Online gaming involves two separate tax mechanisms in India. GST is charged on the gaming supply handled by the operator, while income tax and TDS apply to the player’s net winnings. Do not add the two percentages to the amount you withdraw: they use different bases, are collected by different parties and are reported differently.
GST and TDS are different charges
The quickest way to avoid a wrong calculation is to separate the transaction into two questions: what did the operator supply, and what net income did the player earn?

| Tax | Who normally handles it | Rate in the current framework | What is measured | When it matters |
|---|---|---|---|---|
| GST | The online gaming operator is treated as the supplier | 28% | The prescribed value of the online-money-gaming supply, based on amounts paid, payable or deposited with the supplier, subject to the exclusion for amounts re-entered from earlier winnings | When you deposit or pay to participate; check the operator’s invoice or ledger |
| TDS under Section 194BA | The person responsible for paying the winnings, usually the operator or intermediary | 30%; the official rate table shows no threshold for this section | Net winnings in the user account | When winnings are withdrawn and on remaining net winnings calculated at the end of the financial year |
| Income tax under Section 115BBJ | The player reports the income in the income-tax return | 30% special rate from assessment year 2024–25 | Net winnings from online games | When the annual tax return is prepared; TDS is claimed as a credit |
GST is not a second 28% charge on your cash payout, and Section 194BA TDS is not an additional 30% tax on top of the final Section 115BBJ liability. TDS is withholding against that income-tax liability.

What counts as online money gaming
The 2023 amendments define online money gaming as online gaming in which a player pays or deposits money or money’s worth, including virtual digital assets, expecting to win money or money’s worth. The definition covers games whose outcome depends on skill, chance or both.

The GST Council’s 51st-meeting release of 2 August 2023 recommended a 28% levy on the full face value of online gaming actionable claims, without a different rate for skill and chance games. The Government has stated that this online-gaming GST treatment began on 1 October 2023.
The GST value
The Council’s stated valuation approach uses the amount paid or payable to, or deposited with, the supplier by or for the player. It excludes an amount that is entered into a game or bet out of winnings from an earlier game or bet. The recommendation is designed to avoid taxing every individual bet as though it were a fresh deposit.
In practical terms, GST is normally built into the operator’s deposit, entry-fee or similar gaming transaction. The operator arranging the specified actionable claim is treated as the supplier and is responsible for accounting for the levy. Your own calculation should therefore begin with the operator’s GST invoice, wallet statement or transaction ledger, not with the amount ultimately withdrawn.

Assume you deposit money with a platform, win an amount, and use part of those earlier winnings to enter another game. The amount re-entered from the previous winnings is not counted again under the Council’s stated exclusion. The ledger should show the amounts paid or deposited and the GST charged on the relevant supply. The fact that your wallet later contains a larger balance does not, by itself, create a 28% GST calculation on that balance.
What to check in the platform statement
- Whether the statement identifies deposits or entry amounts used to provide the gaming service.
- Whether GST is shown on an invoice, receipt or separate ledger line.
- Whether amounts re-staked from prior winnings are distinguished from fresh deposits.
- Whether the period covered is on or after 1 October 2023, when the Government says this 28% online-gaming treatment was introduced.
If GST has already been charged by the operator on the gaming supply, do not apply another 28% to the withdrawal shown in your bank statement. GST and income-tax calculations use different records.
How TDS under Section 194BA is calculated
The rate and threshold
Section 194BA requires the person responsible for paying online-game winnings to deduct income tax on net winnings in the player’s user account. The Income Tax Department’s published TDS-rate table lists a 30% rate for Section 194BA and shows no threshold for this section. A small withdrawal is not automatically exempt merely because it is below a general threshold used for another kind of income.
The 30% figure is applied to net winnings, not automatically to every rupee credited to a wallet and not automatically to the gross amount requested for withdrawal.

When you withdraw during the year
When a player withdraws during the financial year, the payer deducts TDS on the net winnings included in that withdrawal. The operator’s running calculation should take account of the user-account balance, deposits and earlier withdrawals rather than treating the withdrawal as an isolated profit.

