If a traffic stop, citation, arrest, or prosecution relies on an automatic license plate reader (ALPR) alert, act quickly: ask a lawyer to preserve the camera’s native image, the machine-read characters, the database entry, confirmation and dispatch records, and all related video and audit logs. An ALPR hit is a lead produced by matching a plate reading to a database record; it is not, by itself, proof that the plate was read correctly, that the vehicle was the one listed, that the database entry was current, or that you were driving or committed an offense. The strongest challenge follows the evidence from the camera through the software, database, human verification, stop, and later evidence, using the law of the state and court handling your case.
What an ALPR hit proves—and what it does not
An ALPR camera photographs a passing vehicle, software converts the visible plate into text, and that text is compared with a database or “hot list.” A matching record can generate an alert for an officer or dispatcher. Each stage creates a separate factual question:
As an Amazon Associate I earn from qualifying purchases.
- Capture: Did the camera obtain a clear, complete image, and are the date, time, location, and clock settings reliable?
- Machine read: What characters did the software produce, and could glare, angle, blur, obstruction, a partial plate, or similar characters have changed the read?
- Database match: Which database was queried, when was it queried, and what source and update time did the underlying entry show?
- Human confirmation: Did an officer or dispatcher compare the physical plate, vehicle description, and current wanted status before the stop?
- Identity and conduct: Even if the plate and vehicle matched, what evidence connects the driver to the vehicle and to the charged conduct?
A false alert can arise from a misread character, a different vehicle carrying a similar plate, an incorrect or stale database entry, or a failure to complete required confirmation. The Ninth Circuit’s discussion in Green v. City & County of San Francisco (May 12, 2014) describes occasional false hits and verification practices in that department’s record. It does not establish a nationwide error rate or a universal rule that an alert is insufficient for a stop.
Keep the vehicle’s plate association separate from the driver’s identity. A plate reader may place a particular plate at a location; it does not automatically identify who was behind the wheel or prove what that person did.

What to do immediately after the stop or charge
Get jurisdiction-specific legal help
Contact a criminal-defense or traffic lawyer licensed where the stop and prosecution occurred. Deadlines, preservation procedures, discovery rules, and binding precedent differ by state and court. Give counsel the citation, charging document, tow or impound paperwork, bond conditions, and every document that mentions the alert. Do not try to obtain restricted law-enforcement data by contacting an officer directly about the merits of your case.
Send a focused preservation request
Through counsel, identify the agency, any regional dispatch center, and the system operator or vendor named in reports. State the plate number as displayed, the vehicle description, camera or roadway location, date and a reasonable time range, incident and report numbers, and the court case number. Request preservation of both inculpatory and exculpatory material. A request should cover the native image and metadata, machine-read output, alert, database record and update history, dispatch audio and computer-aided-dispatch history, officer reports, body-camera and dash-camera video, query and audit logs, and relevant system policies and configuration.
Preservation is not the same as automatic disclosure. Counsel may need a subpoena, warrant, court order, sworn statement, or a showing of relevance and materiality. Ask which procedure applies before a statutory retention period expires.
Make a contemporaneous factual record
- Write down where and when you were stopped, the officers present, what each officer said about the alert, and whether anyone compared the plate to the vehicle.
- Photograph the plate, mounting, surrounding frame, tint, covers, damage, and any temporary or specialty-plate markings, without altering the vehicle.
- Preserve registration, title, repair records, travel records, receipts, work schedules, and witness information that establish who had the vehicle and where it was.
- Do not delete messages, location history, dash-camera files, or cloud backups that could establish timing or identity.
Build the ALPR evidence chain
Compare the original image with the physical plate
Ask for the highest-quality native image, not only a screen capture or printed report. Compare every character and the plate’s state, color scheme, type, stickers, and proportions. Inspect for:
- glare, shadows, rain, dirt, motion blur, an oblique camera angle, or partial visibility;
- characters that can be confused, such as 0/O, 1/I, 5/S, 8/B, or 2/Z, depending on the jurisdiction’s plate design;
- an incorrect state, province, plate class, temporary tag, or specialty design;
- a vehicle make, model, color, body style, damage, or distinctive feature inconsistent with the database record; and
- an image that shows a different car, a plate copied or altered, or no readable plate at all.
