Multiply the penalty demanded by 0.10: a ₹1,00,000 penalty gives a ₹10,000 pre-deposit. The Delhi High Court has described this rule as effective from 1 October 2025. Because the court has also addressed a fact-specific transition dispute, check the dates and applicable law before relying on the formula in a particular case.
Calculate the deposit for a penalty-only order
First confirm that the appealed order demands a penalty and does not involve a demand of tax. If it meets that description and the substituted penalty-only proviso applies, calculate the deposit as:

Pre-deposit = penalty amount demanded × 10%
Use the penalty amount stated in the order as the calculation base—not the amount of disputed tax, the total amount you might owe under other parts of the order, or a generic estimate of your exposure. The 10% is a filing pre-deposit, not payment of the full penalty.

| ₹10,00,000 | ₹10,00,000 × 10% | ₹1,00,000 |
For example, if the operative order specifies a penalty of ₹50,000, one-tenth of that amount is ₹5,000. The same calculation applies to the other examples: ₹1,00,000 multiplied by 10% is ₹10,000, while ₹10,00,000 multiplied by 10% is ₹1,00,000. These examples illustrate the statutory percentage; they do not determine which rule governs a particular order.

The Delhi High Court’s 2026 judgment in Gaurav Jain & Anr v Joint Commissioner (Appeals-II) CGST reproduces the substituted proviso as requiring “a sum equal to ten per cent of the said penalty.” The court describes the proviso as applying from 1 October 2025. This is the basis for the formula above; for a live appeal, confirm the operative statutory text and any later amendment.
Check what the order actually demands
Read the operative part of the order, not only its heading or the amount shown in a portal summary. The relevant distinction is whether the order demands penalty without involving a demand of tax. If the order also confirms tax, do not apply the penalty-only formula to the whole case. The demands may follow different statutory rules, and the appeal calculation needs to account for the tax-related component too.
It can help to write down the amounts the order actually states and label them by type before calculating anything. The central question is not simply whether the word “penalty” appears in the order. It is whether the appealed order is one demanding penalty without involving any demand of tax. If the operative order includes a tax demand as well, the penalty-only description may not fit, even if the penalty is a prominent part of the amount in dispute.

The rule described by the Delhi High Court uses the penalty demanded as its percentage base. If the documents appear inconsistent about the amount or whether tax is also demanded, clarify the classification and figures before filing rather than choosing the smaller or more convenient base.
Penalty-only and tax-involving orders use different calculation bases
The penalty-only proviso changes the percentage base: it is the penalty demanded. The former general section 107(6) rule worked differently. Under that rule, an appellant had to pay admitted tax, interest, fine, fee and penalty in full, along with 10% of the remaining disputed tax, subject to the statutory ceiling. The earlier penalty-specific proviso concerned orders under section 129(3).
| Order type | Relevant calculation approach | What to check |
|---|---|---|
| Penalty demanded, no tax demand | 10% of the penalty, if the substituted penalty-only proviso applies | Penalty amount in the order and whether the transition rules affect the case |
| Order involving a tax demand | The former general rule uses admitted dues and 10% of the remaining disputed tax, subject to the statutory ceiling | Admitted amounts, disputed tax, the applicable statutory version and the ceiling |
| Tax and penalty both appear in the order | Do not treat the entire order as penalty-only or calculate 10% of penalty alone without assessing the tax demand | How the components are framed and which statutory rules apply to each |
The table describes the rule paths, not a substitute for classifying a particular order. A mixed order can require legal interpretation; no single calculation resolves every way tax and penalty may be combined. The Delhi High Court describes the penalty-only percentage as having no ceiling in the substituted proviso, unlike the capped disputed-tax amount under the general rule. Verify the current statutory wording before relying on that distinction.
The percentage base is a practical way to distinguish the two paths. Under the penalty-only proviso, the arithmetic starts with the penalty demanded. Under the former general formula, the relevant percentage was tied to the remaining disputed tax after admitted dues were paid, and that percentage amount was subject to a statutory ceiling. These are not interchangeable calculations: using 10% of tax for a penalty-only order, or 10% of penalty alone for an order that also involves tax, can misstate the required pre-deposit.

