How to Build a Fan Game Without Using Copyrighted Game Assets

You can make a game inspired by another game without copying its protected expression. Keep the gameplay ideas that inspire you, but replace the original game’s art, music, writing, characters, names, logos, software, and other expressive elements with work you created, commissioned, or licensed for your exact use. Record the creator, source, license or permission, attribution terms, platforms, commercial rights, and proof for every asset. If you cannot document the right to use an asset, remove it.

What “without copyrighted assets” actually means

A fan game becomes legally risky when it reproduces recognizable expression from the original game, not merely because it shares a genre or a gameplay concept. A platformer can use jumping, running, collectibles, enemies, and side-scrolling without copying a particular game’s artwork or story. It becomes a different problem when it uses the original character sprite, dialogue, map, soundtrack, sound effects, logo, extracted code, or other distinctive material.

The U.S. Patent and Trademark Office identifies video games, software, music, artwork, movies, and sound recordings as examples of copyrightable creative works. That means a single project can contain many separate rights: the code may belong to one owner, the soundtrack to another, commissioned illustrations to an artist, and a voice recording to a performer. Treat each asset as its own rights question.

Ideas and systems are different from expression

Copyright generally does not give one creator ownership of an abstract idea, genre, game mechanic, rule, or broad mood. You may design a game about exploring a haunted station, use a health bar, or build a turn-based battle system. Your implementation still has to be your own. New code, maps, dialogue, character designs, textures, interface graphics, music, and sound effects help separate an inspired concept from a copied work.

Derivative-work risk

A game that adapts protected characters, settings, story elements, or artwork can implicate the copyright owner’s exclusive right to prepare or authorize a derivative work. The U.S. Copyright Office explains that only the copyright owner can authorize creation of a new version of a work. Informal community practice, a noncommercial label, or a credit line does not transfer that authority.

Choose a rights route before you start production

Decide how every planned asset will be cleared before artists and programmers build around it. The table below ranks common approaches by certainty and explains where each can fail.

Approach What you use Rights certainty Best fit Main risk
Original work Assets you create from scratch, including code, art, audio, text, and branding Highest, assuming you own or properly assign contributor rights Any public or commercial release A collaborator or tool may have introduced third-party material without clear terms
Commissioned work New assets made for your project under a written agreement High when the agreement grants the needed rights Projects that need a consistent art or audio direction Paying for a file does not automatically transfer copyright; the contract must say what you receive
Third-party licensed assets Assets under a license that covers your distribution and modifications High if the license is authentic, retained, and followed Teams using established asset libraries or open licenses Attribution, platform, sublicensing, or commercial restrictions can be missed
Written permission from the original owner Specific original characters, music, names, or other protected material Depends on the scope and wording of the permission An officially authorized fan project or partnership A verbal statement or message from someone without authority may not cover the rights you need
Unlicensed borrowing Ripped sprites, extracted audio, original logos, or copied story material Lowest None for a public release Takedown, lost distribution, rework costs, or litigation

For a private experiment, you may limit distribution while you test mechanics, but that does not turn copied assets into your property. Before sharing a build publicly, replace or clear every borrowed element.