These observations are investigative leads, not proof of a false read until the image and testimony support them. Preserve the original file because export, compression, and cropping can remove metadata or obscure the disputed character.

Trace the alert and database entry
Determine the exact time the camera captured the image, the time software produced the read, the time the database was queried, and the time the alert reached the officer or dispatcher. Obtain the record that generated the hit, its source agency, entry and update timestamps, and any cancellation, correction, or “cleared” history. A valid plate can still produce an improper stop if the underlying record was stale, entered for the wrong vehicle, or no longer active when the alert was acted on.
Identify independent confirmation
Compare the officer’s report, dispatch recording, computer-aided-dispatch events, body-camera video, and in-car video. Look for a statement that the officer visually read the plate, checked the plate state and vehicle description, and confirmed the wanted or stolen status through the originating agency before initiating the stop. Note whether confirmation occurred before the stop, during the stop, or only afterward. In Green, the Ninth Circuit record discussed instructions to verify the physical plate and wanted status; use that case to frame the factual inquiry, not as a universal checklist imposed on every agency.
Can police stop a car based only on an ALPR hit?
There is no nationwide yes-or-no answer. Reasonable-suspicion law, the quality of the alert, the officer’s knowledge, confirmation practices, and controlling appellate decisions all matter. A defense should identify exactly what the officer knew at the moment the stop began, rather than arguing from the existence of ALPR technology in the abstract.
United States v. Porter, a Fifth Circuit opinion dated March 17, 2026, reports that the district court upheld a stop based solely on an ALPR hit under the facts presented. That decision illustrates why an alert is not automatically invalid and why the jurisdiction, database status, confirmation evidence, and timing must be examined. Check subsequent history and whether the opinion is binding in the court hearing your case before relying on it.
Possible factual arguments
- The image does not show the characters reported in the alert.
- The alerted plate belongs to a different state, plate type, or vehicle description.
- The database entry was stale, entered in error, canceled, or not active at the relevant time.
- The officer stopped the vehicle without visually confirming the plate or current status when policy or training required confirmation.
- The officer learned the incriminating information only after the stop, so later discoveries cannot retroactively supply the original justification.
Do not claim that an ALPR alert can never establish reasonable suspicion. Frame the motion around the actual image, record, officer knowledge, and governing precedent.

Choose the right legal challenge
| Challenge | Target | When it is raised | Questions to prove | Possible result |
|---|---|---|---|---|
| Suppression motion | The stop, detention, search, or evidence derived from it | Usually before trial under local criminal procedure deadlines | What facts supported reasonable suspicion or probable cause at the instant of the stop? Was the alert accurate and properly confirmed? | Exclusion of evidence or denial of the motion; the result depends on the court’s record and exceptions to exclusion. |
| Evidentiary objection | The image, automated read, database report, or testimony offered at trial | At a hearing or trial, often subject to pretrial disclosure and motion deadlines | Is the exhibit relevant, authenticated, complete, and reliable? Does a witness explain how the image, machine output, transfer, and timestamps were created? | Limitation or exclusion of particular proof, or admission with a dispute left to the fact-finder. |
| Preservation or discovery motion | Access to records or relief for missing records | As soon as loss is suspected, under the applicable statute and court rules | What data existed, who controlled it, when was preservation requested, and why is it material? | Preservation order, disclosure, sanctions, a remedy for discovery violations, or no relief if the legal standard is not met. |
These avenues can overlap but are not interchangeable. A constitutional challenge to collection or querying is different from an argument that one alert was inaccurate. An objection to a report’s authentication is different from a claim that the stop lacked reasonable suspicion.

Tailor requests to the event and the jurisdiction; no agency necessarily possesses every item below, and discoverability varies.
- Image and metadata: native camera file, image sequence, resolution, embedded timestamps, camera identifier, GPS or mapped location, and clock-synchronization records.
- Machine processing: characters read, confidence or status fields if retained, software and firmware version, and any image enhancement or crop used to generate the alert.
- Hit and list records: the alert message, hot-list or database name, originating agency, entry and update times, wanted or stolen status, and cancellation history.
