Do not usually approach the GST Appellate Tribunal (GSTAT) with the original detention order. The normal route is to file a first appeal in FORM GST APL-01 before the Appellate Authority. Only after an order under section 107 or section 108 is communicated can you generally consider an appeal to the GSTAT under section 112 of the Central GST Act, 2017. A detention order under section 129(3) also has a special tribunal-stage pre-deposit: 25% of the penalty, not the ordinary disputed-tax percentage.
This is a procedural guide for the central CGST framework, with corresponding SGST and UTGST provisions. State notifications, the applicable bench, portal availability and the wording of the order can change the filing steps. Check the live notification and obtain case-specific advice before allowing a limitation period to expire.

The appeal route in one view
The GST Portal treats several enforcement decisions as first-appeal matters, including orders demanding tax and penalty, confiscation and demand proceedings, and specified rectification or remand orders. The first appeal is filed through the GST Portal. A later GSTAT appeal is ordinarily available only against the resulting Appellate Authority order under section 107 or a revisional order under section 108. The official first-appeal instructions are in the GST Portal FAQ for FORM GST APL-01, while the current statutory tribunal rules appear in section 112 of the CGST Act.
Recommended Free Tools
- Identify the signed operative order and its statutory section.
- Record the date and manner in which that order was communicated.
- Preserve the notice, reply, transport records, tax and penalty calculations, payment evidence and portal acknowledgments.
- File APL-01 within the first-appeal period and pay the applicable first-appeal deposit.
- After the section 107 or 108 order, calculate the section 112 deadline and tribunal-stage deposit for the particular type of dispute.
- File the GSTAT appeal using the live instructions for the relevant bench and state implementation.
A portal summary is not a substitute for the operative order. The section cited in that order controls the forum, limitation calculation, deposit and relief you should request.

Identify the order before choosing the forum
| What you have | Usual immediate forum | What to verify | Why the distinction matters |
|---|---|---|---|
| Detention, tax and penalty order under section 129(3) | Appellate Authority through APL-01 | The section 129(3) order, the detention or seizure record, payment history and the communication date | A later GSTAT appeal has a special 25% penalty pre-deposit rule |
| Confiscation proceedings under section 130 or an order demanding tax and penalty | First appeal where the order is appealable through the portal | The operative confiscation or demand order and the statutory provision used | The amount in dispute and the relief sought may differ from a release or detention dispute |
| Penalty-only order under another GST provision | Usually the first Appellate Authority | The penalty section, whether tax is also disputed, and the applicable appealability rule | Do not automatically apply a disputed-tax formula to a penalty-only case |
| Order under section 107 or section 108 | GSTAT under section 112, subject to the applicable filing date and conditions | The communication date, any government-notified filing date, bench or portal status and deposit calculation | This is the order from which the tribunal limitation normally runs |
The first-appeal FAQ also covers enforcement orders described as demand of tax and penalty and section 129 appeals. If the portal does not show the order, use the document procedure described below rather than treating the missing upload as permission to delay.
Deadlines and pre-deposits
| Stage | Time limit | Deposit or payment rule | Source and qualification |
|---|---|---|---|
| First appeal to the Appellate Authority | Three months from communication of the adjudicating authority’s decision or order. The authority may condone up to one further month when sufficient cause is shown. | Pay the amount required under the first-appeal provisions before submission. The exact calculation depends on the order and the amounts already paid. | GST Portal APL-01 FAQ |
| Ordinary GSTAT appeal | Section 112 provides three months from communication of the section 107 or 108 order, or the government-notified date, whichever is later. The Tribunal may admit an appeal within a further three months after expiry when sufficient cause is shown. | Pay admitted dues and 10% of the remaining disputed tax, in addition to the amount paid under section 107(6), subject to the statutory cap. | Current section 112 text; verify the notification applicable to the particular appeal. |
| GSTAT appeal against a section 129(3) order | Use the section 112 period and any applicable notified filing date after the first-appeal order. | The section 112 proviso requires payment of 25% of the penalty before an appeal against a section 129(3) order can be filed. Confirm what was already paid and what the portal credits. | Section 112 and the GST Portal enforcement-appeal FAQ |
The three-month periods are not interchangeable. For a first appeal, count from communication of the adjudicating order. For a GSTAT appeal, section 112 refers to communication of the section 107 or 108 order, but also refers to a government-notified date, whichever is later. The sources do not establish one universal GSTAT start date or a single current e-filing workflow for every state and order. Check the notification and live filing instructions before calculating the last day.
How to calculate the ordinary tribunal deposit
For an ordinary tax dispute, section 112(8) requires admitted dues and 10% of the remaining disputed tax, in addition to the amount paid under section 107(6), within the statutory cap. Section 112(9) provides for a stay of recovery of the balance when the statutory payment is made. Separate the figures in a worksheet: admitted tax, disputed tax, tax already deposited at first appeal, the additional 10% amount, interest, and penalty. Do not describe the 10% figure as a universal deposit for a penalty-only appeal.
How the section 129(3) calculation differs
The current section 112 text prevents an appeal against a section 129(3) order unless 25% of the penalty is paid. The GST Portal’s enforcement FAQ identifies the same 25% requirement, and its functionality compilation explains that the portal will not request the 25% again where the penalty has already been paid. The system’s treatment of an earlier payment must still be checked against the challan, electronic liability ledger and order. Keep proof of every payment and do not pay twice merely because a screen appears inconsistent; resolve the discrepancy through the prescribed portal or jurisdictional channel.
Step 1: preserve the order and the communication date
Limitation is commonly lost because a taxpayer keeps only a notice or a portal snapshot. Create a dated case file containing:

