Capture the page in its full browser context, record the collection time in UTC, preserve the untouched native files and page data, and keep a contemporaneous evidence log. A screenshot can show what was visible, but it does not by itself prove who published the material, that the file was not altered, or that your jurisdiction will admit it. Treat the image as one part of a documented preservation process and confirm filing and authentication requirements with a lawyer.
What a timestamped screenshot can—and cannot—prove
A properly preserved capture can document the appearance of a webpage at a particular observation time: the URL, headline, image or likeness, surrounding wording, byline or account, visible publication date, comments, and engagement. It is useful evidence of what a visitor could see when you collected it.

It is not automatically proof of the page’s original publication time, the identity of the person who controlled it, the truth of any claim on the page, or the legal elements of a personality or right-of-publicity claim. Courts apply local rules on relevance, authenticity, hearsay, privilege, and electronic records. The cited authorities do not establish a universal acceptance rate for screenshots in personality-rights cases, and no universal rule requires a particular screenshot app, camera, printer, storage device, or timestamp vendor.

- United States filing context: 37 C.F.R. § 222.2 permits a copy of allegedly infringing material to be accompanied by “a hyperlink or screenshot that shows any allegedly infringing activity.” That regulation does not decide whether a screenshot satisfies every authentication or evidentiary requirement in a separate personality-rights case.
- United Kingdom preservation context: Justice UK Practice Direction 31B treats electronic documents broadly, includes metadata, and says that once litigation is contemplated legal representatives must notify clients of the need to preserve disclosable documents. It also describes metadata as “data about data.”
- Legal advice: GOV.UK guidance recommends early legal advice for court action and notes that evidence of reputational harm may be needed in a moral-rights dispute. A publicity-rights lawyer can tell you what foundation, witness statement, affidavit, disclosure format, or court-specific certificate is required.
Prepare before opening the page
Identify the target precisely
Start an exhibit or collection ID before you capture anything. Record the complete URL, domain, page title, account or publisher name, and the date and time you first observed the material. If a URL contains tracking or session parameters, preserve the exact address you used and also note a clean canonical address separately; do not overwrite the original.

Use a reliable clock and UTC
Write the collection time in UTC, not only your local time. Record the local time and time-zone offset as well. Note the device, operating system, browser and version, and the person operating it. A visible clock or an independent time source can corroborate the device clock, but a timestamp printed on an image is not proof that the image is authentic.
Choose a repeatable environment
Use a stable browser profile and record whether you were signed in, using a private window, or viewing a public page. Do not change the page, dismiss content, or interact beyond what is necessary to reveal the alleged use without recording that action. If a consent dialog, login gate, or other overlay affects what is visible, document it rather than silently hiding it.
DIY capture workflow
- Open the exact URL and verify identity. Check the address bar, domain, page title, account or publisher name, and any visible publication or update date. Capture the full browser frame with the address bar and relevant context before scrolling.
- Save the page where technically possible. Keep the downloaded HTML, a print-to-PDF copy, and any available network archive or source files. Record the download time and the method used. A saved page may not reproduce scripts or remote images later, so keep the visual capture as well.
- Take a full-page capture. Capture the complete page, including headers, navigation, footer, and material surrounding the alleged infringement. If the browser cannot make a reliable long capture, take sequential screenshots with overlap and number them in order.
- Take focused captures. Make separate, readable images of the alleged use; the surrounding text; the byline, account name, or publisher identity; the URL; visible publication or update dates; and comments or engagement that matter. Do not crop the only copy. Create crops later from a preserved original.
- Record dynamic behavior. If content appears after scrolling, clicking, or waiting, note the action and the time. Capture the state before and after a material interaction. If the page changes while you are working, preserve each distinct state with a new collection ID.
- Preserve a disappearing page immediately. Save the native screenshots, HTML, PDF, and available network data before refreshing. Note an error page, takedown notice, redirect, or disappearance as an observation rather than trying to recreate the missing content.
- Capture independent corroboration. Save platform notices, demand-letter correspondence, page-source or download timestamps, and an independent capture by another person when available. Record when you learned that the page later changed or disappeared.
Build an evidence log while you collect
Do not reconstruct the history from memory. Use one row per file or event and append entries as you work.