- Human actions: officer notes, dispatch audio, computer-aided-dispatch history, body-camera and dash-camera video, radio traffic, and records of visual or telephone confirmation.
- System governance: policies, training materials, retention schedules, access controls, audit logs, configuration relevant to the event, and records identifying the custodian who can explain them.
- Export history: who generated a PDF, screenshot, or report, when it was exported, and whether the export changed fields, time zones, or image quality.
Ask each proposed witness to explain the complete path from image capture to courtroom exhibit: the device, software, database, transfer, timestamp, and safeguards against alteration. In Eleventh Circuit case 22-11159 (2024), defendants challenged ALPR database evidence on constitutional grounds and argued that expert testimony should be required. The opinion addresses those arguments on its record; it does not create a categorical expert requirement. Whether a technical or records expert is needed depends on the evidence and the rules applied by your court.
Retention deadlines differ by state
ALPR data can be deleted under ordinary schedules unless a law, policy, litigation hold, or preservation request requires retention. The following statutes are examples, not national deadlines. Check the current text, effective date, covered agencies, and event date with local counsel.
| Jurisdiction and authority | Rule described by the cited source | Important qualification |
|---|---|---|
| Virginia, Va. Code § 2.2-5517 | Permitted uses and audit-trail requirements; system data generally purged after 21 days and audit-trail data after two years, with continued retention for data involved in specified ongoing investigations, prosecutions, or civil actions through stated disposition stages. | Confirm the current statute, effective date, and whether the agency and system are covered. |
| Nebraska, Neb. Rev. Stat. § 60-3205 | A defendant may request preservation pending a warrant, subpoena, or court order. A court-disclosure route requires specific and articulable facts showing relevance and materiality. | The procedure is Nebraska-specific and may not reach unrelated records. |
| North Carolina, G.S. 20-183.32 | Covered data generally may be retained for 90 days, subject to listed exceptions that include preservation requests and warrants; the statute specifies content for agency preservation requests and a disclosure process. | Verify the current text and who may request preservation or disclosure in your circumstances. |
| Washington, RCW 10.130.040 and .080 | The cited 2026 statutory text describes a 21-day general retention limit with exceptions and requires audit records documenting access and searches, including user, time, query data, purpose, and case number. | Confirm the enactment’s effective date and whether it governs the date of your event. |
A short deadline is a reason to act, not proof that records are already gone. Have counsel identify every custodian and send a request that describes the specific camera, plate, time range, and case. If data is missing, obtain the retention policy, deletion logs, audit trail, and declarations explaining when and why it was deleted.

What if police deleted or failed to preserve the data?
Missing ALPR material can support a preservation or discovery argument, but deletion does not automatically dismiss a case or suppress all evidence. The court may consider whether the material was potentially useful or materially exculpatory, whether officials acted in bad faith or violated a rule, whether the defense requested preservation in time, and whether other evidence can replace it.
State v. Simonson, a Washington Court of Appeals opinion dated January 29, 2026 and marked unpublished in the source, illustrates a dispute over missing ALPR data, preservation, and discovery. It describes a trial-court finding that the data was potentially useful and not preserved, along with appellate arguments concerning suppression and misconduct. Check subsequent history and Washington’s citation limits; do not treat the case as a general remedy.
Practical response to a missing-record notice
- Ask for the written retention schedule, system configuration, deletion or purge logs, and the identity of the custodian who authorized or observed deletion.
- Show when the agency knew of the incident and when counsel requested preservation.
- Describe specifically how the missing image, read, timestamp, or audit entry could test the stop or an element of the charge.
- Request an order preserving remaining backups, exports, related cameras, dispatch records, and audit trails.
- Ask the court for the remedy authorized by the applicable discovery and constitutional standards, rather than assuming dismissal or automatic exclusion.
Authentication and reliability at trial
The prosecution may need to establish who operated or maintained the camera, how the image and machine read were produced, how the database was populated, and how the offered report or exhibit was exported and kept. Counsel can ask:
- Who can identify the camera, location, clock source, and native file?
- Does the witness know whether the displayed characters came from software, a human edit, or both?