- Portal screenshots or downloaded acknowledgments showing the communication date, application status and any error message.
- Later APL-01, APL-02, appellate orders and communication records.
Use the date on which the order was communicated under the applicable rules, not the date on which someone first noticed it. If several communications exist, preserve each one and ask your adviser to identify the legally operative communication.
Step 2: file the first appeal in FORM GST APL-01
Start the application
- Sign in to the GST Portal.
- Open Services > User Services > My Applications.
- Choose the application type for Appeal to Appellate Authority and select New Application.
- Select the order shown in the list and confirm the statutory details. If the order is not shown, use the portal’s prescribed manual or document option and retain evidence of the attempt.
- Enter the disputed amounts, grounds and relief requested. Match each amount to the order and payment ledger.
- Upload the required documents, complete verification and submit.
When the order is not uploaded
The GST Portal FAQ says that when the order is unavailable in the first-appeal application, the appellant must supply a self-certified copy within seven days. A later submission of that copy shifts the filing date to the date of that submission. Do not assume that starting an online draft preserves limitation. The appeal is treated as filed when the final APL-02 acknowledgment and appeal number are issued.

Check the acknowledgment, not just the draft
Download APL-02 and record its number, date and status. Keep the submitted form and payment receipt together. If the portal shows an error, save the error screen, note the time, and use the official grievance or jurisdictional contact route while continuing to protect the statutory deadline. Once the appeal is admitted, the portal guidance states that the balance disputed amount is flagged as non-recoverable; that status does not remove the need to pay the prescribed deposit or comply with later directions.
Step 3: move from the first appeal to the GSTAT
A GSTAT appeal is not a shortcut around the first appeal. Wait for the section 107 appellate order or a section 108 revisional order unless a different statutory route applies to the order before you. Read the entire appellate or revisional order: it may confirm, reduce, enhance, remand or alter the original demand. The tribunal memorandum should challenge the order that is legally appealable at that stage and identify the corresponding relief.
Confirm that the tribunal filing window is open for your case
Section 112 contains the three-month period and a further three-month condonation power, but the section also refers to a date notified by the Government. The official material does not establish one filing-start date, a complete current e-filing checklist or a uniform portal workflow for every state and bench. Before signing the appeal, check the notification applicable to the order, the GSTAT bench with territorial jurisdiction, the current e-filing or physical-filing directions, permitted formats, verification requirements and whether the relevant registry is accepting filings.

