Start with the evidence chain, not the alert label. An automated license plate reader (ALPR) record can contain several separate events: a camera image, software’s transcription of the plate, a comparison with a hot list or other database, an officer’s review or query, and a later stop, search, identification, or warrant. A defensible challenge tests each link and the legal rule that governs the particular link.

Whether a judge excludes ALPR-derived evidence depends on the jurisdiction, the facts, the way the information was used, and the procedural route. A technical error, a policy violation, or an unverified hit does not automatically require suppression. A lawyer who practices in the relevant court should examine the actual records, preservation deadlines, discovery rules, and controlling precedent.

What an ALPR record actually proves

ALPR systems are not a single observation made by an officer. In the system described by the Supreme Court of California, cameras captured plate images; character-recognition software generated a plate number; the software compared that number with a hot list containing plates associated with matters such as suspected crimes, AMBER alerts, or outstanding warrants; and the system stored the plate number, time, and location. Those details describe the system in that case, not every agency or current product.

For litigation, separate the events instead of treating an “ALPR hit” as one item:

  • Scan: the camera’s original image and the date, time, and location assigned to it.
  • Recognition: the software’s transcription of the characters and any confidence or exception information retained by the system.
  • Alert: the comparison with a list or database and the reason the record matched.
  • Human review: what an officer saw on the screen, what the officer compared in the field, and any later query.
  • Use: how the information contributed to a stop, detention, warrant, search, identification, or other evidence.

A single observed plate, an alert against a hot list, a later search of stored scans, and a location history assembled from repeated scans raise different legal and factual questions. Your motion, discovery request, or hearing should identify which one the prosecution is relying on.

Build a case-specific evidence map

Before arguing about reliability or privacy, make a timeline. Record when the camera captured the image, when the system generated a read, when an alert appeared, when anyone queried the record, and when officers acted. Note whether the prosecution relies on the image itself, the software read, an alert, a database entry, an officer’s testimony, or a combination.

Then identify the proposition each item is offered to prove. An image may be offered to show that a vehicle was present at a location. A database alert may be offered to justify a stop. A later query may be offered to connect a vehicle with an investigation. An expert may interpret system records to establish identity or movement. An objection aimed at one proposition may not resolve another.

Preserve the records before they disappear

ALPR systems can have retention limits, and agencies may keep the image, the transcription, and audit information in different systems. Counsel should send a targeted preservation demand as soon as possible and ask the court for relief if material is at risk. Preservation should cover the particular vehicle, time range, cameras, alerts, and users involved rather than an unlimited demand for every scan.

Potentially relevant categories include:

  • the original image in its native format and any displayed or exported copy;
  • the software’s plate transcription, confidence information, exception codes, and associated metadata;
  • the hot-list or database record as it existed at the time, including the alert reason, source, update history, and expiration or cancellation information;
  • event logs showing who viewed, queried, edited, exported, or shared the record and when;
  • agency policies governing use, verification, access, retention, sharing, and deletion;
  • maintenance, calibration, configuration, and quality-control records for the relevant camera and software;
  • training materials and records for the officers who interpreted or acted on the alert; and
  • communications, reports, and warrant or stop paperwork that describe how the ALPR information led to later evidence.

Whether any category exists or is discoverable depends on the agency, vendor, system configuration, local law, and the case’s discovery rules. A preservation request is not itself a right to receive everything requested.

Test the image and the software read

Obtain the captured image rather than relying on a report that merely repeats the plate number. Compare the image with the transcription. Examine whether the plate was obscured, angled, poorly lit, dirty, damaged, or visually similar to another character. Check the image’s timestamp, location, camera identifier, and any processing or export history.

Do not assert a numerical error rate without reliable evidence for the particular system and setting. No current, generalizable accuracy statistic is established here. A plausible mismatch is an issue to investigate, not proof that the entire system is unreliable.

Ask an examiner to work from the original file when possible. An exported screenshot may omit metadata or alter the image. The examiner should document what was received, how it was preserved, what characters are visible, and whether the software read can be reproduced from the available records. If the prosecution’s witness relies on a confidence score or an internal quality flag, request the definition of that field and the version of the software that generated it.

Challenge the hot list or underlying database

An alert is only as current and accurate as the list that generated it. Request the exact alert reason, the plate or vehicle identifier entered, the source agency, the date and time the entry was created or updated, and the status in effect when the scan occurred. Determine whether the entry was stale, cancelled, entered for a different vehicle, or associated with a person or matter that did not match the vehicle in the image.

Ask who was authorized to add, modify, or remove the entry and whether an audit trail records those actions. If the alert was based on a warrant, stolen-vehicle report, missing-person report, or other underlying event, determine whether that event still existed at the time of the scan and whether the database supplied enough information for an officer to understand its limits.

Examine independent verification before the stop

One of the most important factual questions is what the officer did after the alert appeared. Did the officer compare the displayed image with the actual plate? Did the officer check the vehicle description, jurisdiction, make, model, or other identifying information? Did another source confirm that the vehicle still met the alert condition? Was the officer instructed to verify the hit before taking action?