A hash is an integrity check: it can show that a later file matches the bytes you hashed. It does not prove who created the file, when the webpage was published, or that the original capture process was truthful. Record the hash without replacing the native file with a hashed derivative.
Preserve originals and establish a master copy
Keep native files untouched
Retain the original screenshot format produced by the browser or capture tool, plus the downloaded HTML, PDF, network archive, and source files you collected. Do not crop, annotate, recompress, rename over, or overwrite those files. Make working copies for highlights, redactions, resizing, or exhibit layout.

Protect a definitive copy
The UK Defence Science and Technology Laboratory’s Digital Imaging and Multimedia Procedure v3.0, published 16 November 2021, describes handling evidential images and associated metadata. Its core approach is to maintain a definitive, documented copy protected from alteration. Apply that principle by placing the originals in controlled, access-logged storage, limiting write access, and backing them up without changing the source files.
Maintain a chain of custody
For each transfer, append who handled the item, when, why, and what was done. If you export a PDF or create a marked image, give it a new filename and exhibit ID and link it in the log to the native source. Keep the original available for inspection.

Self-capture or professional collection?
Self-capture is often the fastest way to preserve a page that may disappear. Professional web-evidence or digital-forensics collection can add independent documentation and specialized handling. Compare the options on the factors that matter to your court and deadline.

Prepare exhibits only after preservation
- Make a working copy of the preserved native file.
- Create a readable PDF or printout and any marked-up image needed for the pleading.
- Label the derivative with the exhibit ID, complete URL, UTC capture time, and a statement that it is derived from the preserved original.
- Attach or reference the evidence-log entry, hash, and custody history according to your lawyer’s filing plan.
- Keep the untouched native files available for inspection and disclosure.
Do not let a clean exhibit replace the underlying evidence. If a PDF omits metadata, dynamic content, or part of a long page, identify that limitation and retain the source files.

Images or text appear only after scrolling
Scroll through the entire page before the final full capture, wait for lazy content, and take sequential sections if the browser cannot render a reliable full-page image. A capture tool’s full-page mode with lazy-image loading can help, but log the mode used.
The content requires a login or special location
Capture only material you are authorized to access. Record the account or publisher identity and the sign-in state. For an automated capture, supply lawful cookies, headers, Authorization, time-zone, or geolocation settings and preserve those settings with the result.

Assign each state a new item ID, record the exact time and action that produced it, and keep both versions. Do not overwrite an earlier file or describe a later capture as if it were the first observation.
A hash does not match later
Stop modifying the file, preserve the discrepant copy, and compare the filenames, sizes, transfer history, and hash algorithms. The mismatch may reflect recompression or a derivative rather than tampering; document the explanation and retain every version.
The exhibit is too small or cropped
Return to the untouched original and create a new working derivative at a readable scale. Include a context capture showing the address bar and surrounding page, and identify every crop as a derivative.
Practical reliability and cost notes
A single screenshot is fragile when the page is dynamic, personalized, or likely to disappear. A stronger collection combines a full-page image, focused images, HTML or PDF where available, a detailed log, hashes, and independent corroboration. Sequential captures take more storage and operator time but preserve context that a single crop loses.

For repeated or urgent collections, automation improves consistency only when the request parameters and returned status are logged. Caching can reduce repeat work, but a cache hit is not a new observation of the live page; record the cache result and its TTL. Bulk capture is efficient for up to 100 URLs per call, while asynchronous jobs and signed webhooks help with long-running pages. Neither approach removes the need to preserve the original response and collection time.

Should I send a demand letter before capturing the page?
Preserve the page and its surrounding context before taking an action that could cause it to change. Ask counsel about the order of preservation, notice, and any litigation hold that applies to your jurisdiction.
Can I use a screenshot made by someone else?
It may be useful corroboration, but obtain the native file, original URL, collection time, device or tool details, and the collector’s account of how it was made. A forwarded or recompressed image without provenance is harder to authenticate.
What should I do if the page is in another language or uses a localized version?
Preserve the original-language capture and URL, record the locale, time zone, and geolocation presented to the browser, and create any translation as a clearly labeled derivative rather than replacing the original.

Does a visible date on the webpage establish when the infringement occurred?
No. It records what the page displayed when you observed it. Corroborate publication timing with platform records, server information, correspondence, or other independent evidence where available.
Is a PDF better evidence than a PNG or WebP screenshot?
Not automatically. A PDF can be convenient for review, while the native image and associated metadata preserve the original capture. Keep both when possible and identify the PDF as a derivative.
Who can tell me whether my evidence meets the filing rules?
A lawyer familiar with the governing jurisdiction and personality-rights claim can assess authentication, disclosure, affidavit, preservation, and formatting requirements.