Step-by-step: build the game around original expression

  1. Write an inspiration brief. Describe the experience you want—such as fast aerial movement, puzzle-focused exploration, or cooperative survival—without naming copied characters, locations, dialogue, art directions, or plot scenes as requirements. This brief becomes a design target that does not depend on the source game’s files.
  2. Create a clean project repository. Start with your own code and a folder structure that records where every asset came from. Do not import a ripped game archive “temporarily”; temporary files are easily shipped in a release build.
  3. Replace the visual identity. Design new characters, silhouettes, color relationships, costumes, environments, icons, fonts, menus, logos, title screens, and promotional images. Avoid a combination of details that makes your project look like a renamed copy, even when no single file is identical.
  4. Write new text. Produce original dialogue, item descriptions, tutorials, quest names, lore, cutscenes, and jokes. Do not translate, lightly edit, or reassemble lines from the original game.
  5. Implement new code. Rebuild systems yourself or use code whose license allows your intended use. Do not decompile, extract, or copy proprietary scripts, shaders, level data, or tools. Keep license notices for third-party code in the repository and in the distribution where required.
  6. Compose or license audio. Use new music, sound effects, and voice recordings. A sound that seems short or generic can still be part of a protected recording. Save the contract or license for each track and confirm that game distribution, trailers, streams, and updates are covered.
  7. Run an asset audit before every release candidate. Search source folders, build folders, packages, and marketing exports for original filenames, logos, character names, extracted audio, and hidden references. Remove anything without a rights record.
  8. Review the public presentation. Use a distinct title, logo, domain, store description, screenshots, and trailer. State that the project is independent only if that wording is accurate, and do not imply sponsorship, approval, or an official connection.
  9. Freeze a provenance package. Preserve the final asset list, licenses, permissions, invoices, contributor agreements, attribution text, and the exact build released. Store dated copies in a location the team can access if a platform or rights holder asks questions.

Design a distinct identity and avoid confusion

Copyright is not the only reason to change the original game’s branding. Names, logos, character names, and marketing language can create trademark or consumer-confusion problems even when a copyright argument is uncertain. A project that uses the original title in its name, places the original logo on its splash screen, or presents its characters as official can be mistaken for an authorized product.

Change these identity elements

  • Project title and abbreviation
  • Logo, wordmark, and icon shape
  • Character names, silhouettes, costumes, and signature props
  • Fonts, menu layouts, title-screen composition, and key art
  • World names, faction names, item names, and distinctive terminology
  • Store copy, trailer narration, screenshots, and social-media handles

A disclaimer cannot cure copied assets or grant permission. It can clarify independence, but the safer approach is to make the project visibly and textually distinct from the start.

How to source replacement assets responsibly

Create the assets yourself

Self-created work is the simplest route when you can demonstrate that you made it without tracing or incorporating protected source material. Keep editable files, dated exports, and notes about any references used during development. References may inform a mood or technique; they should not become copied characters, logos, maps, or recordings.

Commission artists, composers, and writers

Use a written agreement that identifies the deliverables and grants the rights your release needs. Confirm whether the artist is assigning copyright or granting a license, whether you may modify the work, whether you may sublicense it to a distributor or platform, and whether the permission covers trailers, screenshots, downloadable updates, ports, and monetization. Address attribution, portfolio display, moral-rights waivers where legally relevant, and the treatment of rejected drafts. Keep invoices and signed approvals with the agreement.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Use third-party licenses only within their scope

Read the exact license attached to each file, not just a marketplace label. Check all of the following:

  • Whether commercial distribution is allowed, including paid downloads, advertising, crowdfunding rewards, and in-game purchases
  • Whether editing, remixing, format conversion, and bundling into a game are allowed
  • Whether the license permits distribution on your target platforms and in your target countries
  • Whether attribution must appear in-game, in a credits file, on a website, or in another specified location
  • Whether the license forbids trademark use, endorsement claims, or redistribution of the asset as a standalone file
  • Whether you need to pass license terms to downstream users or contractors
  • Whether the person who uploaded the asset had the right to license it

Save the license text, the asset’s page or identifier, the download date, and any changes you made. Licenses can be updated or pages can disappear; a dated copy is evidence of the terms you accepted.

Keep a rights ledger for every asset

A rights ledger turns a vague “we credited everyone” claim into an auditable record. Use one row per file or tightly defined asset group, and update it whenever an asset is replaced.

