How to Calculate GST Interest and Penalties on a Disputed Tax Demand

To estimate a disputed Indian GST demand, calculate the tax, interest and penalty separately. The interest depends on the tax due date, the applicable Rule 88B calculation and the amount outstanding; the penalty depends chiefly on whether the notice proceeds under section 73 or section 74 of the CGST Act. The notice, payment records and law applicable to the tax period—not a calculator alone—determine the amount actually payable.

What you need to establish before calculating

Start with the notice or order and identify what the amount labelled “demand” actually includes. It may combine tax, interest and penalty, or show them separately. Do not use the total demand as the interest principal without checking the breakdown.

  • Tax period and tax head: note the period and whether the amount is CGST, SGST/UTGST, IGST, or a combination.
  • Type of issue: check whether the allegation concerns unpaid or short-paid tax, wrongly availed or utilised input tax credit (ITC), or an erroneous refund.
  • Legal basis: record the section cited, the grounds alleged and the type and date of each notice or order.
  • Payment history: list payments already made, their dates and how they were credited. Reconcile the electronic liability register and electronic cash ledger, and keep the payment evidence.
  • Relevant dates: identify the statutory tax due date, return-filing date if relevant, dates proceedings began, and dates of any payments.

The CGST Act is the starting point for CGST and, as relevant, corresponding provisions for other GST components. The IGST Act applies specified CGST provisions mutatis mutandis. Check the provision and law applicable to the tax head and period in your case. Read the CGST and IGST Acts published by CBIC.

How to calculate GST interest

Find the correct principal, rate and period

Section 50(1) provides for interest when tax or part of it is not paid within the prescribed period. Under section 50(2), interest is calculated from the day after the date the tax was due. The Act says the rate under subsection (1) must not exceed 18%; for the specific undue or excess ITC or output-tax-reduction situation in subsection (3), it must not exceed 24%. These are statutory ceilings, not confirmation of the rate notified for your tax period. Verify the operative notified rate for the relevant period and category before using it.

Rule 88B sets out how to calculate interest in different circumstances. In a qualifying case where a return declaring supplies is filed late, interest for the delay is calculated on the tax paid by debiting the electronic cash ledger. The rule treats other situations differently; do not assume either that interest always applies to the full demand or that it is always limited to the cash-ledger amount. Check the relevant Rule 88B branch, including whether proceedings under section 73 or 74 had begun before the late return was filed. See Notification No. 14/2022-Central Tax, which inserted Rule 88B.

Interest = principal × annual rate × chargeable days ÷ 365

The formula does not decide the legally correct principal, rate, day-count basis or start and end dates. If the outstanding balance changes—for example, because a payment is credited partway through—split the calculation into intervals and calculate each interval using its applicable balance and dates.

Illustration: the arithmetic, not an assumed GST rate

Suppose, solely to demonstrate the formula, the verified interest-bearing principal for an interval is ₹100,000, the applicable annual rate has independently been confirmed as 12%, and there are 90 chargeable days. The arithmetic is ₹100,000 × 0.12 × 90 ÷ 365 = approximately ₹2,959. This example does not establish that 12% applies to any particular GST demand; use the rate and calculation method applicable to your facts and period.

Check the calculation against the record

  • Compare the interest principal with the tax amount actually subject to interest, not simply the total printed on the notice.
  • Check that the start date follows the statutory due date and that the calculation accounts for payment dates and any changes in the outstanding balance.
  • Confirm which Rule 88B treatment applies, particularly for late returns, ITC-related issues and cases where proceedings had commenced.
  • Verify the notified rate for the relevant period and tax category; a maximum rate in section 50 is not proof of the operative rate.

How the demand section changes the penalty

Penalty is a separate question from interest. First establish which demand provision applies and whether its stated grounds are supported by the facts. Sections 73 and 74 address specified unpaid or short-paid tax, erroneous refunds and wrongly availed or utilised ITC, but they distinguish cases without fraud-related grounds from those alleging fraud, wilful misstatement or suppression of facts to evade tax.

Demand route What to check Penalty and payment framework
Section 73 Whether the case is for reasons other than fraud, wilful misstatement or suppression of facts to evade tax. For a determination under section 73(9), the Act provides a penalty of 10% of the tax or ₹10,000, whichever is higher, subject to the section’s terms. Section 73 also provides payment-based routes that can conclude proceedings without the ordinary penalty. For example, section 73(8) addresses payment of tax and interest within 30 days of the show-cause notice. Check the applicable conditions and law for the case.
Section 74 Whether the notice alleges that the issue arose by reason of fraud, wilful misstatement or suppression of facts to evade tax, and what evidence supports that allegation. The section provides for a tax-equivalent penalty in its notice framework and reduced-penalty closure routes tied to payment, interest and the stage of proceedings. Their availability depends on the specific statutory conditions and timing; verify the applicable provisions rather than assuming a reduction applies.

A notice using the word “fraud” does not, by itself, resolve whether section 74 applies. Assess the actual allegations, evidence and statutory grounds; a classification can materially affect the penalty and payment options. Check the applicable section in the CGST Act.

Should you pay, appeal or seek a waiver?

Check the first-appeal payment requirement

For a first appeal under section 107, the Act requires payment of the amount admitted from the impugned order and a pre-deposit equal to 10% of the remaining disputed tax amount, subject to the statutory maximum and applicable wording. Once the required payment is made, recovery of the balance is deemed stayed while the appeal is pending. Confirm the current provision and how it applies to the type of order: the treatment may differ where an order imposes only a penalty or a special procedure applies. The pre-deposit is not a calculation of the full amount you owe; it is a condition connected to the appeal.

Check whether section 128A relief may apply

Section 128A may provide relief from interest or penalty for qualifying section 73 demands. CBIC Circular No. 238/32/2024-GST discusses the conditions and explains that eligible situations can include cases where the tax has been fully paid but interest or penalty remains disputed. Relief is not automatic: check the applicable tax period, payment, application and procedural requirements, as well as the deadline and current rules. A waiver application is distinct from an appeal challenging the original demand on its merits. Read Circular No. 238/32/2024-GST.

Reconcile how payments are made and recorded

CBIC’s GST payment rules describe the electronic cash ledger mechanism for paying interest, penalty, fee and other amounts. Reconcile the electronic liability register with the cash ledger and retain challans and other payment evidence. The rules establish the payment channel; they do not establish what a taxpayer’s live portal demand should display. See the GST Payment Rules.

Use this decision checklist before relying on an estimate

  1. Separate the components: identify the principal tax, interest and penalty in the notice or order and confirm what each figure represents.
  2. Verify the demand basis: check the tax period, tax head, alleged issue and whether section 73 or 74 is cited.
  3. Rebuild the interest timeline: confirm the due date, applicable Rule 88B treatment, verified rate, chargeable days and payment credits.
  4. Assess penalty independently: review the stated grounds and evidence, then check any payment-based closure conditions that fit the stage of the case.
  5. Choose a procedural route: compare payment, appeal and potential section 128A relief against their distinct amounts, deadlines and eligibility requirements.
  6. Match the records: reconcile the liability register, cash ledger and payment evidence against the department’s figures.

A spreadsheet can help with the arithmetic, but it cannot determine the correct demand section, resolve disputed facts, select the applicable Rule 88B branch or establish eligibility for a statutory relief. Where those issues affect the amount or a deadline, verify them against the notice, current law and payment record before acting.