The distinction also matters when considering admitted amounts. Under the former general rule, the appellant was required to pay admitted tax, interest, fine, fee and penalty in full, as well as the applicable percentage of disputed tax. That description should not be collapsed into “pay 10% of the order.” The amended penalty-only proviso instead states a percentage of the penalty where the order demands penalty without involving tax. The order’s components and the statutory version applicable to the appeal both matter.
The Delhi High Court characterized the substituted penalty-only proviso as not prescribing a ceiling for the 10% penalty amount. That should be read as the court’s description of the amended text, not as a reason to skip checking the current legislation. In particular, an order involving disputed tax follows a different rule path, including the statutory ceiling described for the earlier general formula. Check the operative wording that applies to the appeal before treating either the percentage or ceiling as settled for a particular case.
Check the dates before applying the 10% rule
The stated effective date is 1 October 2025, but the transition question is not always answered by looking only at the date you plan to file. The Delhi High Court considered Gaurav Jain & Anr v Joint Commissioner (Appeals-II) CGST, in which the show-cause notice was issued on 25 June 2025 and the penalty order followed on 16 December 2025. The court held that the substituted proviso did not govern those petitioners’ appeals because the adjudicatory proceedings had begun before the amendment.
The decision is a High Court ruling on the facts before it, not a nationwide resolution of every case involving an earlier notice and a later order or appeal. It left the constitutional challenge open and did not decide whether the penalties themselves were justified. The case also discusses competing arguments about whether the relevant date is when proceedings began or when the appeal is filed.
Make a three-date record
- Show-cause notice: Record the date the notice was issued. It may matter if the proceeding began before 1 October 2025.
- Penalty order: Record the date of the order and when it was communicated to you. These are separate facts; the appeal period runs from communication.
- Planned appeal filing: Record the filing date you are working toward. It may be relevant to arguments about which statutory version applies, but does not by itself settle the transition issue.
If the notice predates 1 October 2025 while the order or planned appeal is later, do not assume either that the new 10% deposit definitely applies or that it definitely does not. The Delhi High Court’s ruling may be relevant, but its result was tied to the petitioners’ circumstances. A qualified adviser familiar with the applicable jurisdiction can assess the dates, the order and any later binding authority.
The example in Gaurav Jain shows why all three dates should be kept together: the notice was issued on 25 June 2025, before the stated effective date; the penalty order came on 16 December 2025, after it. The court treated the beginning of the adjudicatory proceedings as significant on those facts. That does not establish a universal rule that every pre-1 October notice controls every later appeal, nor does the later order date alone answer the question.
When reviewing the transition issue, distinguish the date the law took effect from the date that a court considers relevant to a pending proceeding. The judgment discussed competing positions about whether commencement of proceedings or the appeal date should determine the applicable version. Since the court left the constitutional challenge open and decided the statutory issue in the petitioners’ factual setting, do not describe the ruling as a final nationwide answer to all transitional cases.

For a case with a pre-amendment notice and a post-amendment order, organize the notice, order, communication and planned filing records and have them reviewed together. The question may affect the amount required to file, so resolving it from a single date can create avoidable filing risk. A qualified Indian GST adviser can assess whether the Delhi High Court decision, later amendments or binding authority in the relevant jurisdiction affects the case.

Meet the appeal deadline and confirm the payment is completed
Section 107 provides an ordinary period of three months from communication of the decision or order to appeal. The Appellate Authority may allow a further period of one month if sufficient cause is shown. The additional month is not automatic: treat the ordinary deadline as the target and do not plan on an extension being granted.
Count from communication, not just the date printed on the order. Keep evidence of when the decision or order was communicated, because that is the event section 107 identifies for the ordinary appeal period. The order date remains relevant to transition analysis, but it is not the same as the communication date used for the stated deadline.
The possible additional month is a limited opportunity for the Appellate Authority to allow a late appeal when sufficient cause is shown. It is not a routine grace period, and the rule described here does not guarantee that a particular explanation will be accepted. Build the filing plan around the ordinary three-month period and seek advice promptly if the deadline may be close or has passed.
Payment of the applicable pre-deposit is a condition for filing. Section 107(7) provides that once the applicable section 107(6) deposit is paid, recovery of the balance is deemed stayed. That statutory stay concerns recovery of the balance; it is not a decision that the penalty is invalid or that the appeal has succeeded.
In practical terms, the pre-deposit and the appeal serve different roles. The deposit is the statutory filing condition described here; the appeal is where the challenge to the order is considered. The deemed stay on recovery of the balance follows once the applicable deposit has been paid. It does not decide the merits, cancel the remainder of the penalty, or prove that the order is legally wrong.
Distinguish ledger balance from the required debit
Do not assume that placing funds in the electronic cash ledger, by itself, completes the pre-deposit. In Ssukrit Forwarding Agency, the Jharkhand High Court considered a case where the authority could see the amount in the ledger but it had not been debited as the pre-deposit. Given those circumstances, the court said the taxpayer should have been notified of the defect and given reasonable time to cure it. That procedural lesson is not permission to leave a required deposit undebited.

- Determine the amount under the rule that applies to the order.
- Complete the required payment as a pre-deposit, rather than leaving the funds only as an unused ledger balance.
- Check the payment record and the appeal filing record for evidence that the amount was debited and treated as the pre-deposit.
- If the amount appears in the ledger but the filing process does not recognize it, promptly check the payment status and address the defect. Do not rely on the circumstances of Ssukrit Forwarding Agency as a guaranteed right to cure every filing defect.
A ledger credit and a completed pre-deposit are not necessarily the same thing. The distinction in Ssukrit Forwarding Agency was that funds were visible in the electronic cash ledger but had not been debited as the required pre-deposit. The High Court’s observation about notice and reasonable time to cure arose in that case’s circumstances. It is safer to verify the debit and the appeal record before filing than to expect an authority or court to provide a later opportunity to correct the payment.
The available information does not establish a current portal menu path or a universal payment workflow, so confirm the live instructions for the relevant filing system rather than relying on an assumed screen sequence.