Ledger field What to record
Asset identifier Exact filename, package name, or a stable internal ID
Function For example, player animation, menu font, ambient loop, or dialogue script
Creator and rights holder Legal name or organization, plus the contributor who delivered it
Source Where you obtained it, including the page address or contract reference
License or permission License name and version, or the signed permission identifying the allowed use
Allowed actions Modification, synchronization with gameplay, bundling, sublicensing, and distribution
Platforms and territory Desktop, console, mobile, web, physical media, and the countries covered
Commercial status Whether paid distribution, advertising, subscriptions, donations, or other revenue is allowed
Attribution text The exact credit required and where it will appear
Proof Archived license, permission email, signed agreement, invoice, and dated download
Review status Approved, needs clarification, replaced, or removed

Do not treat a credit line as a substitute for permission. Attribution satisfies a license condition only when the license grants the underlying use.

Fair use in the United States: why “free” is not a safe harbor

Section 107 of the U.S. Copyright Act describes fair use as a case-specific limitation and lists four factors. The statute does not create an automatic fan-game exception. The U.S. Copyright Office’s Fair Use Index states that there is no formula, percentage, word count, or other safe harbor that guarantees fair use. The Copyright Office also says it cannot provide individual legal advice.

The four factors

Factor Question for a fan-game project Why the answer is difficult
Purpose and character Is the use commercial or nonprofit, and does it add a genuinely different purpose or message? A free release may help this factor, but a project can still be highly commercial in effect if it builds an audience, accepts donations, sells extras, or competes with an official product. Calling the game a tribute is not the same as transforming the copied expression.
Nature of the original work Is the source factual or highly creative? Games combine fictional characters, artwork, music, dialogue, and software—the kinds of expressive works that generally receive strong protection.
Amount and substantiality How much was copied, and did the use take the most recognizable or important parts? There is no permitted percentage. A short but famous theme, logo, character design, or signature scene can matter more than a large amount of less distinctive material.
Effect on the potential market Could the project substitute for an official game, expansion, remake, soundtrack, or licensed merchandise? A free download can still affect demand, confuse players, or undermine an authorized derivative product. Market harm is not limited to direct sales lost on your download.

These factors interact; no single favorable fact decides the result. A nonprofit prototype may present a different analysis from a monetized, widely promoted release, but neither label guarantees protection. If your project depends on fair use rather than original or licensed material, obtain advice from an attorney who can assess the actual assets, distribution plan, and relevant law.

Geography and distribution scope matter

Fair use is a U.S. doctrine. Other countries may use different exceptions, such as fair dealing or specific parody provisions, with different tests and enforcement procedures. A game distributed worldwide can face claims in several jurisdictions at once. Identify the countries where you will host, sell, advertise, and support the game, then obtain local advice when the project is public or monetized.

Platform rules create another layer of risk. A store, hosting service, video platform, or payment provider may remove a project after a rights complaint even before a court decides the merits. Their terms can be stricter than a copyright exception. Keep a contact email, a takedown procedure, and a way to publish a corrected build.

Audit the repository and release build

Perform the audit twice: once before content lock and again on the exact archive uploaded to a platform.

Search for obvious remnants

find . -type f | sort > all-files.txt
grep -RniE "original-character|original-title|logo-name" .

Replace the example search terms with the original game’s distinctive filenames, names, and abbreviations. Inspect binary packages and exported archives manually; text search cannot reveal an embedded texture or audio track.

Check the build, not only source files

  • Open every menu, cutscene, tutorial, and ending.
  • Play enough of each level to trigger alternate music, enemy sets, and event dialogue.
  • Inspect localization files, accessibility descriptions, controller prompts, and hidden debug rooms.
  • Compare the release archive against the ledger and mark every included file as approved.
  • Review trailers, screenshots, press kits, thumbnails, and store metadata separately.

Remove uncertain material

Quarantine an asset when its creator, license, or permission cannot be established. Do not leave it in “just in case” folders that might be packaged by an automated build. Replace it with a new asset or redesign the feature so the release does not depend on it.