For example, if a withdrawal consists partly of your own deposited funds and partly of net winnings, Section 194BA applies to the winnings component determined under the prescribed account method. The amount that reaches your bank account can therefore be lower than the withdrawal request after TDS.
When winnings remain in the account
TDS is also required on net winnings left in the user account at the end of the financial year. A player cannot avoid the year-end calculation simply by leaving money in the gaming wallet. The operator must calculate the remaining net winnings and deduct the required tax at that point.
Use the financial-year statement supplied by the platform to identify the closing balance and any year-end TDS entry. Keep in mind that the financial year is the period used for the annual computation; the exact statement dates should match the platform’s tax certificate and your tax records.
Winnings paid wholly or partly in kind
If winnings are wholly or partly in kind and there is not enough cash available to cover the tax, the payer must ensure that the tax has been paid before releasing the winnings. A prize, token or other non-cash benefit is therefore not a way to bypass Section 194BA. Ask the payer how the tax was funded and retain the supporting certificate.
Multiple accounts and platforms
Rule 133 applies to the user account registered with the online gaming intermediary. Obtain a complete statement for every account and platform you used. Do not combine opening balances, deposits, withdrawals and closing balances across platforms unless the records and the tax computation clearly support that treatment. A separate platform statement may also mean a separate TDS certificate and separate reconciliation in Form 26AS or the Annual Information Statement.
What “net winnings” means under Rule 133
Use the account-based method
CBDT Circular No. 5 of 2023 confirms that Rule 133 of the Income-tax Rules prescribes the net-winning computation and that the rule applies to the user account registered with the online gaming intermediary. The calculation is account-based, not a simple total of wallet credits or a simple total of withdrawals.
A useful way to express the Rule 133 structure for a full-year reconciliation is:

Use the categories and classifications in the platform’s Rule 133 ledger. In particular, distinguish taxable deposits, non-taxable deposits, winnings and withdrawals as the statement identifies them. The formula is a framework for checking the account computation; it is not a reason to replace the platform’s prescribed fields with gross wallet credits.
The records needed for the calculation
| Record item | Why it matters |
|---|---|
| Opening balance | Establishes the amount already in the user account at the start of the period. |
| Deposits, separated by the platform’s taxable and non-taxable classifications | Prevents your own deposited money from being mistaken for winnings and preserves the Rule 133 account calculation. |
| Withdrawals and withdrawal dates | Shows when TDS should have been deducted during the year and how much was taken out. |
| Winnings credited | Explains changes in the account and supports the net-winnings result. |
| Closing balance | Captures net winnings left in the account for the year-end TDS calculation. |
| Form 16A, Form 26AS and AIS entries | Confirms the tax deducted and lets you claim the correct credit in the return. |
Why gross figures produce the wrong answer
Adding every wallet credit can count the same money more than once. Adding every withdrawal can treat returned deposits as income. Likewise, applying 30% to each game result ignores the opening balance, deposits and earlier withdrawals that Rule 133 requires. The correct starting point is the full account ledger for the relevant period.
How Section 115BBJ taxes the result
Section 115BBJ applies a 30% special rate to net winnings from online games from assessment year 2024–25. The net winnings are removed from the ordinary income computation and taxed under this special provision. Your other income is calculated separately under the provisions that apply to it.
Surcharge and health and education cess may apply to the final income-tax liability under the normal income-tax rules. Consequently, a 30% TDS entry is not necessarily the final amount payable for every taxpayer, and it is not a reason to pay another 30% on the same income without taking the TDS credit.
Claiming TDS in the income-tax return
Use the TDS certificate issued by the platform, then verify the same deduction in Form 26AS and the Annual Information Statement. Report the net winnings under the Section 115BBJ provision in the income-tax return required for your wider income profile. Claim the Section 194BA amount as tax deducted at source.
If the certificate and Form 26AS disagree, do not silently change the income figure to make the numbers match. Ask the operator to correct its TDS reporting, retain the original statement and use the corrected records when filing or revising the return.
Worked example: separating the three calculations
Income-tax and TDS
Suppose the platform’s Rule 133 statement shows net winnings of ₹100,000 for the financial year. Section 194BA TDS at 30% is ₹30,000, before any applicable surcharge or cess treatment at final assessment. The same ₹100,000 is the income to be taxed at the 30% special rate under Section 115BBJ. The ₹30,000 already deducted is claimed as a tax credit; it is not added as a second ₹30,000 tax.
GST
That ₹100,000 result does not tell you the GST amount. GST must be checked separately in the operator’s deposit, entry-fee and invoice records. The relevant GST value is the prescribed gaming-supply value, including amounts paid or deposited with the supplier and excluding amounts entered from earlier winnings under the Council’s stated approach. Applying 28% directly to the ₹100,000 payout would answer the wrong tax question.

