified circumstances. These are examples for the named Australian forums, not rules that automatically apply elsewhere.
Before preparing or filing anything, identify the exact court and document. Read the latest practice direction and filing instructions, check any declaration or certification wording, and ask the registry or a lawyer if the rule is unclear. A rule that applied last year, in a different division, or to a different document may not apply to your matter.

Protect confidential and personal information
Consumer AI services may retain, reuse, or expose submitted information depending on their terms and settings. Legal Aid NSW warns that information entered into a tool may be stored, reused, or viewed by others. Illinois Legal Aid Online also advises reading the service’s privacy policy and using caution.
Information to keep out of a consumer tool unless cleared
- Names, addresses, dates of birth, identification numbers, and case or account numbers.
- Medical, financial, employment, immigration, family, or safeguarding details.
- Confidential correspondence, settlement offers, privileged legal advice, and unpublished evidence.
- Passwords, access codes, signatures, full documents, and information about another person.
If you need help organizing a problem, remove identifying details, replace dates and amounts with labels, and summarize only the issue. Anonymization is not a guarantee: distinctive facts can still identify a person or matter. Check the service’s retention, training, sharing, deletion, and access terms, and consider whether your professional, contractual, statutory, or court confidentiality duties permit the disclosure at all.
What AI can safely help with—and what it should not decide
Lower-risk uses after removing sensitive details
- Turning a known timeline into a chronological checklist.
- Summarizing a document you are authorized to use, while preserving the original for comparison.
- Generating questions to ask a lawyer, legal-aid service, court registry, or regulator.
- Explaining unfamiliar legal vocabulary in plain language, followed by verification.
- Checking whether your notes mention a date, document, or factual gap that needs confirmation.
Uses that require professional review
- Choosing whether to sue, plead guilty, settle, appeal, sign a waiver, or disclose information.
- Calculating a limitation or filing deadline.
- Drafting evidence, affidavits, declarations, pleadings, or submissions for filing.
- Interpreting a contract or notice where a mistake could cause substantial loss.
- Making decisions about safety, custody, deportation, detention, benefits, housing, or employment termination.
AI can help you prepare for a consultation, but it cannot replace a lawyer’s responsibility to investigate facts, identify the governing law, protect confidentiality, and exercise professional judgment. If you cannot afford private counsel, contact a local legal-aid organization, law centre, or court-approved referral service in your jurisdiction.

A practical verification worksheet
Use one row for each material statement in an AI response:
| Field | Entry |
|---|---|
| Claim | Copy the exact sentence or instruction. |
| Claim type | Fact, statute or rule, case, quotation, deadline, procedure, or recommendation. |
| Jurisdiction and forum | Country, state or province, court or tribunal, case type, and procedural stage. |
| Primary source | Official title, citation, section or paragraph, issuing body, and URL or database record if available. |
| Currentness | Version or decision date, effective date, amendments, and subsequent history. |
| Support | The exact passage that proves the proposition, or “not supported.” |
| Uncertainty | Missing facts, conflicting authority, discretionary language, or unresolved issue. |
| Action | Retain, narrow, correct, remove, or obtain professional advice. |
Do not mark a claim “verified” merely because two AI tools give the same answer. They may reproduce the same source error or invented citation. Independent confirmation means finding the underlying authority and reading it.
Red flags and recovery steps
Red flags in the response
- A citation has no discoverable record in the official database.
- The answer switches between jurisdictions or uses unexplained court names.
- A quotation has no page, paragraph, or matching text in the decision.
- The response gives an exact deadline without identifying the triggering event or rule.
- It promises a guaranteed result, says a court “always” acts a certain way, or ignores exceptions.
- It cites a blog or summary while omitting the statute, rule, decision, or official guidance.
- It asks you to upload confidential documents or personal identifiers unnecessarily.
If you already relied on an unverified answer
- Stop sending the information or filing the document until the claim is checked.
- Preserve the prompt, response, date, source links, and any action you took.
- Identify any deadline or hearing date that could be affected and verify it with the official forum immediately.
- Contact a qualified lawyer, legal-aid service, or court registry; explain the possible error plainly.
- Correct or withdraw inaccurate material through the procedure the forum requires. Do not silently replace a filed document when a formal correction is necessary.
Bottom line
A legal answer from AI is a starting list of questions, not authority. Pin down the jurisdiction and forum, split the response into checkable claims, read current primary sources, verify case text and later history, confirm local filing and AI-use rules, protect confidential information, and obtain qualified legal help before a consequential decision or filing. If a claim cannot be supported by the correct current source, do not rely on it.