Plan for a rights complaint

A rights holder or platform may contact you even when you believe your project is defensible. Responding quickly is easier when you have a provenance package.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  1. Record the notice, sender, date, identified asset, and requested action.
  2. Pause promotion or distribution of the disputed build while you verify the ledger entry.
  3. Ask your attorney to assess permission, license scope, fair-use arguments, and jurisdiction. Do not make legal admissions in a casual reply.
  4. If the asset is uncleared, remove it, replace it, and invalidate old download links where possible.
  5. Publish a versioned update and preserve the removed file separately for your records.
  6. Document the fix and update the ledger so the same asset cannot return through a later merge.

For a public or monetized release, obtain legal advice before launch rather than waiting for a complaint. The cost of redesigning an asset during development is usually lower than rebuilding a shipped game and its marketing materials.

Match the workflow to your release stage

Stage Practical rights standard What to do
Private prototype Keep distribution tightly controlled and treat copied material as temporary test data Use placeholders or self-made assets where possible; do not upload the build or share it beyond people who need access.
Closed playtest Use assets you can clear for the testers and platform involved Collect tester agreements, remove copied material, and ensure screenshots or recordings do not publish uncleared assets.
Public free release Clear every shipped asset and separate your branding from the source Complete the ledger, audit the build and marketing, include required credits, and prepare a takedown process.
Monetized release Use original, commissioned, or expressly commercial licenses, with professional review Check revenue methods, territories, platform terms, sublicensing, advertising, and future ports before launch.

Common mistakes and practical fixes

“I changed the file format, so it is new.”

Converting a sprite, recoloring it, or adding a filter does not by itself create independent expression. Replace the design rather than cosmetically modifying the original.

“I gave credit, so I have permission.”

Credit identifies a source; it does not grant a license. Obtain written permission or use a license that expressly covers your release.

“The game is free, so nobody can object.”

Nonprofit purpose is only one part of the U.S. fair-use analysis. Creative source material, substantial copying, market substitution, and confusion can still weigh against you.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

“The asset was labeled free online.”

“Free download” may describe price rather than legal permission. Verify the actual license, the uploader’s authority, attribution rules, commercial terms, and modification rights.

“A contractor made it, so I own it.”

Copyright ownership depends on the agreement and applicable law. Put assignment or license terms in writing before delivery and retain the signed document.

“A disclaimer makes it official—or makes it safe.”

A disclaimer can reduce misleading presentation, but it cannot authorize copying. Build a distinct identity and clear the underlying assets.

A concise launch checklist

  • Gameplay inspiration is separated from copied characters, settings, story, art, audio, and code.
  • Every asset has a ledger row with creator, source, license or permission, scope, and proof.
  • Commission agreements address ownership or license, modification, distribution, platforms, territory, revenue, attribution, and future updates.
  • Third-party licenses have been saved in dated form and their conditions are implemented.
  • The title, logo, characters, fonts, maps, UI, store copy, and marketing art are distinct from the original game.
  • The source tree, build archive, localization files, trailers, and screenshots contain no uncleared remnants.
  • Distribution countries and platform rules have been considered.
  • A versioned takedown and replacement process is ready.
  • An attorney has reviewed the project when release is public, monetized, or dependent on a fair-use argument.

Frequently Asked Questions

Can I use the original game’s name in a fan-game title?

Using the original name can create trademark and confusion concerns even if your copyright analysis is uncertain. A distinct title and logo are safer; obtain permission if the project must use the original branding.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Does a short clip of the original soundtrack avoid copyright problems?

There is no duration-based safe harbor. A short but recognizable recording can still be significant, so use original or properly licensed audio.

What if I received permission from a community moderator or former developer?

Confirm that the person actually controls the relevant rights and that the permission covers your assets, platforms, countries, modifications, duration, and commercial status. Keep the written authorization.

Should I delete a private prototype that contains ripped assets?

Do not distribute it, and remove the ripped material before inviting testers or publishing screenshots. Replace it with placeholders or original assets so the prototype does not become part of a public release.