Step-by-step annual reconciliation
- Download every statement. Obtain the full-year wallet ledger for each user account, the withdrawal history, GST invoices or receipts, the Form 16A TDS certificate and the platform’s year-end tax summary.
- Set the period. Confirm that opening balance, transactions and closing balance all belong to the same financial year and the same registered user account.
- Classify the entries. Mark opening balance, taxable deposits, non-taxable deposits, withdrawals, winnings and closing balance exactly as the platform labels them.
- Reperform the Rule 133 check. Compare the platform’s net-winnings figure with the account-based structure of withdrawals plus closing balance, less opening balance and the relevant deposits. Investigate any unexplained difference instead of substituting gross credits.
- Check withdrawal deductions. Match each Section 194BA TDS entry to the withdrawal date and amount. Confirm that deductions were made on net winnings rather than on the entire withdrawal request.
- Check the year-end deduction. Look for TDS on net winnings remaining in the account at the financial year-end, including an account that was not emptied.
- Reconcile government records. Match Form 16A with Form 26AS and AIS. Resolve missing or incorrect entries with the payer before filing where possible.
- Prepare the return. Report the net winnings under Section 115BBJ and claim the Section 194BA TDS credit. Calculate the rest of your income separately and account for any surcharge or cess that applies to the final liability.
- Reconcile GST independently. Compare the operator’s 28% GST entries with deposits or entry amounts and preserve invoices. Do not derive GST from the income-tax payout figure.
- Keep the evidence. Retain statements, invoices, certificates, bank records and proof of deposits and withdrawals in case the figures need to be explained later.
Common mistakes and how to fix them
Applying 28% to the withdrawal
Why it fails: GST is linked to the gaming supply and its prescribed valuation, not automatically to the player’s final cash payout.
Fix: Use the operator’s GST invoice or deposit ledger and check the exclusion for amounts re-entered from earlier winnings.
Applying 30% to every wallet credit
Why it fails: Section 194BA uses net winnings in the user account, while deposits and returned funds are not automatically winnings.

Paying the 30% twice
Why it fails: TDS is withholding against the Section 115BBJ liability.
Fix: Report the net winnings, claim the TDS appearing in Form 16A, Form 26AS and AIS, and pay only any remaining balance after the credit and other applicable tax adjustments.
Ignoring money left in the wallet
Why it fails: Section 194BA also covers net winnings remaining in the account at the end of the financial year.

Using one platform’s statement for another
Why it fails: Rule 133 applies to the user account registered with the intermediary, and each payer reports its own TDS.
Fix: Keep an account-by-account schedule and reconcile each certificate separately.
Overlooking in-kind prizes
Why it fails: Tax still has to be paid when winnings are wholly or partly in kind and cash is insufficient.
Fix: Obtain the payer’s written calculation and proof that the tax was paid before the prize was released.
Assuming a skill game has a lower GST rate
Why it fails: The 2023 online-money-gaming framework does not create a lower GST rate for skill-based games.
Fix: Apply the same 28% GST framework to online-money gaming covered by the definition, regardless of whether the outcome is skill, chance or both.
What documentation to retain
- Full-year Rule 133 wallet ledger for every registered user account.
- Opening and closing balance reports.
- Deposit records showing the platform’s taxable and non-taxable classifications.
- Withdrawal history and bank-credit records.
- Game or wallet statements showing winnings and any amounts re-entered from earlier winnings.
- GST invoices, receipts and ledger entries for deposits or entry amounts.
- Form 16A or equivalent TDS certificate from each payer.
- Form 26AS and the Annual Information Statement.
- Proof of tax paid where a prize was wholly or partly in kind.
These records let you explain both sides of the transaction: the operator’s GST supply and your own income-tax computation.

Key answers at a glance
| Question | Answer |
|---|---|
| How is TDS calculated on online gaming winnings? | At 30% on net winnings under Section 194BA, with deductions when winnings are withdrawn and on net winnings left in the user account at year-end. The official rate table shows no threshold for this section. |
| Is GST charged on winnings or deposits? | GST is on the prescribed value of the online gaming supply, generally reflected in amounts paid or deposited with the operator. It is not calculated by applying 28% to the final payout. |
| What is net winning under Rule 133? | It is the account-based result that uses opening balance, relevant deposits, withdrawals and closing balance. Gross wallet credits and gross withdrawals are not substitutes. |
| Can the 30% TDS be claimed in an ITR? | Yes. Match the Section 194BA deduction with Form 16A, Form 26AS and AIS, report the Section 115BBJ net winnings and claim the TDS as a credit. |
| Does skill gaming get different tax treatment? | Not under the 2023 online-money-gaming GST framework. The 28% treatment covers online gaming involving skill, chance or both. |
Bottom line
Start with the operator’s records, not the bank payout. Reconcile GST to the gaming supply and deposits, calculate net winnings through the Rule 133 user-account method, verify 30% Section 194BA TDS at withdrawals and year-end, then report the same net winnings under Section 115BBJ while claiming the TDS credit. This keeps the 28% GST levy and the 30% income-tax system separate and prevents either tax from being calculated on the wrong amount.
