How to Challenge a Service-Tax Demand for Residential Construction Work in India

Challenge a residential-construction service-tax demand by first identifying whether it is a show-cause notice or a final order, then testing the legal category, limitation period and calculation against the actual contract and service records. The result depends on the noticee, the work and agreements, the tax period and the law then in force. This is a guide to India’s historical service-tax regime—not a determination that a homeowner, builder, developer or contractor owes or does not owe tax. Do not apply today’s GST rules to an older service-tax period.

Start by identifying the document and deadline

A show-cause notice proposes a demand and calls for a reply; a final adjudication order communicates a decision and may require an appeal. The next step depends on which document you received. Do not treat the date printed on a notice as proof of when it was served.

  1. Record the details: note the issuing authority, named noticee, project, service recipient, tax category, provisions cited, periods, amount and every stated deadline.
  2. Establish service: retain the envelope, email headers, portal download record or other evidence showing when and how the document reached you.
  3. Separate proposal from decision: check whether the document asks for a reply or records an adjudication order. Keep any hearing notices, submissions and hearing record with it.
  4. Make a date-specific plan: for a notice, work to its stated reply deadline. For an order, promptly verify the appeal provision, forum, form, any payment or deposit requirement and time limit under the law applicable to that order and its communication date.

The applicable appeal mechanics cannot be stated reliably without the authority, order date, statutory version and procedural posture. If an order has arrived, get advice promptly rather than assuming a deadline or forum.

Check who the demand names and what transaction it covers

The person who bought or occupies a flat is not necessarily the person named as liable. Construction disputes may concern a contractor engaged by a builder, a developer contracting with buyers, or another party. Read the notice and agreements to establish who supplied what to whom; do not assume that a ruling or tax theory involving one relationship settles another.

  • Match the noticee and service recipient to the parties named in the contract, invoices and payment records.
  • Identify the precise project, work scope and tax periods in the demand.
  • Check whether the department relies on a particular construction-service category or a statutory explanation concerning developers, and whether that provision applied during the periods alleged.

Test the service classification against the contract

Compare the category in the notice with the actual work and contractual obligations. A central issue can be whether the arrangement was a service activity simpliciter or an indivisible composite works contract involving both services and transfer of property in goods.

Pure construction service or composite works contract?

Read the main agreement alongside amendments, scope-of-work documents, bills of quantities, invoices and records of materials. Establish whether goods were transferred as part of the bargain and how the contract treated them. The Supreme Court has considered the statutory works-contract service regime introduced from 1 June 2007 and the valuation rules for works contracts. That framework may be relevant, but it does not automatically decide a different contract or period. Read the judgment, statutory amendments and agreement together.

Who contracted with whom, and when?

Distinguish work performed by a contractor for a developer from a developer’s arrangement with buyers. Also identify whether the period falls before or after the statutory changes on which the notice relies. A tribunal decision concerning residential-complex construction records differing department and assessee positions, including a works-contract objection; it is an issue map, not a ruling that every residential development receives the same treatment.

Classification, the parties’ relationship, the applicable statutory period and valuation are connected questions. A conclusion about one does not resolve the others automatically.

Check whether the demand is within time

CBIC’s service-tax recovery guidance summarizes Section 73 as providing an ordinary notice period of one year from the relevant date, with an extended period of up to five years for specified cases involving fraud, collusion, wilful misstatement, suppression of facts or contravention with intent to evade. These are statutory periods, not a calculation for every historical demand.

Check the version of Section 73 governing each period, how the relevant date is defined, when the notice was served, and whether any applicable exclusion—such as one related to a court stay—affects the calculation. The Finance Act text and amendments in force for the demand period matter.

If the notice invokes the extended period, inspect the specific conduct and intent it alleges. Identify what facts it says were concealed or misstated, and compare that account with returns, registration records, invoices, contract disclosures, audit records, correspondence and earlier notices. Whether the department already knew particular facts, or whether there was suppression, depends on the record; a bare assertion either way is not enough.

Reconcile the amount period by period

Do not answer a calculation dispute only with a general objection to the tax category. Build a working reconciliation from the notice figures to the underlying records, keeping a source document for each adjustment.

For each tax period, record What to compare
Demanded category and gross amount The category and figures stated in the notice, with the notice calculation or annexure.
Contract consideration The agreement and amendments, invoices, receipts and payment ledger for that period.
Goods component, if relevant Contract and invoice records supporting amounts attributed to goods in an asserted composite works contract.
Tax already paid and credits claimed Returns, challans, ledgers and supporting records; list credits separately from tax payments.
Resulting difference Show the arithmetic from the department’s figure to the amount you say remains, with a document beside each change.

For a works-contract argument, check whether the valuation method available for that contract and period was used. The Supreme Court’s works-contract judgment discusses the statutory valuation framework and amendments; the appropriate treatment depends on the governing version and facts.

If the notice separately alleges an irregular CENVAT credit, answer that allegation on its own legal and factual basis, with its own records and calculation. A dispute over construction classification does not by itself dispose of a credit allegation. The Jyoti Limited order illustrates that both issues can appear in a construction-sector service-tax dispute; it concerns a company, not every homeowner’s demand.

Prepare a focused reply or appeal file

For a show-cause notice

Respond within the stated deadline. Organize the reply around the notice’s individual allegations rather than relying on a broad denial. For each point, state the relevant fact, identify the supporting document or legal proposition, and explain the effect on classification, limitation or amount. If a relied-upon document is missing, identify it and request access as needed. Attach a chronology and period-wise reconciliation.

For a final order

Read the order against the notice, your submissions and hearing record. Identify which findings were made and what issues remain disputed, then verify the appeal route and applicable requirements against the law governing that order. Do not assume that a reply deadline, appeal deadline or forum is the same for every authority or period.

Gather the records

  • Notice, annexures, relied-upon documents and proof of service
  • Adjudication order, hearing notices and hearing record, if any
  • Contracts, amendments, scope-of-work documents and project records
  • Invoices, receipts, payment ledgers and records concerning goods
  • Service-tax returns, challans, ledgers and CENVAT-credit records, where relevant
  • Project approvals, completion records and prior department or audit correspondence
  • A chronology and period-wise computation tied to the source documents

Preserve originals and mark missing material. Keep factual evidence, legal submissions and arithmetic distinct so each can be checked on its own.

Keep the historical regime separate from GST

This guide concerns demands under the legacy service-tax regime. Later GST rules do not determine the treatment of an earlier service-tax period. Use the statutory provisions and amendments applicable to the dates in the demand; CBIC’s GST material addresses a later regime and should not be substituted for the historical service-tax analysis.