Prepare the deposit evidence
Prepare a reconciliation that identifies the amount already paid under section 107(6), admitted dues, remaining disputed tax or penalty, the additional section 112 amount, and the date and reference of each payment. For a section 129(3) appeal, separately show the 25% penalty payment and whether it was already collected at the enforcement stage. Attach the challan and ledger proof requested by the current registry. A mismatch between the order, payment ledger and appeal form can lead to a deficiency notice or rejection at the filing counter.
Assemble the tribunal paper book
Organize the record chronologically and add an index. Include the impugned section 107 or 108 order, original order, notice, reply, evidence, hearing requests, payment records, APL-01 and APL-02, and proof of communication. Label each document so the grounds can point to a page rather than making a general allegation. Keep the complete unredacted record, even if the filing rules require a smaller set of annexures.
Develop grounds that connect the facts to the statute
The official sources establish the route and deposits, not the merits of any individual detention. A strong appeal explains what the notice alleged, what you answered, what the officer decided and why the decision is legally or factually wrong. No single procedural defect automatically invalidates every order; the effect depends on the statute, facts and applicable case law.
Compare the notice, reply and operative order
Make a three-column comparison: allegation in the notice, answer and evidence supplied, and finding in the order. Flag a new allegation, a different tax period, a changed vehicle or invoice number, or a calculation that was never put to you. State the prejudice caused and identify the provision requiring notice, hearing or reasoned adjudication.
Test the transport and tax records
For a detention case, reconcile the invoice, e-way bill, vehicle number, consignor, consignee, route, transporter records, quantity and tax treatment. Explain whether an alleged discrepancy is clerical, expired, inaccurate or unsupported by the documents. Attach the original electronic records and certified copies where required. Do not claim that a minor discrepancy is harmless or fatal without the legal authority applicable to the facts.