- Classify the order: Does it demand penalty without involving a tax demand, or does it also involve tax?
- Identify the governing rule: For a penalty-only order, consider the substituted proviso and its stated 1 October 2025 effective date. For a tax-involving order, assess the applicable general rule instead.
- Calculate from the correct base: If the penalty-only proviso applies, multiply the penalty demanded by 10%.
- Check transition dates: Keep the show-cause notice, order, communication and intended filing dates together, especially where the notice predates 1 October 2025.
- Diary the deadline: Calculate three months from communication of the order; treat any further month as a possible extension only if sufficient cause is shown and the authority allows it.
- Confirm payment completion: Verify that the amount has been debited as the pre-deposit, not merely credited to the electronic cash ledger.
- Keep records: Retain the order, notice, communication details, payment evidence and appeal acknowledgement so that the calculation and filing can be checked.
It is useful to keep the calculation and its supporting documents together. The file should make clear which order is being appealed, the penalty amount used as the base, the percentage applied, and why that statutory path was selected. Include the dates relevant to the transition question and the communication date used for the deadline calculation. A payment credit alone may not show that the deposit was debited as required, so retain evidence of the completed payment and the appeal record.
If the case involves both tax and penalty, do not force it into the penalty-only row of the checklist. Identify the tax-related component and assess the applicable general rule, including admitted dues, disputed tax and any statutory ceiling. If dates straddle 1 October 2025, add a transition review before treating the 10% penalty calculation as conclusive.
What the rule does—and does not—establish
The 10% calculation answers the amount of the pre-deposit for an eligible penalty-only order. It does not establish that the underlying penalty is correct, decide whether a particular order is genuinely penalty-only, or resolve every transition dispute. Nor does payment of the pre-deposit amount mean the entire penalty has been paid.
The key authority described here is the Delhi High Court’s 2026 judgment, which quotes and interprets the substituted proviso and addresses one transition fact pattern. It left the constitutional challenge open. The official CBIC act page and FAQ identified in connection with the former rule predate the penalty-only amendment and reflect earlier general pre-deposit language; they should not be treated as confirmation of the amended rule. For a specific appeal, check the operative legislation and current law in the relevant jurisdiction.

The statutory figures in this guide are a rate and filing period, not empirical measures of appeal outcomes: the penalty-only percentage is 10%, and the ordinary first-appeal period is three months from communication, with a possible additional month for sufficient cause. Neither figure answers whether an appeal will succeed or whether an extension will be granted.

No general product or software recommendation follows from these rules. Confirm the provider’s qualifications and the applicable law rather than relying on a generic calculator to classify the order.
Frequently Asked Questions
How do I calculate the GST appeal pre-deposit for a penalty-only order?
If the appealed order demands penalty without involving any demand of tax and the substituted proviso applies, multiply the penalty demanded by 10%. For example, a ₹1,00,000 penalty gives a ₹10,000 pre-deposit. The base is the penalty amount in the order, not disputed tax.
Does the penalty-only 10% rule apply if the order also demands tax?
Do not automatically use the penalty-only formula for a mixed order. The former general section 107(6) rule uses admitted dues and 10% of the remaining disputed tax, subject to the statutory ceiling. Classify the order’s components and check which statutory version governs.
When did the 10% penalty-only pre-deposit rule take effect?
The Delhi High Court’s 2026 judgment describes the substituted proviso as effective from 1 October 2025. Confirm the operative statutory text and any later amendment when assessing a live appeal.
What if my show-cause notice was issued before 1 October 2025 but the penalty order came later?
The Delhi High Court addressed that situation in Gaurav Jain & Anr v Joint Commissioner (Appeals-II) CGST. The notice there was issued on 25 June 2025 and the order on 16 December 2025; the court held the amended proviso did not govern those petitioners’ appeals because proceedings had begun before the amendment. The ruling is fact-specific and does not resolve every transition case. Review the notice, order, communication and filing dates with qualified advice.
How long do I have to file a first appeal under section 107?
The ordinary period is three months from communication of the decision or order. The Appellate Authority may allow a further month if sufficient cause is shown, but that extension is not automatic.
Is money in my electronic cash ledger enough to satisfy the pre-deposit?
Not necessarily. In Ssukrit Forwarding Agency, the Jharkhand High Court considered funds that were visible in the ledger but had not been debited as the pre-deposit. Verify that the payment is completed and treated as the required deposit; the case does not guarantee a right to cure every defect.
Does paying the pre-deposit mean I have paid the full penalty or won the appeal?
No. The pre-deposit is a filing condition, not payment of the full penalty and not a decision on the merits. Under section 107(7), payment of the applicable deposit means recovery of the balance is deemed stayed.
The Bottom Line
For an eligible penalty-only GST order, the first-appeal pre-deposit is 10% of the penalty demanded—not 10% of disputed tax. Before filing, confirm that the order involves no tax demand, check the transition dates around 1 October 2025, meet the three-month deadline from communication, and verify that the payment has been debited as the pre-deposit.