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

The University of California, Berkeley School of Law’s 2016 primer identifies independent verification as an issue to investigate. Montana law provides a state-specific example: Montana Code Annotated § 46-5-117 says a positive ALPR match alone does not constitute reasonable suspicion and specifies corroboration steps. That rule should not be generalized to another state. In a jurisdiction without a comparable statute, the question may instead turn on constitutional precedent, agency policy, or the totality of circumstances.

Obtain the officer’s report, dispatch recordings, body-camera footage, in-car video, and computer-aided-dispatch messages if they show what was known before the stop. The key time is generally the moment the officer acted, not information learned afterward.

Trace every query and access

A later search of stored ALPR data is different from the original scan. Request logs that identify the user, date and time, search terms or plate numbers, stated investigative purpose, result set, export, and sharing. Look for searches performed before the officer claimed to know about the vehicle, searches that returned a broader history than the initial alert, and access by users who were not assigned to the investigation.

Availability and discoverability vary. Some agencies retain query logs; others may keep only limited audit information. If the prosecution relies on a location history, identify how many observations it contains, the time span, the geographic area, and whether the history was assembled by a targeted search or by routine retention.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Distinguish a single scan from long-term location history

Privacy and search arguments depend heavily on the nature and duration of collection. A single scan records an observation on a public road. Repeated scans over days, months, or years can create a much more revealing account of movement. Do not present those situations as interchangeable.

In United States v. Floyd, No. 8:23-cr-00305 (M.D. Fla. Nov. 21, 2025), a federal district court denied suppression on the facts before it, reasoning that the ALPR data reflected discrete observations on public roads rather than comprehensive long-term tracking. That is a fact-specific trial-court decision, not a nationwide rule. A different record—especially one involving extensive duration, targeted monitoring, or additional aggregation—may require a different analysis under controlling law in that jurisdiction.

Describe the collection precisely: number of scans, dates, locations, retention period, method used to assemble the history, and whether officers sought a particular vehicle or reviewed a broad dataset. Then apply the jurisdiction’s precedent on searches, location information, and governmental data aggregation.

Attack the legal basis for the stop

Ask what facts supplied reasonable suspicion or another lawful basis before the vehicle was stopped. An alert may be one fact among several, or it may have been the sole reason. Compare the alert’s content with what the officer could see and verify at the scene.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Potential questions include:

  • Was the plate number in the image actually the number transmitted to the officer?
  • Did the alert identify a specific vehicle or merely a plate associated with a broad category of concern?
  • Was the database entry current and tied to the same vehicle?
  • Did the officer confirm the image and vehicle details before initiating the stop?
  • Did the officer learn additional facts only after the stop had begun?

If the initial stop lacked a lawful basis, counsel may seek suppression of evidence obtained as a result. The available remedy depends on the jurisdiction, the reason for the defect, exceptions to the exclusionary rule, and the causal connection between the stop and later evidence.

Challenge technical testimony under the court’s expert-evidence standard

When the prosecution presents an analyst or technical witness, examine qualifications, the system actually used, the records reviewed, and the method applied to the image or database. A witness who can describe an agency’s procedure may not automatically be qualified to offer an opinion about software reliability, image recognition, or statistical error.

The Berkeley primer discusses Daubert and Frye hearings as issue-spotting tools. The governing test, timing, and procedure depend on the court. Counsel should identify the jurisdiction’s expert-evidence rule, request the underlying data and methodology, and ask whether the opinion can be independently checked. A challenge may focus on an unsupported confidence claim, missing validation records, an unexplained software version, or an interpretation that assumes the database entry was accurate.

Compare policy and statutory violations carefully

Agency policy can reveal what officers were required to do, such as verify a hit, limit searches, document a purpose, or delete data after a specified period. A deviation may support cross-examination, discovery, or a constitutional argument, but policy language alone does not guarantee exclusion.

State statutes may impose operational duties. Montana Code Annotated § 46-5-117 illustrates requirements concerning policies, annual audits, access records, and maintenance and calibration records. Washington’s current RCW chapter 10.130 contains policy, audit, reporting, and transparency requirements with future deadlines. The consulted provisions do not establish a general exclusion rule for every ALPR-derived item. Check the code, amendments, effective dates, and remedy provisions for the jurisdiction and date of the conduct.

Do not confuse public-records rulings with criminal discovery

A public-records case answers a disclosure question under a public-records statute. It does not automatically decide whether a criminal defendant can obtain the same material through discovery or whether a judge must exclude evidence.

In ACLU Foundation of Southern California v. Superior Court of Los Angeles County, S227106 (Cal. Aug. 31, 2017), the Supreme Court of California held that scan data in that case were not exempt as records of investigations under the California Public Records Act. The court also recognized a separate public-interest basis to withhold raw data and remanded the anonymization question. Its frequently quoted statement was: “a plate scan does not become exempt merely because it later surfaces in a search of an ALPR database.” That sentence addresses a California public-records exemption, not a general criminal-evidence suppression rule.