- What record proves the database entry existed and was current at the time of the alert?
- Are timestamps in local time or UTC, and were clocks synchronized?
- Does the exhibit include the complete image and surrounding context, or only a cropped screenshot?
- Are there gaps, edits, duplicate exports, or unexplained changes in the audit history?
Potential objections can involve relevance, hearsay, authentication, completeness, reliability, and unfair prejudice, subject to the rules in the court hearing the case. A challenge to an exhibit’s foundation does not necessarily decide whether the stop was lawful, and a suppression ruling does not automatically resolve every trial-evidence objection.
How to organize the defense investigation
- Map the timeline. Put capture, software read, database query, dispatch notification, confirmation, stop, search, arrest, and evidence collection on one line with sources for each time.
- Mark disputed links. Highlight any mismatch between the image and read, read and database, database and vehicle, or vehicle and driver.
- Match each link to a witness or record. Identify the camera custodian, records custodian, dispatcher, officer, database agency, and any technical witness.
- File the correct request or motion. Use the state’s preservation procedure, criminal discovery rule, subpoena process, or suppression deadline; do not rely on an informal email alone where a sworn filing is required.
- Present an alternative theory. If the court admits the alert, argue why a machine-generated lead still leaves identity, timing, reliability, or intent unresolved.
Keep technical questions and legal questions distinct. A blurry image may undermine the machine read; a stale hot-list record may undermine the officer’s information; a clear, verified image may still fail to identify the driver. Each proposition should be tied to the record and the rule that governs it.
Best Value
Common mistakes that weaken an ALPR challenge
- Waiting for ordinary discovery. Short retention periods can expire before a case reaches a hearing.
- Requesting only the police report. The report may omit the native image, query history, dispatch audio, or deletion logs.
- Arguing a universal “error rate.” The cited authorities establish no named numerical failure rate; use the actual image and event records.
- Assuming an alert is automatically inadmissible. Courts may admit an alert or uphold a stop on particular facts.
- Confusing the vehicle with the driver. Plate location evidence does not alone establish who drove.
- Ignoring later history. Check whether an opinion is binding, unpublished, amended, or affected by later appellate decisions.
- Altering or “cleaning up” the plate image. Enhancements can be useful for investigation, but preserve the untouched native file and document every alteration.
What a lawyer should know before filing
Bring counsel a copy of every notice and a factual chronology. Explain who normally used the vehicle, whether the plate or vehicle was recently replaced, any temporary or specialty plate, and whether you received notice of a stolen-vehicle or registration entry. Identify witnesses who can testify about possession and location. Tell counsel about any prior request for records and the date it was sent. The lawyer can then determine whether to seek a preservation order, subpoena, discovery ruling, suppression hearing, evidentiary hearing, or expert assistance under local law.
The result turns on the governing jurisdiction and the particular record. A court may find a stop lawful even when the defense identifies limitations in ALPR technology, or may restrict an exhibit without suppressing all later evidence. The useful objective is not to label the technology reliable or unreliable in general; it is to show precisely which link in this alert’s chain is unsupported, inaccurate, unauthenticated, or legally insufficient.
Frequently Asked Questions
Can I personally obtain the original ALPR photograph?
Sometimes, but access depends on state public-records, criminal-discovery, privacy, and law-enforcement rules. A lawyer can use the applicable subpoena, preservation, or court-disclosure procedure and request the native image, metadata, alert, database record, and audit history together.
Free tools Windows power users keep installed
One-click scans. No signup required.
Does a wrong plate character automatically invalidate the stop?
Not automatically. The court will apply the jurisdiction’s reasonable-suspicion law to what the officer knew before the stop, including any visual confirmation, vehicle-description match, and database status.
Is an expert witness always required to challenge ALPR evidence?
No categorical requirement is established by the authorities discussed. Whether expert testimony is needed depends on the offered image or report, the technical issue, and the evidence rules in the particular court.
What should I do if the agency says the records were purged?
Ask counsel to obtain the retention policy, deletion logs, audit records, and custodian explanation, then seek the preservation or discovery remedy authorized by the governing law. The consequence depends on materiality, the reason for loss, preservation requests, and the case record.