Check jurisdiction, authority and procedure
Identify the officer who issued the notice and order, the relevant registration and place of supply, and the provision said to confer jurisdiction. Check service of notice, opportunity of hearing, consideration of the reply, reasons for rejecting evidence and the statutory basis for tax, interest, penalty, release or confiscation. A ground should say what the officer did, which requirement applies and what remedy you seek.
Audit the arithmetic
Recalculate taxable value, tax, interest, penalty, amounts already paid and the deposit required for the next stage. Keep separate totals for admitted and disputed amounts. If the order uses a payment already made, identify the challan and ledger entry. Arithmetic errors are easier for the Appellate Authority or Tribunal to verify when each figure is tied to a document.
State precise relief
Ask for relief that matches the findings you challenge: complete setting aside, reduction, deletion of a penalty, correction of a calculation, remand with directions, release-related consequential relief or any other remedy available under the governing provision. Avoid asking for an order that the forum has no power to grant.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Section 129(3): the detention appeal that needs special care
Section 129 concerns detention, seizure and release of goods and conveyances in transit. The section 129(3) order is the point at which the proper officer determines the tax and penalty payable for release. The GST Council’s material on detention, seizure and release discusses the notice and order timing under this provision; consult the 55th GST Council material alongside the current statute and the actual order.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Clear out junk files and repair common Windows errors3Fix the driver behind crashes, sound loss and screen glitchesAt the first-appeal stage, use the APL-01 route and the period stated by the GST Portal. At the tribunal stage, the 25% penalty proviso in section 112 applies. That is different from an ordinary appeal where the calculation is based on admitted dues and a percentage of remaining disputed tax. If the penalty was paid to obtain release, establish whether that payment is the 25% required for the later appeal or whether another amount remains due under the order and current portal calculation.
Best Value
Do not treat payment for release as an admission that the order is correct. Record the commercial reason for payment, the date, the amount, the ledger entry and any reservation or correspondence. The legal effect of payment and the relief available are matters for the forum applying the relevant provisions and case law.
Portal-uploaded order versus unavailable order
| Situation | Action | Filing evidence to retain |
|---|---|---|
| Order appears in My Applications | Select the order, complete APL-01, pay the required amount and submit. | Submitted form, payment receipt, APL-02 and appeal number |
| Order is not uploaded | Start the appeal using the available manual or document route and provide a self-certified copy within seven days, as directed by the FAQ. | Upload attempt, self-certified copy, submission receipt and the date the copy was accepted |
| Portal shows an incorrect amount or prior payment is missing | Reconcile the order with the electronic liability ledger and challans; use the official grievance or jurisdictional channel and preserve the error record. | Screenshots, ticket number, challan, bank proof and ledger extract |
| APL-01 draft exists but no APL-02 | Do not assume the appeal has been filed. Complete final submission and verify the acknowledgment and appeal number. | Final APL-02, timestamp and status |
Common failure modes and practical fixes
- Filing directly in the GSTAT: Confirm whether the challenged document is still the original adjudication order. File the first appeal when section 107 is the prescribed route.
- Counting from the wrong date: Preserve proof of communication and, for section 112, check whether a later notified date governs.
- Using the ordinary 10% formula for section 129(3): Apply the 25% penalty proviso and reconcile any penalty already paid.
- Stopping at a saved draft: Obtain APL-02 and the appeal number; a draft is not the portal’s final filing acknowledgment.
- Ignoring the seven-day copy requirement: When the order is unavailable, submit the self-certified copy within seven days and retain proof. A later copy can shift the filing date.
- Submitting a generic merits statement: Tie each ground to the notice, evidence, statutory provision and requested relief.
- Leaving payment evidence unconnected: Match every deposit to a challan, ledger entry and order figure, especially where release payment has already occurred.
- Assuming one state workflow applies everywhere: Verify the applicable SGST or UTGST notification, bench instructions and live registry requirements.
Case-file checklist before submission
- Operative detention, penalty, confiscation, appellate or revisional order.
- Notice, seizure or detention memo and proof of communication.
- Reply, written submissions, hearing record and proof of service.
- Invoice, e-way bill, transport and vehicle records relevant to the allegation.
- Tax, interest and penalty computation showing admitted and disputed amounts separately.
- Challans, electronic liability ledger, bank evidence and proof of any release payment.
- APL-01, APL-02, appeal number and all portal status messages.
- For a proposed GSTAT appeal, the section 107 or 108 order and the notification or registry instruction governing the filing date.
- A calculation of the applicable first-appeal or tribunal deposit, with the statutory provision used.
- An indexed chronology and grounds that identify the exact finding being challenged.
State, UT and live-status checks
The central CGST procedure has corresponding SGST and UTGST provisions, but state-level notifications and registry operations can affect implementation. Before filing, verify the taxpayer’s registration state or Union Territory, the authority that issued the order, the competent Appellate Authority or GSTAT bench, the current filing mode, and any state-specific form or document instruction. The section 112 text and official portal FAQ should be read with the notification applicable to the particular order, not as a guarantee that every registry has the same technical workflow.
Keep a dated copy of the notification and portal instructions relied on for the deadline and deposit. If the live system conflicts with the order or the statutory calculation, escalate promptly through the official channel while preserving limitation evidence; an unresolved portal problem is not itself an extension of time.

What filing changes after admission
At the first-appeal stage, the GST Portal states that the balance disputed amount is flagged as non-recoverable once the appeal is admitted. At the tribunal stage, section 112(9) provides for a stay of recovery of the balance when the statutory payment has been made. These protections depend on valid filing, payment and admission under the applicable provision. They do not eliminate obligations for admitted dues, deposits, undertakings, later directions or amounts outside the dispute.
When to obtain case-specific help
Consider a qualified Indian GST advocate or tax professional when goods remain detained, a confiscation order is involved, the amount is substantial, several registrations or states are affected, limitation is disputed, the portal will not recognize a payment, or the order raises a novel classification or jurisdiction issue. Give that adviser the complete indexed record rather than only a portal summary. The procedural rules above identify the route and key dates; they do not determine the merits of an individual case.
Final submission check
Before submitting, confirm that the order you are challenging is the correct one, the communication date is documented, the forum is correct, the deposit matches the statutory section, and the final acknowledgment has been issued. For a section 129(3) matter, separately verify the 25% penalty requirement and any amount already paid. For every GSTAT appeal, check the current section 112 notification and registry instructions on the day of filing.