For a criminal case, use the applicable discovery rule, subpoena process, inspection order, or preservation motion. Explain why the requested item is material to the stop, search, identification, expert opinion, or other contested issue.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use the right procedural vehicle

The same factual defect can require different filings. Counsel may combine or sequence requests, depending on local procedure:

  1. Discovery request: seek images, reads, alert records, query logs, policies, and technical materials tied to the incident.
  2. Motion to preserve: ask the court to require retention of identified records when deletion is imminent or disputed.
  3. Motion to compel or inspect: request an order when the prosecution or agency withholds material required by the governing rules.
  4. Motion to suppress: challenge the stop, search, warrant, or derivative evidence under the jurisdiction’s constitutional and statutory standards.
  5. Expert-evidence motion: contest qualifications, methodology, or reliability when technical testimony is offered.
  6. Trial objections and cross-examination: separate authentication, hearsay, relevance, foundation, and reliability issues that remain after pretrial rulings.

Deadlines and burdens differ. A lawyer should calculate them from the charging document, arraignment, discovery order, and local rules rather than assuming that a later objection will be allowed.

How courts may view the main arguments

Argument Question the court must decide Important qualification
Unverified alert Did the officer have a legally sufficient basis to stop the vehicle before obtaining further information? Montana’s corroboration rule is state-specific; other jurisdictions may apply different standards.
Misread image Does the original image support the software transcription and the officer’s identification? Do not claim an error rate without reliable evidence for the system and conditions.
Location history Was the data a discrete public-road observation or an extended, targeted history? Floyd was a fact-specific federal trial-court ruling and is not binding nationwide.
Expert reliability Are the witness, methodology, software records, and opinion admissible under the court’s expert-evidence rule? Daubert or Frye applicability and procedure depend on the jurisdiction.
Policy or statute violation What duty was violated, and does the controlling law provide a remedy? A defect does not by itself establish exclusion.
Public-record disclosure Does the public-records law require disclosure of the requested material? A disclosure ruling does not automatically decide criminal discovery or suppression.

Historical scale figures are not current accuracy measures

The California Supreme Court’s 2017 opinion described estimates in the record that the Los Angeles Police Department recorded data from about 1.2 million cars per week and retained scan data for five years, while the Los Angeles County Sheriff’s Department recorded about 1.7 to 1.8 million plates per week and retained data for two years. Those were historical agency estimates described in that opinion. They are not present-day statistics, universal retention periods, or measures of recognition accuracy.

Questions to ask an officer or system witness

  • What did the original camera image show, and can the witness identify the file and metadata?
  • What exact plate characters did the software produce?
  • What list or database generated the alert, and what was the alert reason at that time?
  • When was the underlying entry created, updated, verified, or cancelled?
  • What did the officer compare before stopping the vehicle?
  • Who queried or exported the record, at what time, and for what stated purpose?
  • What retention, audit, maintenance, or calibration rule applied?
  • Was the witness trained to interpret the software output, or is the witness offering a separate technical opinion?
  • How many scans and what time span make up any location history?
  • What evidence would remain if the ALPR information were removed from the investigation?

Common mistakes that weaken a challenge

  • Arguing that every ALPR record is unconstitutional without describing the collection and use at issue.
  • Assuming a database hit proves the plate was correctly read or that the underlying alert was current.
  • Demanding a nationwide accuracy percentage when the relevant question is whether this image and system output are reliable.
  • Treating an agency-policy violation as an automatic suppression rule.
  • Using a public-records decision as if it resolved criminal discovery or admissibility.
  • Ignoring the difference between the initial stop and a later search of stored location data.
  • Waiting until trial to request records that may be deleted under a short retention schedule.
  • Failing to identify the court level, jurisdiction, date, and precedential status of a favorable case.

A practical checklist for counsel and defendants

  1. Write the event timeline from scan through every later use.
  2. Identify each ALPR component relied on: image, transcription, alert, query, history, or testimony.
  3. Send a narrowly tailored preservation request covering the vehicle, cameras, dates, users, and databases involved.
  4. Request the original image, metadata, read, alert record, underlying entry, query logs, and relevant policies.
  5. Compare the image with the transcription and document visibility conditions.
  6. Determine what independent verification occurred before the stop or search.
  7. Research the jurisdiction’s rules for reasonable suspicion, searches, expert evidence, discovery, and remedies.
  8. Analyze whether the collection was a single scan, repeated observations, or a long-term location history.
  9. Ask whether policy or statute supplies a duty and whether controlling law supplies a remedy.
  10. File the appropriate preservation, discovery, suppression, or expert-evidence motion before the governing deadline.

ALPR evidence is strongest when every link is documented and independently verified; it is most vulnerable when an image, software read, database status, officer action, or later interpretation cannot be tied to reliable records. The court’s decision will turn on the actual chain and the law of that jurisdiction, not on the label “ALPR hit” alone.
